Description:

Please find attached here with biased and illegal agenda items No. 12, 13

and 14 was placed before the Haryana Khadi and Village Industries Board

in its BoD meeting on July 17, 2014 concealing the factual position, with out

proper approval and examination of replies submitted by Naresh Kadian,

TS (L) and these replies were received by the Board bearing No. 67 dated 7-

4-14, No. 1072 dated 17-6-14 and No. 1145 dated 19-6-14, where as all

relevant evidences were provided including Civil Surgeon, Faridabad

endorsement, Rs. 10,25,638/- recovery proof of Education Department from

then purchaser, which was hold guilty by her parent Department, where as

Board have not yet refunded 5% service charges for this amount, when

execution was made out according to the agreement executed between

Board and the supplier, if any terms and conditions violated by the supplier

then he should be asked but Board never asked the supplier for breach of

agreement, instead holding guilty Naresh Kadian with out any proper

examination, performance of duty in the interest of Board became offense

in Haryana, as per past practice necessary goods receipt was obtained but

illegally 16-11-2007 instructions were imposed, HIPA papers were never

circulated to the field functionaries, two charge sheets were issued for same

reasons, two different biased inquiry officers were appointed against

payment, unnecessary burden on the Board, favoritism as well, to the

retired officers, these both inquiry officers needs immediate dismissal

because they failed to conduct fair and transparent inquiry, Medical

certificate issuing Authority was never examined by them, when third

inquiry report proved that execution was in the interest of Board, breach of

agreement complaint was lodged by Naresh Kadian against the supplier

then where are the fault of Naresh Kadian, who performed his duty in the

interest of Board in good faith, as per past practice verble permission was

granted by then CE, in fact there was no purchase at the level of Board, no

stock and materials were examined by the Board officials before supply,

never make any entry in the stock register of the Board, if any actionpresumed in the interest of Board, then it was duty of Naresh Kadian to act

promptly because Board was received 5% service charges from the

supplier, after deduction this amount rest amount was disbursed through

cheque, Bank transaction then where are the fault at the level of Naresh

Kadian but biased officials of the Board failed to examine all replies and

papers submitted before them, biased and illegal agenda was placed along

with many objectionable unwarranted materials, only to harm Naresh

Kadian 30 years career, no proper opportunities were granted, where as

many appeal against CE orders were pending before the Chairman of the

Board then these biased officials placed agenda and now they are also

preparing same agenda for another BoD meeting to be held on 6-8-14, onlyto dismiss Naresh Kadian from service for no reasons and fault, where as

all these tainted Board officials needs immediate suspension and charge

sheets along with the IAS officer, who accepted half backed and biased

inquiry reports, approved the agenda items as well, RTI petition has been

moved along with many service benefits illegally with held, no proper

suspension allowances were granted along with many years annual

increments, ACP's, EB was illegally with held on 15-12-2009, where as

promotion of Naresh Kadian due for the post of DO (L), hence Board Chief

Secretary to Haryana may kindly be directed to look in to the matter on top

priority for natural justice to Naresh Kadian, all service benefits with

promotion may kindly also be granted, suspension order be revoked,dropping all three baseless charge sheets, suspension period be treated as

duty period, tainted officials be punished, full time Member Secretary be

appointed at once, biased agenda for 6-8-14 needs to dropped.
