CANVASSING PRINCIPLES

Canvassing procedure is administrative and summary in nature.

ERs are accepted as valid and shall automatically be included in the canvass unless there is convincing proof of tampering, alteration or falsification.

CANVASSING PRINCIPLES

BBOCs are legally created bodies, which canvass all votes on ERs submitted to it by the respective BETs.

BBOCs power is limited to adding the vote tallies from the ERs and declaring the winners of the election.

BOARD OF CANVASSERS

One (1) BBOC in each barangay to canvass the ERs for the Barangay Election and thereafter proclaim the winning candidates.

EO shall constitute BBOC to be composed of a Chairman, Vice-Chairman and Member-secretary, who shall be chosen among the different Chairmen of the BETs In a barangay with only 1 BET, said BET shall convert itself as the BBOC.

SUPERVISION AND CONTROL

COMELEC has direct supervision and control over the BBOC.

BBOC member may, at any time, be relieved for cause and substituted motu proprio by COMELEC.

RELATIONSHIP WITH CANDIDATES AND OTHER MEMBERS

BBOC members shall not be related within the fourth civil degree of consanguinity or affinity to any:

barangay candidates or any member of the same BBOC.

PROHIBITION AGAINST LEAVING OFFICIAL STATION

Beginning October 28, 2013 until proclamation, BBOC member shall not be:

transferred;assigned or detailed outside of his official station,allowed to leave his official station without prior authority from COMELEC.

FEIGNED ILLNESS

BBOC member feigning illness in order to be substituted shall be guilty of an election offense punishable with 1 to 6 years imprisonment and perpetual disqualification to hold public office and to exercise the right to vote.

NOTICE OF MEETING OF THE BARANGAY BOARD OF CANVASSERS

At least five (5) days before the meeting of the BBOC, Chairman shall:

give Notice of Meeting to all members stating the date, time and place of the meeting.

PRELIMINARIES TO CANVASSING

October 28, 2013 Barangay Elections

BBOC for barangays with more than 1 BET shall meet at 6:00 pm on October 28, 2013 in the voting center of the barangay and shall forthwith canvass the ERs of the precincts within the barangay.

Canvassing shall be held in the voting center most accessible as determined by EO.

EO shall make corresponding report which voting center was used as canvassing venue to his PES, who shall likewise report the same to the RED.

STEP 1: The Secretary shall:receive the envelope containing the ERs record in the Minutes of Canvass

Chairman shall:examine the condition of the inner paper seal of ERs, while Secretary records in the Minutes the condition and SN of paper seal break inner seal, unfold ERs and exhibit it ,while secretary records in the Minutes the condition and SN of ERsproceed to canvass by reading votes of the candidate and entering the same in the Statement of Votes (SOVs), if there is no objection

STEP 4: After the ER has been canvassed, Chairman shall:

write on the upper right hand corner the word “CANVASSED”.affix below it his signature and date of canvassedreturn canvassed ER to its envelope.

STEP 5: When all ERs have been canvassed, Vice-Chairman and Secretary shall:

compare the entries in their respective copies of SOV

refer to ERs in case of discrepancy

initial all corrections together with all members of the BBOC.

If there are no discrepancies, the members of the BBOC shall affix their signatures above their printed names and imprint their thumbmarks on the certification portion of the SOVs.

CANVASSING PROCEDURE

BBOC shall prepare the Certification of Canvass and Proclamation and proclaim the winning candidates, after all SOVs have been completed

In barangays with only one (1) clustered precinct, the BBOC shall immediately accomplish in triplicate the SOVs and COCP and proclaim the winning candidates.

MATERIAL DEFECTS IN THE ELECTION RETURNS

There are material defects in the ERs when:Requisites in form or data have been omitted such as name of candidate and/or his corresponding votes

BBOCs shall:call all members of the BET by most expeditious meansdirect BETs to affect the correction require BET to complete necessary data regarding name of candidate and or his corresponding votes and affix their initials on the corrections COMELEC shall order the BET to open the ballot box and count the votes for candidates whose votes have been omitted, with notice to other candidates, if votes in the ERs cannot be ascertained

DELAYED, LOST OR DESTROYED ERs

BBOC by messenger or other means, obtain such missing ERs from:

BET, orUpon prior authority, if copy has been lost or destroyed, the BBOC may use any authentic copies of ERs and then direct its representative to investigate the case and immediately report the matter to the Commission.

DELAYED, LOST OR DESTROYED ERs

Even if the BBOC has not received all ERs , it may on the basis of available ERs:

candidates electionProvided that the missing election returns will no longer affect the results of the elections.

FALSIFIED OR TAMPERED ERs

When the Election Returns appear to be : tamperedaltered falsified not authenticprepared by persons other than BETprepared by BET under duress, force, intimidation

BBOC shall seek prior authority from COMELEC anduse another copy of ERs and, if necessary, the copy inside the ballot box.

DISCREPANCIES IN ERs

If discrepancies in the votes of any candidate affect the results of the elections, the COMELEC, upon motion of the BBOC or any candidate affected and after due notice to candidates shall:

proceed summarily to determine whether the integrity of the ballot box had been preserved order opening of the ballot box to recount the votes cast to determine the true results.disallow the recount of the ballots, seal the ballot box and order its safe keeping if there are signs of replacement. tampering, or violation of the integrity of the ballots.

HOW TO CORRECT MANIFEST ERROR

If discovered before proclamation, BBOC shall: promulgate an order in writing for the correctioneffect the necessary correction in the SOVs/COCP by crossing out the erroneous figures/entries with their initialsenter the correct figures/ entriesrecord in the Minutes the matter or fact of correction

APPEAL ON MANIFEST ERROR CORRECTION

Candidate aggrieved by the BBOC order may appeal to the COMELEC within 24 hours from promulgation.

Once an appeal is made, the BBOC shall not proclaim the winning candidate(s) unless the votes are not affected by the appeal.

If discovered after proclamation, BBOC or any aggrieved party shall file with the COMELEC an appeal seeking correction when manifest errors are discovered.

QUESTIONS AFFECTING ERs

All questions affecting ERs shall be: raised during the canvassdecided immediately by the majority vote of all BBOC members

BBOC decision shall be in writing and form part of the Minutes of the proceedings, and shall be final and immediately executory.

After all questions on ERs have been resolved, BBOC shall proclaim the winning candidates, without prejudice to the right of an aggrieved party to file an election protest.

ELECTIONS RESULTING IN A TIE

In case of a tie for Punong Barangay or first or last place for Sangguniang Barangay Kagawad, BBOC shall:

record this fact/information in the Minutes.by resolution, and upon 5 days notice to candidates concerned, hold a special public meeting for the purpose of drawing of lots between the candidates with tie votesproclaim as elected the candidate(s) who win in the drawing of the lots

ELECTIONS RESULTING IN A TIE

Other candidates who lost in the draw for the first place, shall automatically be the second placer. If more than 2 candidates tied for first place, rolled pieces of paper duly marked by the numbers “1”, “2”, “3”, and so on shall be made and candidates draws any one thereof, one after the other, and thereafter publicly open the same. Number of the rolled paper drawn by each shall decide their ranking.

ELECTIONS RESULTING IN A TIE

If the tie is for the position of Punong Barangay or for the 7th place for Kagawad, the one favored by luck shall be proclaimed the winner.

BBOC issues a certificate stating the name of the candidate who had been favored by luck and his proclamation is based thereon.

The losing candidate in the drawing of lot is not deprived of his right to contest the election.

CERTIFICATE OF CANVASS AND PROCLAMATION (COCP)

BBOC shall PREPARE the following:Certificate of Canvass and Proclamation (COCP) duly signed and thumbmarked by each member (4 copies).Statement of Votes is (SOVs) received by each candidate.

On the basis of the above documents, PROCLAIM the elected Punong Barangay and 7 Kagawads who obtain the highest number of votes.

Subject to reasonable exceptions, the BBOC shall complete the canvass within twenty-four (24) hours from the time first ER is canvassed.

Detainee voters shall be grouped/listed by district in cities with several districts

Only those who are in the custody of detention centers/jail facilities as of August 16, 2013 shall be included in the EDCVL-DV and PCVL-DV. The BJMP shall submit to the Committee on Detainee Voting the list of released detainees.

Detainee voters included in the EDCVL-DV but released before the elections shall be allowed to vote in the regular polling place where is registered. For this purpose, the SBET shall manually cross-out name of the released detainee in the EDCVL-DV.
