SUMMARY OF SESSION

This, the First Session of the Fiftieth Parliament was the shortest in South Australian Parliamentary history, being only one day. A general election held on 9 Februray 2002 resulted in neither of the major parties achieving an absolute majority. The results of the seats won by each party, was as follows:

Following the election it was widely speculated that the Liberal Party would be able to form Government with the support of the three Independent Members and the National Party Member. The three Independents comprise of two former members of the Liberal Party and a Nationals Member who had supported the previous Liberal Government. However subsequent to negotiations with both the Liberal and Labor Parties, the Independent Member for Hammond, Mr Lewis, annouced his intention to support the Labor Party. Mr Lewis’ vote provided the Labor Party with an absolute majority of the Members of the House of Assembly. In accordance with a precedent set in 1968, the Liberal Party decided to test the numbers on the floor of the House. The sitting of the Parliament was complicated by the visit to South Australia of Her Majesty Queen Elizabeth the Second at the end of February. The Parliament finally sat on Tuedsay 5 March with Liberal Party Members on the Government benches and Labor Party Members on the Opposition benches.

Due to the likely outcome and truncated nature of the sitting, the Government ensured that the pomp and ceremony of the opening day was kept to a minimum. The Governor’s speech, which lasted only about five minutes, included the following statements:

My Ministers have advised me to call you together at this early date in order to resolve the matter of who will form Government in this Parliament. Because no Party has an absolute majority it is appropriate that the will of the Parliament is tested on the floor of the House of Assembly, as it was in 1968.

Two nominations for the position of Speaker were received. The Government nominated Mr McEwen, Independent Member for Mount Gambier and the Opposition nominated Mr Lewis. The result of the ballot was Mr McEwen 22 votes, Mr Lewis 25 votes. Thus Mr Lewis was elected as Speaker. Following the tabling of Papers and the election of Hon R B Such, Independent Member for Fisher, to the position of Chariman of Committees, Standing Orders were suspended to provide for a motion of confidence in the Liberal Government. The Motion read:

That following the election on 9th February 2002 at which the Liberal Party received a clear majority of the two-party preferred vote, this House supports the continuation of a Liberal Government.

A division was called on the question “that the motion be agreed to”. The result was 22 votes for the ayes and 23 votes for the noes. The casting vote of the Speaker was not required. On the result of the vote being announced, the Premier (Hon R G Kerin) advised the House it was his intention to call upon the Governor to tender his resignation and that of his Government. The sitting was adjourned at 3.55 pm. The Leader of the Opposition (Hon M D Rann) then visited the Governor to advise that he had the necessary support to form the first Labor Government since 1993. No formal business was conducted and no committees were apppointed. The Parliament was prorogued overnight until Tuesday 7th May 2002.
