    General introduction to registration

    This document provides basic information on how to apply to register your trade mark in the HKSAR.Please read it carefully before you submit your application. The applications forms are also attached. Asample application form has also been included for your reference. Before you begin to fill out your formthere are a number of points concerning your trade mark that you need to consider. These are listed in theBefore you applysection and it is important that you pay particular attention to them as they couldaffect your application.

    Our Search and Preliminary Advice Services

    Before applying to register a trade mark it is necessary to find out if someone else has already registeredor has applied to register the same or similar trade mark. The Trade Marks Registry offers Search andPreliminary Advice services to anyone who wishes to obtain information on trade marks from theRegistrys records.

    We can do a search of the records and supply a list of trade marks that are the same as or similar to yourproposed trade mark and in respect of the same or similar class of goods or services.

    In addition to the search we can provide preliminary advice as to whether your proposed trade mark issufficiently distinctive so that it distinguishes your goods and services from those of other traders.

    If you wish to use our Search and Preliminary Advice services, simply complete Forms T1 and submit itwith the appropriate fee (HK$200 for each service) to the Registry at the address above.

    Fees

    The application fee for the registration of a trade mark is HK$1300 plus HK$650 per each additionalclass of goods or services, if any.

    Once you have read through this document, conducted a trade mark search, filled in your application form(Forms T2is compulsory,Form T2Aonly if applicable) provided a graphic representation of your trademark and attached the required fee, you may then submit your application.     What is a trade mark?

    A trade mark is a sign that distinguishes the goods and services of one trader from those of others.Typically a trade mark can be words (including personal names), indications, designs, letters, characters,numerals, figurative elements, colours, sounds, smells, the shape of the goods or their packaging or anycombination of these. A sign must be capable of being represented graphically in order for it to beregistered as a trade mark.

    Why register a trade mark?

    Registering your trade mark means that you have the exclusive right to use the trade mark in relation tothe goods and services for which the mark is registered. If other traders use it in Hong Kong, China inrelation to the same or similar goods or services without your consent, they may be liable forinfringement of your mark and you may take legal action. If you do not register your mark, it is harder toprove that you are the owner of the mark and as such your protection is limited.

    Before you apply

    When we receive your application our examiner will check it and decide whether we need to object toyour trade mark based on the criteria laid down in the Trade Marks Ordinance. Therefore there are anumber of factors which you must consider before applying to register a trade mark. Listed below aresome important points:

    Is it distinctive?Does your trade mark stand out from the crowd? Does your trade mark, be it a logo, word,picture, etc. clearly set your goods and services apart from those of other traders? We will

    object to the mark if we do not think it does. We will consider invented words or everydaywords that are in no way associated with your line of business as distinctive. For example theinvented word ZAPKOR is distinctive for spectacles and the word BLOSSOM isdistinctive for medical services.

    Is it a description of your goods and services?If your trade mark describes the goods and services or shows the quality, purpose, quantity orvalue of them, then we are likely to object to the mark. Similarly we are likely to object to theuse of geographical name in a mark. For example, we would for the above reasons object tothe following marks: QUALITY HANDBAGS, FRESH AND NEW and NEW YORK

    FASHION.

    Is it a well known term in your line of business?If your trade mark is a well known term or representation in your line of business we wouldobject to it. For example V8 for vehicle engines.

    Other peoples Trade MarksHas someone else already registered or applied to register the same or similar trade mark forthe same or similar goods and services? If your trade mark looks or sounds the same or similarto another registered mark, or one that is being applied for, we will object to your mark.

    Trade Mark searchIt is important to conduct a search of the trade mark register to see if your trade mark isalready registered or has been applied for by another trader. As mentioned earlier you can use

    Other important information to consider before you applyIt is important to consider all the points mentioned above when applying to register your trademark as once we receive your application you cannot make anychanges to your application

    (only minor clerical errors on the form may be amended).

    If we object to your mark and hence you decide to make changes to it to facilitate itsregistration, a new application will have to be submitted. Obviously this will slow theregistration process of your trade mark.

    Therefore you should carefully consider all the reasons why we may object to your mark at thestart and make changes accordingly before you submit the application. We recommend thatyou use ourSearch and Preliminary Advice Services before submitting your application as thiscan give a good indication as to whether your trade mark is eligible for registration.

    Time scale (how long does the process take?)If there are no deficiencies in the application and no objections to the trade mark then thewhole application procedure can take as little as 6 months from receipt of application toregistration.

    Deficiencies checking

    Before beginning to examine your application, we will carry out a thorough check of theapplication form(s) and any attachments. This is to see if all the necessary parts of the form(s)have been filled in, if they are correct and if any required information is missing.

    If any required information is missing, we will ask you to provide the information to remedythe deficiencies. Some amendments are very minor and will not affect the filing date of yourapplication, e.g. the class number of the applied for goods. Others are more important andwill therefore affect the filing date, e.g. you have not provided the representation of your trademark. Also, major changes to the application will not be accepted, for example, changes tothe representation of the trade mark.

    If everything is in order your application will proceed to the next stage (Search andexamination).

    Search & ExaminationAfter the deficiencies checking has been completed and all is found to be in order we willconduct a search of the trade marks records to see if the same or similar trade mark hasalready been registered or been applied for by another trader in respect of the same or similarclass of goods and services.

    We will also see if the trade mark satisfies the registration requirements laid down in theTrade Marks Ordinance. Some of these criteria are listed in the Before you applysectionalthough this is not a comprehensive list.

    The examiner will then issue an opinion in writing which will either lay out the grounds forobjection to the mark or confirm the mark is acceptable for registration.

    ObjectionsIf the requirements for registration are not met we will object to the mark. You, the applicant,have 6 months in which to meet the requirements. A further 3 months extension may begranted.

    How to overcome objectionsWe will indicate in the opinion why the mark does not meet the requirements for registrationand may suggest ways of overcoming the objection if we think it is possible to do so.

    If the objections remainEven if you have tried to overcome the objections made in the initial opinion we may still findthat the requirements for registration have not been met and will issue a further opinionindicating these findings. At this stage, if you still wish to pursue your trade mark application,then you have 3 months from the date of the further opinion to satisfy the registrationrequirements or call for a hearing. You may ask for an extension of this period only in certaincircumstances specified in the Trade Marks Rules e.g. where you need additional time to

    obtain the consent of the owner of an earlier trade mark.

    If you call for a hearing, all the evidence for and against the trade mark will be considered at ahearing, and a decision will be issued by a hearing officer.

    Publication of Trade MarkOnce your trade mark has been accepted for registration, it is published in the Hong KongIntellectual Property Journal athttp://www.ipd.gov.hk/eng/ip_journal.htm.

    Opposition to your Trade Mark by a 3rd Party

    Anyone can view your trade mark in the Hong Kong Intellectual Property Journal and lodgean opposition to it. They have to file an opposition notice within the 3-month periodbeginning on the publication date. As the applicant, you may withdraw your application orrespond to the opposition by filing a counter-statement. Please note that if you withdrawyour application or lose in the opposition proceedings, you may have to pay the other partyscosts. You and the opponent are given the opportunity, within certain time limits, to fileevidence in support of the application and opposition. When all the evidence has beenreceived, a hearing will take place before a hearing officer who then makes a decision. Thesuccessful party in opposition proceedings is usually entitled to an award of costs.

    Registration

    Once your trade mark has been accepted for registration, the Registrar of Trade Marks willenter the details of your trade mark into the trade marks register and you will be issued with acertificate of registration. Notice of the registration will be published in the Hong KongIntellectual Property Journal and the registration of your trade mark will date back to the filingdate of your application. That means as the owner of a registered trade mark, your rights takeeffect from the filing date of the application.

    How to complete your Trade Mark application formThe following is a step by step guide to completing your trade mark application form. Please read thesenotes carefully. Before you fill in the form there are a couple of important points to note.

    General points before filling in the form:Firstly, once you have submitted your form, you cannot make any significant changes to it. Only minorclerical errors will be accepted. Furthermore, we cannot refund your application fee for any reason.Therefore, please read this document carefully.

    Secondly, have you read the Before you applysection? Have you conducted a trade mark search to seeif someone else has already registered or applied to register your trade mark?

    Which forms do I use?Forms T2You need to fill in Form T2 to apply to register a trade mark.

    OptionalForm T2AThis form should only be completed if you are applying for a certification, collective or defensive mark, asound or smell mark, or if you claim a 3-dimensional shape or a colour(s) as a trade mark or an elementof your trade mark, or if you wish to include a disclaimer, limitation or condition. Form T2A should beused in these cases, in addition to T2 and is also attached.

    Explanatory Notes on Trade Mark Forms T2

    IntroductionPlease note that only minimal changes to the application are allowed after you have filed the application.

    Either Chinese or English can be used as the language of proceedings. Please complete this form inEnglish unless otherwise stated. If this form is used, the language of proceedings will be in English andthe certificate of registration will be issued in English.

    This form must be signed and dated. If there is not enough space for any part on this form, pleasecontinue on an additional sheet. Number each additional sheet and state the number of additionalsheets. Please keep a photocopy of the application form for your own records.

    On submission of this form, you are taken to have consented to any use including reproduction of thetrade mark or other information for scanning and examination purposes. Information provided in thisapplication form, including personal information, may be made available on the Internet.

    Part 01Details of applicantState the full name of the applicant of the trade mark. If the name of the applicant is not in Roman letters(e.g. Japanese or Korean company name) or in Chinese, a transliteration of the name into Roman lettersmust be provided. The applicant may be an individual or a company. The applicants name consistingsolely of a trading name is not acceptable. For multiple or joint applicants, all names should be given.The address given should be the normal trade or business address. For multiple or joint applicants,provide each of their addresses if they differ.

    Part 02Trade MarkYou cannot amend the mark (except for addition of a registered mark) after you have filed the application.

    Place a representation of the trade mark in Part 02 and ensure that the trade mark is placed in the boxthe right way up and is clear enough for scanning purpose. Please do not staple the representation ofyour mark to the form.

    Series of trade marksSeries of trade marks means a number of trade marks, which resemble each other as to their materialparticulars and differ only as to matters of a non-distinctive character not substantially affecting theidentity of the trade mark.Owner of a series consisting of not more than 4 trade marks can apply to register them in a singleregistration. If you are applying for a series of trade marks, please arrange the marks in the series inalphabetical order by printing a capital letter A at the top left-hand corner of the first mark in the series,a capital letter B to the second mark, a capital letter C to the third mark and a capital D to the fourth

    mark.If the marks in a series are identical but only differ in colour, you may wish to claim the relevant colour(s)as element(s) of your marks in the series, since otherwise there is no difference between them. To claimthe colour(s) as element(s) of your mark, you are required to mark Part 07 and complete Part 13 onForm T2A as well (see SAMPLE attached).

    Part 03Non-Roman letters and non-Chinese charactersIf your trade mark consists or contains a word, letter or character that is neither in Roman letters nor inChinese characters, you are required to provide the transliteration and/or translation of the word, letter orcharacter into English and state the language in question.

    Part 04Convention priority detailsIf the applicant has duly filed an application for registration of this trade mark in respect of the samegoods or services in a Paris Convention country or WTO member within 6 months before the date offiling of this application, right of priority can be claimed. Attention is drawn to section 41 of the TradeMarks Ordinance.It is possible to claim multiple priority dates in respect of different goods and/or services.

    Part 05Goods and/or services covered by this applicationPlease list the goods and/or services for which you want to register your trade mark. If your applicationcovers goods or services in more than one class, please group them together by class in numerical order.State the class number(s) in the left-hand column of Part 05. You will not be able to add any extra goodsor services to your application after you have filed it with the Registry. You may however be able toamend your application by using Form T5A and pay the applicable fee (HK$650 per class) if some of thegoods or services listed are, according to the Registrar, not in any class you have stated in thisapplication.

    Part 12Certification markA certification mark is a sign indicating that the goods or services in connection with which it is used arecertified by the trade mark owner (or by any person approved by the owner) in respect of origin, material,mode of manufacture of goods or performance of services, quality, accuracy or other characteristics.If this application is for a certification mark, you must file regulations within 9 months after the date whenyou file this application. Attention is drawn to paragraphs 6, 7, Schedule 4 of the Trade Marks Ordinanceand rule 101 of the Trade Marks Rules.

    Collective markA collective mark is a sign distinguishing the goods or services of members of an association from thoseof other undertakings.

    If this application is for a collective mark, you must file regulations within 9 months after the date whenyou file this application. Attention is drawn to paragraphs 5, 6, Schedule 3 of the Trade Marks Ordinanceand rule 100 of the Trade Marks Rules.

    Defensive markAn application for defensive mark may be filed if a registered trade mark has become exceptionally wellknown in Hong Kong in relation to some goods or services that its use in relation to other goods orservices would likely to detract from its distinctive character in relation to the goods or services for whichit has been used. The owner is not required to use the trade mark on the goods or services applied forbut evidence is needed to support the application.If this application is for a defensive mark, you must file statutory declaration or affidavit within 9 monthsafter the date when you file this application. Attention is drawn to Section 60 of the Trade Marks

    Ordinance and rule 99 of the Trade Marks Rules.

    Part 13A trade mark must be graphically represented. Where the sign is a 3-dimensional shape, colour, soundor smell, you need to give a clear description of the sign.

    ShapeAn application for registration of a 3-dimensional shape as a trade mark or as an element of trade markshall not be treated as a shape mark unless the application contains a statement claiming the shape asthe trade mark or as an element of trade mark.If the trade mark does not consists of or contains a 3-dimensional shape, there is no need to mark thisbox.

    ColourAn application for registration of a colour or colours as a trade mark, or as an element or elements oftrade mark shall not be treated as a colour mark unless the application contains a statement claiming thecolour or colours as the trade mark, or as an element or elements of trade mark. In addition, the trademark, or the element or elements of trade mark must appear in the representation of the trade markincluded in the application in the colour or colours for which the claim is made.

    SoundIf the trade mark consists wholly or in part of a sound, please state that fact and provide a description ofthe mark.

    SmellIf the trade mark consists wholly or in part of a smell, please state that fact and provide a description ofthe mark.

    Part 14Disclaimer, limitation or condition

    If you want to disclaim the right to the exclusive use of any part of your mark or to limit your use of themark, please give details in this box.
