MINUTES OF THE EDUCATION COMMITTEE MEETING

Wednesday, April 12,1978.

The Full Education Committee held a meeting on April 12, 1978 at 5:55 p.m. in Room 246 of the Capitol. Attached is a copy of the minutes and attendance sheet of the said meeting.

The meeting was called to order at 5:55 p.m. in Room 246 by Chairman James J. A. Gallagher. There was a quorum present. (A copy of the attendance sheet is attached)

Basic Education Subcommittee Chairman Lincoln reported H.B. 1773 and H.B. 2037 to the Full Committee for disposition. He said that a public hearing had been conducted on H.B. 1773.

H.B. 1773 changes the language of the Code pertaining to -- hazardous routes for busing purposes. It would allow PennDOT evaluators more leeway in determining if a route is hazardous under Act 372. Presently, the presence or absence of sidewalks is the sole factor in making that determination.

On the motion of Mr. Lincoln, seconded by Mr. Garzia, the hill was reported to the Floor. It was on a unanimous voice vote-except Mr. Noye.

H.B. 2037 is designed to extend the period of training for those special ed students covered by the PARC decision who have obtained only a minimal amount of training.

Mr. Hutchinson proposed an amendment to change the word- ing "special education training" to read "instruction." The amendment was adopted by unanimous voice vote.

On the motion of Mr. Hutchinson, seconded by Mr. Lincoln, the hill was reported out as amended. The vote was unanimous except Mr. Noye.

H.B. 2337 coordinates PHEAAs grant programs and an- nouncement dates with the Federal BEOG program. It changes the grant announcements from May 1 to March 1. The bill also changes the PHEAA continuation law to read the same way. In other words, if the legislature has not acted to the contrary by March 1 (instead of May 1) the current PHEAA appropriation will he considered reenacted. The hill does not alter any appro- priations-just time elements.

On the motion of Mr. Fischer, seconded by Mr. Lincoln, the hill was reported to the Floor by unanimous voice vote.

H.B. 2069 requires that no school administrator be able to change the grade of a student in any course unless the teacher of the student in that particular course consents in writing.

On the motion of Mr. Fischer, seconded by Mr. Burns, the hill was reported to the Floor hy unanimous voice vote.

H.B. 1225 and H.B. 1226 are the Medical Districting and the Physicians Education Planning Acts, respectively. They are similar to bills considered at some length in previous sessions. Essentially, they are designed to bring medical facilities and personnel into medically deprived areas of the State.

Mrs. Wise and Mr. Hutchinson asked for more time to review and consider the two measures. It was agreed to table them un- til the next meeting.

Chairman Gallagher gave a brief resume of the previous ac-

tion taken hy the Committee with regard to Senate Bill 1180. He noted that the Committee had adopted amendments which would strip the original intent of the hill, thus restoring the re- quirement that public school teachers he U. S. citizens except those on exchange programs and those teaching foreign lan- guages not on a permanent basis.

H, ,,id the committee also had adooted an amendment re- ducing the term of school directors from 6 to 4 years and re- storing the requirement of 900 hours of instruction for elemen- tary students.

On the motion to report the hill, however, there were insuf- ficient votes.

The Committee agreed unanimously to the amendments de- leting the original intent of S.B. 1180 and to insert the provi- sion enabling the Secretary to approve a school year program of 900 hours at the elementary level.

Mr. Burns urged consideration of an amendment requiring a referendum in the affected districts before any voluntary mer- ger of school districts could he undertaken. The Committee had failed to consider this amendment to S.B. 1180 at its meeting of March 29,1978.

Mr. Burns said the scare of a possible merger with Philadel- phia becomes an election issue every two years-even though there is no logical merit in the argument. He said it could be unique to his district and that of Mr. Gallagher, but neverthe- less, it keeps coming up.

Mr. McLane brought up the converse situation-pertaining to breaking up school districts.

Mr. Hutchinson said he was reluctant to put the question of mergers and dissolutions on the Floor for debate. He urged that the Committee not consider the merger referendum amend- ment.

Mr. Hutchinson also moved to delete the amendment dealing with the term of school directors-hanging from 6 to 4 years. The motion was defeated 5 to 8.

On the motion of Mr. Burns, seconded by Mrs. Wise, S.B. 1180 as amended was reported to the Floor by unanimous voice vote.

There being no further business to come before the Commit- tee, the meeting was adjourned at 6:ZOp.m.

So the Speaker is requesting both Republican and Democratic cau- cuses to caucus on the entire calendar so that is is available for voting tomorrow.

INTERROGATION Mr. WILSON, under unanimous consent, interrogated Mr.

PIEVSKY. Mr. WILSON. Mr. Speaker, over the weekend, I had some

very disturbing news. Last year we spent some 9 months discussing a budget of which the funds for higher education were the last thing to he funded, including the institutional grants. I hate to put you on the spot. I am sorry, but I do not know anybody else to ask the question of. I have a local institu- tion that has been paid nothing a t this moment on institutional grants, zero. I t has been paid nothing on its preferred appropriations, and I am afraid that none of the colleges have gotten any money since December and we are now coming up on May. Can you tell me what is the problem? Why these col- leges have not gotten their institutional assistance grants nor their preferred appropriations? Can you give me some insight to that?

Mr. PIEVSKY. Mr. Speaker, I do not have the answer to that, but I can certainly find out for you in short order.

Mr. WILSON. Yes, sir. In how short order? Mr. PIEVSKY. Give me a t least 15 or 20 minutes. Mr. WILSON. Thank you, sir. I would appreciate an answer

because I think the turmoil this body and the other body went through last year to develop those moneys deserves a better

gentleman from Allegheny, Mr. Goehel, calls up on page 15 the discharge resolution relating to HB 59.

The SPEAKER. For the information of the members who have not voted on the discharge resolution before, this requires a constitutional majority to pass; 102 members must vote in favor of the discharge of the committee.

Temple has got 50 percent of its money, and the rest of the money has been held UP.

Mr. PIEVSKY. Well, the first quarter had been paid on March 15 and the second quarter is due right now, in fact, so I imagine the money is forthcoming very shortly.

Mr. WILSON. As of last Friday, the smaller colleges have gotten no payments whatsoever, and as of last Friday, the larger institutions, such as Penn State and Temple, have gotten 50 percent. Is that what you are talking about, your March pay- ment and so forth? so they have only gotten 50 percent. could you tell us-and maybe you do not have the answer-do you have the real inside dope as to what they did with the money sinceDecember?

Mr. PIEVSKY. I cannot answer that, Mr. Speaker. m, mLsoN, I think it would be interesting to find out what

they have done with the money. Evidently they have collected the CNI - corporate net income - atleast, retroactively. They have had that for a t least 6 months or 4 months, and I think it would be informative to this House to find out what happened to the dough and why we have not gotten payments to these institutions,

Chair intends to read because the Chair thinks the note makes a great deal of sense. I t is from Representative Mike Fisher. It says: "Mr. Fisher, the action on HB 992 on concurrence is an example of why 1 believe the calendar should contain an ex- planation of Senate amendments to House hills and the reason tha t I asked tha t all prime sponsors explain these changes to the full House before a vote on concurrence. Too much bad law is heing routinely voted for on concurrence."

1 think the gentleman's point is well taken, and whereas the Speaker is not ahle to change the calendar quite tha t rapidly, the Speaker is ahle, and does now announce, that the Speaker will not entertain on concurrence any vote from now on, any concurrence in Senate amendments, until someone on the floor-and i t does not necessarily have to be a prime spon- sor-someone, maybe the majority leader, the minority leader or a committee chairman, has explained to the House what the amendments were which were inserted in the House hills.

Now, even though the Speaker is taking a step, i t does not lift the responsibility of the individual member to ascertain what has been amended into a House hill. The individual memher still has the responsibility of reading the legislation on which he or she votes. But just in case there may he one or two who have not, from now on we will ask in each case on concurrence in Senate amendments tha t someone rise to explain those Sen- ate amendments.

There heing no further business to he called before the House of Representatives a t this time, the Speaker has signed the following hills, the numbers and titles which the clerk will read.
