With all this snow, area residents might as well get out and find ways toenjoy it. The annual Gun Lake Winterfest offers plenty of options forfamily fun Feb. 14, 15 and 16. The iconic Polar Dip is a Winterfest
favorite that organizers say some people even put on their “bucket lists” to do atleast once in their lifetimes. It’s never too early to start thinking of summer andwarmer waters, so the annual swimsuit fashion show adds a summer twist toWinterfest events. Back by popular demand this year is the Battle of the Beardscontest, the 1980s dance party, comedy show and music trivia contest. There willbe plenty of games for kids of all ages and even a .05K beer run to officially openthe beer tent Saturday. Restaurants and businesses in the area will offer manyspecials all weekend. THE COMMUNITY SPOUSE PLAN:Changing your estate plan to reflect the illness of a spouse
When a married couple first decides toobtain estate planning documents, it is usu-ally when both spouses are healthy. The cou-ple may be younger with the main motiva-tion for seeing an attorney being to "takecare of the kids." Commonly, a married cou-ple's estate plan follows more or less thesame route: when the first spouse dies, allassets go to the surviving spouse. When thesecond spouse dies, assets are passed tosome combination of beneficiaries, often-times children. This type of planning may fitthe needs of the couple for years, evendecades.
If one spouse has health issues, however,an old estate plan can cause more harm thangood. I often see couples where one spousehas been diagnosed with debilitating dis-eases (i.e. dementia, Parkinson’s orAlzheimer’s). The diagnosis of one of thesetypes of illnesses can turn the goals of oldestate plan upside down.
After a diagnosis, we often see the"healthy spouse" become the main caregiver,housekeeper, and bookkeeper of the couple.If the "healthy spouse" unexpectedly passesaway first, is it still a good idea to leave allassets to the surviving "ill spouse?" Will thesurviving spouse be able to live at homewithout the assistance of the now deceasedspouse, or will long term care in a facilitymost likely be needed? Can the survivingspouse manage assets, or is an agent neededto protect and preserve assets?
For these couples and their families, good"community spouse planning" is a must. Theold estate plan that left all assets to the sur-viving spouse needs to be updated.
Here is an example: a husband and wifecome into my office following a dementiadiagnosis for the husband. At this time, thehusband can live at home with the aid andassistance of his wife. He needs supervision,help with bathing, eating and medications,and cannot manage the checkbook. The hus-band and wife have a living revocable trustthat leaves all assets to the surviving spouse.
On the second spouse's death, all assets go totheir three children.
The estate plan no longer reflects theneeds of this couple. If the wife unexpected-ly dies, the husband obtains ownership andcontrol over all assets. This may be a verybad result.
Because of the husband's health, he prob-ably cannot manage the assets safely.Moreover, without the care of the wife, thehusband will most likely need long term carein a facility. Owning all of the assets will notbe advantageous to the husband.
A good community spouse plan envisionsprotecting the couple’s assets at the time ofthe death of the healthy spouse. This canmean creating a special testamentary trustthat would allow a child or other trustee toprotect and manage the assets for the surviv-ing ill spouse. It could also mean bypassingthe ill spouse completely, leaving all assetsto the children, presuming the children willuse whatever assets are necessary for thesurviving ill spouse's care and comfort.
Many couples have an estate plan.However, a diagnosis of a debilitating illnessfor one spouse should trigger a review of theold estate plan. More often than not, theestate plan will need to be amended to reflectthe new realities of the couple's situation, aswell as their hopes and desires for the use ofthe estate.
