1.0 INTRODUCTION

1.1 TEP was commissioned by Foundation Matters to prepare a Himalayan Balsam Method

Statement to comply with Condition 6 of planning permission (application ref:

9/2014/0955) for the extension to an existing children’s camp, creation of a recreation

lake and recreational facilities at Pine Lake, Stenson.

1.2 Condition 6 states:

“No development, including site clearance, shall take place until a detailed method statement for the management during the construction phase of the Himalayan balsam located on the site has been submitted to and approved in writing by the Local Planning Authority. The method statement shall include measures that will be used to prevent the spread of Himalayan balsam, Water fern and New Zealand pygmyweed during any operations for the duration of construction (e.g. mowing, strimming or soil movement). It shall also contain measures to ensure that any soils brought on to or removed from the site are free of the seeds/root/stem of any invasive plant listed under the Wildlife and Countryside Act 1981 (as amended). Development shall proceed in accordance with the approved method statement at all times.”

1.3 Water fern and New Zealand pygmyweed were not identified during site surveys and no

records of these species were returned during the desktop survey (TEP report ref.

4519.003 Pine Lake, Stenson, Ecological Assessment). Reference to these species in

Condition 6 appears to be in error; this method statement therefore only addresses

measures to avoid the spread of Himalayan balasam Impatiens glandulifera.

1.4 The locations of Himalayan balsam are shown on the Phase 1 Habitat Map (TEP Ref:

G4519.001) at Appendix 1. Himalayan balsam is present along the banks of Twyford

Brook, along a ditch surrounding an amenity grassland field in the east of the site and

within an area mapped as swamp habitat in the south east of the site.

1.5 Himalayan balsam is a non-native invasive plant and is listed on Schedule 9 of the

Wildlife and Countryside Act 1981. Under provisions made within the Wildlife and

Countryside Act 1981, it is an offence to spread Himalayan balsam. Liability may also

extend in situations where a landowner has knowingly permitted the spread of

Himalayan balsam onto neighbouring land.

1.6 Any waste containing Himalayan balsam is classed as Controlled Waste under the

Environmental Protection (Duty of Care) Regulations 1991, which requires all producers,

carriers and disposers of waste to follow a code of practice and keep records.

1.7 Failure to manage and dispose of invasive species in accordance with the above

legislation can lead to prosecution.

2.0 METHOD STATEMENT

2.1 All staff working on site will be made aware that Himalayan balsam is present on site; an

explanation of the content of this Method Statement will be included in the Site Induction.

This Method Statement will be on display in the Site Office for the duration of the works.

2.2 Fencing will be erected at 10m distance from the bank tops of Twyford Brook and

ditches. This is to prevent accidental encroachment onto and disturbance of the brook

banks, ditch banks and swamp and to prevent the spreading of Himalayan balsam to

other parts of the site. The area within the fencing is referred to as the Exclusion Zone

and is shown on the Landscape Buffer Zones plan (TEP Ref: D4519.006) at Appendix 2.

2.3 Where works require access to the Exclusion Zone, these works will be overseen by an

Ecological Clerk of Works.

2.4 Vehicles working within the Exclusion Zone will be cleaned within the Exclusion Zone

before being used in other parts of the site or before leaving the site. This is to prevent

contaminating other parts of the site or off-site areas.

2.5 Any material from within Exclusion Zone that is not reused within the Exclusion Zone will

be taken off-site and disposed of at a facility licensed to accept Controlled Waste. The

Ecological Clerk of Works will supervise the loading of Controlled Waste onto carrier

vehicles and will ensure that these loads are sealed before leaving the site. The

Ecological Clerk of Works will obtain signed receipts from carriers from all loads of

Controlled Waste that leave the site and will give these receipts to the Site Manager.

2.6 During construction, areas outside of the Exclusion Zone but within the site will be

monitored for Himalayan balsam by a suitably qualified person. Monitoring inspections

will be undertaken each month between April and September. If any Himalayan balsam

plants are identified outside of the Exclusion Zone, management measures will be

implemented to keep the species under control.

2.7 Management measures implemented outside of the Exclusion Zone will aim to prevent

Himalayan balsam plants from flowering and hence prevent the plants from setting seed.

Identified plants will either be cut with a scythe below the lowest node or sprayed with a

glyphosate-based herbicide. Plants will be cut or sprayed once every four weeks within

the monitoring period of April to September inclusive.
