A BILL TO BE ENTITLED

AN ACT

To amend Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating to1

incorporation of municipalities, so as to provide that no local Act granting a municipal2

charter shall be enacted wherein any part of the proposed corporate boundary is less than a3

distance of three miles from the corporate boundary of any existing municipal corporation4

in this state; to provide for related matters; to repeal conflicting laws; and for other purposes.5

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:6

SECTION 1.7

Chapter 31 of Title 36 of the Official Code of Georgia Annotated, relating to incorporation8

of municipalities, is amended by revising Code Section 36-31-3, relating to minimum9

population standards for proposed municipal corporation, as follows:10

"36-31-3.11

(a) To be eligible for original incorporation as a municipal corporation, the minimum12

population standards of the area embraced within the proposed municipal boundary shall13

be as follows:14

(1) A total resident population of at least 200 persons; and15(2) An average resident population of at least 200 persons per square mile for the total16

area.17

(b) No local Act granting a municipal charter shall be enacted wherein any part of the18

proposed corporate boundary is less than a distance of three miles from the corporate19

boundary of any existing municipal corporation in this state."20

SECTION 2.21

All laws and parts of laws in conflict with this Act are repealed.22
