ExCape Town cops appear on assault chargesFormer Cape cops in court for brutality caseCop filmed beating suspect dismissed
Januarie pleaded guilty and was found guilty ofassaulting the vagrant with intent to inflictgrievous bodily harm.
He initially appeared with his former colleagueDavid Gunn, 53, who pleaded not guilty and willstand trial from 17 February. Gunn is out on bailof R1 500.
In March, a woman in a building in the CapeTown CBD made a cellphone recording of thealleged incident in the street below.
The video clip was posted online and went viralon social media.
Gunn was dismissed from the police afterdisciplinary action, but Januarie resigned beforedisciplinary action could be taken against him.
According to the court record, Gunn and Januarieresponded to a complaint of an attempted armedrobbery at the Sky nightclub on the night of 6March.
The owner alleged that a naked, homeless man,Clement Eneh, who was outside in the street, hadtried to attack him with a small axe.
The State alleges that Gunn and Januarie hit andkicked the man, before bundling him into the backof their patrol vehicle.
"You and your coaccused completely lost yourselves," Esau told Januarie.
According to defence attorney Jacqui Muller, the court had accepted that Januarie merely hit theman on the back of his neck with his elbow, and thus played a minor role in the incident.

Lol.
Esau said violent crime in South Africa had reached endemic proportions, and that the communityexpected it to be severely punishment.
He said Januarie had "thrown away" 25 years of service in the police, and that the prosecution andthe defence had agreed that the circumstances did not justify a prison sentence.

Why is a Nigerian vagrant in South Africa at all ? It is disturbing to have police brutality but even moredisturbing that the very people who are supposed to be protecting the borders of South Africa are notdoing their jobs but actually aiding an insidious threat to take over the country through incompetance, corruption, ulteriormotives and treason.

A naked Nigerian with an axe?
All they do is taking local jobs, run scams and commit crime.Like the public ,I am sure that the Cops are also frustrated with them.No good has ever come from allowing them into our country.I say let them take their beatings when they deserve it or send them home. Merely arresting them andleaving it up to the courts to deal with them is obviously not working.

What happened to the naked Nigerian? Did he get the bare minimum sentence for attempting to rob andattack the nite club owner? Where did he conceal the axe?

The Nigerian guy was wrong for wielding an axe in his birthday suit and thinking he could 'rob' a clubowner and get away. However, the cops were also wrong for not simply arresting him. Why? Becausethe latest of many crimes is that of a cop who shot and killed a 16 year old child THREE times in theback he was while lying down, facing the ground HANDCUFFED! Let the criminal get away, he will doworse. Let the cops get away, and it could be mine or your child laying dead on the ground tomorrow. The cop that shot the 16 year old boy who was living alone in a SHACK is the same nationality as theboy. It's not a matter of racism or foreigners taking SA citizen's jobs... it's a matter of standing up togetherand calling 'a spade, a spade'!
