Congress makes the following findings:

(1)FederalimmigrationlawsmustupholdAmericaslonghistoryofbeingaNationofimmigrantsfrom

everycontinentintheworld,andreaffirmourNationscommitmenttostrongandunitedfamilies,civil

rights,economicopportunityanddiversity.

(2)TheGovernmentoftheUnitedStatesshouldreducethedeficitbyensuringthatallindividualsand

employerspay

their

fair

share

of

taxes

and

contribute

equally

to

the

prosperity

of

our

great

Nation.

(3)TheGovernmentoftheUnitedStateshasanobligationtoensurethelaborrightsofallworkersin

ourcountry,andendthedrivingdownofwagesandworkplacestandardsthatexiststodayduetoour

brokenimmigrationsystem.Unscrupulousemployersshouldnotbeabletoprofitoffofthebacksofa

workforcewithnovoiceintheworkplaceorcivicsociety.

(4)TheGovernmentoftheUnitedStatesalsohasanobligationtoensurethegrowthandvitalityof

honestAmericanbusinessesthatareplayingbytherulesandfuelingoureconomicrecovery.

(5)ThelaborandimmigrationpoliciesoftheUnitedStatesGovernmentshouldbemodernizedtoreflect

thecurrent

needs

of

American

workers

andthe

American

economy.

(6)TheGovernmentoftheUnitedStatescannoteffectivelycarryoutitsnationalsecuritypoliciesunless

itrequiresundocumentedimmigrantstocomeforwardandparticipatefullyinourcommunitiesand

legallyintheeconomyoftheUnitedStates,sothatenforcementeffortsareconcentratedonthetruly

badactors.

(7)EliminationofAmericasimmigrantworkforceisnotaneffectiveorhonestsolutiontoAmercas

economiccrisis.Weneedasolutionthatlevelstheplayingfieldandpromotesequalrightsforall.

(8)DividingAmericanfamiliesinnotamoralorjustsolutiontothebrokenimmigrationsystem.We

needpolicies

that

treat

all

families

equally

andkeep

them

together,

to

support

each

other

and

build

strongcommunities.

(9)Flawedimmigrationlawsandpersistentunequaladministrationofjusticeatthelocallevel,basedon

raceornationalorigin,hasunderminedeffectivecommunitypolicingbydiscouragingthereportingof

crimeandcooperationwithprosecutorsinimmigrantcommunities,duetowellfoundedfearsof

immigrationenforcementactionagainstthem.Thisputsentirecommunitiesatriskandundermines

publicsafetyforall.

(10)TheGovernmentoftheUnitedStatesshouldensurethatracialprofilingandunequaladministration

ofthelawbasedonraceornationaloriginisnotpermittedbyanyagencyofFederal,Stateorlocal

governmentbodies.

(11)OurGovernmentshouldensurethatourNationsbordersaresecurebyinvestingineffective

strategies,eliminatingthemillionsofdollarscurrentlybeingallocatedtoineffectiveones,andby

requiringconsultationwithstateandlocalcommunitiesonboththenorthernandsouthernborders

beforeimplementingnewborderenforcementstrategies.

(12)Foreigngovernments,particularlythosethatshareaninternationalborderwiththeUnitedStates,

mustplayacriticalroleinsecuringinternationalbordersanddeterringillegalentryofforeignnationals

intotheUnitedStates.

(13)TheGovernmentoftheUnitedStateshasanobligationtoreaffirmitscommitmenttoeffective

immigrantintegration

by

supporting

the

teachingand

promoting

the

learning

of

English.

(14)Comprehensiveimmigrationreformandstrongenforcementofimmigrationlawswillencourage

legalimmigration,deterillegalimmigration,andpromotetheeconomicandnationalsecurityinterests

oftheUnitedStates.

SEC.3.REFERENCETOTHEIMMIGRATIONANDNATIONALITYACT.Exceptasotherwiseexpresslyprovided,wheneverinthisActanamendmentorrepealisexpressedin

termsofanamendmentto,orrepealof,asectionorotherprovision,thereferenceshallbeconsidered

tobemadetoasectionorotherprovisionoftheImmigrationandNationalityAct(8U.S.C.1101etseq.).

SEC.4.DEFINITIONS.InthisAct:

(1)DEPARTMENT.Exceptasotherwiseprovided,thetermDepartmentmeanstheDepart1mentof

TITLEIBORDERSECURITYANDENFORCEMENT

SEC.101.SENSEOFCONGRESS.ItisthesenseofCongressthat

(1)theSecretaryofHomelandSecurityshouldestablishanationalstrategicplanforshorttermand

longtermbordersecuritywithimprovedaccountabilityandtransparencyinagencyfunctions;

(2)theSecretarysbordersecurityprioritiesmustsupportandstrengthenthesignificantadvancesin

operationalcontroloftheborder;

(3)theSecretarymustsecureourNationsportsofentryandfacilitatetheflowofcommerceandtravel;

(4)theportsofentrytotheUnitedStatesrequireadditionalassets,personnel,infrastructureand

improvementsintechnology;

(5)althoughstatesalongtheSouthernandNorthernbordersplayauniqueroleinsupportingthe

FederalGovernment,bordersecurityandenforcementoftheimmigrationlawsaretheresponsibilityof

theFederalGovernment;

effectivebordersecuritydependsonsustainedinternationalcooperation.

SubtitleABorderSecurity

SEC.111.NATIONALSTRATEGYFORBORDERSECURITY.(a)REQUIREMENTFORSTRATEGY.TheSecretary,inconsultationwiththeheadsofotherappropriate

Federalagencies,shalldevelopaNationalStrategyforBorderSecuritythatdescribesactionstobe

carriedouttomaintainoperationalcontroloverallportsofentryintotheUnitedStatesandthe

internationallandandmaritimebordersoftheUnitedStates.

(b)CONTENT.The

National

Strategy

for

Border

Security

shall

include

the

following:

(1)Anassessmentofthethreatposedbyterroristsandterroristgroupsthatmaytrytoinfiltratethe

UnitedStatesatlocationsalongtheinternationallandandmaritimebordersoftheUnitedStates.

(2)AriskassessmentforallUnitedStatesportsofentryandallportionsoftheinternationallandand

maritimebordersoftheUnitedStatesthatincludesadescriptionofactivitiesbeingundertaken(A)to

preventtheentryofterrorists,unlawfulaliens,instrumentsofterrorism,narcotics,andother

contrabandintotheUnitedStates;and(B)toprotectcriticalinfrastructureatornearsuchportsofentry

orborders.

(3)An

assessment

of

the

most

appropriate,

practical,

and

cost

effective

means

of

defending

the

internationallandandmaritimebordersoftheUnitedStatesagainstthreatstosecurityandillegal

transit,includingintelligencecapacities,technology,equipment,personnel,andtrainingneededto

addresssecurityvulnerabilitiestoinclude(A)acomprehensiveassessmentofrisksintermsofcost,

probability,andthreatstosocietyandriskpreventionandresponsemeasurescurrentlytakenand

potentiallytakenrelativetothatassessmentofrisks;(B)preventioneffortsandresponsemeasuresto

addresssuchrisks,whetheralreadyunderwayorplanned;(C)recommendationsonrealignmentof

programs,locations,andresourcestobestaddressthecomprehensiveassessmentofrisks.

(4)Anassessmentofstaffingneedsforallbordersecurityfunctions,takingintoaccountthreatand

vulnerabilityinformationpertainingtothebordersandtheimpactofnewsecurityprograms,policies,

andtechnologies.

(5)AdescriptionofthebordersecurityrolesandmissionsofFederal,State,regional,local,andtribal

authorities,andrecommendationsregardingactionstheSecretarycancarryouttoimprove

coordinationwithsuchauthoritiestoenablebordersecurityandenforcementactivitiestobecarried

outinamoreefficientandeffectivemanner.Anassessmentofexistingprograms,activitiesand

technologiesusedforbordersecurityandtheeffectoftheuseofsucheffortsandtechnologiesoncivil

rights,familyunity,privatepropertyrights,privacyrights,andcivilliberties,includinganassessmentof

effortstotakeintoaccountasylumseekers,traffickingvictims,unaccompaniedminoraliens,andother

vulnerablepopulations.

(7)A

prioritized

list

of

research

and

development

objectives

to

enhance

the

security

of

the

international

landandmaritimebordersoftheUnitedStates.

(8)Adescriptionofwaystoensurethatthefreeflowoflegitimatetravelandcommerceisnot

diminishedbyefforts,activities,andprogramsaimedatsecuringtheinternationallandandmaritime

bordersoftheUnitedStates.

(9)Adescriptionoftheperformancemetricstobeusedtoensureaccountabilitybythebureausofthe

DepartmentinimplementingsuchStrategy.

(10)AschedulefortheimplementationofthesecuritymeasuresdescribedinsuchStrategy,includinga

prioritizationof

security

measures,

realistic

deadlines

for

addressing

the

security

and

enforcement

needs,anestimateoftheresourcesneededtocarryoutsuchmeasures,andadescriptionofhowsuch

resourcesshouldbeallocated.

(c)CONSULTATION.IndevelopingtheNationalStrategyforBorderSecurity,theSecretaryshall

consultwithrepresentativesof(1)State,local,andtribalauthoritieswithresponsibilityforlocations

alongtheinternationallandandmaritimebordersoftheUnitedStates;and(2)appropriateprivate

sectorentities,nongovernmentalorganizations,andaffectedcommunitiesthathaveexpertiseinareas

relatedtobordermanagement.

(d)

COORDINATION.The

National

Strategy

for

Border

Security

shall

be

consistent

with

the

National

StrategyforMaritimeSecuritydevelopedpursuanttoHomelandSecurityPresidentialDirective13,

datedDecember21,2004.

(e)SUBMISSIONTOCONGRESS.(1)STRATEGY.Notlaterthan1yearafterthedateofenactmentof

thisAct,theSecretaryshallsubmittoCongresstheNationalStrategyforBorderSecurity.(2)UPDATES.

TheSecretaryshallsubmittoCongressanychangeofsuchStrategythattheSecretarydeterminesis

necessary,notlaterthan30daysaftersuchdetermination.

(f)IMMEDIATEACTION.NothinginthissectionmaybeconstruedtorelievetheSecretaryofthe

responsibilitytotakeallactionsnecessaryandappropriatetomaintainandenhanceoperationalcontrol

SEC.112.

INCREASE

IN

NUMBER

OF

CUSTOMS

AND

BORDER

PROTECTION

OFFICERS.(a)CUSTOMSANDBORDERPROTECTIONOFFICERS.Duringthe5yearperiodbetweenfiscalyears2010

and2014,theSecretaryofHomelandSecurityshall,subjecttotheavailabilityofappropriationsforsuch

purpose,increasebynotfewerthan5,000thetotalnumberoffulltime,activedutyCustomsand

BorderProtectionOfficerswithinUnitedStatesCustomsandBorderProtectionforpostingatUnited

Statesportsofentryabovethenumberofsuchofficersforwhichfundsweremadeavailableduring

fiscalyear2009.

(b)AGRICULTURESPECIALISTS.Duringthe5yearperiodbetweenfiscalyears2010and2014,the

SecretaryofHomeland

Security

shall,

subject

to

the

availability

ofappropriations

for

such

border

securitypurposes,increasebynotfewerthanatotalof1,200thenumberoffulltimeCustomsand

BorderProtectionagriculturespecialistsforUnitedStatesportsofentryabovethenumberofsuch

supportpersonnelforwhichfundsweremadeavailableduringfiscalyear2009.(c)BORDERSECURITY

SUPPORTPERSONNEL.Duringthe5yearperiodbetweenfiscalyears2010and2014,theSecretaryof

HomelandSecurityshall,subjecttotheavailabilityofappropriationsforsuchpurpose,increasebynot

fewerthanatotalof350thenumberoffulltimebordersecuritysupportpersonnelforUnitedStates

portsofentryabovethenumberofsuchsupportpersonnelforwhichfundsweremadeavailableduring

fiscalyear2009.

SEC.113.IMPROVINGPORTSOFENTRYFORBORDERSECURITYAND

OTHERPURPOSES.(a)INGENERAL.ThereareauthorizedtobeappropriatedtotheAdministratoroftheGeneralServices

Administration$1,000,000,000foreachoffiscalyears2010through2014tomakeimprovementsto

existingportsofentryintheUnitedStatestoimprovebordersecurityandforotherpurposes.

(b)PRIORITY.Inmakingimprovementsdescribedinsubsection(a),theAdministratoroftheGeneral

ServicesAdministration,incoordinationwiththeCommissionerofCustomsandBorderProtection,shall

giveprioritytotheportsofentrythattheAdministratordeterminesareinmostneedofrepairto

improveborder

security

and

for

other

purposes

in

accordance

with

port

ofentry

infrastructure

assessmentstudiesrequiredinsection603oftitleVI,divisionE,oftheConsolidatedAppropriationsAct

of2008(PublicLaw101161).

SEC.114.INVENTORYOFPERSONNEL.(a)INVENTORY.TheSecretaryshallidentifyandinventorythecurrentpersonnelorotherhuman

resourcesdedicatedtobordersecurityandenforcementpriortoanyincreaseinpersonnelorother

humanresources.

(b)REPORT.The

Secretary

shall

submit

the

inventory

required

in

subsection

(a)

to

the

following

congressionalcommittees,90daysaftertheenactmentofthisAct

(1)theCommitteeonHomelandSecurityandGovernmentalAffairsandtheCommitteeontheJudiciary

oftheSenate;

(2)theCommitteeonHomelandSecurityandtheCommitteeontheJudiciaryoftheHouseof

SEC.115.

STANDARDS

OF

PROFESSIONAL

CONDUCT.

(a)ESTABLISHMENTOFSTANDARDS.Notmorethan90daysafterthedateofenactmentofthisAct,the

SecretaryofHomelandSecurityshallestablishclearstandardsofprofessionalconductforinteraction

withthepublic,forallCustomsandBorderProtectionagents,U.S.BorderPatrolagents,Immigration

andCustomsEnforcementagents,andAgriculturalInspectorsstationedwithin100milesofalllandand

marinebordersandatportsofentry.

(b)PURPOSE.Thesestandardsofprofessionalconductwillprovideagentswithabetterunderstanding

oftheprohibitionsandlimitationspertainingtotheirconductandactivitieswhilerepresentingthe

DepartmentofHomelandSecurity.Thesestandardsareintendedto(1)alertagentstosomeofthe

moresensitiveand

often

problematic

matters

involved

in

agent

conduct;(2)

specify,

where

possible,

actionsandinactionsthatarecontrarytoandthatconflictwiththedutiesandresponsibilitiesof

DepartmentofHomelandsecurityagents;and(3)guideagentsinconductingthemselvesinamanner

thatreflectsstandardsofdeportmentandprofessionalism.

(c)STANDARDS.DepartmentofHomelandSecurityagentsstationedwithin100milesofalllandand

marinebordersandatportsofentry(1)shallnotviolateanylaworanyagencypolicy,rule,or

procedure;(2)shallobeyalllawfulorders;(3)shallnotengageinanyconductoractivitieson oroff

dutythatreflectdiscreditontheagents,tendtobringtheagencyintodisrepute,orimpairitsefficient

andeffectiveoperation;(4)shallconductthemselvestowardthepublicinacivilandprofessional

manner

that

connotes

aservice

orientation

and

that

will

foster

public

respectand

cooperation;

(5)

shall

treatviolators,orperceivedviolators,withrespectandcourtesy,guardagainstemployinganofficious

oroverbearingattitudeorlanguagethatmaybelittle,ridicule,orintimidatetheindividual,oractina

mannerthatunnecessarilydelaystheperformanceoftheirduty;(6)whilerecognizingtheneedto

demonstrateauthorityandcontroloversuspectsanddetainees,agentsshalladheretothisagencys

useofforcepolicyandshallobservethecivilrightsandprotectthewellbeingofthoseintheircharge;

and(7)shallnotusetheiragencypowerstoresolvepersonalgrievances(e.g.,thoseinvolvingthe

officer,familymembers,relatives,orfriends)withindividuals.Incaseswherethereispersonal

involvementwithamemberofthepublicthatwouldreasonablyrequirelawenforcementintervention,

agentsshallsummonotherondutypersonnelandasupervisor.

(d)OVERSIGHTANDEVALUATION.TheDepartmentofHomelandSecurityshalldevelopandimplement

aplan

that

applies

the

aforementioned

standards

in

officerevaluation

and

supervisor

evaluation.

This

planshallincludethefollowingprovisionstoensureresponsibilityandprotectcivilrights:(1)Adherence

tothestandardsofprofessionalconductshallbeacentralcriterioninthechangefromprobationaryto

journeymanstatus,aswellasperiodicevaluationsandpromotionsofofficers.(2)Managersandsenior

officerswillbeheldresponsiblefor(A)performanceaccordingtothesestandards;(B)assessmentsof

subordinatesaccordingtothesestandards;and(C)performanceoftheirsubordinatesonthese

standards,withmeaningfulpenaltiestosupervisorsforfailuresofsubordinatestoadheretosuch

standards.(3)TheDepartmentshallestablishstrongpenaltiesforfailurestofollowthestandardsof

professionalconductthatwereunaddresseduntilexposedbycomplaintprocessesorInspectorGeneral

investigations.However,organizationalpeersandsuperiorswhouncoverandactonfailuresorabuses

shallbeexempt

from

such

penalties.

(4)Agentsshouldnotbeindemnifiedwhenitisdeterminedthataviolationofcivilrightsstandards

occurred.

(e)EXCEPTION.Thestandardsofconductsetforthinthissectionarenotintendedtoserveasan

exhaustivetreatmentofrequirements,limitations,orprohibitionsonagentconductandactivities

establishedbytheSecretaryofHomelandSecurity.(f)NOTICE.Thestandardsofconductestablished

underthissectionshallbepostedatallportsofentryinlocationseasilyviewedbymembersofthe

public.(g)COMPLAINTS.Notmorethan180daysafterenactment,theSecretaryshall,inconsultation

withtheOfficeofCivilRightsandCivilLiberties,establishauniformandstandardizedprocessforthe

publicregarding

complaints

against

all

Customs

and

Border

Protection

agents,U.S.

Border

Patrol

agents,

andAgriculturalInspectorsforviolationsofstandardsofprofessionalconduct.Thecomplaintprocess

shall(1)quicklyreview,effectivelyinvestigate,meaningfullyresolvecomplaintsandidentifypatterns

ofabuseormalfeasanceandbeaccessible,transparent,consistent,effective,andfair;(2)apply

uniformlytoallBorderPatrolSectorsandPortsofEntry;(3)specifytowhom,how,andwhere

complaintsaretobefiled;(4)bevisibletothepublicatallportsofentryandinteriorcheckpoints,and

beaccessibleinmultiplelanguages;(5)receivestaffandfundingcommensuratewiththequantityof

complaintssubmittedandwiththefundingdisbursedtoDepartmentenforcementinitiatives;(6)

establishapubliclyaccessiblenational,standardizeddatabasecapableoftrackingandanalyzing

complaintsandtheirresolution;and(7)providepubliclyaccessiblerecords,withcopiesofcomplaints

andtheirresolutionspermanentlypreservedandavailableforinspection,whilemaintainingthe

confidentialityofcomplainantsidentities.(h)COMPLAINANTS.Thefollowingshallapplytoall

complainants:(1)Anyinterestedpartymayfileacomplaintthroughthecomplaintprocedure,including

alegalrepresentative.(2)Complainantsshallbeprotectedfromretaliatoryactionbylawenforcement.

SEC.117.CUSTOMSBORDERPATROLANDBORDERPROTECTION

ASSETS.(a)PERSONALEQUIPMENT.(1)BODYARMOR.TheSecretaryshallensurethateveryagentisissued

highqualitybodyarmorthatisappropriatefortheclimateandrisksfacedbytheagent.Eachagentshall

bepermittedtoselectfromamongavarietyofapprovedbrandsandstyles.Agentsshallbestrongly

encouraged,butnotrequired,towearsuchbodyarmorwheneverpracticable.Allbodyarmorshallbe

replacednotlessoftenthanonceeveryfiveyears.(2)WEAPONS.TheSecretaryshallensurethat

agentsareequippedwithweaponsthatarereliableandeffectivetoprotectthemselves,theirfellow

agents,andinnocentthirdpartiesfromthethreatsposedbyarmedcriminals.TheSecretaryshallensure

thatthepoliciesoftheDepartmentauthorizeallagentstocarryweaponsthataresuitedtothe

potentialthreatsthattheyface.(3)UNIFORMS.TheSecretaryshallensurethatallagentsareprovided

withallnecessaryuniformitems,includingouterwearsuitedtotheclimate,footwear,belts,holsters,

andpersonalprotectiveequipment,atnocosttosuchagents.Suchitemsshallbereplacedatnocostto

suchagentsassuchitemsbecomewornorunserviceableornolongerfitproperly(b)HELICOPTERSAND

POWERBOATS.(1)HELICOPTERS.TheSecretaryshallconductareviewofassetneeds,andif

determinedtobeinsufficient,shallincreasethenumberofhelicoptersunderthecontroloftheBorder

Patrol.TheSecretaryshallensurethatappropriatetypesofhelicoptersareprocuredforthevarious

missionsbeingperformed.(2)POWERBOATS.TheSecretaryshallconductareviewofassetneedsand

ifdeterminedtobeinsufficient,shallincreasethenumberofpowerboatsunderthecontrolofthe

shall

ensure

that

procured

(c)MOTORVEHICLES.(1)QUANTITY.TheSecretaryshallconductareviewofassetneedsandif

determinedtobeinsufficient,establishafleetofmotorvehiclesappropriateforusebytheBorder

Patrol.TheSecretaryshallensurethattherearesufficientnumbersandtypesofothermotorvehiclesto

supportthemissionoftheBorderPatrol.(2)FEATURES.AllmotorvehiclespurchasedfortheBorder

Patrolshall(A)

be

appropriate

for

the

mission

of

theBorder

Patrol;

and(B)

have

apanic

button

and

a

globalpositioningsystemdevicethatisactivatedsolelyinemergencysituationstotrackthelocationof

agentsindistress.

(d)ELECTRONICEQUIPMENT.(1)PORTABLECOMPUTERS.TheSecretaryshallensurethateachpolice

typemotorvehicleinthefleetoftheBorderPatrolisequippedwithaportablecomputerwithaccessto

allnecessarylawenforcementdatabasesandotherwisesuitedtotheuniqueoperationalrequirements

oftheBorderPatrol.

(2)RADIOEQUIPMENT.TheSecretaryshallaugmenttheexistingradiocommunicationssystemsothat

PatrolagentwhoisdeterminedbytheSecretarytoneedahandheldglobalpositioningdeviceto

effectivelyandsafelycarryouthisorherdutiesisissuedastateofthearthandheldglobalpositioning

systemdevicefornavigationalpurposes.

(4)NIGHTVISIONEQUIPMENT.TheSecretaryshallensurethatsufficientquantitiesofstateoftheart

night

vision

equipment

are

procured

and

maintained

to

enable

each

Border

Patrol

agent

workingduring

thehoursofdarknesstobeequippedwithaportablenightvisiondevice.(e)APPROPRIATIONS.There

associatedwithbordersecuritysearchesofelectronicdevices.

(b)CONTENT.Theruleissuedpursuanttosubsection(a)shallincludethefollowing:(1)Arequirement

thatinformationcollectedduringabordersecuritysearchofanelectronicdevicethatisdeterminedto

becommercialinformation,includingtradesecrets,informationsubjectto

attorneyclientprivilege,informationsubjecttodoctorpatientprivilege,orinformationsubjectto

anotherprivilegeorprotectionshallbehandledconsistentwiththelaws,rules,andregulations

governingsuchinformationandshallnotbesharedwithaFederal,State,local,tribal,orforeignagency

that

such

agency

has

themechanisms

place

to

comply

with

such

rules,

searchortheinformationcollectedfromsuchdevicemayberetained,unlessprobablecauseexists,that

deviceorinformationandthatrequiressuchinformationtobedestroyedifinthecustodyofan

authorizedagentafter

searchiscopied,shared,retained,orenteredintoanelectronicdatabase,theindividualfromwhose

electronicdevicesuchinformationiscollectedshallreceivewrittennotificationofsuchcopying,sharing,

retention,orentryunlesssuchnotificationwouldhinderaninvestigationinvolvingnationalsecurityor

wouldmeetanothercriteriaestablishedbytheSecretaryintherule.

(5)Arequirementthatanindividualsubjectedtoabordersecuritysearchofanelectronicdeviceshall

receiveareceiptforsuchdeviceifsuchdeviceisremovedfromthepossessionofsuchindividual.

that

an

individual

subjectedto

aborder

security

search

of

an

electronic

deviceshall

receivenoticeofhowtoreportabusesorconcernsandhowtoseekredressfromtheDepartmentof

(2)COMPETITIVEBASIS.TheAttorneyGeneralshallawardgrantsunderthissectiononacompetitive

basis.

(3)PRIORITY.Inawardinggrantsfortheusesdescribedinparagraphs(1)through(3)ofsubsection(b),

theAttorneyGeneralshallgiveprioritytolawenforcementagencies:(A)locatedinacountythatis

within111milesfromtheUnitedStatesborderwithMexicoorCanada;and(B)incompliancewith

FederalandStateracialprofilinglawsandguidelines.

(4)DURATION.Grantsawardedunderthissectionshallnotexceedtwoyears.Priorawardeesmust

reapplytobeconsideredforcontinuedfunding.

(5)PROHIBITION.TheAttorneyGeneralshallnotawardagranttoanyapplicantthatisunder

investigationforviolationsoffederalorstateracialprofilinglawsorguidelines.

(b)USEOFFUNDS.Grantsawardedunderthissectionmayonlybeusedtoprovideadditionalresources

foreligiblelawenforcementagenciestoaddressdrugrelatedcriminalactivity,andforthetrainingand

scribedinparagraph(4)fororganizationsdescribedinsubsection(a)(3),includingresourcesto(1)

combatcriminalactivitiesalongtheNorthernandSouthernborderby(A)obtaining,upgrading,or

maintainequipment;(B)hiringadditionalpersonnel;(C)reimbursingoperationalexpenditures,

includingovertimeandtransportationcosts;and(D)providingotherassistancenecessarytoaddress

drugrelatedcriminalactivity;(2)facilitateinformationsharingandcollaborationby(A)establishing,

maintaining,or

enhancingmulti

jurisdictional

intelligence

gathering

andsharing

activities;(B)

facilitating

regionalcrimepreventionandreductionefforts;and(C)strengtheningpartnershipsbetweenFederal,

tribal,State,andlocallawenforcementagencies;(3)enhancejails,communitycorrections,and

detentionoperationsby

(A)improvingtheadministrationandoperationsofcorrectionfunctionsrelatedtoreducingand

preventingcriminalnarcoticsactivity;(B)improvingaccesstointelligenceandcollaborationbetween

lawenforcementandcorrectionalsystempersonnel;(C)reducingtherecidivismratesofdrugoffenders;

and(D)hiringdetention,probation,parole,andothercorrectionspersonnelforimplementationofthe

effortsdescribedinthisparagraph;and(4)providetrainingandtechnicalassistance,includingtraining

andassistance

related

to(A)

narcotics

related

kidnapping

negotiation

and

rescue

tactics;(B)

intelligenceandinformationsharingondrugtraffickingorganizations;and(C)theinterdictionof

narcotics,weapons,andillegaldrugproceeds.

(c)APPLICATION.(1)INGENERAL.Eacheligiblelawenforcementagency,orcoalitionofsuch

agencies,seekingagrantunderthissectionshallsubmitanapplicationtotheAttorneyGeneralatsuch

time,insuch

manner,andaccompaniedbysuchinformationastheAttorneyGeneralmayreasonablyrequire.

(2)CONTENTS.Eachapplicationsubmittedunderparagraph(1)shall(A)describetheactivitiesfor

whichassistance

under

this

section

is

sought;(B)

disclose

whether

the

applicant

has

everbeen

investigatedfororconvictedofviolationofFederalorStateracialprofilinglawsorguidelines;and(C)

providesuchadditionalassurancesastheAttorneyGeneraldeterminestobeessentialtoensure

compliancewiththerequirementsunderthissection.

(d)MONITORINGANDOVERSIGHT.(1)EachgranteeshallsubmittotheAttorneyGeneral

documentationoftheuseofgrantfunds,includinganassessmentoftheirutilityinprotectingborder

communitysafety,thepreventionofsmugglingactivities,andtheapprehensionofpersonsinvolvedin

violenceandorganizedcrime.

(2)Thesereportswilldeterminewhetherthegranteeusesfundsappropriatelyandshouldbe

consideredforarenewalgrant.

(e)DEFINITIONS.Inthissection:

(1)ELIGIBLELAWENFORCEMENTAGENCY.Thetermeligiblelawenforcementagencymeansatribal,

State,orlocallawenforcementagency,includingacommunitycorrectionsagencyandanyagencythat

employsprosecutors,probationofficers,orparoleofficers,whichislocatedorperformsdutiesin(A)a

countythatisnotmorethan100milesfromaUnitedStatesborderwithMexico;(B)acountythatisnot

morethan100milesfromaUnitedStatesborderwithCanada;or(C)ajurisdictionthathasbeen

(f)ASSESSMENTANDREPORT.TheAttorneyGeneralshallsubmitabiannualreportassessingthe

success

oftheprogramincombatingandreducingdrugtraffickinganddrugrelatedcriminalactivity,cost

effectivenessoftheprogram,andfuturevalueandviabilityoftheprogramto(1)theCommitteeon

theJudiciaryoftheHouseofRepresentatives;and(2)theCommitteeontheJudiciaryoftheSenate.
