I, Abraham Jacobus Raubenheimer, in my capacity as Minister of Water Affairs, determine, in terms of section 63 (2) of the Water Act. 1956 (Act 54 of 1956)" that the maximum extent of land within the Modder River and Lower Riet River Government Water Control Areas and in that portion of the Riet River Government Water Control Area mentioned below which may, from the date of publication hereof, be irrigated by means of water from a Government Water Work shall be as follows:

1. (a) The area of land on riparian properties within the Mooder River and Lower Riet River Government Water Control Areas (excluding properties situated within the Modder and Lower Riet River Irrigation District) and the properties Remaining Ed 5, Remaining Erf 6, Erven 10, 276. 278. 280. 281. 282, 285 and 286 of Ritchie. a

. portion 'of Doorns 131. Portions 1 to 13 and 16 to 18, Remaining Portion 19. Portions 48 and 49, Remaining Portion 20, Remaining Portion 23. Portions 24, 32, 45, 50 and 51 of Tweerivier 129 and Plots 381 to' 384 of Tweerivier 43 within the Riet River Government Water Control Area, which. in the opinion of the. scheduling board appointed by me in terms of section 64 (1) of the said Water Act. can be beneficially .irrigated after subtracting the extent of land which forms part of any piece of land which is already scheduled in terms of section 63 (7) of the said Water Act,. 1956, but not exceeding seventeen comma two (17,2) hectares per owner, as registered in the Deeds Registry on the date on which that land was included in any of the said Government Water Control Areas; or

(b) the area of land on riparian properties which, on the date on which those properties were included in any of the aforementioned Government Water Control Areas, was beneficially and legally irrigated withpul;>lic water after subtracting the extent of land which forms part of any piece of land which is already scheduled in terms. of section 63 (7) of the said Water Act, 1956, but excluding properties situated within the Modder. and, Lower, Riet

Furthermore I determine, in terms of section 63 (2) (b) of the said Water Act, that. if available, the maximum quantity of water which can be supplied annually from the Krugersdrift Government Dam for the irrigation of each hectare of land shall be as. follows:

(i) Eight thousand one hundred and thirty (8 130) cubic , metres (813 mm) for the area extending from the Krugers

drift Government Dam up to and including the Ryansdale Dam, including' the farms remainder of Ryansdale 685 on the right bank and Kalkbank 161 on the left bank;

(li) eight thousand six hundred and forty (8 640) cubic metres (864 rom) for the area extending downstream of the farms remainder of R yansdal~ 685 on the right bank and Kalkbank 161 on the left bank up to and including the Scholtzburg Dam and including the fanns Portion 1 of Qoorns 131 on the right bank and Portion 11 of Tweerivier 129 on the left bank;

(ill) nine thousand one hnndred and forty (9140) cubic metres (914 mm) for the area downstream of the aforementioned farms which is not included in the Modder and Lower Riet River Irrigation District; and

(iv) five thousand and eighty (5 080) cubic metres (508 mm) for the area situated within the MQdder and Lower Riel River Irrigation District

ESTATE AGENTS ACT, 1976

(ACT 112 OF 1976)

The Estate Agents Board. with the approval of the Minister of Economic Affairs. hereby publishes the following Draft Code appertaining to the general conduct of estate agents for purposes of general information and comment. "

Any comment should be forwarded to the Secretary Estate Agents Board. P.O. Box 315, Johannesburg, 2000, before 18 November 1977.

CODE OF CONDUCT 1. An estate agent shall

(1) conduct his business in such a manner as not to prejudice his reputation as an estate agent or that of other estate agents in general; . (2) protect the interests of his client at all times to the best of his ability, with due regard to the interests of all other parties concerned;

(3) display his fidelity fund certificate at all times in a prominent position in. his place of business;

(4) take all reasonable steps to ascertain and to convey. to . a purchaser /lessee or intending purchaser/lessee of a property in respect of which a mandate to sell/ lease has been given to him, all pertinent facts concerning such property;

. (5) furnish witho~t undue delay to all persons entitled U1~ret'?' or having an interest therein. a copy of every a$Ieement of sale, agreement of lease, offer to purchase0, other document relating to every property transaction to which he is a party as an estate agent;

(6) conduct his business mainly from proper and suitable business premises situated in an area approved by the local authority for general business purposes.

2. No estate agent 'shaU

(1) unreasonably criticise to any member of the public any other estate agent;

(2) directly or indirectly offer employment, either temporarily or permanently. to any person employed by an estate agent, while having full knowledge of such employment. without the latter'S knowledge and consent, provided that an employee of anoth~r estate agent who in response to an advertisement' or 'of his own initiative applies to him for employment may be engaged subject to hisinforrning the applicant's present employer within a reasonable time after the commencement of such engagement;

(3) canvass' custom for or advertise a property for sale through the medium of press advertisements purporting to be published by a private buyer or seller or containing only telephone or post office box numbers or newspaper accommodation address numbers;

(4) without restriction of the generality of the aforegoing, in advertising property for sale or for letting. wilfully mislead or exaggerate in regard to any matters pertaining thereto, including the property itself or the improvements thereon. the size thereof, the availability of services. the legal title and formalities. the price. terms of payment and loan facilities, municipal valuations. ~uilding. society valuations, and the cost price or replacement values of any land or improvements referred to in such advertisement;. }

(5) sanction or issue any advertisement which is not Jawful. decent, honest and factual;

(6) purchase directly or indirectly for himself.. or acquire any interest in any property which lie has been

, GEDRAGSKODE 1. 'n Eiendomsagent moet

(l) sy sakeondememing op so 'n wyse dryf dat dit nie sy reputasie as eiendomsagent of die van ander eiendomsagente in die algemeen benadeel nie; .

(2) die belange van sy klient te alle tye na sy beste vermoe beskerm. met redelike inagneming van die belange van aIle ander betrokke partye;

(3) te ane tye sy getrouheidsfondssertifikaat op 'n prominente plek op sy sakeperseel vertoon; ,

(4) aIle redelike stappe doen om aile tersaaklike feite met betrekking tot 'n eiendom ten opsigte waarvan 'n mandaat om te verkoop/verhuur aan hom gegee is. vas te stel en aan 'n koper /huurder of voornemende koper I huurder van die eiendom mee te deel;

. (5) sonder oormatige vertraging aIle persone wat daartoe geregtig.is of belang daarby het, voorsien van 'n kopie van elke koopooreen.koms. huurooreenkoins. aanbod om te koop. of anderdokumente wat betrekking het op elke,eiendomstransaksie waarby hy as eiendomsagent betrokke is;

(6) sy besigheid hoofsaaklik dryf vanaf 'nbehoorlike en geskikte sakeperseel.gelee in 'n gebied deur die

. plaaslike owerheid vir algemene besigheidsdoeleindes goedgekeur. 2. Geen eiendomsagent mag

(l) enige ander eiendomsagent onredelik kritiseer teenoor 'n lid. van die publiek nie;

(2) aan 'n persoon wat by 'n eiendomsagent in diens is, sonder sodanige eiendomsagent se wete en instemmingo direk of indirek werk, hetsy tydelik of vas, aanbied. weI wetende dat sodanige werknemer aldus in diens is nie: Metdien verstande dat 'nwerknemer van 'n ander eiendomsagent wat op eie inisiatief of na aanleiding van 'n advertensie by hom om 'n' betrekking aansoek doen. wei in diens geneem mag word,. mits hy die aansoeker se huidige werkgewerbmne 'n redelike tyd na sodanige indiensneming daarvan in kennis stel;

(3) 'n eiendom adverteer of klante daarvoor wed deur middel van persadvertensies wat voorgee gepubliseer te wees deur 'n private koper of verkoper of wat slegs telefoon. posbusnomers of koerantakkommodasieadresnommers bevat nie;

(4) sonder om afbreuk te doen aan die algemeenheid van die voorafgaande. wanneer hy 'n ~endom te koop of te huur adverteer. mislei of oordryf nie ten opsigte van enige tersaaklike aangeleentheid wat betref die eiendom self, of die verbeteringe daarop. die grootte daarvan, die beskikbaarheid van dienste, die regstitel en -formaliteite. die prys, betalingsvoorwaardes, leningsfasiliteite. munisipale waardasies, bouverenigingWaardasies. kosprys of vervangingswaardes van grond of vetbeterings in die advertensie gemeld;

(5) 'n advertensie magtig of uitreik wat rue wettig. fatsoenlik. eerlik en feitlik is nie; .

(6) eiendom ten opsigte waatvan hy 'n mandaat het om dit te verkoop. vir homself direk of ind.irek aankoop

given a mandate to sell, without the full knowledge and consent of the seller, or sell JUs own property or any property in'which he has any direct or indirect interest to any prospective purchaser who has retained his services. without, that purchaser having full knowledge of his ownership of, or interest in. such property;

(7) offer any property for sale or to let without the "prior written authority of the owner or his agent. which

authority shall clearly state whether it confers a sole agency or not;

(8) offer to provide either to a prospective client or to any third party any gift or favour, whether in cash or otherwise. calculated to secure a mandate or instructions for work;

(9) pay any fee or commission to a third party for orin respect of the introduction of a client unless such third party is an estate agent in possession of a valid fidelity fund certificate;

(10) except with the written consent of his client, directly or indirectly stipulate for or receive from any third party any reward or benefit for anything done by him in the course of or in connection with the services rendered by him to or on behalf of such client;

(11) act or offer to act in any capacity in relation to a matter which is the subject of judicial or quasi judicial proceedings either on the basis that no charge will be made unless the proceedings are successful or 'that the amount of the charge raised by him will be related to the degree of success attained;

(12) intentionally use' any information obtained from any other estate agent concerning any property or pending transaction relating thereto, to the prejudice of such other estate agent; .

, (13) directly OF indirectly. orally or in writing, seek instructions for work from' a prospective buyer or a prospective seller or a company or companies directly or indirectly controlled by or associated with a prospective buyer or seller, which work he knows or with reasonable 'care could have ascertained is being currently negotiated by another estate agent;

(14) in relation to a property of which or a prospective purchaser of whom particulars have been requested or obtained from another estate agent, negotiate ordeal directly or indirectly with the owner of that property -or that prospective purchaser save through that other

estate agent, provided that should that property be withdrawn from the market or the mandate of that other estate agent be terminated, all obligations by the former estate agent to the latter shall cease in respect of that property and purchaser; .

(15) through the medium of a company or third party, ,or using such company or third party as a front, do

anything which it would not be perrhissible for him to do if he were operating as an estate agent;

. (16) accept any mandate or instructions for work if his interest therein would conflict with his responsibilities to an existing client; ,

(17) attempt either directly or Indirectly to influence the transfer to himself or to any' other person of any J mandate or instructions for w9rk previously or presently held or undertaken by another estate agent;

(18) contravene or fail to comply with any provision of the Act, the regulations or this code of conduct;
