In exercise of the powers conferred by the proviso

to article 309 of the Constitution, read with the Go­

vernment of India, Ministry of External Affairs

letter No. F.7 (11) /62-Goa dated the 25th July, 1963,

the Admhlistrator of Goa, Daman and Diu is pleased

to make the ifolioWing rules relating to the recru1t­

ment to Class III and Class IV non-ministerial posts

hl the Directorate of ArChives under the Government

of Goa, Daman and Diu.

1. Short title. - These rules may be called Goa

Government Directorate of Archives Class ITr (non­

-ministerial non-Gazetted) and Class IV posts re­

cruitment rules, 1975:

2. Application. - These rules shall apply to the

posts specified in column 1 of the Schedule to these

rules.

3. Nllmber, classification and scale of pay. - The

number of posts, classification of the said posts amd

the scales of pay attached thereto shall be as speci-"v-'"

filed hl columns 2 to 4 of the said Schedule.

4. Method of recruitment, age limit and other

qualifications. - The method of recruitment to the

swid posts, age lhllit, qualificatioosand other matters

connected therewith shall be as specified in colll1lUJ8

5 to 13 of the aforesaid Scl1edule.

Provided that,

(a) the maximum age limit specified hl the

Schedule in respect of direct recruitment

may be relaxed in the case of candidates

belonging to the Scheduled Tribes and other

special categories in accordance with the

orders issued by the. Government from time

to time.

(b) no marle candidate, who has more than one

wife living and no: female candidate, who

has mrurried a person havhlg already a wife

living, shall be eligible for appointment

unless the Government, after having been

satisfied that there are special grounds for

doing SO exempts any such candidate from

the operaJtion of this rule.

5. These rules will come into effect from the date

of the Notification and will relate to appointments

to the various posts made on or after this date. An

appointment made prior to this date through a duly

constituted Staff Selection BoaI-d/Departmental Pro­

motion Committee will be deemed to be a regular

appointment, notwithstanding any provisions con­

tained in these rules, and the probation period in

that case will extend to six months only from the

date of this notification.

6. This issues in supersession of the recruitment

rules framed under Notification No. OSD/RRVS/53/

/67 dated 23rd July, 1971 published hl Government

Gazette Series I, No. 20 dated 12th August, 1971.

The Goa. Daman and Diu Administrative Tribunal {Amendment} Act, 1975

(Act No. 15 of 1975) [26th October. 1975]

AN ACT

to amend the Goa, Daman and Diu Ad1ninistrative Tribunal Act, 1965. Be it enaded by the Legislative Assembly of Goa,

Daman and Diu, in the Twenty-sixth Year of the Republic of India as follows:-

1. Short title and commencement. - (1) This Act may be called the Goa, Daman and Diu Admi­nastrative Tribunal (Amendment) Ad, 1975.

(2) It shall come into force at.'once.

2. Amendment of section 7. - In section 7 of the Goa, Daman and Diu Administrative Tribunal Act, 1965 (6 of 1965), after sub-section (i) the following shall be iuserted, namely:-

"(iA) In any proceeding, other than an original proeeeding, Wilich is pending before it, the Tribunal may, if it thiJnks necessary, direct that such further 'investigation be made, or such addi1Jional evidence be taken; or may itself take such additional evidence; or may remand the case for disposal witih such direction as it deems fit." .

to validate appointments of certailnofficers under the Goa, Daman and Diu Excise Duty Act, 1964,

Be it enacted by the LegiSlative AS\sembly of Goa, Daman and !Diu in tihe Twenty-sixth Year of the Republic of India as follows:-

1. Short title. - This Act may be called the Goa, Daman and DiuExciise Duty (Validation of Appoint" ments and Proceedings) Act, 1975.

2. Definition.-In this Act,-

(1) "Administrator" means the Adm'inistrator of the Union territory of Goa, Daman and DLu a~ pointed by the President under article 239 of the . Constitution;

(2) "appointment" means appointment as~-(a) Commissi'oner of Excise; or , (b) Assistant Commissioner of ExciSe; or (c) Superilntendent of Excise; or . (d) Excise Officer; or (e) Excise Inspector; or (f) Sub-Inspector of Excise; or (g) Excise guard.

3. Validation of certain appointments, levy of excise duty etc. - Notwithstanding anything con­tained in any judgement, decree, or order of any court, tribunal or other authority, -

(a) no appointment of any person made or purporting to have been made under or for the purposes of the Goa, Daman and Diu Excise Duty Act, 1964 5 of 1964 (hereinafter referred to as the prin-cipal Act), before the commencement of thlls Act, shall be deemed to be illegal or invalid, or ever to have been illegal or i!llvalod, merely on the ground that such appointment was not made in accordance with the promions of section 3 of the principal Act, or on the ground ~at such appointment was not made under that sectiion, or on bOth those grounds; arid . . '. .

(b) no levy or collection of any" ~uty, tax or fee, made or purporting to have been made under the principal Act, before the conuneneement of this Act, and no jurisdiction exercised, no' order made, and no other act or, proceeding or thing done or taken by, or before, a person referred to in clause (a) in relation to such levy or collection shalll be deemed to be illegal or [nvalid, or ever to have been illegal. or invalid merely on the ground that such jurisdiction was exercised or such order had been made or such other act or proceedings or thing had been done, or taken by, or b"fore, a person whose appointment was not made in accordance with or under the provi:sions of sectipn 3 of the prinCipal Act, and accordingly --

(i) all appointments made or purporting to have been made under or for the purposes of the principal Act, before the commencement of this Act, shall, for all purposes, be deemed to be; and to have been, made in accordance with

. law; (ii) the jurisdiction exercised, orders made

or by any other officer of that Government or hy any ,1Jribuna1 or other authority in connection with the sa;id appointments or in connection with the levy or collection of duty, tax or fee under the principal Act, shall for 3Ji1 purposes, he deemed to be and to have heen exercised, made, done or taken in accordance witih law; and

(iii) no suilt or other proceedings. shall be maintained or contiinued in any court or before any trihunal! or otiher authority whatsoever on the ground that any such appointment was illegal or invalid or any such jurisdiction, order or other ad, proceeding or thing <was not exer­cised, made, done or taken in accordance with law.

4. Repeal and saving. - (1) The Goa, Daman and Diu Excise Duty (Validation of Appointments and Proceedings) Ordinance, 1975 (1 of 1975) is hereby repealed.

(2) Notwitihstanding such repeal, anything done or any action taken under ,the slliid Ordinance so repealed shall be deemed .to 'have heen done or taken under th'is ActJ, as if ,this Act had commenced on the 28th June, 1975.

1. Short title and commencement. - (1) This Act may be called the Goa, Daman and Diu Mamlatdar's Court (Amendment) Act, 1975.

(2) It shall come into force at once.

2. Amendment" of section 22. - After sub-sec­tion (4) of section 22 of the Goa, DanIan and Diu Mamlatdar's CourtJ Act, 1966 (9 of 1966) the follow-ing Shall ,be 'nserted, namely: - '

"(5) While taking proceedings under this section if the Collector, or any officer authorised

under sub-section (3), is of the opinion that it is necessary to take such additional evidence he may remand the case for disposal with such direction as he deems fit.".

Be it enacted by the Legislative Assembly of G&a, Daman and Diu in the Twenty-sixth Year of the Republic of India as follows:-

1. Short title and commencement. - (1) This Act may be called the Goa, Daman and Diu Agricultural Tenancy (Amendment) Act, 1975.

(2) It shall come into force at once.

2. Insertion of new, section 7A. - After section 7 of the Goa, Daman and Diu Agricultural Tenancy Act, 1964' (7 of 1964) (hereinafter called the 'prin­cipal Act'), the following shall be inserted, namely:-

"7 A. Question as to nature of land. -- If any question arises as to whether any land is or is not used for agricultural purposes the Mam­latdar shall, after holding an inquiry, decide such question.".

3. Amendment of section 51. - In section 51 of the princtpal Act, after the word "may" and before the words "pass such other order", the words "re­mand the case for disposal with such direction as deemed fit or" shall be inserted.

Amendment of section 1. - In sub­-section: (4) of section 1 of the Goa, Daman and Diu (Protection from Eviction of Mundcars, Agricultural Labourers and Village Artisans) Act, 1971 (hereinafter referred to as the principal Act, for the words "four years" the words "six years" shall be substituted.

Be it enacted by the Legislative Assembly of Goa, Daman and Diu in the Twenty-sixth Year of the Republic of India as follows:

1. Short title and commencement. - (1) This Act may be called the Goa, Daman and Diu Protection of Rights of Tenants (Cashewnut and Arecanut Gardens) (Amendment) Act, 1975.

(2) It shall come into force at once.

2. Amendment of section 1. - In sub-section (4) of section 1 of the Goa, Daman and Dilu Protection of Rights of Tenants (Cashewnut and Arecanut Gardens) Act, 1971 (11 of 1971) (hereinafter refer­red to as. the "principal Act"), for the words "four years", the words "six years" shall be substi­tuted.

3. Insertion of new section 10. - After section 9 of the principal Act, the following shall be inserted, namely:-

"10. Exemptions. - The provisions of this Act shall not apply to lands leased or held by the Government or lands vested 'in the Custodian under the Goa, Daman and Diu Administration of Evacuee Property Act, 1964 (6 of 1964).".

4. Repeal and saving. - (1) The Goa, Daman and Diu Protection of Rights of Tenants, (Cashewnut and Arecanut Gardens) Amendment Ordinance, 1975 (2 of 1975), is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the prinCipal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act.
