SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OFMARYLAND, That:
(1) The Board of Public Works may borrow money and incur indebtedness onbehalf of the State of Maryland through a State loan to be known as the MarylandConsolidated Capital Bond Loan of 2005 in the total principal amount of $665,335,000$665,443,000. This loan shall be evidenced by the issuance, sale, and delivery of Stategeneral obligation bonds authorized by a resolution of the Board of Public Works andissued, sold, and delivered in accordance with Sections 8–117 through 8–124 of theState Finance and Procurement Article and Article 31, Section 22 of the Code.
(2) The bonds to evidence this loan or installments of this loan may be sold asa single issue of bonds under Section 8–122 of the State Finance and ProcurementArticle.
(3) The cash proceeds of the sale of the bonds shall be paid to the Treasurerand first shall be applied to the payment of the expenses of issuing, selling, anddelivering the bonds, unless funds for this purpose are otherwise provided, and thenshall be credited on the books of the Comptroller and expended, on approval by theBoard of Public Works, for the following public purposes, including any applicablearchitects’ and engineers’ fees:

DE02.02 PUBLIC SCHOOL CONSTRUCTION(Statewide)
(A) Public School Construction Program. Provide funds to constructpublic school buildings and public school capital improvementsin accordance with Sections 5–301 through 5–303 of theEducation Article, provided that, notwithstanding Section5–302(e) of the Education Article or any other provision of law,the Interagency Committee on School Construction shall, inaccordance with the provisions below, allocate 100% of thefunds available for public school construction projects in fiscalyear 2006. The Interagency Committee on School Constructionshall include funds available in the contingency fundestablished in § 5–301(j) of the Education Article in allocations.

Provide funds to preparepreliminary plans to construct a new Forensic Medical Center,provided that no funds shall be expended for planning or designuntil the Department of Health and Mental Hygiene (DHMH),the Department of Budget and Management (DBM), and theDepartment of General Services (DGS) have prepared andsubmitted a report to the budget committees by September 1,2005, that provides an analysis of potential suitable sites for thefuture construction of a new forensic medical center for theOffice of the Chief Medical Examiner (OCME). Any siteconsidered by DHMH, DBM, and DGS as a potentially suitablelocation for the construction of a new forensic medical centershall be identified in the report, and all sites identified shallinclude a site suitability assessment analysis by DHMH andDBM. In determining whether a site is suitable, DHMH andDBM shall consider at a minimum:
(1) proximity to OCME core functional partners,including the State’s Attorney’s Office, theUniversity of Maryland Medical SystemGroup, the Johns Hopkins University Schoolof Medicine Institutions, and the MarylandInstitute for Emergency Medical ServicesSystems; and
(2) the ability to construct a facility, whether itbe one or multiple buildings, that meets thepresent and future operational and functionalneeds of OCME, and ensures compliance with

(4) An annual tax is imposed on all assessable property in the State in rateand amount sufficient to pay the principal of and interest on the bonds, as and whendue and until paid in full. The principal shall be discharged within 15 years after thedate of issue of the bonds.
(5) (a) Prior to the payment of any matching grant funds under theprovisions of Section 1(3), Items ZA00 through ZB02 above, grantees shall provideand expend matching funds as specified. No part of a grantee’s matching fund may beprovided, either directly or indirectly, from funds of the State, whether appropriatedor unappropriated. Except as otherwise provided, no part of the fund may consist ofreal property, in–kind contributions, or funds expended prior to the effective date ofthis Act. In case of any dispute as to what money or assets may qualify as matchingfunds, the Board of Public Works shall determine the matter, and the Board’s decisionis final. Grantees have until June 1, 2007, to present evidence satisfactory to theBoard of Public Works that the matching fund will be provided. If satisfactoryevidence is presented, the Board shall certify this fact to the State Treasurer and theproceeds of the loan shall be expended for the purposes provided in this Act. If thisevidence is not presented by June 1, 2007, the proceeds of the loan shall be applied tothe purposes authorized in Section 8–129 of the State Finance and ProcurementArticle.
(b) It is further provided that when an equal and matching fund isspecified in Section 1(3), Items ZA00 through ZB02 above, grantees shall provide amatching fund equal to the lesser of (i) the authorized amount of the State grant or(ii) the amount of the matching fund certified by the Board of Public Works. Ifsatisfactory evidence is presented, the Board shall certify this fact and the amount ofthe matching fund to the State Treasurer and the proceeds of the loan equal to theamount of the matching fund shall be expended for the purposes provided in this Act.If this evidence is not presented by June 1, 2007, the proceeds of the loan shall beapplied to the purposes authorized in Section 8–129 of the State Finance and

Procurement Article. The proceeds of any amount of the loan in excess of thematching fund certified by the Board of Public Works shall also be applied to thepurposes authorized in Section 8–129 of the State Finance and Procurement Article.
(6) When an historical easement is specified in Section 1(3) of this Act:
(a) Prior to the issuance of the bonds, the grantee shall grant and conveyto the Maryland Historical Trust a perpetual preservation easement to the extent ofits interest:
(i) On the land or such portion of the land acceptable to the Trust;and
(ii) On the exterior and interior, where appropriate, of the historicstructures.
(b) If the grantee or beneficiary of the grant holds a lease on the landand structures, the Trust may accept an easement on the leasehold interest.
(c) The easement must be in form and substance acceptable to the Trustand the extent of the interest to be encumbered must be acceptable to the Trust andany liens or encumbrances against the land or the structures must be acceptable tothe Trust.
(6) (7) The proceeds of the loan must be expended or encumbered by theBoard of Public Works for the purposes provided in this Act no later than June 1,2012. If any funds authorized by this Act remain unexpended or unencumbered afterJune 1, 2012, the amount of the unexpended or unencumbered authorization shall becanceled and be of no further force and effect. If bonds have been issued for the loan,the amount of unexpended or unencumbered bond proceeds shall be disposed of asprovided in Section 8–129 of the State Finance and Procurement Article.
(8) Multiple grants provided to the same organization in this Section are inaddition to one another. Unless otherwise provided, any matching fund requirementsapply to each individual grant.
SECTION 2. AND BE IT FURTHER ENACTED, That:
(a) With respect to any parking facility financed using any combination ofcash, revenue bonds, or other debt and constructed on the State property bounded byRowe Boulevard/Bladen Street, Calvert Street, St. Johns Street, and BloomsburySquare in Annapolis or any other location within 1,320 feet of the boundaries of thatproperty:
(1) The operator of that facility shall allocate for 12 months of the year atleast 250 parking spaces for employees of the General Assembly which shall beassigned by the President of the Senate and the Speaker of the House of Delegates.

(2) Spaces in the facility shall be made available to the General Assemblyon the financial terms equivalent to the most favorable terms under which spaces maybe provided to other State agencies.
(3) All contracts for financing, construction, or operation of this facilityshall be made subject to the requirements of this section.
(b) The Department of General Services may not reduce the total number ofparking spaces available to staff of the General Assembly in the parking lot adjacent tothe Lowe House Office Building (“B” lot), the adjoining parking garage (“A” Garage),or the Gotts Garage below the number assigned on April 11, 2005 without the writtenconsent of the President of the Senate and the Speaker of the House of Delegates.
(c) The Department of General Services, the Maryland TransportationAuthority, and any other public agencies or instrumentalities involved in thefinancing, construction, or operation of the parking facilities referenced in this Sectionshall be subject to the requirements of this Section.
SECTION 3. AND BE IT FURTHER ENACTED, That the Department of StatePolice, in consultation with the Emergency Medical Systems Board, the EmergencyMedical Systems Advisory Council, and the Maryland Institute of Emergency MedicalSystems, shall submit a plan to the budget committees by September 1, 2005, for thescheduled replacement of the Dauphin Med–Evac helicopters beginning in fiscal 2007.Further provided that the budget committees shall have 45 days to review andcomment on the plan.
SECTION 2. 4. AND BE IT FURTHER ENACTED, That the Laws ofMaryland read as follows:

AND BE IT FURTHER ENACTED, That the MarylandStadium Authority is authorized to prepare various studies, including site studies,architectural programs, budget estimates, value engineering, and project schedules,and may design and construct facilities for State agencies, the University of MarylandMedical System or local governments, provided that prior to beginning work on behalfof a State agency, the University of Maryland Medical System or local government, theAuthority must notify the budget committees in writing of the proposed project ANDTHE ESTIMATED COSTS AND FUNDING SOURCES and allow the committees 30days to review and comment on the proposed work. The Authority is permitted to enterinto contracts, engage consultants, and make recommendations relating to thispurpose and shall use funds provided by the State agencies, the University ofMaryland Medical System or local governments or otherwise appropriated for theparticular purpose. THE AUTHORITY IS PERMITTED TO USE UP TO $500,000 OFAVAILABLE NON–BUDGETED STADIUM AUTHORITY FUNDS IN EACHFISCAL YEAR FOR FEASIBILITY STUDIES APPROVED BY THE BUDGETCOMMITTEES (OTHER THAN FOR CONSTRUCTION), INCLUDING FUNDS INTHE FISCAL YEAR 2005 OPERATING BUDGET.

(A) Baltimore City Detention Center – Property Acquisition ANDDEMOLITION. Provide funds to acquire AND DEMOLISHadjacent properties to expand the Baltimore City DetentionCenter, provided that no funds may be expended on this projectuntil:
(1) the appraisal has been reviewed by theDepartment of Budget and Management;
(2) a cost estimate for acquisition, demolition,and site work based on the approvedappraisal has been prepared by theDepartment of General Services; and
(3) the budget committees have reviewed andcommented on the cost estimate or 45 dayshave elapsed from the date the cost estimateis received by the committees.
Further provided that no funds may be expended forthis project until:
(1) the Department of Public Safety andCorrectional Services submits a CapitalMaster Plan;
(2) the Capital Master Plan does not include anynew correctional facility construction or anycorrectional facility expansion projects inBaltimore City south of Monument Street;
(3) the Department of Public Safety andCorrectional Services and the Department ofGeneral Services have met with members ofthe communities affected by the acquisition ofnew property and new correctional facilityconstruction; and

(2) DELIBERATIONS AND DECISIONS REGARDING THEELIGIBILITY OF PROJECTS AND ALLOCATION OF FUNDING SHALL BECONSIDERED QUASI–LEGISLATIVE FUNCTIONS FOR THE PURPOSES OFTHE OPEN MEETINGS LAW.
SECTION 6. AND BE IT FURTHER ENACTED, That notwithstanding §5–302(e) of the Education Article or any other provision of law, for fiscal year 2007, theBoard of Public Works may not, before May 1, 2006, approve public school constructionprojects that comprise more than 75% of the preliminary school construction allocationrecommended by the Governor as required in § 8–113 of the State Finance andProcurement Article.

SECTION 3. 7. AND BE IT FURTHER ENACTED, That the Laws ofMaryland read as follows:

8–109.
The Committee consists of the following [5] 7 members:
(1) 1 individual appointed by the Governor; [and]

(i) the Comptroller;
(ii) the Treasurer;

SECTION 3. 4. 8. AND BE IT FURTHER ENACTED, That the GeneralAssembly declares that it is the public policy of this State to manage State generalobligation bond debt in a manner that will maintain Maryland’s AAA bond rating. TheGeneral Assembly further declares that legislative oversight, control, and review ofall forms of State obligations is essential to maintenance of the State’s existing bondrating and protection of the fiscal integrity of the State.
SECTION 4. 5. 9. AND BE IT FURTHER ENACTED, That, before work maycommence pursuant to any supplement to any appropriation contained in this Act,satisfactory evidence must be given to the Board of Public Works that the project canbe completed with the aggregate of the funds in this Act and previously appropriatedfor the stated purpose.
SECTION 5. 6. 10. AND BE IT FURTHER ENACTED, That, with theapproval of the Department of Budget and Management, any appropriation forconstruction provided in this Act may be used to purchase capital equipment if the

amount of the appropriation exceeds the amount required for construction expenses,including allowances for contingencies.
SECTION 6. 7. 11. AND BE IT FURTHER ENACTED, That, except asotherwise provided in this Act, before a State agency or institution named in this Actas responsible for an individual item may begin work with funds appropriated by thisAct, the agency or institution shall provide satisfactory evidence to the Board ofPublic Works that the work described in the individual item can be completed withthe funds specified for that item.
SECTION 7. 8. 12. AND BE IT FURTHER ENACTED, That, with theapproval of the Department of Budget and Management, any appropriation under theprovisions of this Act that is in excess of the amount needed for a project may becredited to the Construction Contingency Fund under Section 3–609 of the StateFinance and Procurement Article.
SECTION 8. 9. 13. AND BE IT FURTHER ENACTED, That, if federal fundsare available to help accomplish any project identified in this Act, the State agency orinstitution responsible for the project shall make efforts through properadministrative procedures to obtain these federal funds. Before spending any fundsappropriated by this Act, the agency or institution shall certify its efforts to the Boardof Public Works and state the reason for any failure to obtain federal funds. If federalfunds are obtained, they shall be used to defray the costs of the project described inthis Act and not to expand its scope.
SECTION 9. 10. 14. AND BE IT FURTHER ENACTED, That:
(a) for any appropriation for the planning of a State–owned project provided inthis Act, if a program required by Section 3–602(d) of the State Finance andProcurement Article has not been submitted, the State agency or institutionresponsible for the project shall submit a program to the Department of Budget andManagement for approval before funds may be expended from the appropriation; and
(b) for any appropriation for the construction of a State–owned projectprovided in this Act, if preliminary plans and outline specifications required bySection 3–602(f)(2)(i) of the State Finance and Procurement Article have not beenprepared, the State agency or institution responsible for the project shall submitpreliminary plans and outline specifications to the Department of Budget andManagement for approval before funds may be expended from the appropriation.
SECTION 10. 11. 15. AND BE IT FURTHER ENACTED, That no portion ofthe proceeds of a loan or any of the matching funds provided for a project fundedunder this Act may be used for the furtherance of sectarian religious instruction, or inconnection with the design, acquisition, construction, or equipping of any buildingused or to be used as a place of sectarian religious worship or instruction, or inconnection with any program or department of divinity for any religiousdenomination. Upon the request of the Board of Public Works, a recipient of theproceeds of a loan under this Act shall submit evidence satisfactory to the Board that

none of the proceeds of the loan or any matching funds has been or is being used fora purpose prohibited by this Act.
SECTION 11. 12. 16. AND BE IT FURTHER ENACTED, That, theComptroller may advance funds to any loan funds account established pursuant to ageneral obligation bond loan enabling Act, for any expenditure authorized by that Act,provided that if general obligation bonds have not been issued under the authority ofthat Act, the next ensuing sale of general obligation bonds shall include the issuanceof bonds under the authority of that Act in an amount at least equivalent to theamount of the funds so advanced.
SECTION 12. 13. 17. AND BE IT FURTHER ENACTED, That, the net newdebt to be authorized by legislation in fiscal year 2006 may not exceed $670,000,000,as evidenced by the following:
