0 Executive Summary

Goldwind Australia has prepared this Pre-Operations Compliance Report (POCR) on behalf ofNew Gullen Range Wind Farm Pty Ltd (NGRWF).

The Gullen Range Wind Farm obtained Project Approval under the Environmental Planning andAssessment Act, 1979 and must be implemented in accordance with the Project ApprovalConditions. The POCR addresses the requirement of Project Approval Condition 6.1(b) and willbe submitted to the Department of Planning and Environment (DPE) and the EnvironmentalRepresentative.

The status of project implementation is outlined in Section 2. Construction commenced inSeptember 2012 and involved installation of 73 wind turbines, a 33kV/330kV substation, accesstracks and electrical collections circuits. The substation was completed and energised inDecember 2013 which has enabled the progressive connection, testing and generation forindividual turbines. All 73 wind turbines have now been installed and are undergoing final testingprior to the wind farm transitioning to full operations which is expected to occur in lateNovember/early December 2014.

Section 3 of this POCR describes the property associated with the Gullen Wind Farm project.

Section 4 lists the Project Approval Conditions and the status of compliance for each Condition.The compliance status varies widely from ‘completed’, ‘in progress’ or ‘ongoing’ and in somecases, being ‘future actions’. A brief description of the proponent’s review of compliance status isalso provided. Section 4 is complemented by Section 5 that gives additional detail of compliancefor the key conditions relating to the operational stage of the development.

Section 6 provides the conclusions of the POCR which are repeated below. The POCRconcludes that:

A comprehensive program of actions has been implemented by NGRWF to ensurecompliance with the Project Approval Conditions.

Many requirements for the Construction Stage of the Project are complete. There areongoing requirements in terms of site restoration following construction.

An OEMP has been approved by DPE and is being addressed by the proponent Programs to be initiated in conjunction with the operational status of the wind farm are

either underway or will be implemented during November/December 2014. NGRWF has also implemented a number of actions that go beyond compliance.

Further reporting of performance during the operation of the wind farm is required in accordancewith the Project Approval Conditions.

1. IntroductionThis Pre-Operations Compliance Report (POCR) relates to the Gullen Range Wind Farm locatedin the NSW Southern Tablelands and the subject of Project Approval MP07_0118 granted on 4August 2010.

Purpose of this documentThis Pre-Operations Compliance Report (POCR) provides the proponent’s review of compliancewith the Gullen Range Wind Farm Project Approval Conditions, particularly as relevant toprogression of the project from the construction stage to operations stage.

Condition 6 of the Project Approval sets out the requirements for a Compliance TrackingProgram. Condition 6.1 (b requires the following as part of the Program:

“provisions for periodic reporting of the compliance status to the Director-General including atleast prior to commencement of construction of the project and prior to the commencement ofoperation of the project.”

A Pre-Construction Compliance report was supplied to the NSW Department of Planning andEnvironment (DPE) in September 2012, prior to construction commencing.

All the project’s 73 wind turbines and ancillary equipment have now been installed. The siterestoration works that form part of the construction stage are still in progress.

This Pre-Operations Compliance Report has been prepared by Goldwind Australia to documentcompliance with conditions relating to commencement of operations and completion ofrequirements in relation to the construction stage. This report is submitted to DPE in accordancewith Condition 6.1 (b) and is also provided to the Environmental Representative for review andcomment.

Structure of this document

Section 1 sets out the purpose of the pre-compliance report and document structure.

Section 2 details the status of the project implementation, location details for turbines andapplicable turbine model. Maps of the turbine locations are also included in Section 2.

Section 3 updates the status of the properties associated with the project and any acquisitions oragreements established since the construction commenced.

Section 4 Provides the status of compliance for each of the Project Approval Conditions. It iscomplemented by the details in Section 5.

Section 5 Outlines the key compliance matters relating to the operations stage.

Section 6 lists the conclusions of the pre-operations compliance assessment.

Section 7 lists relevant references for preparation of this POCR.

2. Status of project implementation

Update on status of project implementationThe construction of the GRWF project has now reached the stage where 73 wind turbines areinstalled, the substation has been completed and energised and, the testing and commissioningof turbines is being completed. The turbine locations and model installed for the respective sitesare shown in Table 2-1 below together with details of the Turbine Model.

The Final Design location and elevation data is based on survey data obtained in February 2014.An additional survey arranged by the DPE has confirmed the turbine locations.

The locations of the turbines are also shown in the maps accompanying this POCR (Figures 2.1,2.2 and 2.3).

The details of adjustments to turbine locations from the indicative approved sites to the finaldesign, installed locations and the associated change in social and environmental impacts havebeen comprehensively described in the Environmental Assessment, March 2014 andSubmissions Report, June 2014. DPE has also reviewed these documents as reported in theSecretary’s Environmental Assessment Report, July 2014.

The full wind farm comprising all 73 turbines and ancillary facilities has been installed and siterestoration works are in progress. The commencement of the wind farm operation has beendelayed during 2014 due to the review process in respect of the adjusted turbine locations. Thisreport has been prepared on the basis of the final turbine locations provided in Table 2.1.

An Operation Environmental Management Plan (OEMP) was approved by the DPE on 5December 2013. The OEMP referenced the final design turbine locations. A range ofManagement Plans are relevant to the Operations Stage and are being applied or will beactivated in November/December 2014. Details of the proponent’s response to the ApprovalConditions is provided in the following sections.

Further reporting of project performance is required in accordance with the Project ApprovalConditions.

Update on status of Environment Protection LicenceAn Environment Protection Licence (EPL 20365) has been issued by the Environment ProtectionAuthority (EPA) in October 2014. EPL 20365 has been issued under the Protection of theOperations Act, 1997 distinct from the Project Approval that is granted under the EnvironmentalPlanning and Assessment Act, 1979. The provisions of EPL are nevertheless required to beconsistent with the Project Approval Conditions.

The EPL 20365 included a requirement for a further noise assessment report to be provided toEPA in November 2014. A draft noise assessment was provided on 30 October 2014 for reviewand discussion to assist finalisation of the assessment in a form suitable for reference inconjunction with the EPL. A revised copy of the Noise assessment will be submitted in December2014.

3. Property IssuesThis section provides an update on the status of property associated with the GRWF and inrelation to the identification of residences in the areas surrounding the wind farm and theirassociation status.

Overview of property required for the projectThe various land categories relative to project development are listed below and are shown inFigure 3.1.

Twelve properties where the approved project, 73 turbines and ancillary facilities, are located.These include several properties owned by the proponent and others leased from thelandowners. (Table 3.1)

Lands where easements obtained for access or cabling. (Table 3.2) Status of compliance with requirements of the Project Approval Conditions 2.25 to 2.32

(Table 3.3) Other agreements have been reached with specific neighbouring landowners such that they

are now Associated but these are additional to the requirements of Condition 2.25 and notdiscussed further in this document.

Status of agreements or negotiations in respect of Crown Lands (Table 3.5)

The Project Approval defines ‘Associated property’ and ‘Associated residence’ as follows:

‘Associated property’ - A property comprising one or more lots, that is owned, leased orotherwise lawfully used by the Proponent or where there is a written agreement between theowner of the property and the Proponent (but only during the currency of the agreement) that partof the property in relation to which the agreement is established.

‘Associated residence’ A residence within a property, comprising one or more lots, that isowned, leased or otherwise lawfully used by the Proponent or where there is written agreementbetween the owner of the property and the Proponent (but only during the currency of theagreement) that part of the property in relation to which the agreement is established.

The following sections provide details for the properties involved with the project.

Project lands

The land on which the project is located is shown in Table 3.1 and in Figure 3.1. The projectspans 12 privately owned properties and additional lands, over which NGRWF has obtainedeasements for access purposes or placement of electrical cabling. In respect of the adjustment ofturbine locations, all turbines remain on the land where they were located for the approvaldocuments and to which the Project Approval applies.

Additional land shown in Table 3.2 is required for access and installation of cables.

Condition 2.25 is provided below:“Should the Proponent determine to proceed with any or all of the turbines listed in Table 3, the

Proponent shall notify in writing the owner of each of the Lots listed in the corresponding rowof the specific turbine(s) it intends to proceed with and that it is initiating the acquisitionprocess.

Properties that are subject to Conditions 2.25 to 2.32 are shown in Table 3.3 and on Figure 3.1.NGRWF has complied with all its obligations under Condition 2.25 as detailed in Table 3.3.

Associated land where agreements have been reached with landownersA number of landowners for lands adjoining the project area but not referenced in the Tableabove have agreements with the proponent and the lands are now referred to as associatedproperties. These agreements are additional to the requirements of Condition 2.25 and havebeen mutually reached between NGRWF and the landowner. They are not discussed further inthis document.

Crown land issuesUse of Crown lands by NGRWF may include using the land for access routes or placement ofutilities, such as underground cables within the Crown Land, either to cross from one property toanother or as a means of routing cables from one part of the project to another without disturbingthe adjoining privately owned land.

NGRWF has undertaken consultation with NSW Trade and Investment, Crown Lands Agency inrespect of Crown Lands and, where necessary, in relation to adjustment of turbine locations in

respect of overhang of turbine blades for turbines located close to areas of Crown land such asGUR07. NGRWF has obtained all relevant landowner, Council and Crown consents, including byway of entering into agreements with landowners, as required for any use of Crown Lands.

The Crown Lands letter of 22 May 2014 notes the need for closure of a Crown Road directlysouth of GUR_01 within the project lands.

3.5.1 Sugarloaf Trig Reserve (TR130029) and Trig Station (TS5138).The approved indicative location for Turbine GUR 07 was on a steep slope, 101.5 metres to thesouth of its Final Design position. As part of the review of the 73 sites, it was relocated to a moresuitable location near Sugarloaf Trig Station. Subsequently it was adjusted again due to proximityto Sugarloaf Trig Station (TS5138) and was moved away from the Trig Station. However, due tosteep land at the locality, options for relocation were limited. Following further correspondencewith NSW Land and Property Information (LPI), GUR 07 was subsequently moved back to itsprior location (Layout 3b) adjacent trig reserve TR130029. LPI’s letter of 10 October 2012(Approval No 2011/010) stated that the Surveyor General did not have any objection to thelocation adjacent the Trig Reserve, provided that it was as shown in LPI’s letter and does notobstruct Trig Station sight lines that were also shown in its letter (Figure 3-2). The Turbine modelfor this location is a GW82-1.5 which has a blade length of 41 metres and will overhang the TrigReserve 130029.

LandscapingRelevant conditions relating to landscaping treatments to mitigate visual impact of the wind farminclude, Conditions 2.1 to 2.3 and 7.5(b).

A landscaping plan has been prepared in accordance with Condition 7.5(b) and approved byDPE. The Plan is currently being implemented. As at 5 November, 2014, 61 properties havebeen inspected and 37 Individual Landscape Plans prepared. Of these, 28 have been agreedwith landowners and implementation has commenced for four plans with three plans completed.Maintenance of plantings is required for a two year period. The implementation of many Plans isscheduled for Autumn 2015 to optimise the plant establishment effectiveness.

Operational noise compliance

Relevant conditions relating to operational noise performance include, Conditions 2.15 to 2.24,3.2 and 7.5(a). Together these establish the requirements for ensuring acceptable operationalnoise performance.

The OEMP includes a Revised Noise Assessment (RNA), Noise Compliance Plan and NoiseManagement Plan. These plans form part of the OEMP that has been approved by DPE on 5December 2013. The RNA was based on the Final Design layout.

Commencement of noise compliance monitoring requires the wind farm to be fully operationalwith all turbines operating so that the full impact of the wind farm is assessed. Monitoring fornoise compliance, in accordance with the Noise Compliance Plan is expected to be underway inDecember 2014. A report is expected 3 to 4 months after commencement of the monitoring.It is noted that, due to additional agreements reached with neighbours to the project, the NoiseOperating Strategy described in the OEMP is no longer necessary. The Noise ComplianceAssessment will be undertaken without the Noise Operating Strategy being implemented.

Biodiversity issuesConditions relating to biodiversity management include 2.33 and 2.35.

Condition 2.33 requires shut down of turbines POM 03, 04, 06 and 07 over evenings for a 4month period (December to March, inclusive). The shutdown of the four turbines is required tomitigate a potential risk to Powerful Owl fledglings during their dispersal period. As the Pomeroyturbines were installed first and able to be operated in summer of 2013/2014, the shutdown of theturbines in accordance with that condition was first undertaken during Summer of 2013/2014.

In addition, a recent avifauna survey undertaken in October 2014, was targeted at identifyingwhether juvenile Powerful Owls were present. A breeding pair was observed but no juvenile wasseen. The survey report indicated that while no juvenile was observed it was not conclusive thatno juvenile was present as the ecologists considered it was possible that the juvenile(s) mayhave already separated from the adults.

A review of the Little Eagle was also undertaken and provided to DPE, via Planning AssessmentCommission in association with its review of the Modification Application. A Collision RiskAssessment of impacts on the Powerful Owl has also been undertaken by Brett Lane andAssociates.

The impacts on avifauna are also subject to monitoring and adaptive management through theBird and Bat Adaptive Management Plan (BBAMP) that is required by Condition 3.1. The BBAMPhas been approved by DPE and an expert to implement the Plan has also been approved byDPE.

Condition 2.35 requires the implementation of a Compensatory Habitat Package (CHP). A CHPwas prepared and DPE approval given in letter dated 10/9/2012. The proposed mechanism toconfirm the CHP in perpetuity is by way of a Conservation Property Vegetation Plan (CPVP).Consultation had commenced with OEH and CMA in 2013, but following a site meeting with OEHin June 2014, a revised CHP has been prepared. The revised CHP was submitted to DPE viaPAC in August 2014. Further attempts have been made in September and October 2014, toprogress the finalisation of the revised CHP but neither, OEH or DPE, has been available for theconsultation required to progress this matter.A validation of the project’s impacts on native vegetation has been undertaken by NGH and therevised impact has been used to prepare the revised CHP.

Site rehabilitation also requires that effective weed monitoring and control programs areundertaken for the areas disturbed by the construction works. Appendix J of the OEMP providesa Weed and Pest Management Plan.

Notifications to aviation safety authorities and stakeholdersConditions 2.41 and 2.42 relate to management of aviation safety and include notification torelevant stakeholders of wind farm structures that could form a hazard to aircraft safety.

NGRWF has kept aviation stakeholders aware of the turbine locations since the beginning ofconstruction and recently updated the notifications when the final turbine was installed.

Notifications have included advice that all 73 turbines have now been installed together withsupply of location data for the 73 turbines, two permanent monitoring masts and two temporarymonitoring masts. Elevation data has also been provided for the ground level at the respectivelocations of the various structures and dimensions of the particular structure has also beensupplied. Each stakeholder has also been provided with the proponent contact details and beeninvited to contact the proponent if any questions or further information is required.

Management of bushfire riskConditions relating to management of bushfire risk include Conditions 2.43 to 2.46.

NGRWF maintains regular contact with the Rural Fire Service (RFS) in relation to bushfire risksand their management. Measures implemented for the project include:

Regular consultation with RFS (latest meeting was September 2014) Preparation of a Bushfire Risk Management Plan that was prepared in consultation with

RFS. Maintenance of fire-fighting equipment at the GRWF site office, at each turbine site and in

the on-site vehicles. Additional equipment is proposed for the operations phase once theconstruction contractor demobilises.

Provision of cleared zones around turbines and electrical plant. Maintenance of access tracks to all parts of the project infrastructure.

It is noted that the wind farm access tracks provide excellent access through the project area thatcould assist RFS management of bushfires in the locality.

Safety Management SystemCondition 2.47 requires that a Safety Management System is developed in accordance with theDPE’s Hazardous Industry Planning Advisory Paper number 9. A comprehensive SafetyManagement System (SMS) has been prepared and forms part of the Operations ManagementPlan (OMP). The provisions of the SMS have been mapped against requirements of the DPE’sHazardous Industry Planning Advisory Paper No. 9, to ensure that the relevant aspects areaddressed.

Electromagnetic interferenceConditions 2.54 to 2.56 address potential impact on television reception and interference to pointto point communication links.

A comprehensive pre-commissioning assessment of Television reception was undertaken inApril, 2012 by Aitken and Partners. The assessment involved 54 locations chosen to give arepresentative sample of television reception measurements within 5km of the wind farm.

As turbines have progressively transitioned from construction stage to commissioning andgeneration, NGRWF has consulted local residents in relation to TV reception and has beenimplementing measures to rectify any impacts attributed to the wind farm installation.

To date, 12 residents have contacted NGRWF in regards to effects on their TV reception. Onedwelling is outside the 5km zone required for assessment of impacts. Nine inspections havebeen undertaken by a local, independent, communications and TV specialist. Two furtherinspections are still to be completed with one scheduled for week commencing 17 November2014 and the timing of the other inspection to be confirmed.

Eight of the nine inspections undertaken to date confirmed that impact on TV reception, for theresidence location, can be reasonably attributed to the wind farm. As a consequence, NGRWFarranged for reasonable and feasible mitigation measures to be implemented at the eightproperties, with the Proponent being responsible for reasonable costs. The recommendedmitigation measure in all cases to date (as recommended by TV Specialist) has been a VASTsatellite system (either installation or modification of existing satellite system to incorporate theVAST system). VAST is a free to air satellite service providing digital TV to viewers in remoteareas of Australia. It has no ongoing costs.

In addition and separate from the requirements of Project Approval Conditions, NGRWF hasmade a commitment to a financial contribution to Upper Lachlan Shire Council to support theinstallation of a new TV antenna for Crookwell township locality that is expected to improvetelevision reception for the Crookwell township and nearby areas.

In relation to point to point telecommunications services, an assessment was undertaken of thecurrently licensed services and the proximity and clearances of relevant services to the installedwind turbines. The assessment was prepared by Lawrence Derrick and Associates in April 2014.It was appended to the Submissions Report, June 2014 and has been forwarded to NSWGovernment Telco, RFS and Telstra for consultation purposes. While the assessment does notconfirm an impact on any of the services close to the wind farm, further consultation with RuralFire Services (RFS) has been recommended to ensure that the RFS service between Mt Maryand Egans Hill is unaffected. With the commencement of the wind farm operations and theGurrundah turbines in particular, testing of the RFS link from Mt Mary to Egans Hill may bewarranted to confirm that it is unaffected by the turbine operations.

Community consultationCondition 5, Community Information, Consultation and Involvement, includes requirements formeasures to keep the community informed of relevant project details, applicable statutory contextand approval requirements and status of compliance reviews. This includes making relevantinformation available on the dedicated project web-site, establishing a Community InformationPlan (CIP) (Condition 5.3) and maintaining a complaints handling system and complaintsregister. These systems have been established and are being maintained.

The requirements of Condition 5.3, for a CIP include items (a) to (d) that relate to the constructionstage and items (e) and (f) that are applicable to the operations stage.

NGRWF also obtains support from KMH that utilises specialist software, ‘Consultation Manager’,to record consultation events between the proponent and a broad range of stakeholders.

In 2014, Goldwind appointed a Community Engagement Manager to address these matters as akey focus area with the objective of delivering improved consultation performance.

Community Enhancement ProgramCondition 5.6 requires preparation of a Community Enhancement Program (CEP) to be approvedby the Director-General.

A Community Enhancement Program was prepared and approved by DPE on 9 September2012. It includes two elements, a Community Fund and a Clean Energy Program. Both of theseelements are designed to benefit the local community. In response to a request by Upper

Lachlan Shire Council (ULSC), the CEP was updated on October 2013. The updated plan wasapproved by DPE on 13 September 2013.

ULSC manages the Community Fund Committee and has confirmed the committee membershipthat includes local community representatives and has also established procedures for theCommittee. The Committee is expected to be active from end of November 2014 once the windfarm is operational.

Environmental managementCondition 7.1 requires the involvement of an independent Environmental Representative to bethe Proponent’s principal point of advice in relation to the environmental performance of theproject. An Environmental Representative (ER) has been approved by DPE. The ER undertakesperiodic inspections of the project and undertakes consultation with key project staff to assessthe status of compliance and identify any improvement areas. The ER inspections to date, haveprimarily focused on construction and site restoration matters and have provided direction forimprovements as required.

The Operational Environmental Management Plan (OEMP) was approved by DPE on 5December 2013. It addresses a range of matters relevant to the operations stage of the windfarm and includes sub-plans in respect of matters such as noise compliance and mitigation,landscape screening.

Environmental reportingThere have been no “significant off-site impacts on people or the biophysical environment”(Condition 8.1) and no reporting to the D-G, of such incidents, has been required by NGRWF.

An Environmental Assessment, March 2014 was submitted to DPE in April 2014 that provideddetails of project implementation and a detailed assessment of project impacts. A submissionsreport (June 2014) and Report to Planning Assessment Commission (Aug 2014) have also beensubmitted to DPE. Consultation with DPE is undertaken as required and NGRWF is currentlywaiting for feedback on a revised CHP.

This POCR addresses a reporting requirement of Condition 6.1(b).

Beyond complianceA range of measures are regarded by NGRWF as going beyond compliance. These include:

Assistance and funding to secure Bannister Hall as a community resource Upgrade of local roads has involved expenditure of $5.8M is considered to have

exceeded the requirements for the project. Expenditure on road restoration, following completion of construction, significantly

exceeds the amount that was independently estimated based on detail dilapidationassessments.

Additional properties over and above those specified in Condition 2.25 have beenacquired or agreement reached for them to be ‘associated’ properties.

Local community sponsorships including Albion Hotel community bus and ‘Walk AgainstCancer’ fund raising event.

6. ConclusionsThis Report is submitted to DPE in accordance with requirements of Condition 6.1(b) andconcludes that:

A comprehensive program of actions has been implemented by NGRWF to ensurecompliance with the Project Approval Conditions.

Many requirements for the Construction Stage of the Project are complete. An OEMP has been approved by DPE and is being addressed by the proponent Programs to be initiated in conjunction with the operational status of the wind farm are

either underway or will be implemented during December 2014 or January 2015. NGRWF has also implemented a number of actions that go beyond compliance.

Progression of matters such as implementation of the Compensatory Habitat Package has beenhampered by lack of effective consultation from DPE. Completion of these matters will needparticipation of the relevant DPE/OEH officers in consultation on matters relevant to progressionof the matters.

The status of compliance with the Project Approval conditions is considered appropriate for thestage of the development.

A copy of the Report has also been submitted to the Environmental Representative.
