Note: Ensure that the correct HRSDC CDSB/CDSG Application Form is completed.Include all PCG information on the applicable grant forms. For beneficiaries age 18 at the time the application for the Disability Savings Plan is made andthose who turned 18 during the year of the application, the HRSDC form forBeneficiaries Aged 18 or Over must be completed. BMO Trust Company (the “Trustee”)will act as trusteeof an arrangement for aBMODisabilitySavingsPlan,underwhichcontributionsaretobemadeintrusttotheTrusteetobeinvested,usedorappliedforthepurposeofmakingpaymentstotheBeneficiary,andwheretheBeneficiaryiseligibleforthedisabilitytaxcreditinthetaxationyearthearrangementisenteredinto.Inenteringintothearrangement,theTrusteeagreestopayorcausetobepaidDisabilityAssistancePaymentstoaBeneficiary.ThearrangementwillbegovernedbythetermsandconditionsofthisTrustAgreement,the includedapplicationandApplicableLegislation.Underthe ITA,anAccountholder isknownasa“holder”andtheTrusteeisknownasthe“issuer”.NewAccountholdersarenamedintheincludedapplication.The Trustee may delegate the performance of any of the Trustee’s tasks, duties andresponsibilities in respectof thePlanand thePlanTrust toBMO Investments Inc. “Applicable Legislation”meansthe Income Tax Act (the“ITA”),theCanada Disability Savings Act (the“CDSA”)andtheirRegulationsthatgovernthisPlan,the propertyinthisPlan,andthepartiesinvolvedinthisarrangement.“Assistance Holdback Amount”hasthemeaningassignedundertheCanadaDisabilitySavingsRegulations.“Beneficiary”meanstheindividualdesignatedintheapplicationbytheAccountholder(s)to whom, Lifetime Disability Assistance Payments and Disability Assistance Paymentsshallbepaid.“Designated Provincial Program”meansaprogramthatisestablishedunderthelawsofaprovinceandthatsupportssavingsinRegisteredDisabilitySavingsPlans.“Disability Assistance Payment”meansanypaymentfromthePlantotheBeneficiaryortotheBeneficiary’sestate.Forgreatercertainty,aDisabilityAssistancePaymentmaybe,butneednotbe,aLifetimeDisabilityAssistancePayment.“Disability Savings Plan”ofaBeneficiarymeansanarrangementbetweentheTrusteeandoneormoreofthefollowing:a. theBeneficiary,b. (i) an entity that, at the time the arrangement is entered into, is a Qualifying

Personasdescribedunderthedefinitionof“QualifyingPerson”inrelationtotheBeneficiary,

(ii) if the arrangement is entered into before January 2019, a Qualifying FamilyMember in relation to the Beneficiary who, at the time the arrangement isenteredinto,isaQualifyingPersoninrelationtotheBeneficiary,

(iii) a Qualifying Family Member in relation to the Beneficiary who, at the timethe arrangement is entered into, is not a Qualifying Person in relation to theBeneficiarybutisaholderofanotherarrangementthatisaregistereddisabilitysavingsplanoftheBeneficiary,and

c. a legal parent of theBeneficiarywho is not aQualifyingPerson in relation to theBeneficiaryatthetimethearrangementisenteredintobutisanaccountholderofanotherRegisteredDisabilitySavingsPlanoftheBeneficiary,underwhichoneormorecontributionsaretobemadeintrusttotheTrusteetobeinvested,used,orappliedbytheTrusteeforthepurposeofmakingpaymentstotheBeneficiaryandwherethearrangementisenteredintoinataxationyearinrespectofwhichtheBeneficiaryiseligibleforthedisabilitytaxcredit.

“DTC-Election”meansanelectionmadebytheHoldertokeepthePlanopenwhentheBeneficiaryisnotaDTC-EligibleIndividual.ADTC-Electionisvaliduntiltheearlierofthebeginningof thefirst calendar year that theBeneficiary again becomes aDTC-EligibleIndividualandtheendofthefifthcalendaryearofcontinuousDTC-ineligibility.“DTC Eligible Individual”meansanindividualwhowouldbeeligibleforthedisabilitytax credit if subsection 118.3(1) of the ITAwere readwithout reference to paragraph118.3(1)(c)oftheITA.“Eligible Individual” means a child or grandchild of a deceased annuitant under aregistered retirement savings plan or a registered retirement income fund, or of adeceasedmemberofapooledregisteredpensionplan,aregisteredpensionplanoraspecifiedpensionplan,whowasfinanciallydependentonthedeceasedforsupport,atthetimeofthedeceased’sdeath,byreasonofmentalorphysicalinfirmity.“Eligible Proceeds”meansanamount(otherthananamountthatwasdeductedunderparagraph 60(l) in computing the Eligible Individual’s income) received by an EligibleIndividualasaconsequenceofthedeathafterMarch3,2010ofaparentorgrandparentoftheEligibleIndividualthatis(a)arefundofpremiums(asdefinedinsubsection146(1));(b)aneligibleamountundersubsection146.3(6.11);or(c)apayment(otherthanapaymentthatispartofaseriesofperiodicpaymentsorthat

relates toanactuarialsurplus)outoforunderapooledregisteredpensionplan,aregisteredpensionplanoraspecifiedpensionplan.

“Government Funded Benefits”meanstheCanadaDisabilitySavingsGrantand/ortheCanadaDisabilitySavingsBond.“Legislated Maximum Formula Result”means the resultof the formuladescribed inparagraph146.4(4)(l)oftheITA.“Lifetime Disability Assistance Payments”meansDisabilityAssistancePaymentsthat,aftertheybegintobepaid,arepayableatleastannuallyuntiltheearlierofthedayonwhichtheBeneficiarydiesandthedayonwhichthePlanisterminated.“Plan”meansthisarrangementestablishedhereunderandknownastheBMODisabilitySavingsPlan.“Plan Trust”meansthetrustgovernedbythePlan.“Qualifying Family Member”inrelationtoaBeneficiaryofadisabilitysavingsplan,atanytime,meansanindividualwho,atthattimeis

a. alegalparentoftheBeneficiary;or

b. aspouseorcommon-lawpartnerof theBeneficiarywho isnot livingseparateandapartfromtheBeneficiarybyreasonofabreakdownoftheirmarriageorcommon-lawpartnership.

“Qualifying Person”means:If the Beneficiary has not reached the age of majority at or before the time thearrangementisenteredinto:1. alegalparentoftheBeneficiary;2. aguardian,tutor,curatororotherindividualwhoislegallyauthorizedtoactonbehalf

oftheBeneficiary;or3. apublicdepartment,agency,orinstitutionthatislegallyauthorizedtoactonbehalf

oftheBeneficiary.IftheBeneficiaryhasreachedtheageofmajorityatorbeforethetimethearrangementisenteredintobutisnotcontractuallycompetenttoenterintothearrangement,QualifyingPersonwillmeananentityasdescribedinparagraphs2or3ofthisdefinition.Otherthanforthepurposeofacquiringsuccessororassigneerightsasdescribedinsection4,an individualwho isaQualifyingFamilyMember in relation to theBeneficiary isaQualifyingPersonifthefollowingconditionsaremet:a. TheQualifyingFamilyMemberopensthePlanfortheBeneficiarybeforeJanuary2019;b. AtthetimethePlanisopened,theBeneficiaryisnottheBeneficiaryofanotherRDSP;c. TheBeneficiaryattainedtheageofmajoritybeforethePlanwasenteredinto;d. NoentitythatislegallyauthorizedtoactonbehalfoftheBeneficiaryexist;ande. After reasonable inquiry, the Trustee determines that the Beneficiary is not

contractuallycompetenttoenterintothisPlanwiththeTrustee.“Registered Disability Savings Plan”meansaDisabilitySavingsPlanthatsatisfiestheconditionsofsection146.4oftheITA.“Specified Maximum Amount”meansthegreaterofthelegislatedmaximumformularesultandthesumof:• 10%oftheplan’sfairmarketvalue;and• allperiodicpaymentsfromlocked-inannuitycontracts.Thefairmarketvaluedoesnotincludeamountsheldinlocked-inannuitycontracts.Also,iftheplandisposesofalocked-inannuitycontractduringthecalendaryear,theperiodicpaymentamountwillcontainareasonableestimateofamountsthatwouldhavebeenpaidfromtheannuityintotheplaninthatyear.“Specified Minister”meanstheMinisterofEmploymentandSocialDevelopmentCanada.“Specified RDSP Payment” meansapaymentthatismadetothePlanafterJune2011thatisdesignated,inprescribedform,bytheHolderandtheBeneficiaryasaSpecifiedRDSP Payment at the time the payment is made. The payment is an amount thatoriginated from the registered retirement savings plan, registered retirement incomefund,specifiedpensionplan,pooledregisteredpensionplanorregisteredpensionplanoftheBeneficiary’sdeceasedparent(s)orgrandparent(s).Theamountwaspaidasarefundofpremiums,aneligibleamount,orapayment(withexceptiontoapaymentthatispartofaseriesofperiodicpaymentsorpaymentsthatrelatetoanactuarialsurplus)becauseoftheparent(s)orgrandparent(s)deathandtheBeneficiarywasfinanciallydependenton theparentorgrandparentbecauseofamentalorphysical infirmityat the timeoftheirdeath.“Specified Year”meanstheparticularcalendaryearinwhichamedicaldoctorlicensedtopractiseunderthelawsofaprovince(oroftheplacewheretheBeneficiaryresides)certifies in writing that the Beneficiary’s state of health is such that, in his or herprofessionalopinion, theBeneficiary isnot likely to survivemore thanfiveyearsand,if thePlan isaSpecifiedDisabilitySavingsPlan,eachsubsequentcalendaryear,or, inanyothercase,eachofthefivecalendaryearsfollowingtheparticularcalendaryear.Forgreatercertainty,aSpecifiedYeardoesnotincludeanycalendaryearpriortothecalendaryearinwhichthecertificationisprovidedtotheTrustee.2. PURPOSE OF THE PLANThePlanwillbeoperatedexclusivelyforthebenefitoftheBeneficiaryunderthePlan.The Beneficiary’s designation is irrevocable and no right of the Beneficiary to receivepaymentsfromthePlaniscapableofsurrenderorassignment.3. REGISTRATIONThefollowingconditionsmustbesatisfiedinorderforthePlantobeconsideredregistered:a. beforethePlanisenteredinto,theTrusteemustreceivewrittennotificationfromthe

MinisterofNationalRevenuethatprovidesapprovalofthespecimenplanunderwhichthearrangementisbased;

b. atorbeforethetimethePlanisenteredinto,theTrusteemustbeprovidedwiththenameandthesocialinsurancenumbersoftheBeneficiaryandeveryentitywhoentersintothePlanwiththeTrustee(inthecaseofanentitythatisabusiness,theirbusinessnumber);

c. atthetimethePlanisenteredinto,theBeneficiarymustberesidentinCanadaunlesstheBeneficiaryiscurrentlyaBeneficiaryunderanotherRegisteredDisabilitySavingsPlan;and

d. theBeneficiarymustbeaDTC Eligible Individual in respectof the taxationyear inwhichthePlanisopenedforhim/her.

The Plan will not be considered registered unless the Trustee notifies the SpecifiedMinisterofthePlan’sexistencewithoutdelay.Thenotificationmustbeinprescribedformcontainingprescribedinformation.The Plan will not be considered registered if the Beneficiary of the Plan is also theBeneficiaryofanotherRegisteredDisabilitySavingsPlanthathasnotbeenterminatedwithoutdelay.The Beneficiary and/or Accountholder maintain the sole responsibility of determiningeligibilityfortheDisabilityTaxCredit(DTC).IntheeventthattheTrustee/AgentreceivesnoticethattheBeneficiaryisnot/nolongerDTC eligible, the Trustee will make reasonable efforts to contact the Accountholder/Beneficiary.4. CHANGES IN ACCOUNTHOLDERAnentitymayonlybecomeasuccessororassigneeofanAccountholderiftheentityis:a. theBeneficiary;b. theBeneficiary’sestate;c. anAccountholderofthePlanatthetimerightsareacquired;d. aQualifyingPersoninrelationtotheBeneficiaryatthetimerightsunderthePlanare

acquired;ore. alegalparentoftheBeneficiarywhowaspreviouslyanAccountholderofthePlan.

Anentitymaynotexercisetheir rightsasasuccessororassigneeofanAccountholderuntil the Trustee is advised that theentityhasbecomeanAccountholderof thePlan.BeforeanentitymayexerciseitsrightsasasuccessororassigneeofanAccountholder,theTrusteemustbeinreceiptoftheentity’ssocialinsurancenumberorbusinessnumber,asthecasemaybe.IfanAccountholder(otherthanalegalparentoftheBeneficiary)ceasestobeaQualifyingPerson,heorshewillalsoceasetobeanAccountholderofthePlan.TheremustbeatleastoneAccountholderofthePlanatalltimesandtheBeneficiaryortheBeneficiary’sestatemayautomaticallyacquirerightsassuccessororassigneeofanAccountholderinordertocomplywiththisrequirement.AQualifyingFamilyMember(whoisaQualifyingPersonsolelybecauseofconditionsa)toe)undertheQualifyingPersondefinition)willceasetobeHolderofthePlan if theBeneficiarynotifiestheIssuerthattheywishtobecometheHolderandeithertheIssuer,after reasonableenquirydetermines thebeneficiary tobe contractually competent,ora competent tribunal or other provincial authority has declared the Beneficiary to becontractuallycompetent.AQualifying FamilyMember (who is aQualifyingPerson solely becauseof conditionsa)toe)undertheQualifyingPersondefinition)willceasetobeHolderofthePlanifanentitydescribedinpoint2or3oftheQualifyingPersondefinitionisgivenlegalauthorityto act on behalf of the Beneficiary. The entity will promptly notify the issuer of theirappointment, at which time the entity will replace the Qualifying Family Member asHolder.IfthereisadisputeoveraQualifyingFamilyMember’sstatusasHolder,theQualifyingFamilyMember(whoisaQualifyingPersonsolelybecauseofconditionsa)toe)undertheQualifyingPersondefinition)mustattempttoavoidareductioninthefairmarketvalueofthePlanTrust’sproperty.TheQualifyingFamilyMembermustapplythisrequirementuntilthedisputeissettledoranewentityisnamedasHolder.5. WHO MAY BECOME A BENEFICIARY OF THE PLANAn individual may only be designated as a Beneficiary of the Plan if the individualis resident in Canada when the designation is made, unless he or she was already aBeneficiaryunderanotherRegisteredDisabilitySavingsPlan.TheindividualmustalsobeaDTCEligibleIndividualinrespectofthetaxationyearinwhichthePlanisopenedforhim/herbeforedesignationasaBeneficiaryofthePlancantakeplace.AnindividualisnotconsideredaBeneficiaryofthePlanuntiltheAccountholderdesignatestheBeneficiaryontheapplicationbyprovidingtheBeneficiary’sfullname,address,socialinsurancenumber,gender,anddateofbirth.6. CONTRIBUTIONSOnlytheAccountholdermaymakecontributionstothePlanunlesstheAccountholderhasgivenwrittenconsenttoallowanotherentitytomakecontributionsintothePlan.Contributions may not be made into the Plan if the Beneficiary is not a DTC EligibleIndividualinrespectofthetaxationyearinwhichthecontributionismade.AcontributionmaynotbemadeintothePlanif:a theBeneficiaryisnotresidentinCanadaatthattime;b. theBeneficiaryturns59yearsofagebeforethecalendaryearthatincludesthattime;

orc. thetotalofthecontributionandallothercontributionsmade(otherthanasatransfer

inaccordancewithsection11)atorbeforethattimetothePlanortoanyotherplanoftheBeneficiarywouldexceed$200,000.

ContributionsmaynotbemadeintothePlaniftheBeneficiarydiedbeforethattime.AcontributiondoesnotincludeGovernmentFundedBenefits,paymentsfromDesignatedProvincialProgramsorpaymentsfromprogramssimilartoDesignatedProvincialProgramsthatarefunded,directlyor indirectly,byaprovince(otherthananamountpaidbyanentitydescribedinparagraph3ofthedefinitionofQualifyingPersonin itscapacityasholderoftheplan).Otherthanforthepurposesofthissectionandforthepurposesofsection10,aSpecifiedRDSPPaymentandanaccumulatedincomepaymentfromaregisterededucationsavingsplanarenot considered contributions to thePlan. Thesepaymentsarenot consideredadvantages in relationto theplan(theyarenotconsideredabenefitora loanthat isconditionalinanywayontheexistenceofthePlan).Any dishonoured cheques or other amounts that cannot be processed will not beconsideredtobeacontributiontotheAccount.7. INVESTMENTSThepropertyofthePlanTrustshallbeinvestedandreinvestedbytheTrusteeexclusivelyontheinstructionsoftheAccountholder(orofapersonauthorizedbytheAccountholder,inaformandmannersatisfactorytotheTrusteeortheAgent,tomanagetheinvestmentsoftheAccount).Thepropertymaybeinvestedininvestmentswhichrequiredelegation,suchasmutualfunds,pooledfundsandsegregatedfunds.ThepropertymaybeinvestedininvestmentswhichareissuedbytheTrustee,theAgentoranyoftheiraffiliates.BMOInvestmentsInc.willbethemutualfunddealerfortheAccountholderinconnectionwith the Plan. In its capacity as the mutual fund dealer for the Accountholder inconnectionwiththePlan,BMOInvestmentsInc.willbegovernedbythelaws,rulesandregulationsapplicable tomutual funddealers.Neither theTrusteenor theAgent shallhaveanydutyor responsibility,fiduciaryorotherwise (including, forgreater certainty,underanylegislationregardingtrusteeinvestmentdutiesandpowers)tomakeorchooseanyinvestment,todecidewhethertoholdordisposeofanyinvestmentortoexerciseanydiscretionwithregardtoanyinvestmentofthepropertyofthePlanTrust,exceptasotherwiseexpresslyprovidedinthisTrustAgreement.OtherthanitsdutieswithrespecttothePlanoritspropertyasexpresslystatedinthisTrustAgreement,theTrusteeshallnotberequiredorexpectedtotakeanyactionwithregardtoaninvestmentwithoutpriorinstructionsfromtheAccountholder.Neither the Trustee nor the Agent shall be responsible for determining whether anyinvestmentmadeon instructions isor remainsaqualified investment fora registereddisabilitysavingsplanundertheITAhowever,theTrusteeshallexercisethecare,diligenceandskillofareasonablyprudentpersontominimizethepossibilitythatatrustgovernedbytheRDSPholdsanon-qualifiedinvestment.8. RECORDKEEPING FOR THE ACCOUNTThe Trustee will record all contributions and transfers made to the Plan Trust, allinvestmenttransactionsandinvestmentearnings,gainsandlossesandalldistributionsandtransfersmadefromthePlanTrust.TheAgentwillprepareperiodicstatementsofaccountofthePlanTrustinaccordancewiththerules,regulationsandpracticesapplicabletomutualfunddealers.9. PAYMENTS FROM THE PLANNopaymentswillbemadefromthePlanotherthan:a. thepaymentofDisabilityAssistancePaymentstoaBeneficiaryofthePlan;b. the transferofanamount toanother trust that irrevocablyholdspropertyundera

RegisteredDisabilitySavingsPlanoftheBeneficiary,asdetailedinsection11;and

c. repaymentsofamountsundertheCDSAanditsRegulationsoraDesignatedProvincialProgram.

ADisabilityAssistancePaymentmaynotbemadefromthePlanifthefairmarketvalueofthepropertyheldbythePlanTrust,immediatelyafterthepaymentismade,wouldbelessthantheAssistanceHoldbackAmountinrelationtothePlan.WherethereisinsufficientcashinthePlanTrustatanytime,theTrusteeortheAgentshallmakereasonablerequestsforinstructionsfromtheAccountholderregardingwhichinvestmentsofthePlanTrusttoliquidateinordertorealizesufficientcashtomakethepayment.If,aftermakingreasonablerequestsfromtheAccountholderatthelastaddressprovided by the Accountholder, the Trustee or the Agent do not receive instructionssatisfactorytoitfromtheAccountholderwithinareasonabletime,theTrusteemay, inits discretion, liquidatepart or all of theproperty of thePlan Trust in order to realizesufficientcashtomakethepayment.AnysuchliquidationshallbemadeatsuchpricesastheTrusteemayinitsdiscretiondeterminetobethefairmarketvalueofthepropertyatthetime.LifetimeDisabilityAssistancePaymentswillbeginnolaterthantheendofthecalendaryear inwhich theBeneficiary turns60yearsofage. In suchacasewhere thePlan isestablished after the Beneficiary turns 60 years of age, Lifetime Disability AssistancePayments will begin in the calendar year immediately following the calendar year inwhichthePlanisestablished.IftheBeneficiaryreached59yearsofagebeforethecurrentyear,thetotalamountofall payments that are made from the Plan in the year must be at least equal to theLegislated Maximum Formula Result.LifetimeDisabilityAssistancePayments for a calendar year are limited to theamountdeterminedbytheLegislated Maximum Formula Result.10. DISABILITY ASSISTANCE PAYMENTSIf the total amount of all Government Funded Benefits paid into this and any otherRegisteredDisabilitySavingsPlanoftheBeneficiarybeforethebeginningofthecalendaryearexceedsthetotalamountofcontributionspaidintothisandanyotherRegisteredDisabilitySavingsPlanoftheBeneficiarybeforethebeginningofthecalendaryear,thenthefollowingconditionsmustbeadheredto:a. IfthecalendaryearisnotaSpecifiedYearforthePlan,thetotalamountofDisability

AssistancePaymentsmade in theyear fromthePlanwillnotexceedtheSpecifiedMaximumAmount.

When calculating the total amount, a transfer as detailed in section 11 is to bedisregardedifpaymentsaremadeinlieuofthosethatshouldhavebeenmadeunderthepriorplanoftheBeneficiaryasdescribedinparagraph146.4(8)(d)oftheITA.Atransferasdetailedinsection11istobedisregardedifthetransferismadeinlieuofapaymentthatwouldhavebeenpermittedtobemadefromtheotherplaninthecalendaryearifthetransferhadnotoccurred.

b. If theBeneficiaryhas reached27yearsofagebutnot59yearsofagebefore theparticular calendar year, the Beneficiary may direct that one or more DisabilityAssistancePaymentsbemade fromthePlan in theyearprovided that the totalofallDisabilityAssistancePaymentsmadefromtheplanintheyeardonotexceedtheamountimposedbytheconstraintsofparagrapha.ofthissection.ThesepaymentsmaynotbemadefromthePlanifthefairmarketvalueofthepropertyheldbythePlanTrust,immediatelyafterthepaymentismade,wouldbelessthantheAssistanceHoldbackAmountinrelationtothePlan.

c. IftheBeneficiaryhasreached59yearsofagebeforetheparticularcalendaryear,thetotalofallDisabilityAssistancePaymentsmadefromthePlanintheyearwillnotbelessthantheLegislatedMaximumFormulaResult.IfthepropertyinthePlanTrustisinsufficienttomakeavailabletherequiredamount,alesseramountmaybepaid.

11. TRANSFERSAtthedirectionof theAccountholder(s)of thePlan, theTrusteemaytransfer(out)allpropertyheldbythePlanTrustdirectlyintoanotherRegisteredDisabilitySavingsPlanoftheBeneficiary.TheTrusteewillprovidetheissuerofthenewplanwithallinformationintheirpossessionthatisnecessaryforthenewissuertocomplywiththerequirementsoftheApplicableLegislation.TheTrusteewillterminatethePlanimmediatelyfollowingthetransferintothenewRegisteredDisabilitySavingsPlanandthetransferwillbecompletedwithoutdelay.InadditiontoanyotherDisabilityAssistancePaymentsthatarerequiredtobepaidtothe Beneficiary in the year, if the Beneficiary is transferring an amount from anotherRegisteredDisabilitySavingsPlanandtheBeneficiaryattainedtheageof59yearsbeforethecalendaryearinwhichthetransferoccurs,thePlanwillmakeoneormoreDisabilityAssistancePaymentstotheBeneficiarywhosetotalwillbeequaltotheamountbywhich:a. thetotalamountofDisabilityAssistancePaymentsthatwouldhavebeenmadefrom

thepriorplanintheyearifthetransferhadnotoccurredexceeds;b. thetotalamountofDisabilityAssistancePaymentsmadefromthepriorplaninthe

year.TransfersofcashandotherpropertyacceptabletotheTrusteemaybemadetothePlanbythePlanholder.Acceptabletransfersinclude,transfersfromotherRDSPs,transfersofamountsreceivedasabeneficiaryofanRESP,RSP,anRPPoraRIF.TheassetsofthePlan(intheaggregate,the“Fund”)shallconsistofsuchcontributionsandtransfers,togetherwithanyincomeorgainsearnedorrealized,andshallbeheld,investedandappliedinaccordancewiththisTrustAgreement.12. TERMINATION OF THE PLANAftertakingintoconsiderationtheAssistanceHoldbackAmountandanyrepaymentsofamounts under the CDSAand its Regulationsor aDesignatedProvincial Program, anyremainingamountinthePlanwillbepaidtotheBeneficiaryortohisorherestate.Thisamountwillbepaidbytheendofthecalendaryearfollowingtheearlierof:a. thecalendaryearinwhichtheBeneficiarydies;andb. if the Plan remains open because of a DTC election, the first calendar year under

whichtheDTCelectionceasestobevalid,and inanyothercase, thefirstcalendaryearthroughoutwhichtheBeneficiaryhasnosevereandprolongedimpairmentasdescribedinparagraph118.3(1)(a.1)oftheITA.ThePlanmustbeterminatedbytheendofthecalendaryearfollowingtheearlierof:

(i) thecalendaryearinwhichtheBeneficiarydies;and(ii)if the Plan remains open because of a DTC election, the first calendar year under

whichtheDTCelectionceasestobevalid,and inanyothercase, thefirstcalendaryearthroughoutwhichtheBeneficiaryhasnosevereandprolongedimpairmentasdescribedinparagraph118.3(1)(a.1)oftheITA.

13. NON-COMPLIANCE OF THE PLANIf either the Trustee, theAccountholder, or theBeneficiaryof thePlan fails to complywiththerequirementsinrespectofRegisteredDisabilitySavingsPlansassetoutintheApplicableLegislationorifthePlanisnotadministeredinaccordancewithitsterms,thePlanwillbeconsiderednon-compliantandwillceasetobeaRegisteredDisabilitySavingsPlanatthattime.

At the time the Plan ceases to be registered, a Disability Assistance Payment will bedeemed tohavebeenmade from thePlan to theBeneficiary or, if theBeneficiary isdeceased,totheirestate,thatisequaltotheamountbywhichthefairmarketvalueofthepropertyheldbythePlanTrustexceedstheAssistanceHoldbackAmount.IfthePlanceasestoberegisteredbecauseaDisabilityAssistancePaymentismadethatresultsinthefairmarketvalueofthepropertyintheplanbeinglessthantheAssistanceHoldbackAmount,anadditionalDisabilityAssistancePaymentwillalsobedeemedtobemadefromthePlantotheBeneficiaryatthattimewhichisequalto:(i) theamountbywhichthelesseroftheAssistanceHoldbackAmountinrelationtothe

PlanandthefairmarketvalueofthepropertyheldbythePlanTrustatthetimeofpaymentexceeds;

(ii)the fairmarketvalueof thepropertyheldby thePlanTrust immediatelyafter thepayment.

Thenon-taxableportionofthispaymentwillbedeemedtobenil.IftherequirementsoftheApplicableLegislationarenotmet,thePlanwillceasetobeaRegisteredDisabilitySavingsPlanunlesstheMinisterofNationalRevenuewaivessuchrequirements.14. OBLIGATIONS OF THE TRUSTEETheTrusteewillforwardnotificationofanychangeinAccountholderunderthePlantotheSpecifiedMinisterinprescribedformcontainingprescribedinformationonorbeforethedaythatis60daysafterthelaterof:(i) thedayonwhichtheTrusteeisadvisedofthechangeinAccountholder;and(ii)thedayonwhichtheTrusteeisprovidedwiththesocialinsurancenumberorbusiness

numberofthenewAccountholder.TheMinisterofNationalRevenuemustapproveamendmentstothespecimenplanunderwhichthisPlanisbasedbeforetheTrusteecanamendthePlantermsandconditions.IftheTrusteediscoversthatthePlanisorwilllikelybecomenoncompliant,theTrusteewillnotifyboththeMinisterofNationalRevenueandtheSpecifiedMinisterofthisfactwithin30daysaftertheTrusteebecomesawareofpossibleorfactualnon-compliance.IftheTrusteeentersintothePlanwithaqualifyingfamilymemberwhoisaQualifyingPersonsolelybecauseofa-eunderthedefinitionofQualifyingPerson,above,theTrusteewillberequiredto:a. sonotifythebeneficiaryunderthePlanwithoutdelayinwritingandincludeinthe

notificationinformationsettingoutthecircumstancesinwhichtheAccountholderofthePlanmaybereplacedundersection146.4(1.5)or146.4(1.6)oftheIncomeTaxAct(Canada)(ITA).

b. collect and use any information provided by the holder that is relevant to theadministrationandoperationofthePlan.

IftheTrusteefailstocomplywiththeseobligations,theTrusteeisliabletopenaltiesassetoutinsubsection162(7)oftheITA.TheTrusteewillexercisethecare,diligenceandskillofareasonablyprudentpersontominimizethepossibilitythatanAccountholderofthePlanmaybecomeliabletopaytaxunderPartXIoftheITAinconnectionwiththePlan.15. THIRD PARTY ORDERS OR DEMANDS – AND INDEMNITYTheTrusteeand/ortheAgentshallbeentitledtobeindemnifiedbytheAccountholderinrespectofanycosts,expenses,chargesorliabilitieswhatsoeverthatmayariseoutoftheTrustee’sand/ortheAgent’sgoodfaithcompliancewithanylaw,regulation,judgment,seizure, execution, notice or similar order or demand which lawfully imposes on theTrusteeand/or theAgentaduty to takeor refrain from takinganyaction concerningthePlanorpartorallof thepropertyof thePlanTrust,or to issuepayment fromthePlan Trust, with or without instructions from the Accountholder or in contradiction ofinstructionsof theAccountholder. The Trusteeand/or theAgentmaypermit anydulyauthorizedpersontohaveaccesstoandtherighttoexamineandmakecopiesofanyrecords,documents,paperandbooksinvolvinganytransactionofthePlanorPlanTrustorrelatedtothemandshallsimilarlybeentitledtoindemnityoutofthepropertyofthePlanTrustforsodoing.IntheeventthepropertyofthePlanTrustshallbeinsufficienttoindemnifytheTrusteeand/ortheAgentfullyinanysuchregard,byestablishingtheAccounttheAccountholderagreestoindemnifyandholdtheTrusteeand/ortheAgentharmlessforanysuchcosts,expenses,chargesorliabilities.The Trustee/Agent retains the ability to restrict trading upon receipt of an order ordemand.TheTrustee/Agentwillnotbeliableforanydecreasesinaccountvalueduringtherestrictionperiod.16. OWNERSHIP AND VOTING RIGHTSThe Trustee may hold any property or investment of the Plan Trust in its own name,inthenameof itsnominee, inbearerformor insuchothernameastheTrusteemaydetermine.ThevotingorotherownershiprightsattachedtoanyinvestmentsheldinthePlanTrustmaybeexercisedbytheAccountholderandtheAccountholderisappointedastheTrustee’sagentandattorneyforthispurpose,toexecuteanddeliverproxiesand/orotherinstruments,inaccordancewithapplicablelaws.17. FEES, EXPENSES, TAXES, INTEREST AND PENALTIESTheTrusteeand/ortheAgentmaychargeadministrationandtransactionfees, insuchamountsandatsuchtimesasmaybefixedbytheTrusteeand/ortheAgentfromtimetotime,providedthattheTrusteeand/ortheAgentwillgivereasonablepriorwrittennoticetotheAccountholderofachangeintheamountofsuchfees.Suchfeesmaybepaidforoutof,orrecoveredfrom,thepropertyofthePlanTrust,totheextentthattheyarenotpaidwhenduebytheAccountholder.The Accountholder acknowledges that BMO Investments Inc. may charge fees,commissionsandexpensestothepropertyofthePlanTrustinitscapacityasthemutualfunddealerfortheAccountholder.TheTrusteeand/ortheAgentmaychargeexpensesincurredbytheTrusteeand/ortheAgentintheadministrationofthePlanandthePlanTrust.Suchexpensesmaybepaidoutof,orrecoveredfrom,thepropertyofthePlanTrust,totheextentthattheyarenotpaidonatimelybasisbytheAccountholder.All taxes, penalties, and interest applicable to thePlan, the Trustee, or thePlan Trust(butnot,forgreatercertainty,applicabletotheAccountholder)shallbechargedtotheAccountholder. Such taxes, interest and penalties will be paid by the Accountholder.ProvidedhoweverthattheTrusteeand/ortheAgentmaynotchargeorrecoverfeesorexpensestotheextentthatitwouldresultinthefairmarketvalueofthepropertyofthePlanTrustbeinglessthantheAssistanceHoldbackAmount.Subject to the paragraph above, the Trustee may, without instructions from theAccountholder,applyanycashheldinthePlanTrustforthepaymentoffeesorexpenseschargedtothePlanorthePlanTrust.WherethereisinsufficientcashinthePlanTrustatanytime,theTrusteeortheAgentshallmakereasonablerequestsforinstructionsfromtheAccountholderregardingwhichinvestmentsofthePlanTrusttoliquidateinordertorealizesufficientcashtomakethepayment.If,aftermakingreasonablerequestsfromtheAccountholderatthelastaddressprovidedbytheAccountholder,theTrusteeortheAgent

donotreceiveinstructionssatisfactorytoitfromtheAccountholderwithinareasonabletime,theTrusteemay,initsdiscretion,liquidatepartorallofthepropertyofthePlanTrustinordertorealizesufficientcashtomakethepayment.AnysuchliquidationshallbemadeatsuchpricesastheTrusteemayinitsdiscretiondeterminetobethefairmarketvalueofthepropertyatthetime.18. INSTRUCTIONSTheTrusteeandtheAgentshallbeentitledtorelyuponinstructionsreceivedfromtheAccountholderorfromanypersondesignatedinwriting, inaccordancewithapplicablelaws,bytheAccountholdertogiveinstructionsonbehalfoftheAccountholderorfromanypersonpurportingtobetheAccountholderorsuchdesignatedperson,asiftheywerefromtheAccountholder.TheTrusteeortheAgentmay,withoutincurringanyliabilitytotheAccountholder,theBeneficiaryoranyotherperson,declinetoactuponanyinstructioniftheinstructionisnotgiveninatimelymanner,isnotinwritingwheretheTrusteeorAgentrequireit,isnotinaformorformatwhichtheTrusteeorAgentrequire,orintheopinionoftheTrusteeorAgentisnotcompleteordoesnototherwisecomplywiththeTrustee’sorAgent’sotherrequirementsatsuchtime;orifanyofthemhasanydoubtthattheinstructionhasbeenproperlyauthorizedoraccuratelytransmitted.19. LIMITATION OF LIABILITY AND INDEMNITYNeithertheTrusteenortheAgentshallbeliabletotheAccountholderortheBeneficiary(or to the spouseor common-lawpartner of theAccountholder orBeneficiary, or anybeneficiaryorlegalpersonalrepresentativeoftheAccountholderorBeneficiary)foranylosstoordiminutionofthepropertyofthePlanTrustorforanyotherlosses,expenses,taxes,interestandpenalties,damages,claimsordemandsresultingfromanyoftheiractsoromissions,orforactinginaccordancewithinstructionsorfailingtoactintheabsenceofinstructions,excepttotheextentthatitiscausedbytheirnegligence,wilfulmisconductorlackofgoodfaith.TheTrusteeandtheAgentshallbeentitledtobeindemnifiedoutofthepropertyofthePlanTrustforallcosts,expenses,chargesorliabilitiesofwhatevernatureorkindwhichmayinanywayariseoutoforbeconnectedwiththisTrustAgreementorthePlanorPlanTrustexcepttotheextentthatsuchcosts,expenses,taxes,interestorpenalties,chargesorliabilitiesaredirectlycausedbygrossnegligence,wilfulmisconduct,lackofgoodfaithorbreachofApplicableLegislationonthepartoftheTrusteeortheAgent.IntheeventthepropertyofthePlanTrustshallbeinsufficienttoindemnifytheTrusteeandtheAgentfullyinanysuchregard,byestablishingthePlantheAccountholderagreestoindemnifyandholdtheTrusteeandtheAgentharmlessforanysuchcosts,expenses,chargesorliabilities.If,afterreasonableinquiry,theTrusteeofadisabilitysavingsplanisoftheopinionthatanindividual’scontractualcompetencetoenterintoadisabilitysavingsplanisindoubt,noactionliesagainsttheTrusteeand/ortheAgentforenteringintoaplan,underwhichtheindividualistheBeneficiary,withaQualifyingFamilyMemberwhoisaQualifyingPersonsolelybecauseofparagraph(c)ofthedefinitionof“QualifyingPerson”,above.IfadisputearisesasaresultoftheTrustee’sacceptanceofaQualifyingFamilyMemberwhoisaQualifiedPersonsolelybecauseofparagraph(c)ofthedefinitionof“QualifiedPerson”,above,asanAccountholderofthePlan,fromthetimethedisputearisesuntilthetimethatthedisputeisresolvedoranentitybecomestheholderofthePlanundersubsection146.4(1.5)or146.4(1.6)oftheITA,theAccountholderofthePlanshallusetheirbesteffortstoavoidanyreductioninthefairmarketvalueofthepropertyheldbytheplantrust,havingregardtothereasonableneedsoftheBeneficiaryunderthePlan.20. AMENDMENTSubjecttosection15,theTrusteemayfromtimetotimeinitsdiscretionamendthisTrustAgreementortheincludedapplicationwhichcomprisethePlanbygiving30dayspriornoticetotheAccountholder;providedhoweverthatanyamendmentshallnotdisqualifytheAccountasaRegisteredDisabilitySavingPlanacceptableforregistrationundertheITAoranyapplicableprovinciallegislation;andprovidedfurtherthatanyamendmenttoensurethePlancontinuestocomplywiththeITAmaytakeeffectonadatepriortothedatenoticeisgiven.21. REPLACEMENT OF TRUSTEETheTrusteemayresignupon60days’priorwrittennoticegiventotheAgent(orsuchshorternoticeastheAgentmayaccept).TheAgentmayterminatetheTrusteeastrusteeupon 60 days prior written notice given to the Trustee (or such shorter notice as theTrusteemayaccept).UpontheresignationorterminationoftheTrustee,theTrusteeshallbe releasedanddischarged fromall duties and liabilities under this TrustAgreement.WheretheTrusteeresignsoristerminated,theAgentshallappointasuccessortrusteewhoispermittedtobetheissuerofaRegisteredDisabilitySavingsPlanundertheITA.TheAgentshallgivetheAccountholderwrittennoticeofthesuccessortrusteewithin30daysoftheappointment.22. FAILING TO ATTAIN/LOSING REGISTERED STATUSThe Accountholder is solely responsible for ensuring that the information provided totheTrustee/AgentuponaccountopeningisconsistentwiththeinformationonfilewiththeCanadaRevenueAgency.TheAccountholderissolelyresponsibleforcontactingtheCanadaRevenueAgencytorectifyanyinconsistenciesinthisinformation.Intheeventthatanaccountfailstoattainregisteredstatus,orlosesitsregisteredstatus,theTrusteemaytreattheaccountinaccordancewithSection13Non-ComplianceofthePlan,above.23. NOTICEYoumaygiveus instructionsverbally,electronically,bypersonaldelivery,by facsimileorbymail,postagepre-paid,addressedtousortheAgentoranyotheraddressthatwedesignate,andshallbedeemedtohavebeenreceived,ifmailed,onthethirdbusinessdayaftermailingor,ifsentelectronicallyorbyfacsimiletransmission,onthedaysent.Wemaygiveyouanynotice,statementorreceiptbypersonaldeliveryormail,postageprepaid, at the address yougaveon yourApplication. If younotifiedus or theAgentaboutyournewaddress,anynotice,statementorreceiptfromusortheAgentwillbeconsideredtohavebeengiventoyouatthetimeofpersonaldelivery,orifmailed,onthethirdbusinessdayaftermailing.24. BINDINGThetermsofthisTrustAgreementshallbebindinguponthesurvivor,beneficiaries,heirs,executorsandadministratorsof theAccountholderandupon the respective successorsandassignsoftheTrusteeandtheAgent.ThisAgreementmaybeassignedbytheTrusteeatanytimetoapersonwhoispermittedtobetheissuerofaRegisteredDisabilitySavingsPlanundertheITA;howevertheAccountholdermaynotassignthisTrustAgreement.25. GOVERNING LAWThis Trust Agreement shall be governed by and interpreted in accordance with thelawsof the jurisdiction inCanada inwhich thebranchof theAgent (oranaffiliate) islocatedwheretheAccountismaintained.IfanyprovisionoflegislationreferredtointhisAgreementisrenumberedduetoachangeinlaw,thenthatreferenceistobeconsideredtobetotheprovisionasrenumbered.

Unclaimed Property.IfyourAccountorthesecuritiesinyourAccountbecomeunclaimedpropertywithinthemeaningofanyapplicablelegislationgoverningunclaimedproperty,wemaytakecertainactionsinaccordancewiththeunclaimedpropertylegislationthatisapplicableinyourprovinceofresidence,including:(i)advisingtheapplicablegovernmentagency,(ii)sellinganyorallofthesecuritiesinyourAccountforthepurposeofconvertingyour Account holdings into cash, or (iii) remitting any or all of the securities in yourAccounttoagovernmentagency.

No Waiver of Rights.WecandelayorrefrainfromexercisinganyofourrightsunderthisAgreementwithoutlosingthem.

No Transfer of Rights or Obligations.YoucannottransferanyofyourrightsorobligationsunderthisAgreementtoanyoneelse.

Successors and Assigns.ThisAgreementisbindingonyourheirs,executors,administrators,successorsandassigns.

Amendments. Unless otherwise provided for in this Agreement, we may change thisAgreementatanytimebygivingyou30dayspriorwrittennotice,whichmayincludecommunication via an electronic access device, and your continued use of one ormoreAccountsafterthedateoftheamendmentwillbedeemedyourconsenttosuchamendment.ThefirsttransactionintheAccountfollowingnotificationofachangetothisAgreementconstitutesyouracceptanceofthechangeasoftheeffectivedatesetoutinthenotice.YoucannotchangethisAgreementexceptbyawrittenamendmentsignedbyoneofourofficers.WemayterminatethisAgreementatanytimewithoutnotice.YoumayterminateyourAgreementwithusatanytimebygivinguswrittennoticebutsuchterminationwillnotaffectanyexistingliabilitiesorindebtednesstous.

Terminations. We have the right, in our sole discretion, to terminate and close yourAccountbyprovidingyouwithawrittennoticetothateffect.

Severability. In theeventany termorprovisionof thisAgreement,asamended fromtimetotime,isdeemedinvalidorvoid,inwholeorinpart,byanycourtofcompetentjurisdiction,theremainingtermsandprovisionsoftheAgreementwillremaininfullforceandeffect.

Other Documents.Theterms,rules,procedures,feesandchargessetoutinanywrittenorcomputer-generatedinstructions,manualsorothersuchdocumentsrelatingtoanAccountoranyServiceformpartofthisAgreement.

Governing Law.ThisAgreementwillbegovernedfromtimetotimebythelawsoftheCanadian province or territory where you have your residence. If you reside outsideCanada,thelawsofOntario,Canada,willapply.
