Passport number: TK0764800 After discussion and agreement, the Parties agree as follows:Article 1: THE LEASING AREA 1.1 Party A hereby agrees to lease and Party B agrees to rent the room of 8A/A13 Thai Van Lung, District 1, Ho Chi Minh City.1.2Purpose of use: residence
Article 2: THE LEASING TERMLeasing term: 01 Year from 05 April 2014 to 04 April 2015.Article 3: THE RENTAL3.1 The Rental is USD380 per month (US Dollars Three Hundred and Eighty only)3.2 The Rental is fixed during the leasing term. 3.3 The Rental includes the followings:
Furnished apartments. Fully equipped kitchen utensils and appliances
Internet ADSL (WIFI)
Free in-room cable TV
Daily housekeeping services (except Sundays & Public Holidays) Linen changing service ( once a week ) Individual laundry service. ( 05 items / day ) Electricity and water (maximum USD 100/month) Drinking Water. ( 02 bottles / month )3.4 The Rental is exclusive of:
Telephone charges. Relevant Taxes.
Article 4: PAYMENT TERM AND DEPOSIT4.1 Party B will pay the Rental every month. The payment is made in cash or by bank transfer at the exchange rate of Vietcombank on the payment date.4.2 Right after the contract signing, Party B will make the deposit of 1-month rental USD380 (US Dollars Three Hundred and Eighty only)Article 5: PARTY AS RESPONSIBILITIES5.1. To hand over the leasing area to Party B on the Commencement Date.
5.2. To ensure that Party B will have full and exclusive use of the leasing area.
5.3. To repair promptly the damage as requested by Party B.
5.4. To provide guidance for Party B to comply with the regulations on registration of temporary residence. Article 6: PARTY BS RESPONSIBILITIES6.1 To pay the Rental on time. If the payment is delayed more than 5 days, Party B will be fined at 0.5% per day on the outstanding amount.6.2 To use the leasing area in accordance with the registered and authorized purpose.
6.3 To be responsible for any damages or losses of interior furnishing and facilities caused by itself or for damages caused to a third Party during the use of such leasing area and for protecting all its own personal effects.
6.4 To inform Party A immediately of any damages to the leasing area. 6.5 To strictly obey all the laws and regulations promulgated by the Government of Vietnam and abiding by all the regulations and rules on environmental hygiene, public order and security, fire fighting and prevention.
6.6 Not to transfer the Lease Contract or to sublease the leasing area to another lessee.
Article 7: TERMINATION OF CONTRACT7.1 The Lease Contract will be terminated in the following cases:
On the expiration of this contract and no renewal;
The building is to be abolished under a decision by a duly authorized body;
As the mutual agreement of the Parties.
In the above cases, the Parties will discuss and agree on all expenses and liabilities up to the date of termination and Party liable for these expenses will settle all 1 day prior to Party Bs release of the leasing area. Then Party A will refund the deposit to Party B within 7 working days.7.2 If Party B terminates the lease contract before the expiry date, the deposit and advance payment of the rental paid by Party B will not be refunded.
Article 8: GENERAL CONDITIONS8.1 The Parties are committed to implementing strictly the terms of the Lease Contract.
8.2 All amendments to the Lease Contract shall be agreed by the Parties in writing and approved by the authorized representatives of the Parties.
8.3 In the event of any disputes, the Parties will discuss and try to resolve the problem amicably. If the dispute cannot be resolved by negotiation, it may be referred to Vietnamese Court in Ho Chi Minh City, as the case may be, shall be final and binding on the Parties.
