Definitions (Includes Limitations)A. In this policy, “you” and “your” refer to the person

shown in the Declarations as INSURED and thatperson’s spouse if a resident of the same house-hold. “We”, “us” and “our” refer to the companyproviding this insurance.

B. In addition, these words and phrases in quotationmarks are defined as follows:1. “Actual cash value” means:

a. For buildings or structures the lesser ofthe following, as determined by “us”:(1) The cost actually and necessarily

incurred to repair or replace thedamaged property using standardnew construction materials of likekind and quality and standard newconstruction techniques, less depre-ciation; or

(2) Fair market value.b. For property other than buildings and

structures the lesser of the following, asdetermined by “us”:(1) The cost to repair or replace the

damaged property using materials oflike kind and quality, less deprecia-tion; or

(2) Fair market value.In determining depreciation “we” will con-sider wear and tear, deterioration, obsoles-cence, age, physical condition and reducedmarket value of the property. The rate ofdepreciation shall be the same for both laborand materials. “Actual cash value” does notinclude increased costs due to applicablebuilding codes, laws or ordinances.

2. “Aircraft liability”, “hovercraft liability”, “motorvehicle liability” and “watercraft liability”, sub-ject to the provisions in b. below, mean anyof the following:a. Liability for “bodily injury” or “property

damage” arising out of the:(1) Ownership of such vehicle or craft

by an “insured”;(2) Maintenance, occupancy, operation,

use, loading or unloading of suchvehicle or craft by any person;

(3) Entrustment of such vehicle or craftby an “insured” to any person;

(4) Failure to supervise or negligentsupervision by an “insured”, of anyperson involving such vehicle orcraft; or

(5) Vicarious liability, whether or notimposed by law, for the actions ofany person including a minor involv-ing such vehicle or craft.

b. For the purpose of this definition:(1) “Aircraft” means any contrivance

used or designed for flight exceptmodel or hobby aircraft not used ordesigned to carry people or cargo;

(2) “Hovercraft” means a self-propelledmotorized ground effect vehicle andincludes, but is not limited to, flarecraft and air cushion vehicles;

(3) “Watercraft” means a craft principallydesigned to be propelled on or inwater; and

(4) “Motor vehicle” means a “motor vehi-cle” as defined in 9. below.

3. “Bodily injury” means physical injury to a per-son. Sickness, disease, or emotional dis-tress that is not caused by physical injury isnot “bodily injury”.

4. “Business” means:a. A trade, profession or occupation

engaged in on a full-time, part-time oroccasional basis; or

b. Any other activity engaged in for finan-cial compensation, other compensation,or other professional purposes, exceptthe following:(1) Activities for which no “insured”

receives more than $2,000 in totalcompensation for the 12 monthsbefore the “occurrence”;

(2) Providing home day care servicesfor which no compensation isreceived, other than the mutualexchange of such services; or

(3) The rendering of home day care ser-vices to a relative of an “insured”.

5. “Employee” means an employee of an“insured”, or an employee leased to an“insured” by a labor leasing firm under anagreement between an “insured” and thelabor leasing firm, whose duties are otherthan those performed by a “residenceemployee”.

6. “Fungus” means any type or form of fungus,including but not limited to, mold, mildew,mycotoxins, spores, scents or by-productsproduced or released by fungi.

7. “Insured” means:a. “You” and residents of “your” household

who are:(1) “Your” relatives; or(2) Other persons under the age of 21

and in the care of any person namedabove;

b. A student enrolled in school full time, asdefined by the school, who was a resi-dent of “your” household before movingout to attend school, provided the stu-dent is under the age of:(1) 24 and “your” relative; or(2) 21 and in “your” care or the care of a

person described in a.(1) above; orc. Under SECTION 1:

(1) With respect to animals, watercraft,or “recreational motor vehicles” towhich this policy applies, any personor organization legally responsiblefor these animals, watercraft, or “rec-reational motor vehicles” that areowned by “you” or any personincluded in a. or b. above. “Insured”does not mean a person or organi-zation using or having custody ofthese animals, watercraft, or “recre-ational motor vehicles” in the courseof any “business” or without consentof the owner; or

(2) With respect to a “motor vehicle” towhich this policy applies:(a) “Employees” or “residence

employees” while engaged in“your” employ or that of any per-son included in a. or b. above;

(b) Other persons using the vehicleon an “insured location” with“your” consent; or

(c) A person while operatingmachinery with “your” permis-sion in “your” activities coveredby this policy.

Throughout this policy, when the word “an” or“any” immediately precedes the word“insured”, the words “an insured” or “anyinsured” mean one or more “insureds”.

8. “Insured location” means:a. The “residence premises”;b. Under SECTION 1 only, the part of other

premises, other structures and groundsused as a residence; and(1) Which is shown in the Declarations;

or(2) Which is acquired by “you” during

the policy period for use as “your”principal residence;

c. Any premises used by “you” in connec-tion with a premises described in a. and,under SECTION 1 only, b. above;

d. Any part of premises not owned by an“insured” where an “insured” is tempo-rarily residing;

e. Vacant land owned by or rented to an“insured”;

f. Land owned by or rented to an “insured”on which a one or two family dwelling isbeing built as a residence for an“insured”;

g. Individual or family cemetery plots orburial vaults of an “insured”;

h. Any part of a premises occasionallyrented to an “insured” for other than“business” use; or

i. Any location shown in the Declarations.9. “Motor vehicle” means:

a. A self-propelled land or amphibious vehi-cle; or

b. Under SECTION 1 only, any trailer orsemi-trailer that is being carried on,towed by or hitched for towing by a vehi-cle described in a. above.

10. “Occurrence” means:a. Under SECTION 1, an accident, includ-

ing continuous or repeated exposure tosubstantially the same general harmfulconditions, which results, during the pol-icy period, in:(1) “Bodily injury”; or

(2) “Property damage”.b. Under SECTIONS 2 through 6, the hap-

pening of an event, or series of eventsclosely related in time and nature thatgive rise to a loss.

11. “Pollutants” means any solid, liquid, gase-ous or thermal irritant or contaminant, whe-ther indoor or outdoor, including smoke,vapor, soot, fumes, acids, alkalis, chemi-cals, sewage, methane gas, manure, andwaste. Waste includes materials to be recy-cled, reconditioned or reclaimed.

12. “Property damage” means physical injury toor destruction of tangible property, includingthe resulting loss of use of this property.

13. “Recreational motor vehicle” means anymotorized land vehicle designed for recrea-tional use, principally used off public roads,which is not licensed for road use. A motorvehicle designed or used for racing is notconsidered a “recreational motor vehicle”.

14. “Replacement cost” means:a. Under Loss Settlements 1 and 2, and

Coverage EE Additional ReplacementCost, the cost actually and necessarilyincurred to repair or replace the dam-aged property using standard new con-struction materials of like kind andquality and standard new constructiontechniques. “We” will not pay the addi-tional cost to repair, replace or reproduceobsolete or antique construction.“Replacement cost” does not include anyincreased cost due to applicable buildingcodes, laws or ordinances.

b. Under Personal Property (Sched-uled), Coverage I and Coverage DDPersonal Property Replacement Cost,the lesser of the following, as determinedby “us”:(1) The cost to repair the damaged

property using materials of like kindand quality; or

(2) The cost to replace the damagedproperty with a new article identicalto it. When the identical article is nolonger available, or cannot be legallymanufactured or constructed,“replacement cost” means the costof a new article similar to the one

damaged which is of comparablequality and usefulness.

15. “Residence employee” means:a. An employee of an “insured”, or an

employee leased to an “insured” by alabor leasing firm, under an agreementbetween an “insured” and the labor lea-sing firm, whose duties are related to themaintenance or use of the “residencepremises”, including household ordomestic services; or

b. One who performs duties similar to thosedescribed in a., above, in a differentplace not related to the “business” of an“insured”.

A “residence employee” does not include arelative under age 18 residing in “your”household.

16. “Residence premises” means:a. The one or two family dwelling where

“you” principally reside; orb. That part of any other building where

“you” principally reside; and which is at a location listed in the Decla-rations.“Residence premises” also includes groundsand appurtenant structures at that location.

Unless otherwise stated in SECTION 6, the defini-tions in DEFINITIONS which apply to SECTION 1also apply to Coverages AA, BB and GG in SEC-TION 6.

AGREEMENT“We” will provide the coverages “you” have pur-chased through the company named in the Declara-tions if “you” have paid the premiums and have com-plied with the policy provisions. When “we” refer tothe policy “we” mean this policy booklet (titled HomeInsurance Policy), applications for insurance, Decla-rations, and any applicable endorsements. This pol-icy booklet describes the coverages “you” havepurchased and may include descriptions of othercoverages “you” have not purchased. The coveragesand limits of liability “you” have purchased are statedin the Declarations that are in effect at the time of anyloss, injury or damage, and are subject to the limits ofliability, exclusions, conditions and other terms of thepolicy. A coverage applies only when that coverageis listed in the “Descriptions of Coverage” column onthe Declarations.

SECTION 1Liability, Coverage A

If a claim is made or a suit is brought against an“insured” for damages because of “bodily injury”or “property damage” caused by an “occurrence”to which this coverage applies, “we” will:1. Pay up to “our” limit of liability for the dama-

ges for which an “insured” is legally liable.Damages include prejudgment interestawarded against an “insured”; and

2. Provide a defense at “our” expense by coun-sel of “our” choice, even if the suit is ground-less, false or fraudulent. “We” mayinvestigate or settle any claim or suit as “we”decide is appropriate. “Our” duty to settle ordefend ends when “our” limit of liability forthe “occurrence” has been exhausted bypayment of a judgment or settlement.

Medical Payments, Coverage B (IncludesLimitations)

“We” will pay the necessary medical expensesfor services performed within two years from thedate of an “occurrence” causing “bodily injury”and submitted to “us” within three years from thedate of the “occurrence”. Medical expensesmeans reasonable charges for medical, surgical,X-ray, dental, ambulance, hospital, professionalnursing, prosthetic devices and funeral services.This coverage does not apply to “you” or resi-dents of “your” household except “residenceemployees”. This coverage applies only:1. To a person on the “insured location” with the

permission of an “insured”; or2. To a person off the “insured location”, if the

“bodily injury”:a. Arises out of a condition on the “insured

location” or the ways immediately adjoin-ing;

b. Is caused by the activities of an“insured”;

c. Is caused by a “residence employee” inthe course of the employment; or

d. Is caused by an animal owned by or inthe care of an “insured”.

Exclusions – SECTION 1A. Motor Vehicle Liability

1. Liability, Coverage A and Medical Pay-ments, Coverage B do not apply to any“motor vehicle liability” if, at the time andplace of an “occurrence”, the involved “motorvehicle”:a. Is registered for use on public roads or

property;b. Is not registered for use on public roads

or property, but such registration isrequired by a law, or regulation issued bya government agency, for it to be used atthe place of the “occurrence”;

c. Is being:(1) Operated in, or practicing for, any

prearranged or organized race,speed contest or other competition;

(2) Rented to others;(3) Used to carry persons or cargo for a

charge;(4) Used for any “business” purpose

except for a motorized golf cart whileon a golfing facility; or

(5) Used on a public road or public prop-erty, except this exclusion A.1.c.(5)does not apply to liability arisingfrom the use of lawnmowers or walk-behind snowblowers by an “insured”away from the “residence premises”on public roads or public property; or

d. Is insured on any other policy of insur-ance.

2. If exclusion A.1. does not apply, there is stillno coverage for “motor vehicle liability”unless the “motor vehicle” is:a. In dead storage on an “insured location”;b. Used solely to service an “insured's” res-

idence and lawnmowers or walk-behindsnowblowers when used by an “insured”away from the “residence premises” andnot otherwise excluded;

c. Designed to assist the handicapped and,at the time of an “occurrence”, it is:(1) Being used to assist a handicapped

person; or(2) Parked on an “insured location”;

d. A “recreational motor vehicle”:(1) Not owned by an “insured”; or

(2) Owned by an “insured” provided the“occurrence” takes place on an“insured location” as defined in Defi-nitions, items B.8.a., b., d., e. or h.;or

e. A motorized golf cart that is owned by an“insured”, designed to carry up to 4 per-sons, not built or modified after manufac-ture to exceed a speed of 25 miles perhour on level ground and, at the time ofan “occurrence”, is within the legalboundaries of a golfing facility, and:(1) Is being used within the rules stated

for use of a golf cart; and (2) Is parked or stored there, or being

used by an “insured” to:(a) Play the game of golf or for other

recreational or leisure activityallowed by the facility;

(b) Travel to or from an area where“motor vehicles” or golf carts areparked or stored; or

(c) Cross public roads at design-ated points to access other partsof the golfing facility.

B. Watercraft Liability1. Liability, Coverage A and Medical Pay-

ments, Coverage B do not apply to any“watercraft liability” arising from the owner-ship, maintenance, operation, use, loadingor unloading of any watercraft owned by orrented to an “insured” if the watercraft:a. Has inboard or inboard-outboard motor

power of more than 50 horsepower;b. Is 26 feet or more in overall length; orc. Is powered by one or more outboard

motors totaling over 25 horsepower.This exclusion does not apply to “bodilyinjury” or “property damage” occurring on the“insured location”.

2. Liability, Coverage A and Medical Pay-ments, Coverage B do not apply to “water-craft liability” if at the time of an “occurrence”the involved watercraft is being operated in,or practicing for, any prearranged or orga-nized race, speed contest or other competi-tion. However, this exclusion B.2. does notapply to a sailing vessel or a predicted logcruise.

C. Aircraft Liability Liability, Coverage A and Medical Payments,Coverage B do not apply to “aircraft liability”.

D. Hovercraft Liability Liability, Coverage A and Medical Payments,Coverage B do not apply to “hovercraft liability”.

E. Liability, Coverage A and Medical Payments,Coverage B do not apply to the following:1. Expected Or Intended Injury

“Bodily injury” or “property damage” that mayreasonably be expected or intended to resultfrom the intentional acts of an “insured” evenif the resulting “bodily injury” or “propertydamage”:a. Is of a different kind, quality or degree

than initially expected or intended; orb. Is sustained by a different person, entity,

real property or personal property, thaninitially expected or intended.

This exclusion applies regardless of whetherany “insured” personally participated in orcommitted the alleged act and regardless ofwhether any “insured” subjectively intendedthe “bodily injury” or “property damage” forwhich a claim is made. However, this exclusion E.1. does not applyto “bodily injury” resulting from the use ofreasonable force by an “insured” to protectpersons or property;

2. Businessa. “Bodily injury” or “property damage” aris-

ing out of or in connection with a “busi-ness” conducted from an “insuredlocation” or engaged in by an “insured”,whether or not the “business” is ownedor operated by an “insured” or employsan “insured”.This exclusion E.2. applies but is not lim-ited to an act or omission, regardless ofits nature or circumstance, involving aservice or duty rendered, promised,owed, or implied to be provided becauseof the nature of the “business”.

b. This exclusion E.2. does not apply to:(1) The rental of living space in the “res-

idence premises” if such rental didnot exceed 90 days in the 12months prior to the “occurrence”;

(2) The rental of a private garage on the“residence premises”; or

(3) An “insured” under the age of 21years involved in a part-time oroccasional, self-employed “busi-ness” with no “employees”;

3. Professional Services“Bodily injury” or “property damage” arisingout of the rendering of or failure to renderprofessional services by an “insured”;

4. Insured's Premises Not An Insured Loca-tion “Bodily injury” or “property damage” arisingout of a premises:a. Owned by an “insured”;b. Rented to an “insured”; orc. Rented to others by an “insured”;that is not an “insured location”;

5. War“Bodily injury” or “property damage” causeddirectly or indirectly by war, including the fol-lowing and any consequence of any of thefollowing:a. Undeclared war, civil war, insurrection,

rebellion or revolution;b. Warlike act by a military force or military

personnel; orc. Destruction, seizure or use for a military

purpose.Discharge of a nuclear weapon will bedeemed a warlike act even if accidental;

6. Communicable Disease“Bodily injury” or “property damage” thatarises out of the transmission of a communi-cable disease by an “insured”. This exclusionapplies regardless of whether any “insured”personally participated in or committed thealleged act and regardless of whether any“insured” subjectively intended the “bodilyinjury” or “property damage” for which aclaim is made;

7. Sexual Misconduct, Sexual Molestation,Corporal Punishment Or Physical OrMental Abuse“Bodily injury” or “property damage” arisingout of sexual misconduct, sexual molesta-tion, corporal punishment or physical ormental abuse. This exclusion applies regard-less of whether any “insured” personally par-ticipated in or committed the alleged act andregardless of whether any “insured” subjec-

tively intended the “bodily injury” or “propertydamage” for which a claim is made. Sexual misconduct or sexual molestationmeans any activity, whether or not pro-secuted, which is sexual in nature, whetherpermitted or unpermitted, including, but notlimited to: sexual assault; sexual abuse; sex-ual battery; sexual relations; sexual acts;sexual activity; sexual handling; sexual mas-sage; sexual exploitation; sexual exhibition;photographic, video, or other reproduction ofsexual activity; fondling, intimacy, indecentexposure, or undue familiarity; or lewd or las-civious behavior;

8. Controlled Substance“Bodily injury” or “property damage” arisingout of the use, sale, manufacture, delivery,transfer or possession by any person of aControlled Substance as defined by the Fed-eral Food and Drug Law at 21 U.S.C.A. Sec-tions 811 and 812. This exclusion appliesregardless of whether any “insured” person-ally participated in or committed the allegedact and regardless of whether any “insured”intended the “bodily injury” or “property dam-age” for which a claim is made. However, this exclusion does not apply tothe legitimate use of prescription drugs by aperson following the orders of that person’slicensed physician;

9. Criminal Acts“Bodily injury” or “property damage” arisingfrom any criminal act. Criminal act meansany act or omission which is criminal innature or for which a penal statute or ordin-ance permits or requires any term of impris-onment or sentence of public service duties.This exclusion applies regardless of whe-ther any “insured” is actually charged with orconvicted of a crime and regardless ofwhether any “insured” subjectively intendedthe “bodily injury” or “property damage” forwhich a claim is made;

10. Pollutiona. “Bodily injury” or “property damage” aris-

ing out of the actual, alleged, or threat-ened discharge, dispersal, release orescape of “pollutants”.

b. Any loss, cost or expense resulting fromany governmental direction, order or

request that an “insured” test for, moni-tor, clean up, remove, contain, treat,detoxify, neutralize, or in any wayrespond to, or assess the effects of, “pol-lutants”.

c. Exclusions 10.a. and b. do not apply to“bodily injury” or “property damage”caused by heat, smoke or fumes from ahostile fire.As used in this exclusion, a hostile firemeans one that becomes uncontrollableor breaks out from where it was intendedto be;

11. Fungus or Bacteriaa. “Bodily injury” or “property damage”

caused by, consisting of, or arising outof, either directly or indirectly, “fungus” orbacteria; or

b. Any loss, cost or expense resulting fromany governmental direction, order orrequest that an “insured” treat for, moni-tor, clean up, remove, contain, treat,detoxify, or neutralize “fungus” or bacte-ria; or

12. Lead, Asbestos, Silica or Radon Gasa. “Bodily injury” or “property damage”

caused directly or indirectly, or arisingout of lead, asbestos, silica or radon gas;or

b. Loss, cost or expense resulting from anygovernmental direction, order or requestthat an “insured” treat for, monitor, cleanup, remove, contain, treat, detoxify, orneutralize substances described in 12.a.

Exclusions A. Motor Vehicle Liability, B. WatercraftLiability, C. Aircraft Liability, D. Hovercraft Liabil-ity, and E.4. Insured's Premises Not An InsuredLocation do not apply to “bodily injury” to a “resi-dence employee” arising out of and in the course ofthe “residence employee's” employment by an“insured”.F. Liability, Coverage A does not apply to the fol-

lowing:1. Liability:

a. For any loss assessment chargedagainst an “insured” as a member of anassociation, corporation or community ofproperty owners; or

b. Under any contract or agreemententered into by an “insured”;

2. “Property damage” to property owned by an“insured”. This includes costs or expensesincurred by an “insured” or others to repair,replace, enhance, restore or maintain suchproperty to prevent injury to a person ordamage to property of others, whether on oraway from an “insured location”;

3. “Property damage” to property rented to,occupied or used by or in the care of an“insured”. This exclusion does not apply to“property damage” caused by fire, smoke orexplosion;

4. “Bodily injury” to any person eligible toreceive any benefits voluntarily provided orrequired to be provided by an “insured”under any:a. Workers' compensation law;b. Non-occupational disability law; orc. Occupational disease law;

5. “Bodily injury” or “property damage” fromany:a. Nuclear reaction;b. Nuclear radiation; orc. Radioactive contamination;all whether controlled or uncontrolled or how-ever caused;

6. “Bodily injury” to any “insured”.This exclusion also applies to any claimmade or suit brought against “you” or an“insured”:a. To repay; orb. Share damages with;another person who may be obligated to paydamages because of “bodily injury” to an“insured”;

7. “Property damage” to:a. Goods or products, including containers,

which an “insured” manufactures, sells,handles, or distributes;

b. Work completed by or for an “insured”;or

c. An “insured location” arising out of thealienation (e.g. selling, leasing, separat-ing) of that location; or

8. Punitive or exemplary damages. Theseinclude damages that may be imposed topunish a wrongdoer or deter others fromsimilar conduct. If a suit is brought against an“insured” seeking covered compensatorydamages and punitive or exemplary dam-

ages, “we” will afford a defense to suchaction but will not pay such punitive or exem-plary damages.

G. Medical Payments, Coverage B does not applyto “bodily injury”:1. To a “residence employee” if the “bodily

injury”:a. Occurs off the “insured location”; andb. Does not arise out of or in the course of

the “residence employee's” employmentby an “insured”;

2. To any person eligible to receive benefits vol-untarily provided or required to be providedunder any:a. Workers' compensation law;b. Non-occupational disability law; orc. Occupational disease law;

3. From any:a. Nuclear reaction;b. Nuclear radiation; orc. Radioactive contamination;all whether controlled or uncontrolled or how-ever caused; ord. Any consequence of any of these; or

4. To any person, other than a “residenceemployee” of an “insured”, residing on anypart of the “insured location”.

Additional Coverages – SECTION 1 (IncludesLimitations)“We” cover the following in addition to the limits of lia-bility:A. Claim Expenses

With respect to suits for covered damages, “we”pay:1. Expenses “we” incur and costs taxed against

an “insured” in any suit “we” defend;2. Premiums on bonds required in a suit “we”

defend, but not for bond amounts more thanthe Liability, Coverage A limit of liability.“We” need not apply for or furnish any bond;

3. Reasonable expenses incurred by an“insured” at “our” request, including actualloss of earnings (but not loss of otherincome) up to $250 per day, for assisting “us”in the investigation or defense of a claim orsuit;

4. Postjudgment interest that accrues before“we” pay or tender, or deposit in court thatpart of the judgment which is covered and

does not exceed the limit of liability thatapplies; and

5. Reasonable expenses incurred, other thanloss of earnings, up to $250 per day for thecost of defending a claim brought against an“insured” under a workers’ compensationlaw, if it is finally determined the workers’compensation law is not applicable.

B. First Aid Expenses“We” will pay expenses for first aid to othersincurred by an “insured” for “bodily injury” cov-ered under this policy. ”We” will not pay for firstaid to an “insured”.

C. Damage To Property Of Others1. “We” will pay, at “replacement cost”, up to

$1,000 per “occurrence” for “property dam-age” to property of others caused by an“insured” or animals owned by or in the careof an “insured”.

2. “We” will not pay for “property damage”:a. To property covered elsewhere in this

policy;b. Caused intentionally by an “insured” who

is 13 years of age or older;c. To property owned or rented by an

“insured”;d. To property owned by or rented to a ten-

ant of an “insured” or a resident in “your”household;

e. Arising out of:(1) A “business” engaged in by an

“insured”;(2) Any act or omission in connection

with a premises owned, rented orcontrolled by an “insured”, other thanthe “insured location”; or

(3) The ownership, maintenance, occu-pancy, renting, loaning, entrust-ment, operation, use, loading orunloading of aircraft, hovercraft,watercraft or “motor vehicles”.

This exclusion e.(3) does not apply to a“motor vehicle” that: (a) Is a “recreationalmotor vehicle”; (b) Is not owned by an“insured”; and (c) At the time of the“occurrence”, is not required by law, orregulation issued by a governmentagency, to have been registered for it tobe used on public roads or property; or

f. Caused by wear and tear, latent defects(a defect not immediately apparent), orinherent vice (the quality for self-deterio-ration or damage).

Conditions–SECTION 1(Includes Limitations)A. Limit Of Liability

“Our” total liability under Liability, Coverage Afor all damages resulting from any one “occur-rence” will not be more than the Liability, Cover-age A limit of liability shown in the Declarations.This limit is the same regardless of the number of“insureds”, injured persons, claims made, per-sons liable, claimants, or policies involved. All“bodily injury” and “property damage” resultingfrom any one accident or from continuous orrepeated exposure to substantially the samegeneral harmful conditions will be considered tobe the result of one “occurrence”. “Our” total liability under Medical Payments,Coverage B for all medical expense payable for“bodily injury” to one person as the result of oneaccident will not exceed the limit of liability foreach person as stated in the Declarations. “Our”liability for each “occurrence” as stated in theDeclarations is limited to all medical expensesfor “bodily injury” to two or more persons.

B. Joint ObligationsThe terms of this policy impose joint obligationson persons defined as an “insured” person. Thismeans that responsibilities, acts and failures toact of a person defined as an “insured” personwill be binding upon another person defined asan “insured” person.

C. Duties After OccurrenceIn case of an “occurrence”, “you” or another“insured” will perform the following duties thatapply. “We” have no duty to provide coverageunder this policy if “you” fail to comply with thefollowing duties:1. Give written notice to “us” or “our” agent as

soon as is practical, which sets forth:a. The policy number and the named

insured shown under INSURED in theDeclarations;

b. Reasonably available information on thetime, place and circumstances of the“occurrence”; and

c. Names and addresses of any claimantsand witnesses;

2. Cooperate with “us” and any retained legalcounsel in the investigation, settlement ordefense of any claim or suit;

3. Promptly forward to “us” every notice,demand, summons or other legal documentrelating to the “occurrence”;

4. At “our” request, help “us”:a. To effect settlement;b. To enforce any right of contribution or

indemnity against any person or organi-zation who may be liable for the “occur-rence”;

c. With the conduct of suits and attendhearings and trials; and

d. To secure and give evidence and obtainthe attendance of witnesses;

5. Promptly give notice of an “occurrence”, aclaim that is made, or a suit, to any otherinsurer who might provide insurance for the“occurrence”;

6. Promptly identify, report, and tender thedefense of any claim made or suit to anyother insurer that also might have availableinsurance for the “occurrence”;

7. With respect to C. Damage To Property OfOthers under Additional Coverages –SECTION 1 “you” must submit to “us” within60 days after the loss, a sworn statement ofloss and show the damaged property, if it isin an “insured's” control; and

8. No “insured” will, except at such “insured's”own cost, voluntarily make payment, assumeobligation or incur expense other than forfirst aid to others at the time of the “bodilyinjury”.

D. Duties Of An Injured Person – Medical Pay-ments, Coverage B1. The injured person or someone acting for the

injured person will:a. Give “us” written proof of claim, under

oath if “we” so request, as soon as ispractical; and

b. Authorize “us” to obtain copies of medi-cal reports and records when and asoften as “we” request.

2. The injured person will submit to a physicalexam by a doctor of “our” choice when andas often as “we” reasonably require.

E. Payment Of Claim – Medical Payments, Cov-erage B“We” reserve the right to make direct payment tothe injured person or any individual or organiza-tion rendering medical services. That paymentreduces the total amount “we” will pay for thatinjury. Payment under this coverage is not anadmission of liability by an “insured” or “us”.

F. Suit Against Us1. No action can be brought against “us” unless

there has been full compliance with all of theterms under this SECTION 1.

2. No one will have the right to join “us” as aparty to any action against an “insured”.

3. No action with respect to Liability, Cover-age A can be brought against “us” until theobligation of such “insured” has been deter-mined by final judgment or agreementsigned by “us”.

4. Under Medical Payments, Coverage B anaction to collect benefits must be taken nolater than 3 years after the date of the “occur-rence”.

G. Bankruptcy Of An InsuredBankruptcy or insolvency of an “insured” will notrelieve “us” of “our” obligations under this policy.

H. Other InsuranceThis insurance is excess over other valid andcollectible insurance except insurance writtenspecifically to cover as excess over the limits ofliability that apply in this policy.

I. Concealment Or Fraud“We” do not provide coverage where any“insured”, whether before or after a loss, has:1. Concealed or misrepresented any material

fact or circumstance;2. Engaged in fraudulent conduct; or3. Made false statements;relating to this insurance.

Unless otherwise stated in SECTION 6, definitionsunder Definitions which apply to SECTION 1,Exclusions - SECTION 1 and Conditions - SEC-TION 1 also apply to the following Coverages inSECTION 6: Coverage AA Watercraft Liability,Coverage BB Additional Residence Liability, andCoverage GG Off Premises Recreational MotorVehicle Liability.

For SECTIONS 2 through 6Under SECTIONS 2 through 6, “we” insure coveredproperty against loss. Loss means sudden, acciden-tal direct physical damage to covered property whichis a direct result of a peril that the property is insuredagainst. Covered property is described in this policybooklet for each of the coverages “you” have pur-chased. Perils are described and identified by num-ber in the Perils Insured Against-SECTIONS 2through 6 section of this policy. Covered property isinsured against the perils identified by the corre-sponding peril numbers shown in the Declarations forthe described coverage.

The following do not apply to Coverages AA, BBand GG in SECTION 6:

* Definitions under Definitions which applyonly to SECTIONS 2 through 6;

* SECTIONS 2 through 5;* Perils Insured Against - SECTIONS 2

through 6;* Exclusions - SECTIONS 2 through 6;

and* Conditions - SECTIONS 2 through 6.

DeductibleSubject to the limit of liability that applies and unlessotherwise stated in the applicable Coverage section,“we” will pay only that part of any covered loss overany deductible that applies as stated in the Declara-tions. The deductible applies to each “occurrence” towhich this coverage applies.

SECTION 2Dwelling, Coverage C (Includes Limitations)

1. “We” cover:a. The dwelling on the “residence prem-

ises”; and b. Materials and supplies located on or next

to the “residence premises” used to con-struct, alter or repair the dwelling on the“residence premises”.

2. “We” do not cover land, including;a. The land necessary to support any

Dwelling, Coverage C property;b. Any costs required to replace, rebuild,

stabilize, or otherwise restore the land;or

c. The cost of repair techniques designedto compensate for or prevent land insta-bility to any property, whether or notinsured under Dwelling, Coverage C.

Personal Property, Coverage D (IncludesLimitations)

1. Covered Propertya. Insured’s Property And Property Of

Others“We” cover personal property owned by,or used by, an “insured” while it is any-where in the world. After a loss and at“your” request, “we” will cover personalproperty owned by:(1) Others while the property is on the

part of the “residence premises”occupied by an “insured”; or

(2) A guest or “residence employee”while the property is in any resi-dence occupied by an “insured”.

If “you” ask “us” to cover property under (1)or (2) above, the owner of the property isbound by all of the terms and conditions ofthis policy.

2. Limit For Property At Other Residences“Our” limit of liability for personal propertyusually located at an “insured's” residence,other than the “residence premises”, is 10%of the limit of liability for Personal Property,Coverage D or $1,000, whichever is greater.However, this limitation does not apply topersonal property:a. Moved from the “residence premises”

because the “residence premises” isbeing repaired, renovated or rebuilt andis not fit to live in or store property in; or

b. In a newly acquired principal residencefor 30 days from the time “you” begin tomove the property there.

3. Special Limits Of LiabilityThe special limit for each category shownbelow is the total limit for each loss for allproperty in that category. These special limitsdo not increase the Personal Property,Coverage D limit of liability.a. $200 on money, checks, bank notes, bul-

lion, gold other than goldware, silverother than silverware, platinum otherthan platinumware, coins, casino chips,gift certificates, medals, scrip, storedvalue cards and smart cards.

b. $1,500 on securities, accounts, deeds,evidences of debt, letters of credit, notesother than bank notes, manuscripts, per-

sonal records, passports, tickets andstamps. This dollar limit applies to thesecategories regardless of the medium(such as paper or computer software) onwhich the material exists. This limit includes the cost to research,replace or restore the information fromthe lost or damaged material.

c. $1,500 on watercraft of all types, includ-ing their trailers, furnishings, equipmentand outboard engines or motors. “We”do not cover loss by windstorm or hail tothis property unless the property is insidea fully enclosed building. Canoes androwboats, however, are covered outsideagainst loss by windstorm or hail if thisproperty is on the “insured location”.

d. $1,500 on trailers of all types exceptcamping trailers and those used withwatercraft.

e. $2,500 on jewelry, watches, furs, andprecious and semi-precious stones.This special limit does not apply tolosses caused by Perils Insured Against2 through 18, if those perils are pur-chased on this policy.

f. $2,500 on firearms and related equip-ment. This special limit does not applyto losses caused by Perils InsuredAgainst 2 through 18, if those perils arepurchased on this policy.

g. $2,500 on silverware, silver-plated ware,goldware, gold-plated ware, platinum-ware, platinum-plated ware and pewter-ware. This includes flatware,hollowware, tea sets, trays and trophiesmade of or including silver, gold or pew-ter. This special limit does not apply tolosses caused by Perils Insured Against2 through 18, if those perils are pur-chased on this policy.

h. $2,500 on property, on the “residencepremises”, used or intended for use in a“business”.

i. $500 on property, away from the “resi-dence premises”, used or intended foruse in a “business”.

j. $1,500 on electronic apparatus andaccessories, while in or upon a “motorvehicle”, but only if the apparatus is

equipped to be operated by power fromthe “motor vehicle's” electrical systemwhile still capable of being operated byother power sources. Accessories include antennas, tapes,wires, records, discs or other media thatcan be used with any apparatusdescribed in this Category j.

k. $1,000 for electronic apparatus designedto be operated solely by power from theelectrical system of a “motor vehicle”while such property is not in or upon a“motor vehicle”.

l. $5,000 on electronic data processingequipment and the recording or storagemedia equipment used with that equip-ment. Programming time and expense isexcluded.

m. $500 on “recreational motor vehicles”and parts.

n. $2,500 for trading cards and comicbooks, including any of these that arepart of a collection.

o. $5,000 on any one article and $10,000 inthe aggregate for loss of any rug, carpet(except wall to wall carpet), tapestry,wall-hanging or other similar articles.This special limit does not apply tolosses caused by Perils Insured Against2 through 18, if those perils are pur-chased on this policy.

p. $1,500 on camping trailers, slide-incampers, and campers of any type.

4. Property Not Covered“We” do not cover:a. Articles separately described and specif-

ically insured, regardless of the limit forwhich they are insured, in this or otherinsurance;

b. Animals, birds or fish;c. “Motor vehicles”.

(1) This includes:(a) Their accessories, equipment

and parts; or(b) Electronic apparatus and acces-

sories designed to be operatedsolely by power from the electri-cal system of the “motor vehi-cle”. Accessories include anten-nas, tapes, wires, records, discs

or other media that can be usedwith any apparatus describedabove.

The exclusion of property describedin (b) above applies only while suchproperty is in or upon a “motor vehi-cle”. When not in or upon a “motorvehicle” electronic apparatus is lim-ited to 3. Special Limits Of Liabil-ity, item k.;

(2) “We” do cover “motor vehicles” notrequired to be registered for use onpublic roads which are:(a) Used solely to service an

“insured's” residence and lawn-mowers or walk-behind snow-blowers used away from the“insured’s” residence;

(b) Designed to assist the handi-capped; or

(c) “Recreational motor vehicles”subject to 3. Special Limits OfLiability, item m.;

d. Semi-trailers;e. Mobile homes;f. Aircraft meaning any contrivance used

or designed for flight including any partswhether or not attached to the aircraft; “we” do cover model or hobby aircraftnot used or designed to carry people orcargo;

g. Hovercraft and parts. Hovercraft meansa self-propelled motorized ground effectvehicle and includes, but is not limited to,flarecraft and air cushion vehicles;

h. Property of roomers, boarders and othertenants, except property of roomers andboarders related to an “insured”;

i. Property in a living space on the “resi-dence premises” regularly rented or heldfor rental to others, for more than theamount provided by 3. Special LimitsOf Liability, item h.;

j. Property rented or held for rental to oth-ers off the “residence premises”;

k. “Business” data, including such datastored in:(1) Books of account, drawings or other

paper records; or(2) Computers and related equipment.

“We” do cover the cost of blank record-ing or storage media, and of pre-recorded computer programs availableon the retail market;

l. Credit cards, electronic fund transfercards or access devices used solely fordeposit, withdrawal or transfer of fundsexcept as provided for in SECTION 5, B.Special Coverages, Credit Card andForgery, Coverage O;

m. Water or steam, except for water con-tained in a swimming pool;

n. Radar detectors;o. Any controlled substance; orp. Trees, shrubs, plants and lawns except

as provided for in SECTION 5, B. Spe-cial Coverages, Trees, Shrubs, Plantsand Lawns, Coverage L.

Additional Living Expense – Rental Value,Coverage E (Includes Limitations)

The limit of liability shown in the Declarations isthe total limit for the coverages in 1. AdditionalLiving Expense, 2. Fair Rental Value and 3.Civil Authority Prohibits Use.1. Additional Living Expense

If a covered loss under SECTION 2 makesthat part of the “residence premises” where“you” reside not fit to live in, “we” cover anynecessary increase in living expensesincurred by “you” so that “your” householdcan maintain its normal standard of living. Payment will be for only the shortest timereasonably required to repair or replace thedamage or, if “you” permanently relocate, theshortest time reasonably required for “your”household to settle elsewhere.

2. Fair Rental ValueIf a covered loss under SECTION 2 makesthat part of the “residence premises” rentedto others or held for rental by “you” not fit tolive in, “we” cover the fair rental value of suchpremises less any expenses that do not con-tinue while it is not fit to live in. Payment will be only for the shortest timereasonably required to repair or replace thatpart of the premises rented or held for rental.

3. Civil Authority Prohibits UseIf a civil authority prohibits “you” from use ofthe “residence premises” as a result of direct

damage to neighboring premises by a PerilInsured Against applicable to Dwelling,Coverage C, “we” cover the loss as providedin 1. Additional Living Expense and 2. FairRental Value above for no more than twoweeks.

4. Loss Or Expense Not Covered“We” do not cover loss or expense due tocancellation of a lease or agreement.

The periods of time under 1. Additional LivingExpense, 2. Fair Rental Value and 3. CivilAuthority Prohibits Use are not limited by expi-ration of this policy.

Auxiliary Private Structures, Coverage F(Includes Limitations)

1. “We” cover other structures on the “resi-dence premises” set apart from the dwellingby clear space. This includes structures con-nected to the dwelling by only a fence, utilityline, or similar connection.

2. “We” do not cover:a. Land, including;

(1) The land necessary to support anyAuxiliary Private Structures, Cov-erage F property;

(2) Any costs required to replace, re-build, stabilize, or otherwise restorethe land; or

(3) The cost of repair techniques de-signed to compensate for or preventland instability to any property,whether or not insured under Auxil-iary Private Structures, CoverageF;

b. Other structures rented or held for rentalunless used solely as a private garage;

c. Other structures used in whole or in partfor any “business”, ranching or farmingpurposes unless the “business” is cov-ered under SECTION 1.

3. A structure described in the Declarations towhich SECTION 2, Auxiliary Private Struc-tures, Coverage F specifically applies iscovered only for the perils, Loss SettlementClause and the limit of liability shown in theDeclarations. 1. above, does not apply tothose structures.

SECTION 3Recreational Motor Vehicles, Coverage G (Includes Limitations)“We” insure “recreational motor vehicles” that arelisted in the Declarations owned by an “insured”. Thepolicy territory is the United States of America, its ter-ritories or possessions, and Canada. “We” do notinsure loss resulting from electrical breakdown,unless fire or explosion results and then only fordirect loss caused by such fire or explosion. If “you”have this coverage, newly acquired “recreationalmotor vehicles” will also be insured, effective on thedate of delivery, if “we” are notified within 30 days fol-lowing the date of delivery. Loss Settlement 3 - Actual Cash Value applies.

Watercraft, Coverage H (Includes Limita-tions)“We” insure watercraft, motors and trailers listed inthe Declarations, owned by an “insured”.

1. The policy territory is the United States ofAmerica, its territories or possessions, orCanada. This coverage applies only whilethe covered property is on land, inlandwaters, and coastal waters within 75 nauticalmiles of the United States, its territories orpossessions or Canada.

2. The following definitions apply:a. Boat includes inboard motors and other

equipment permanently attached;b. Motor means outboard motor or trolling

motor, and includes remote controls,steering equipment, electric harness andpressure gas tanks, but does not includebatteries;

c. Boat accessories and equipment meansanchors, extra fuel tanks, oars, oarlocks, lines, paddles, cook stoves, deckchairs, flags, flagstaffs, detachable cano-pies, tools, batteries, battery boxes,chargers, seat cushions, boat and motorcovers, tarpaulins, life preservers, sparepropellers, fire extinguishers, lights,horns, and bilge pumps.

3. “We” do not insure loss or damage:a. To the rudder, propeller, shaft or machin-

ery of an inboard motorboat, eitherinside or outside the vessel, unlesscaused by stranding, burning, collisionwith another vessel, or sinking. This

exclusion does not apply to water forcedpropulsion inboard motorboats; or

b. Resulting from electrical breakdown,unless fire or explosion results and thenonly for direct loss caused by such fire orexplosion.

4. If during the policy period the “insured”acquires ownership of a boat, motor or boattrailer, and notifies “us” within 30 days follow-ing the date of delivery, insurance under thispolicy applies to the newly acquired boat,motor or boat trailer, effective on the date ofdelivery, provided:a. It replaces a boat, motor or boat trailer

covered by this policy. If the new acquisi-tion replaces a boat, motor or boat trailerinsured by this policy, the insuranceceases to cover the unit replaced on thedate the new one is delivered; or

b. “We” insure all boats, motors or boattrailers owned by the “insured” on thedate of delivery. The limit of liability willbe the “actual cash value” of the boat,motor or boat trailer, provided the“insured” pays any additional premiumrequired. This extension does not applyto a newly acquired boat, motor or boattrailer if there is other valid or collectibleinsurance.

5. The deductible will not apply to the boat,motor, trailer, or accessories in the event of atotal loss of the boat, motor, or trailer.

6. Coverage on an insured boat is extended toinclude loss to boat accessories and equip-ment.

7. Loss Settlement 3 – Actual Cash Valueapplies.

SECTION 4Personal Property (Scheduled), Coverage I(Includes Limitations)“We” insure the personal property specifically listedin the Declarations. This coverage applies to prop-erty owned by or in the custody and control of an“insured”. Unless otherwise provided either in thispolicy or by endorsement, “we” insure the propertywherever it may be located.

Acquisition ClauseThis clause is applicable only to fine arts, jewelry,watches, furs, cameras and musical instruments

when such property is insured under this Coverage I.If the “insured” (a) reports additional similar propertyacquired within 30 days from the date of acquisition,and (b) pays full premium on that property from thedate acquired, “we” insure each separate class ofsuch additionally acquired property for an amount notto exceed 25 percent of the limit of liability, or$10,000, whichever is less, on such class, exclusiveof this provision. “We” will cease to insure such addi-tionally acquired property if it is not reported to “us”within the stated 30 day period. This additional cover-age does not apply to property of a class not alreadyinsured under this section.

Replacement Cost ClauseA covered loss to property insured under PersonalProperty (Scheduled), Coverage I will be settled for“replacement cost” if “you” repair or replace the dam-aged property. Payment will be made for the smallestof the following:

1. “Replacement cost” of the damaged propertyat the time of the loss; or

2. The applicable limit of liability shown in theDeclarations. However, when the amountshown in the Declarations is an aggregateamount for multiple items, the limit of liabilitywill be the specific value of the individualitem as determined from information onrecord with “our” home or regional office priorto the loss.

If “you” do not repair or replace the damaged prop-erty, “we” will settle the loss for the “actual cashvalue”. “You” then have one year from the date ofloss to make the repair or replacement and requestpayment for the difference between the actual“replacement cost” and the amount “we” alreadypaid. “Replacement cost” will not apply to:

1. Property not maintained in good or workablecondition; or

2. Property that is obsolete or unusable for thepurpose originally intended.

This clause does not apply if Special Conditions -SECTION 4, Coverage I states another method ofpayment for a specific scheduled item.

Special Conditions-SECTION 4, Coverage I1. Fine Arts. “Our” coverage of fine arts is sub-

ject to additional exclusions and special con-ditions. “We” do not insure:

a. Damage sustained to and resulting fromany repairing, restoration or retouchingprocess;

b. Breakage of art glass windows, stat-uary, marbles, glassware, bric-a-brac,porcelains, and similar fragile articles,unless caused by fire, lightning, aircraft,theft or attempted theft, cyclone, tor-nado, windstorm, earthquake, flood,explosion, malicious damage or colli-sion, derailment or vehicle overturn; or

c. Property on exhibition at a fairgrounds orat any national or international exposi-tion unless such locations are specifi-cally described in the Declarations.

“We” will not be liable for more than theamount set opposite the respective articleslisted in the Declarations. The amounts rep-resent the agreed value of the articles. If there is total loss to any part of a pair orset, “we” agree to pay “you” the full value ofthe set as specified in the Declarations.“You” agree to surrender the remainder ofthe set to “us”.

2. Golfer's Equipment. “We” insure “your” golfclubs and golf equipment (except watches,jewelry and stock for sale) wherever located.Clothing “you” have is covered if contained ina locker situated in a building (such as a clubhouse) that is used in connection with thegame of golf. “We” insure golf balls, however,only against loss by fire or burglary.

3. Guns. “We” do not insure loss from foulingor gradual depreciation, or caused by or dur-ing repair, refinishing, or renovation.

4. Silverware. This coverage does not apply topens, pencils, flasks, smoking implements oraccessories or articles of personal adorn-ment as silverware.

5. Stamp And Coin Collections. This insur-ance on stamp and coin collections appliesto:a. Postage stamps including due, enve-

lope, official, revenue, match and medi-cine stamps, covers, locals, reprints,essays, proofs, and other philatelic prop-erty “you” own or which is in “your” cus-tody or control, including books, pagesor mountings; and

b. Rare and current coins, medals, papermoney, bank notes, tokens of moneyand other numismatic property “you”own or which is in “your” custody or con-trol, including coin albums, containers,frames, cards and display cabinets inuse with such a collection.

“We” do not insure:a. Loss from fading, creasing, denting,

scratching, tearing, thinning, transfer ofcolors, inherent vice (quality for self-deterioration or damage), dampness,extremes of temperature, gradual depre-ciation, or damage sustained from han-dling or while being actually workedupon;

b. Mysterious disappearance of individualstamps, coins or other individual articlesinsured unless specifically listed in theDeclarations with a definite limit of liabil-ity. If not specifically listed, “we” willcover mysterious disappearance if thearticles are mounted in a volume, andthe page to which they are attached isalso lost;

c. Loss of or damage to property in the cus-tody of transportation companies, orshipments by mail unless by registeredmail;

d. Loss by theft from any unattended auto-mobile. This exclusion does not applywhile the property is being shipped byregistered mail; or

e. Loss of or damage to any property that isnot an actual part of a stamp, money orcoin collection.

In the event of loss or damage the amountpayable will be determined in the followingmanner:a. In case of loss of or damage to the prop-

erty listed representing any one stamp,coin or other individual article insured,“we” will pay or make good the loss ordamage up to the amount listed for theitem in the Declarations.

b. In case of loss or damage to propertyspecifically described in the Declarationsas pairs, strips, blocks, series, sheets,covers, frames, cards, or the like, “we”will pay, in the event of total loss of such

an item, up to the amount set oppositethe item involved. In the event of partialloss, “we” will not pay more than thecash market value of the whole set, lessthe cash market value of the remainderat the time of loss. It is understood andagreed, however, that in the event of theproperty being insured for less than thecash market value, “our” liability will notexceed the share the amount insuredbears to the cash market value.

c. In all cases of loss of or damage to theinsured property not provided for in thetwo previous paragraphs, “we” will notpay more than the actual cash marketvalue of the property at the time of loss.This is subject, however, to a limit notexceeding $1,000 on unlisted numis-matic property and not exceeding $250with respect to any one stamp, coin, orother individual article or any one pair,strip, block, series, sheet, cover, frame,card or the like.

d. “We” will not pay a greater share of anyloss on property not specifically listedthan the amount the total sum insured onthat unlisted property bears to the actualcash market value at the time of loss.

SECTION 5When SECTION 5 is shown in the Declarations thefollowing Additional Coverages and Special Cov-erages (as shown in the Declarations) apply to prop-erty covered under this policy.A. Additional Coverages (Includes Limitations)

1. Reasonable Repairsa. If a covered loss occurs, “we” will pay the

reasonable and necessary cost “you”incur for temporary repairs to coveredproperty to protect the property from fur-ther immediate damage or loss.

b. If the measures taken involve repair toother damaged property, “we” will onlypay if that property is covered under thispolicy and the damage is caused by aPeril Insured Against.

This coverage does not:(1) Increase the limit of liability that

applies to the covered property; or

(2) Relieve “you” of “your” duties, incase of a loss to covered property,described in B.5. under Conditions– SECTIONS 2 through 6.

2. Collapsea. With respect to this additional coverage:

(1) Collapse means a member of astructure has actually fallen down orfallen into pieces. It does not includesettling, cracking, shrinking, bulg-ing, expansion, sagging or bowing.

(2) A building or any part of a buildingthat is in danger of falling down orcaving in is not considered to be in astate of collapse.

(3) A part of a building that is standing isnot considered to be in a state of col-lapse even if it has separated fromanother part of the building.

(4) A building or any part of a buildingthat is standing is not considered tobe in a state of collapse even if itshows evidence of cracking, bulging,sagging, bending, leaning, settling,shrinkage or expansion.

b. “We” insure for loss to covered propertyinvolving collapse of a building or anypart of a building if the collapse wascaused by one or more of the following:(1) The Perils Insured Against that apply

to the damaged property. However, ifperil 1. applies to the damaged prop-erty, then only perils 2. through 19.shall apply;

(2) Weight of contents, equipment, ani-mals or people;

(3) Weight of rain that collects on a roofor ceiling; or

(4) Use of defective material or methodsin construction, remodeling or reno-vation if the collapse occurs duringthe course of the construction,remodeling or renovation.

c. Loss to an awning, gutter, fence, patio,deck, pavement, swimming pool, under-ground pipe, flue, drain, cesspool, septictank, foundation, retaining wall, bulk-head, pier, wharf or dock is not coveredunder b.(2) through (4) above, unless

the loss is a direct result of the collapseof a building or any part of a building.

d. This coverage does not increase the limitof liability that applies to the damagedcovered property.

3. Building Ordinancea. Under Dwelling, Coverage C and item

5. Building Additions And Alterations,below, “we” will pay for the increasedcosts “you” incur due to the enforcementof any ordinance or law that requires orregulates:(1) The construction, demolition, remod-

eling, renovation or repair of that partof a covered dwelling damaged by aPeril Insured Against;

(2) The demolition and reconstruction ofthe undamaged part of a covereddwelling, when that dwelling must betotally demolished because of dam-age by a Peril Insured Against toanother part of that dwelling; or

(3) The remodeling, removal or replace-ment of the portion of the undam-aged part of a covered dwellingnecessary to complete the remodel-ing, repair or replacement of thatpart of the covered dwelling dam-aged by a Peril Insured Against.

This coverage provides additional insuranceup to 10% of the stated applicable limit, but isnot increased by Coverage EE or CoverageHH, if Coverage EE or Coverage HH is pur-chased.b. “You” may use all or part of this Building

Ordinance coverage to pay for theincreased costs “you” incur to removedebris resulting from the construction,demolition, remodeling, renovation,repair or replacement of property asstated in a. above.

c. “We” do not cover:(1) The loss in value to any covered

dwelling due to the requirements ofany ordinance or law; or

(2) The costs to comply with any ordi-nance or law which requires any“insured” or others to test for, moni-tor, clean up, remove, contain, treat,detoxify or neutralize, or in any way

respond to, or assess the effects of“pollutants” or “fungus” in or on anycovered dwelling.

4. Grave Markers“We” will pay up to $5,000 for human gravemarkers, including mausoleums, on or awayfrom the “residence premises” for losscaused by a Peril Insured Against applicableto Personal Property, Coverage D. How-ever, if Peril 1 applies to Coverage D, thenPerils 2. through 19. will apply. Loss Settlement 3 - Actual Cash Valueapplies.

5. Building Additions And Alterations If “you” do not own the “residence premises”,“we” cover the building improvements orinstallations, made or acquired at “your”expense, to that part of the “residence prem-ises” used exclusively by “you”. The limit ofliability for this coverage will not be morethan 10% of the limit of liability that applies toPersonal Property, Coverage D.

6. Lock Coverage “We” will pay the reasonable expenses “you”incur to re-key or replace locks on exteriordoors of the “residence premises” if the keysto those locks are stolen and theft coverageis provided. “We” will pay no more than theamount necessary to replace “your” lockswith like kind and quality, or re-key the exist-ing locks whichever is less. The deductibledoes not apply to this coverage.

B. Special Coverages (Includes Limitations)1. Package of Special Coverages, Coverage

KIn this package “we” provide Coverages Lthrough P subject to the agreements, condi-tions and limits applying to each.

2. Trees, Shrubs, Plants and Lawns, Cover-age L“We” will cover trees, shrubs, plants orlawns, on the “residence premises” within250 feet of the dwelling, for loss caused bythe following perils:a. Fire or Lightning;b. Explosion;c. Riot or Civil Commotion;d. Aircraft;e. Vehicles not owned or operated by a res-

ident of the “residence premises”;

f. Vandalism or Malicious Mischief; org. Theft.“We” will pay up to an additional 5% of thelimit of liability that applies to Dwelling, Cov-erage C for all trees, shrubs, plants or lawns.No more than $500 of this limit will be paidfor any one tree, shrub or plant, includingexpenses incurred for removing debris. “We”do not cover property grown for “business”purposes. This coverage is additional insurance. LossSettlement 3 – Actual Cash Value applies.

3. Debris Removal, Coverage Ma. After a covered loss occurs, “we” will pay

“your” reasonable expense for theremoval of debris of covered property.This expense is included in the applica-ble limit of liability that applies to thedamaged property. If the amount to bepaid for the actual damage to the prop-erty plus the debris removal expense ismore than the limit of liability for thedamaged property, an additional 5% ofthat applicable limit is available for suchexpense. This additional coverage doesnot apply to Trees, Shrubs, Plants andLawns, Coverage L.

b. “We” will also pay “your” reasonableexpense, up to $500, for the removalfrom the “residence premises” of tree(s)within 250 feet of the dwelling felled bywindstorm, hail or weight of ice, snow orsleet, provided the tree(s):(1) Damage(s) a covered structure; or(2) Does not damage a covered struc-

ture, but:(a) Block(s) a driveway on the “resi-

dence premises” which pre-vent(s) a “motor vehicle”, that isregistered for use on publicroads or property, from enteringor leaving the “residence prem-ises”; or

(b) Block(s) a ramp or other fixturedesigned to assist a handi-capped person to enter or leavethe dwelling building.

The $500 limit is the most “we” willpay in any one “occurrence” regard-less of the number of fallen trees.

This coverage is additional insurance. 4. Refrigerated Products, Coverage N

“We” will pay an amount not to exceed $500for loss or damage to contents of a freezer orrefrigerated unit on the “residence prem-ises”. If a higher amount is specified in theDeclarations for this Refrigerated Products,Coverage N then that amount will apply.This coverage does not apply to “business”personal property. The contents must beowned by an “insured” and the loss or dam-age caused by change in temperature result-ing from:a. Interruption of electrical service to refrig-

eration equipment caused by damage togenerating or transmission equipment;

b. Interruption of electrical service by anyother cause, unless resulting fromhuman error of an “insured”; or

c. Mechanical or electrical breakdown ofthe refrigeration system.

The “insured” must exercise diligence ininspecting and maintaining refrigerationequipment in proper working condition. Ifinterruption of electrical service, or mecha-nical or electrical breakdown is known, allreasonable means must be used to protectthe insured property from further damage orthis coverage is void. This coverage is included in the PersonalProperty, Coverage D limit. The deductibledoes not apply.

5. Credit Card and Forgery, Coverage Oa. “We” will pay up to $1,000 for:

(1) The legal obligation of an “insured”to pay because of the theft or unau-thorized use of credit cards issued toor registered in an “insured's” name;

(2) Loss resulting from theft or unau-thorized use of an electronic fundtransfer card or access device usedfor deposit, withdrawal or transfer offunds, issued to or registered in an“insured's” name;

(3) Loss to an “insured” caused by forg-ery or alteration of any check ornegotiable instrument; and

(4) Loss to an “insured” through accep-tance in good faith of counterfeit

United States or Canadian papercurrency.

All loss resulting from a series of actscommitted by any one person or in whichany one person is concerned or impli-cated is considered to be one loss.

b. “We” do not cover:(1) Use of a credit card, electronic fund

transfer card or access device:(a) By a resident of “your” house-

hold;(b) By a person who has been

entrusted by an “insured” witheither type of card or accessdevice; or

(c) If an “insured” has not compliedwith all terms and conditionsunder which the cards areissued or the devices areaccessed; or

(2) Loss arising out of “business” use ordishonesty of an “insured”.

c. If the coverage in a. above applies, thefollowing defense provisions also apply:(1) “We” may investigate and settle any

claim or suit that “we” decide isappropriate. “Our” duty to defend aclaim or suit ends when the amount“we” pay for the loss equals “our”limit of liability.

(2) If a suit is brought against an“insured” for liability under a.(1) or(2) above, “we” will provide adefense at “our” expense by counselof “our” choice.

(3) “We” have the option to defend at“our” expense an “insured” or an“insured's” bank against any suit forthe enforcement of payment undera.(3) above.

d. If a higher amount is shown in the Decla-rations for this Credit Card and Forg-ery, Coverage O then that amount willapply.

This coverage is additional insurance. Thedeductible does not apply.

6. Fire Department Service Charge, Cover-age P“We” will pay up to $500 for “your” liabilityassumed by contract or agreement for fire

department charges incurred when the firedepartment is called to save or protect cov-ered property from a loss. “We” do not coverfire department service charges if the prop-erty is located within the limits of the city,municipality or protection district furnishingthe fire department response. If a higher amount is shown in the Declara-tions for this Fire Department ServiceCharge, Coverage P then that amount willapply. This coverage is additional insurance.The deductible does not apply.

SECTION 6Optional Policy Coverages (Includes Limita-tions)Each Optional Coverage applies only if it is shown inthe Declarations. Nothing contained in SECTION 6varies, alters, or extends any provisions of this policyexcept as provided in each optional coverage. Unless otherwise stated in this SECTION 6, the def-initions in Definitions which apply to SECTION 1,Exclusions - SECTION 1 and Conditions - SEC-TION 1 apply to Coverage AA Watercraft Liability,Coverage BB Additional Residence Liability, andCoverage GG Off Premises Recreational MotorVehicle Liability.

Coverage AA Watercraft LiabilityFor additional premium, “we” agree to pay on behalfof the “insured” all sums which the “insured” shallbecome legally obligated to pay as damages,because of “bodily injury” or “property damage”,under Liability, Coverage A and Medical Pay-ments, Coverage B caused by an “occurrence” andarising out of the ownership, maintenance or use ofwatercraft. The policy territory is the United States ofAmerica, its territories or possessions, or Canada.This coverage applies only while the covered prop-erty is on land, inland waters, and coastal waterswithin 75 nautical miles of the United States, its terri-tories or possessions, or Canada. Coverage will alsoapply to newly acquired watercraft if “we” are notifiedwithin 30 days following the date of delivery and pro-vided:

a. That watercraft replaces a boat, motor orboat trailer insured by this policy. If thenew acquisition replaces a boat, motoror boat trailer insured by this policy, theinsurance ceases to cover the unit

replaced on the date the new one isdelivered; or

b. “We” insure all boats, motors or boattrailers owned by the “insured” on thedate of delivery. This extension does notapply to a newly acquired boat, motor orboat trailer if there is other valid or col-lectible insurance.

Paragraph 1. of exclusion B. Watercraft Liability inExclusions - SECTION 1 does not apply to theextent that coverage is provided under this Cover-age AA.Coverage BB Additional Residence LiabilityFor additional premium, insurance under SECTION1, Liability, Coverage A and Medical Payments,Coverage B applies to the additional residencedescribed in the Declarations. Coverage does notapply while a “business”, other than rental as a resi-dence, is conducted at the additional residence with“your” knowledge. With respect to this Coverage:

1. The following changes are made to Defini-tions:“Insured location” and “residence premises”are replaced with the following:“Insured location” means:a. The “residence premises”;b. Any premises used by “you” in connec-

tion with a premises described in a.above.

“Residence premises” means the one or twofamily dwelling listed in the Declarations asHOME PROTECTOR including grounds andappurtenant structures at that location. “Res-idence premises” also means the CONDO-MINIUM - NOT OWNER OCCUPIED listedin the Declarations, if applicable.

2. Under Exclusions - SECTION 1, exclusionE.2. is replaced by the following:2. Businessa. “Bodily injury” or “property damage” aris-

ing out of or in connection with a “busi-ness” conducted from an “insuredlocation” or engaged in by an “insured”,whether or not the “business” is ownedor operated by an “insured” or employsan “insured”. This exclusion E.2. applies but is notlimited to an act or omission, regardless

of its nature or circumstance, involving aservice or duty rendered, promised,owed, or implied to be provided becauseof the nature of the “business”.

b. This exclusion E.2. does not apply to therental or holding for rental of the “resi-dence premises” to which Coverage BBapplies.

Coverage CC InflationThe limit of liability specified in the Declarations forthose items in SECTION 2 of the policy, which areindicated as having inflation coverage, will beincreased at the same rate as the increase in theCompany Dwelling and Personal Property Index. TheCompany Dwelling and Personal Property Index isdeveloped monthly from available government andappraisal company indexes and kept on file in theHome Office Actuarial Division. Coverage will not beless than the amount specified in the Declarations.

Coverage DD Personal Property Replace-ment CostFor additional premium, “we” agree to substitute theterm “replacement cost” for Loss Settlement 3 -Actual Cash Value as it applies to SECTION 2, Per-sonal Property, Coverage D. This provision will not apply to:

1. Antiques, fine arts, paintings, statuary or sim-ilar articles which by their inherent naturecannot be replaced with new articles;

2. Articles whose age or history contribute sub-stantially to their value, including but not lim-ited to memorabilia, souvenirs, andcollector’s items;

3. Property not maintained in good or workablecondition;

4. Property which, at the time of loss, is eitherobsolete or useless to “you”;

5. Tractors or lawn equipment rated at 26horsepower or more; or

6. Property in a dwelling or related auxiliary pri-vate structure listed in the Declarations asDWELLING - HOME PROTECTOR.

“We” will not be liable for any loss under this provi-sion unless and until actual repair or replacement iscompleted. “You” may make a claim under this policyon an “actual cash value” basis, and have one yearfrom the date of loss to make the repair or replace-ment and request payment for the differencebetween the reasonable cost of repair or replace-

ment and the amount “we” have already paid. In noevent will the total amount paid, plus the deductible,exceed the total amount actually and necessarilyspent to repair or replace the damaged property.

Coverage EE Additional Replacement CostIf there is a loss to the building insured under Dwell-ing, Coverage C that exceeds the Coverage C limitof liability shown in the Declarations, “we” willincrease the Coverage C limit of liability to equal thecurrent “replacement cost” of the building. This Cov-erage EE does not increase any coverage providedunder SECTION 5, Additional Coverages, 3. Build-ing Ordinance. The following changes apply to Dwelling, Cover-age C only:

1. Under Conditions - SECTIONS 2 through6, paragraph A. Insurable Interest AndLimit Of Liability is deleted and replaced bythe following:A. Insurable Interest And Limit Of Liabil-

ityEven if more than one person has aninsurable interest in the property cov-ered, “we” will not be liable for any oneloss:1. To the “insured” for an amount

greater than the “insured’s” interest;or

2. For more than the applicable limit ofliability. However, “we” will settlecovered losses to the dwelling build-ing under Dwelling, Coverage C at“replacement cost” without regardfor the limit of liability.

“You” must notify “us” within 90 days ofthe start of any addition to or remodelingof the dwelling which will increase thevalue by $5,000 or more and pay anyadditional premium. If “you” do not notify“us”, “we” will not be liable for more thanthe limit of liability shown in the Declara-tions.

2. Under Conditions - SECTIONS 2 through6, paragraph C. Loss Settlement, items1.b., 1.c. and 1.d. are deleted from Loss Set-tlement 1 - 80% Insurance Requirement.

3. A new item 1.b. is added to Loss Settlement1 - 80% Insurance Requirement in Condi-

b. “We” will pay no more than the“actual cash value” of the damage orthe applicable limit of liability asshown in the Declarations, which-ever is less, until actual repair orreplacement is complete, unless the“replacement cost” is less than$2,500. With respect to losses as aresult of peril 4. Windstorm or Hail,“we” will not pay more than “actualcash value” until actual repair orreplacement is complete, unless thereplacement cost is less than$15,000. “You” have one year fromthe date of the loss to repair orreplace the damaged property andrequest the difference between theamount already paid and the“replacement cost”.

Coverage FF Special Personal PropertyIncreased CoverageFor additional premium, Coverage FF provides addi-tional insurance to that stated in the Declarations forPERSONAL PROPERTY COVERAGE D. “We” provide risk of direct physical loss to jewelry,watches, furs, precious and semi-precious stones,silverware, silver-plated ware, goldware, gold-platedware, platinumware, platinum-plated ware and pew-terware. These items include flatware, hollowware,tea sets, trays and trophies made of or including sil-ver, gold or pewter. However, “we” do not cover lossor damage caused by mechanical breakdown, wearand tear, gradual deterioration, insects, vermin orinherent vice. “We” will pay up to $5,000 per loss to the itemsabove, but not more than $2,500 for a single articleor set of articles. Coverage FF is subject to a $250 deductible. Ifmore than one deductible applies to an “occurrence”only the highest deductible applies.

Coverage GG Off Premises RecreationalMotor Vehicle LiabilityFor additional premium, coverage is provided to an“insured” for the ownership, maintenance or use ofthe “recreational motor vehicle” shown in the Decla-rations while off the “insured location” for Liability,Coverage A and Medical Payments, Coverage B.

If “you” have this Coverage GG, newly acquired “rec-reational motor vehicles” will also be insured if “we”are notified within 30 days following the date of deliv-ery, effective the date of delivery. Paragraph 2.d.(2) of exclusion A. Motor VehicleLiability in Exclusions – SECTION 1 does not applyto the extent that coverage is provided under thisCoverage GG.

Coverage HH Extended Replacement CostIf there is a loss to the building or buildings insuredunder Dwelling, Coverage C which exceeds theCoverage C limit of liability shown in the Declara-tions, “we” will increase the Coverage C limit of liabil-ity to equal the current “replacement cost” of thebuilding up to a maximum of 120% of the amountstated in the Declarations. This Coverage HH doesnot increase any coverage provided under SECTION5, Additional Coverages, 3. Building Ordinance.The following changes apply to Dwelling, CoverageC only:

1. Under Conditions - SECTIONS 2 through6, paragraph A. Insurable Interest AndLimit Of Liability is deleted and replaced bythe following:A. Insurable Interest And Limit Of Liabil-

ityEven if more than one person has aninsurable interest in the property cov-ered, “we” will not be liable for any oneloss:1. To the “insured” for an amount

greater than the “insured’s” interest;or

2. For more than the applicable limit ofliability. However, “we” will settlecovered losses to the dwelling build-ing under Dwelling, Coverage C at“replacement cost”, up to a maxi-mum of 120% of the limit of liabilityshown in the Declarations.

“You” must notify “us” within 90 days ofthe start of any addition to or remodelingof the dwelling which will increase thevalue by $5,000 or more and pay anyadditional premium. If “you” do not notify“us”, “we” will not be liable for more thanthe limit of liability shown in the Declara-tions.

3. A new item 1.b. is added to Loss Settlement1 - 80% Insurance Requirement in Condi-tions - SECTIONS 2 through 6, paragraphC. Loss Settlement, as follows:

b. “We” will pay no more than the“actual cash value” of the damage orthe applicable limit of liability asshown in the Declarations, which-ever is less, until actual repair orreplacement is complete, unless the“replacement cost” is less than$2,500. With respect to losses as aresult of peril 4. Windstorm or Hail,“we” will not pay more than “actualcash value” until actual repair orreplacement is complete, unless the“replacement cost” is less than$15,000. “You” have one year fromthe date of the loss to repair orreplace the damaged property andrequest the difference between theamount already paid and the“replacement cost”.

Perils Insured Against - SECTIONS2 through 6 (Includes Limitations)“We” insure covered property against loss caused bythe following perils as indicated in the Declarationsexcept as excluded under Exclusions – SECTIONS2 through 6.

1. Risk Of Direct Physical Loss 2. Fire Or Lightning3. Removal

“We” insure covered property against directloss from any cause while being removedfrom a premises endangered by a PerilInsured Against and for no more than 30days while removed. This coverage does not change the limit ofliability that applies to the property beingremoved.

4. Windstorm Or HailThis peril does not include loss to the interiorof a building or the property contained in abuilding caused by rain, snow, sleet, sand ordust unless the direct force of wind or hail

first damages the building causing an open-ing in a roof or wall and the rain, snow, sleet,sand or dust enters through this opening.The Windstorm Or Hail peril also does notinclude loss caused directly or indirectly byfrost, cold weather, ice (other than hail),snowstorm or sleet, even if driven by wind.

5. Explosion6. Riot Or Civil Commotion7. Aircraft

This peril includes self-propelled missilesand spacecraft.

8. VehiclesThis peril means impact by a vehicle.

9. SmokeThis peril means sudden and accidentaldamage from smoke, including the emissionor puffback of smoke or soot from a boiler,furnace or related equipment. This peril does not include loss caused bysmoke from agricultural smudging or indus-trial operations.

10. Vandalism And Malicious MischiefThis peril means only willful and maliciousdamage to or destruction of property.

11. Breakage Of Glass Or Safety GlazingMateriala. “We” cover:

(1) The breakage of glass or safetyglazing material that is part of a cov-ered building, storm door or stormwindow;

(2) The breakage of glass or safetyglazing material that is part of a cov-ered building, storm door or stormwindow when caused directly byearth movement; and

(3) The direct physical loss to coveredproperty caused solely by thepieces, fragments or splinters of bro-ken glass or safety glazing materialthat is part of a building, storm dooror storm window.

b. This coverage does not include loss:(1) To covered property which results

because the glass or safety glazingmaterial has been broken, except asprovided in a.(3) above; or

(2) On the “residence premises” if thedwelling has been unoccupied for

more than 60 consecutive daysimmediately before the loss, exceptwhen the breakage results directlyfrom earth movement as provided ina.(2) above. A dwelling being con-structed is not considered unoccu-pied.

c. This coverage does not increase the limitof liability that applies to the damagedproperty.

12. Falling ObjectsThis peril does not include loss to propertycontained in a building unless the roof or anoutside wall of the building is first damagedby a falling object. Damage to the fallingobject itself is not included.

13. Weight Of Ice, Snow Or SleetThis peril means weight of ice, snow or sleetwhich causes damage to a building or prop-erty contained in the building. This peril doesnot include loss to a fence, patio, pavement,swimming pool, foundation, retaining wall,bulkhead, pier, wharf, or dock.

14. Volcanic EruptionThis peril does not include loss caused byearthquake, land shock waves, airborneshock waves or tremors. “We” do pay for“your” reasonable expense for the removal ofash, dust or particles from a volcanic erup-tion that has caused direct loss to a buildingor property contained in a fully enclosedbuilding.

15. Sudden And Accidental Tearing ApartThis peril means sudden and accidental tear-ing apart, cracking, burning or bulging of asteam or hot water heating system, an airconditioning or automatic fire protectivesprinkler system, or an appliance for heatingwater. “We” do not cover loss caused by or result-ing from freezing under this peril.

16. Accidental Discharge Or Overflowa. This peril means accidental discharge or

overflow of water or steam from within aplumbing, heating, air conditioning orautomatic fire protective sprinkler systemor from within a household appliance.

b. This peril does not include loss:(1) To the system or appliance from

which the water or steam escaped;

(2) Caused by or resulting from freezingexcept as provided in Perils InsuredAgainst 17. Freezing; or

(3) On the “residence premises” causedby accidental discharge or overflowwhich occurs off the “residencepremises”.

c. In this peril, a plumbing system orhousehold appliance does not include asump, sump pump or related equipmentor a roof drain, gutter, downspout or sim-ilar fixtures or equipment.

17. Freezinga. This peril means freezing of a plumbing,

heating, air conditioning, or automaticfire protective sprinkler system, or a hottub or spa, or a household appliance; butonly if “you” have used reasonable careto:(1) Maintain heat in the building; or(2) Shut off the water supply and drain

all systems and appliances of water.However, if the building is protected byan automatic fire protective sprinklersystem, “you” must use reasonable careto continue the water supply and main-tain heat in the building for coverage toapply.

b. In this peril, a plumbing system orhousehold appliance does not include asump, sump pump or related equipmentor a roof drain, gutter, downspout or sim-ilar fixtures or equipment.

18. Sudden And Accidental Damage FromArtificially Generated Electrical CurrentThis peril does not include loss to tubes,transistors, electronic components or cir-cuitry that is a part of appliances, fixtures,computers, home entertainment units orother types of electronic apparatus. This limi-tation, however, does not apply if there isdamage to covered property on the “resi-dence premises” caused by one of the PerilsInsured Against 2. through 17. which resultsin an artificially generated electrical current.

19. Thefta. This peril includes attempted theft and

loss of property from a known placewhen it is likely that the property hasbeen stolen.

b. This peril does not include loss causedby theft:(1) Committed by an “insured”;(2) Of tools, materials, and supplies for

use in construction until the buildingis finished and occupied;

(3) From that part of a “residence prem-ises” rented by an “insured” to some-one other than another “insured”; or

(4) That occurs off the “residence prem-ises” of:(a) Trailers and campers;(b) Watercraft of all types, and their

furnishings, equipment and out-board engines or motors; or

(c) Property while at any other resi-dence owned by, rented to, oroccupied by an “insured”, exceptwhile an “insured” is temporarilyliving there. Property of an“insured” who is a student iscovered while at the residencethe student occupies to attendschool as long as the studenthas been there at any time dur-ing the 60 days immediatelybefore the loss.

Exclusions – SECTIONS 2 through 6A. “We” do not insure for loss caused directly or

indirectly by any of the following. Such loss isexcluded regardless of any other cause or eventcontributing concurrently or in any sequence tothe loss. These exclusions apply whether or notthe loss event results in widespread damage oraffects a substantial area or the loss arises fromnatural, man-made, or external forces, or occursas a result of any combination of these.1. Building Ordinance

Building Ordinance means any ordinance orlaw:a. Requiring or regulating the construction,

demolition, remodeling, renovation orrepair of property, including removal ofany resulting debris. This exclusionA.1.a. does not apply to the amount ofcoverage that may be provided for in 3.Building Ordinance under SECTION 5,Additional Coverages;

b. The requirements of which result in aloss in value to property; or

c. Requiring any “insured” or others to testfor, monitor, clean up, remove, contain,treat, detoxify or neutralize, or in anyway respond to, or assess the effects of“pollutants” or “fungus”.

This exclusion A.1. applies whether or notthe property has been physically damaged.

2. Earth MovementEarth Movement means earth movement ofany type, including but not limited to:a. Earthquake. This includes land shock

waves or tremors before, during or aftera volcanic eruption;

b. Landslide, mudslide, lava flow or mud-flow;

c. Subsidence or sinkhole; ord. Any other earth movement including

earth sinking, rising, shifting, creeping,expanding, bulging, cracking, settling, orcontracting of the earth.

Direct loss by fire or explosion resulting fromearth movement is covered.This exclusion A.2. does not apply to:a. Loss by theft;b. Breakage of glass or safety glazing

material which is part of a covered build-ing, storm door or storm window whencaused directly by earth movement; or

c. Losses under Recreational Motor Vehi-cles, Coverage G; Watercraft, Cover-age H; or Personal Property(Scheduled), Coverage I.

3. Water DamageWater Damage means loss from:a. Flood; surface water (including water

flowing naturally on or near the surfaceand water whose flow is artificiallyaltered); waves; tidal water; overflow of abody of water; storm surge; break,breach or leak of a levee, dam or canal;or spray from any of these, whether ornot driven by wind;

b. Water or water-borne material, includingsewage, which backs up through sewersor drains or which overflows or is dis-charged from a sump, sump pump orrelated equipment; or

c. Water or water-borne material, regard-less of its source, below the surface ofthe ground, including water which exertspressure on or seeps or leaks through abuilding, sidewalk, driveway, foundation,swimming pool or other structure.

Direct loss by fire, explosion or theft resultingfrom Water Damage is covered. This exclusion A.3. does not apply to: Rec-reational Motor Vehicles, Coverage G;Watercraft, Coverage H; or Personal Prop-erty (Scheduled), Coverage I.

4. Power FailurePower Failure means the failure of power orother utility service if the failure takes placeoff the “residence premises”. But if the failureresults in a covered loss on the “residencepremises”, “we” will pay for the covered loss.

5. NeglectNeglect means neglect of an “insured” to useall reasonable means to save and preserveproperty at and after the time of a loss orwhen the property is in danger of loss.

6. WarWar includes the following and any conse-quence of any of the following:a. Undeclared war, civil war, insurrection,

rebellion or revolution;b. Warlike act by a military force or military

personnel; orc. Destruction, seizure or use for a military

purpose.Discharge of a nuclear weapon will bedeemed a warlike act even if accidental.

7. Nuclear HazardThis exclusion A.7. pertains to Nuclear Haz-ard to the extent set forth in L. Nuclear Haz-ard Clause under Conditions – SECTIONS2 through 6.

8. Intentional LossIntentional Loss means any loss arising outof any act an “insured” commits or conspiresto commit with the intent to cause a loss. Notwithstanding any other provisions of thispolicy, in the event of such loss, no “insured”is entitled to coverage, even “insureds” whodid not commit or conspire to commit the actcausing the loss.

9. Governmental ActionGovernmental Action means the destruction,confiscation or seizure of property by orderof any governmental or public authority. This exclusion does not apply to such actsordered by any governmental or publicauthority that are taken at the time of a fire toprevent its spread, if the loss caused by firewould be covered under this policy.

10. CollapseExcept as provided in 2. Collapse underSECTION 5, Additional Coverages.

11. Freezing of PlumbingFreezing of a plumbing, heating, air condi-tioning or automatic fire protective sprinklersystem or of a household appliance, or bydischarge, leakage or overflow from withinthe system or appliance caused by freezing.This provision does not apply if “you” haveused reasonable care to:a. Maintain heat in the building; orb. Shut off the water supply and drain all

systems and appliances of water. However, if the building is protected by anautomatic fire protective sprinkler system,“you” must use reasonable care to continuethe water supply and maintain heat in thebuilding for coverage to apply. For purposesof this provision a plumbing system orhousehold appliance does not include asump, sump pump or related equipment or aroof drain, gutter, downspout or similar fix-tures or equipment.

12. Freezing, Thawing, Pressure or WeightFreezing, thawing, pressure or weight ofwater or ice, whether driven by wind or not,to a:a. Swimming pool, including the filtration

and circulation systems, fence, pave-ment, or patio;

b. Footing, foundation, bulkhead, wall, orany other structure or device that sup-ports all or part of a building, or otherstructure;

c. Retaining wall or bulkhead that does notsupport all or part of a building or otherstructure;

d. Pier, wharf or dock; or e. “Recreational motor vehicles” or water-

craft.

13. Theft Of ToolsTheft of tools, materials, and supplies for usein construction until the building is finishedand occupied.

14. Unoccupied DwellingVandalism and malicious mischief, and anyensuing loss caused by any intentional andwrongful act committed in the course of thevandalism or malicious mischief, if the dwell-ing has been unoccupied for more than 60consecutive days immediately before theloss. A dwelling being constructed is not con-sidered unoccupied.

15. Fungus, Wet or Dry Rot, or BacteriaThe existence, growth or dispersal of “fun-gus”, wet or dry rot, or bacteria. Thisincludes, but is not limited to:a. Any loss of use or delay in rebuilding,

repairing or replacing covered property,including any associated cost orexpense, due to interference at the “resi-dence premises” or location of therebuilding, repair or replacement, by“fungus”, wet or dry rot, or bacteria;

b. Any remediation of “fungus”, wet or dryrot, or bacteria, including the cost to:(1) Remove the “fungus”, wet or dry rot,

or bacteria from covered property orto repair, restore or replace thatproperty; or

(2) Tear out and replace any part of thebuilding or other property as neededto gain access to the “fungus”, wet ordry rot, or bacteria; or

c. The cost of any testing or monitoring ofair or property to determine the type,absence, presence or extent of “fungus”,wet or dry rot, or bacteria, whether per-formed prior to, during or after removal,repair, restoration or replacement of cov-ered property.

16. Seepage Or LeakageContinuous or repeated seepage or leakageof water or steam from a:a. Heating, air conditioning or automatic

fire protective sprinkler system;b. Household appliance; orc. Plumbing system, including from, within

or around any shower stall, shower bath,

tub installation, or other plumbing fixture,including their walls, ceilings or floors.

“We” also do not cover loss to the system orappliance from which the water or steamescaped.

17. Controlled SubstanceThe manufacture or processing by any“insured” or with any “insured’s” knowledgeof a Controlled Substance as defined by theFederal Food and Drug Law at 21 U.S.C.A.Sections 811 and 812.

18. VirusThe existence, spread or dispersal of a virusor other microorganism that includes or iscapable of inducing physical distress, illnessor disease. This includes, but is not limitedto:a. Any loss of use or delay in rebuilding,

repairing or replacing covered property,including any associated cost orexpense, due to interference at the “resi-dence premises” or location of therebuilding, repair or replacement, by avirus or other microorganism;

b. Any remediation of a virus or othermicroorganism, including the cost to:(1) Remove the virus or other microor-

ganism from covered property or torepair, restore or replace that prop-erty; or

(2) Tear out and replace any part of thebuilding or other property as neededto gain access to the virus or othermicroorganism; or

c. The cost of any testing or monitoring ofair or property to determine the type,absence, presence or extent of a virus orother microorganism, whether performedprior to, during or after removal, repair,restoration or replacement of coveredproperty.

19. Any of the following:a. Wear and tear, marring, deterioration;b. Mechanical breakdown, latent defect,

inherent vice, or any quality in propertythat causes it to damage or destroyitself;

c. Smog, rust or other corrosion;d. Smoke from agricultural smudging or

industrial operations;

e. Discharge, dispersal, seepage, migra-tion, release or escape of “pollutants”,unless the discharge, dispersal, seep-age, migration, release or escape is itselfcaused by fire on the “residence prem-ises”;

f. Settling, shrinking, bulging or expan-sion, including resultant cracking, ofbulkheads, pavements, patios, footings,foundations, walls, floors, roofs or ceil-ings;

g. Birds, vermin, rodents, or insects;h. Animals owned or kept by an “insured”;i. Pressure from or presence of tree, shrub

or plant roots;j. Any property while: (1) operated in any

prearranged race, competitive speed orstrength test, or preparation for a race,speed or strength test, and regardless ofwhether the race or test had endedbefore the loss occurred; (2) used forhire or charter; or (3) used in any unlaw-ful trade or transportation; or

k. Street creeping.B. “We” do not insure for loss to covered property

caused by any of the following. However, anyensuing loss to covered property not precludedby any other provision in this policy is covered.1. Weather conditions. However, this exclusion

only applies if weather conditions contributein any way with a cause or event excluded inA. above to produce the loss.

2. Acts or decisions, including the failure to actor decide, of any person, group, organizationor governmental body.

3. Faulty, inadequate or defective:a. Planning, zoning, development, survey-

ing, or siting;b. Design, specifications, workmanship,

repair, construction, renovation, remod-eling, grading, or compaction;

c. Materials used in repair, construction,renovation or remodeling; or

d. Maintenance;of part or all of any property whether on or offthe “residence premises”.

Conditions– SECTIONS 2 through 6(Includes Limitations)A. Insurable Interest And Limit Of Liability

Even if more than one person has an insurableinterest in the property covered, “we” will not beliable in any one “occurrence”:1. To an “insured” for more than the amount of

such “insured's” interest at the time of loss;or

2. For more than the applicable limit of liability.B. Duties After Loss

In case of a loss, “we” have no duty to providecoverage under this policy if the failure to complywith the following duties is prejudicial to “us”.These duties must be performed either by “you”,an “insured” seeking coverage, or a representa-tive of either:1. Give prompt notice to “us” or “our” agent;2. Notify the police if the loss is suspected to be

in violation of a law;3. Promptly identify and give notice to any other

insurer who might provide insurance for aloss;

4. Notify the credit card or electronic fund trans-fer card or access device company in case ofloss as provided for in Credit Card andForgery, Coverage O under SECTION 5;

5. Protect the property from further damage. Ifrepairs to the property are required, “you”must:a. Make reasonable and necessary tempo-

rary repairs to protect the property; andb. Keep an accurate record of repair

expenses;6. Cooperate with “us” in the investigation of a

claim;7. Prepare an inventory of damaged or stolen

property showing the quantity, description,“actual cash value” and amount of loss.Attach all bills, receipts and related docu-ments that justify the figures in the inventory;

8. As often as “we” reasonably require:a. Show the damaged property;b. Provide “us” with records and docu-

ments “we” request and permit “us” tomake copies; and

c. Submit to examinations under oath, out-side the presence of all other “insureds”,and sign the same within a reasonable

amount of time of “our” request, afterhaving been informed:(1) of “your” right to counsel; and (2) that “your” answers may be used

against “you” in later civil proceed-ings or criminal proceedings;

9. Send to “us”, within 60 days after “our”request, “your” signed, sworn proof of losswhich sets forth, to the best of “your” knowl-edge and belief:a. The time and cause of loss;b. The interests of all “insureds” and all oth-

ers in the property involved and all lienson the property;

c. Other insurance which may cover theloss;

d. Changes in title or occupancy of theproperty during the term of the policy;

e. Specifications of damaged buildings anddetailed repair estimates;

f. The inventory of damaged propertydescribed in 7. above;

g. Receipts for additional living expensesincurred and records that support the fairrental value loss;

h. Evidence or affidavit that supports aclaim under SECTION 5, Credit Cardand Forgery, Coverage O stating theamount and cause of loss; and

10. Notwithstanding any other provisions inSECTIONS 2 through 6, all claims under thispolicy must be brought within one year of thedate of “occurrence”.

C. Loss Settlement“We” settle covered losses according to LossSettlement 1, Loss Settlement 2 or Loss Settle-ment 3 below, depending on what numberappears on the Declarations in the “LOSSSTLMT” column for applicable coverage. Thenumbers “1”, “2”, and “3” refer to the Loss Settle-ments 1, 2 and 3 described below. For covered “recreational motor vehicles” andwatercraft, the term materials of like kind andquality includes parts from original equipmentmanufacturers as well as parts manufacturedfrom other sources that are of comparable qual-ity. Under no circumstances do “we” pay for:

a. The increased costs necessary to com-ply with the enforcement of any building

code, ordinance or law, except to theextent coverage is provided in BuildingOrdinance under SECTION 5, Addi-tional Coverages; or

b. Any actual or perceived decrease invalue, however measured, resulting fromloss to or repair of “your” damaged prop-erty.

Property covered under Personal Property,Coverage D will be settled under Loss Settle-ment 3 - Actual Cash Value at time of loss,unless “you” purchase Coverage DD PersonalProperty Replacement Cost.Covered losses are settled as follows:1. Loss Settlement 1 - 80% Insurance Require-

mentIf “1” appears in the Declarations under“LOSS STLMT”:a. “We” pay “replacement cost” unless

paragraph b. applies. If a building orstructure is rebuilt at a new location,“replacement cost” may not exceed thecost of restoring the property at the origi-nal location.

b. If the applicable limit of liability for thedamaged property is less than 80% of its“replacement cost” at the time of loss,“we” will pay “actual cash value”.

c. “We” will not pay more than “actual cashvalue” until actual repair or replacementis complete, unless the “replacementcost” is less than $2,500 and less than5% of the applicable limit of liability. Withrespect to losses as a result of peril 4.Windstorm Or Hail “we” will not paymore than “actual cash value” untilactual repair or replacement is complete,unless the replacement cost is less than$15,000.

d. “You” may choose, at “your” election, toaccept “actual cash value” instead of“replacement cost”. If “you” do so, “you”will have one year from the date of theloss to repair or replace the damagedproperty and request the differencebetween “actual cash value” and“replacement cost”.

e. “We” will pay “actual cash value” fordamage to wood fences.

2. Loss Settlement 2 - No 80% InsuranceRequirementIf “2” appears in the Declarations under“LOSS STLMT”, “we” settle covered lossesaccording to Loss Settlement 1, except thatparagraph b. of Loss Settlement 1 does notapply.

3. Loss Settlement 3 - Actual Cash ValueIf “3” appears in the Declarations under“LOSS STLMT”, “we” settle covered lossesaccording to “actual cash value”.

D. Loss To A Pair Or SetIn case of covered loss to a pair or set “we” mayelect to:1. Repair or replace any part to restore the pair

or set to its value before the loss; or2. Pay the difference between “actual cash

value” of the property before and after theloss.

E. AppraisalIf “you” and “we” fail to agree on the amount ofloss, either may demand an appraisal of the loss.In this event, each party will choose a competentand impartial appraiser within 20 days afterreceiving a written request from the other. Thetwo appraisers will choose an umpire, who shallbe competent in the trade or skill necessary toassess the loss. If they cannot agree upon anumpire within 15 days, “you” or “we” may requestthat the choice of an umpire be made by a judgeof a court of record in the state where the “resi-dence premises” is located. The appraisers willseparately set the amount of loss. If the apprais-ers submit a written report of an agreementbetween them to “us”, the amount agreed uponwill set the amount of loss and be final. If they failto agree, they will submit their differences to theumpire. A decision agreed to by any two will thenset the amount of loss and be final.Each party will:1. Pay its own appraiser; and2. Bear the other expenses of the appraisal and

umpire equally.F. Other Insurance And Service Agreement

If a loss covered by this policy is also covered by:1. Other insurance, “we” will pay only the pro-

portion of the loss that the limit of liability thatapplies under this policy bears to the totalamount of insurance covering the loss; or

2. A service agreement, this insurance isexcess over any amounts payable under anysuch agreement. Service agreement meansa service plan, property restoration plan,home warranty or other similar service war-ranty agreement, even if it is characterizedas insurance.

G. Suit Against UsNo action can be brought against “us” unlessthere has been full compliance with all of theterms under SECTIONS 2 through 6 of this pol-icy and the action is started within one year afterthe date of “occurrence”.

H. Our Option“We” may repair or replace any part of the prop-erty damaged or stolen with similar property.“We” may take all or any part of the property atthe agreed or appraised value.

I. Loss Payment“We” will adjust all losses with “you”. “We” willpay “you” unless some other person is named inthe policy or is legally entitled to receive pay-ment. Payment will be made 60 days after “we”receive “your” properly executed proof of lossand “you” have complied with all the policy condi-tions, and:1. “We” reach an agreement with “you”;2. There is an entry of a final judgment; or3. There is a filing of an appraisal award with

“us”.J. Abandonment Of Property

“We” need not accept any property abandonedby an “insured”.

K. No Benefit To Bailee“We” will not recognize any assignment or grantany coverage that benefits a person or organiza-tion holding, storing or moving property for a feeregardless of any other provision of this policy.

L. Nuclear Hazard Clause1. Nuclear Hazard means any nuclear reaction,

radiation, or radioactive contamination, allwhether controlled or uncontrolled or how-ever caused, or any consequence of any ofthese.

2. Loss caused by the nuclear hazard will notbe considered loss caused by fire, explosion,or smoke, whether these perils are specifi-cally named in or otherwise included withinthe Perils Insured Against.

3. This policy does not apply under SECTIONS2 through 6 to loss caused directly or indi-rectly by nuclear hazard, except that directloss by fire resulting from the nuclear hazardis covered.

M. Recovered PropertyIf “you” or “we” recover any property for which“we” have made payment under this policy, “you”or “we” will notify the other of the recovery. At“your” option, the property will be returned to orretained by “you” or it will become “our” property.If the recovered property is returned to orretained by “you”, the loss payment will beadjusted based on the amount “you” received forthe recovered property.

N. Volcanic Eruption PeriodOne or more volcanic eruptions that occur withina 72 hour period will be considered as one volca-nic eruption.

O. Concealment Or Fraud“We” do not provide coverage when any“insured”, whether before or after a loss, has:1. Intentionally concealed or misrepresented

any material fact or circumstance;2. Engaged in fraudulent conduct; or3. Made false statements;relating to this insurance.

P. Builders Risk ClauseThis policy may, if listed in the Declarations,cover a dwelling under construction. If so, untilthe dwelling is completed and occupied, the limitof liability in force shall be the amount necessaryto replace the dwelling at the time of loss, but notgreater than the corresponding DWELLING, SEC2 COV C limit shown in the Declarations.

Conditions - Additional Interests(Includes Limitations)A. Additional Insured

Whenever the word “insured” is used in this pol-icy, the term also includes the person or organi-zation named in the Declarations as additionalinsured. This definition is limited to the following:1. Under SECTION 1 of this policy this defini-

tion of additional insured applies only to theownership, maintenance, and use of the“insured location”. Coverage does not applyto “bodily injury” to a “residence employee”arising out of or in the course of the “resi-

dence employee’s” employment by the addi-tional insured.

2. Under SECTIONS 2 through 6 of this policythis definition of additional insured appliesonly to Dwelling, Coverage C and AuxiliaryPrivate Structures, Coverage F. Losses willbe paid to “you” and the additional insuredaccording to the respective financial inter-ests.

B. Standard Mortgage ClauseThe word mortgagee includes trustee.1. If a mortgagee is named in this policy, any

loss payable under Dwelling, Coverage Cor Auxiliary Private Structures, CoverageF will be paid to the mortgagee and “you”, asinterests appear. If more than one mort-gagee is named, the order of payment will bethe same as the order of precedence of themortgages.

2. If “we” deny “your” claim, that denial will notapply to a valid claim of the mortgagee, if themortgagee:a. Notifies “us” of any change in ownership,

occupancy or substantial change in riskof which the mortgagee is aware;

b. Pays any premium due under this policyon demand if “you” have neglected topay the premium; and

c. Submits a signed, sworn statement ofloss within 60 days after receiving noticefrom “us” of “your” failure to do so. Para-graphs E. Appraisal, G. Suit AgainstUs and I. Loss Payment under Condi-tions – SECTIONS 2 through 6 alsoapply to the mortgagee.

3. If “we” decide to cancel or not to renew thispolicy, the mortgagee will be notified at least10 days before the date cancellation or non-renewal takes effect.

4. If “we” pay the mortgagee for any loss anddeny payment to “you”:a. ”We” are subrogated to all the rights of

the mortgagee granted under the mort-gage on the property; or

b. At “our” option, “we” may pay to themortgagee the whole principal on themortgage plus any accrued interest. Inthis event, “we” will receive a full assign-ment and transfer of the mortgage and

all securities held as collateral to themortgage debt.

5. Subrogation will not impair the right of themortgagee to recover the full amount of themortgagee's claim.

6. Nothing in this B. Standard MortgageClause changes the perils insured against orthe property covered.

C. Loss Payable ClauseIf the Declarations shows a loss payee payablefor certain listed insured personal property, underSECTIONS 2 through 6, the definition of“insured” is changed to include that loss payeewith respect to that property. If “we” decide tocancel or not renew this policy, that loss payeewill be notified in writing.

D. Certificate of InsuranceCoverage provided by this policy when describedin a certificate of insurance is not amended,altered, or extended by that certificate. If this policy, when described in a certificate ofinsurance, is canceled during its term, “we” willprovide not less than ten days notice to the certif-icateholder. Notice by regular mail to the lastknown address will be sufficient compliance withthis provision.

General Policy Conditions(Includes Limitations)A. Policy Period

Policy period means the policy term shown in theDeclarations, commencing on the policy periodbeginning date shown in the Declarations. Under SECTION 1, this policy applies only to“bodily injury” or “property damage” that occursduring the policy period. Under SECTIONS 2 through 6, this policyapplies to loss that occurs during the policyperiod.

B. Liberalization ClauseIf “we” revise this policy to provide more cover-age without charging additional premium, “your”policy will automatically provide the additionalcoverage the day the revision is effective in“your” state.

C. Waiver Or Change Of Policy ProvisionsA waiver or change of a provision of this policymust be in writing by “us” to be valid. “Our”request for an appraisal or examination will notwaive any of “our” rights.

D. Cancellation1. “You” may cancel this policy at any time by

returning it to “us” or by letting “us” know inwriting of the date cancellation is to takeeffect.

2. “We” may cancel this policy only for the rea-sons stated below by letting “you” know inwriting of the date cancellation takes effect.This cancellation notice may be delivered to“you”, or mailed to “you” at “your” mailingaddress shown in the Declarations. Proof ofmailing will be sufficient proof of notice.a. When “you” have not paid the premium,

“we” may cancel at any time by letting“you” know at least 10 days before thedate cancellation takes effect.

b. When this policy has been in effect forless than 60 days and is not a renewalwith “us”, “we” may cancel for any rea-son by letting “you” know at least 10days before the date cancellation takeseffect.

c. When this policy has been in effect for60 days or more, or at any time if it is arenewal with “us”, “we” may cancel:(1) If there has been a material misrep-

resentation of fact which if known to“us” would have caused “us” not toissue the policy; or

(2) If the risk has changed substantiallysince the policy was issued.

This can be done by letting “you” know atleast 30 days before the date cancella-tion takes effect.

d. When this policy is written for a period ofmore than one year, “we” may cancel forany reason at anniversary by letting“you” know at least 30 days before thedate cancellation takes effect.

3. When this policy is canceled, the paid pre-mium for the period from the date of cancel-lation to the expiration date will be refundedpro rata.

4. If the return premium is not refunded with thenotice of cancellation or when this policy isreturned to “us”, “we” will refund it within areasonable time after the date cancellationtakes effect.

E. Continuous Renewal ProvisionSubject to “our” consent and subject to “our” pre-miums, rules, and forms then in effect, this policymay be continued in force for each successivepolicy term. When “we” consent to renew thispolicy, the renewal premium must be paid by thedue date. If the renewal premium is not paid,coverage will cease on the coverage terminationdate. Payment received after the due date will beconsidered a nonbinding application to reinstatethe lapsed policy.

F. Nonrenewal“We” may elect not to renew this policy. “We”may do so by delivering to “you”, or mailing to“you” at “your” mailing address shown in theDeclarations, written notice at least 30 daysbefore the expiration date of this policy. Proof ofmailing will be sufficient proof of notice.

G. Inspections And Surveys“We” will be permitted to inspect “your” premisesand property any time during the policy period.“We” are not obligated to make inspections orsurveys for “your” benefit. Any inspections or sur-veys “we” do perform are for “our” underwritingand rating purposes. “We” do not provide ser-vices relating to “your” health or safety, or thehealth and safety of workers or the public.

H. AssignmentAssignment of this policy will not be valid unless“we” give “our” written consent.

I. SubrogationAn “insured” may waive in writing before a lossall rights of recovery against any person. If notwaived, “we” may require an assignment of rightsof recovery for a loss to the extent that paymentis made by “us”. If an assignment is sought, an “insured” mustsign and deliver all related papers and cooperatewith “us”. Subrogation does not apply to C. Damage ToProperty Of Others under Additional Cover-ages - SECTION 1.

J. Conformity To State StatutesAny terms of this policy which are in conflict withthe statutes of the state in which this policy isissued are amended to conform to such statutes.

K. DeathIf any person named in the Declarations or thespouse, if a resident of the same household,dies, the following apply:

1. “We” insure the legal representative of thedeceased but only with respect to the prem-ises and property of the deceased coveredunder the policy at the time of death; and

2. “Insured” includes:a. An “insured” who is a member of “your”

household at the time of “your” death,but only while a resident of the “resi-dence premises”; and

b. With respect to “your” property, the per-son having proper temporary custody ofthe property until appointment and quali-fication of a legal representative.

L. No Action Against Related EntitiesNothing in this policy gives any person, organiza-tion, corporation or other entity any rights orcauses of action against any parent corporation,affiliate or subsidiary of the company issuing thispolicy. No rights are created or implied againstany parent corporation, affiliate, or subsidiary ofthe company described in the Declarations.

M. Mutuality Of PolicyBy accepting this policy the policyholderbecomes a member of COUNTRY Mutual Insur-ance Company with all the rights and privilegesof a member. These rights and privileges are asprovided in the COUNTRY Mutual By-Laws inforce at the time this policy takes effect, or thatmay become effective during the continuance ofthis policy. When this policy is either lapsed orterminated, the policyholder will cease to be amember of COUNTRY Mutual and the policy-holder’s rights and interests in COUNTRY Mutualwill end. All “insureds” must cooperate with “us”by doing all that is possible to prevent losses.The purpose is to reduce the cost of insurance tothe lowest point consistent with solvency andsound insurance protection.

N. Policy Non-AssessableThis policy will be without contingent liability andis non-assessable.

O. Participation In Savings And EarningsThis policy is on the mutual or participating plan.This means that during the continuance of thispolicy the member will be entitled to participate inCOUNTRY Mutual's savings and earnings asdetermined by the Board of Directors.

P. Annual MeetingsThe annual meeting of the members will be heldat the principal location of COUNTRY Mutual

unless a different place is fixed by the Board ofDirectors. The annual meeting will be held eachyear on a day and hour set by the Board of Direc-tors. The notice of any meeting of members willfix the hour, day and place of that meeting.
