On Sunday August 2, 2020 at approximately 1055 hours I, Officer Darian JDasko, along with Officer Moen were on routine patrol eastbound E Iliff Aveat S Chambers Rd located in the City of Aurora, County of Arapahoe, State ofColorado. While on patrol, I observed a BOSS hit on a stolen vehicle hit the system atthe intersection of E Iliff Ave and S Chambers Rd. I had recognized the hitas I had seen it several times in the month of July. The hit was on a blueDodge Journey which was bearing Colorado license plate . I was ableto keep the photograph of the hit up to confirm the plate and see that thevehicle was indeed a blue Dodge. I was familiar with this vehicle since it has hit the BOSS system at theintersection of E Iliff Ave and S Chambers Rd a few times in the month ofJuly always westbound in either lane 2 or lane 3. I proceeded to check the area of E Iliff Ave and S Chambers Rd particularlythe parking lot located on the north side of E Iliff Ave which belonged toMc Donald's and Arc Thrift store. While searching through the parking lot, Officer Moen observed the vehicleparking in the above said parking lot facing westbound. I slowly droveeastbound through the parking lot where Officer Moen was able to see thelicense plate on the vehicle was indeed . At this time I maneuvered my vehicle around and aired to AuroraCommunications Center that I had located the stolen vehicle from the BOSShit, and our location. I exited my patrol vehicle with my duty weapon out.At this time I was only able to see the driver in the front seat and frontseat passenger. I hand gestured for the driver to roll the window downso she could clearly hear my orders which the driver complied. I advisedOfficer Moen to began giving orders to the front seat passenger to exit thevehicle. Officer Moen did such and the passenger exited the vehicle and wasordered into the prone position. At this time I observed movement inside thevehicle coming from the back seat which now I knew we had more occupants.Officer Moen began giving further orders to the back seat passenger to exitthe vehicle which they did. The passenger was a juvenile female which wasordered into the prone position.

As we believed all passengers inside the vehicle were out, a young juvenilewith a child approximately exited from the vehicle. The juvenilewas told to have a seat next to the parties prone out. I was able to looktowards the direction of Officer Moen and observed Officer Mason and OfficerDrexel with their duty weapons out not pointing at the juvenile or child,but did they them in the low ready position. I observed the driver of the vehicle did put both of her hands inside thevehicle reaching around. I gave orders to the driver to show me her handswhich she quickly obeyed. At no time did any Officer on scene run up to the juvenile female or childand point their duty weapon in their face nor where they put in hand-cuffs. Believing we now had all passengers out of the vehicle I proceeded onordering the female driver out of the vehicle. The driver was verballyaggressive yelling and cussing. As the driver was exiting the vehicle,she stated "the vehicle was reported stolen long ago." The driver wasordered into the prone position which she complied. I proceeded to gohands on with the female party who was later identified as Brittany Gilliam(DOB: . Gilliam began screaming and yelling more which made theyounger child cry. I aired the plate to Aurora Communications Center again which was CNK-737.Aurora Communications Center aired that yes the vehicle was stolen. Shortlyafter they aired again stating the stolen vehicle was a yellow motorcyclewith the same license plate . I knew at this time we had the wrongvehicle and it was a misread. Knowing this information, all parties whichwere detained were released from hand-cuffs. Due to a hostile crowd closing in recording Officers screaming and yellingobscenities a request for more Officers was made and supervisors to respond.There were police agitators on scene who were trying to make their wasthrough Officers to get to the parties we were in contact with. As I was releasing Gilliam from hand-cuffs, I tried to explain our mistake.Gilliam was very hostile towards Officers and stated she wanted to check onher kids which I allowed her to do without hesitation. Supervisors began to arrive on scene and speak to every involved. Using PIMS I was able to see that the vehicle was reported stolen February2nd of 2020. I did find a supplemental report where the vehicle wasrecovered on February 5th. I did approach the juveniles who were removed from the vehicle and apologizefor the mistake that was made. I also spoke with Ronald Gilliam (DOB:

who is Brittany Gilliam's father. I advised Ronald I was thefirst initial Officer to make the stop and also apologized for the mishap. Iissued Ronald my business card with the case number for this incident.

A business card was also given to Brittany with Officer Moen's attachedsince she does not have any issued to her yet. I remained on scene as security while supervisors and command staff spokewith all parties involved. An email was sent to Aurora Police Electronic Support Services to take thevehicle out if the system since it is a misread. This report is for documentation purposes only. All involved parties wereallowed to leave the area not charges pending. Body worn camera was activated this entire call. Nothing Further.

At approximately 1055 hours on 8-2-20, I, Ofc. K. Mason 313603, respondedto assist Ofc. Dasko and Ofc. Moen on a stolen vehicle stop at 16801 E IliffAve, City of Aurora, County of Arapahoe, State of Colorado. Prior to my arrival, Ofc. Dasko advised they had four at gunpoint. When Iarrived, I was on the passenger side of the vehicle behind Dasko's unit. Iwas with Ofc. Moen as the passengers individually exited the vehicle and layface down on the pavement. Ofc. Moen and I had our firearms out and at thelow ready. There were 3 females and 1 small child on the passenger side. Ofc. Moen began restraining the passengers. My mask loop had broken so Imaintained cover and distance. Other officers were arriving on scene. Agroup of irrational people began yelling at us and recording. At some point,an officer advised that the stolen vehicle record was on the same tag froma different state, I believe. I could not hear the radio traffic or muchof our face-to-face communication due to the antics of uninvolved parties. I had to tell one irrational white female several times to step back andrecord from a distance. By the time we were informed the stolen hit wasin error, two female passengers were handcuffed. Officers then removedhandcuffs from the subjects. Supervisors arrived on scene and spoke to the involved parties. I gavemy business card to Sgt. Wells. I avoided further communication with theparties. My body camera was activated.

WELLS 26212 On 8/2/2020 at approx 1055 hrs, I heard Ofc Dasko air that he was behind avehicle that had tripped the Fonix. at E Iliff Ave. and S. Buckley Rd. WB,as a stolen car. The vehicle stopped in the ARC Store parking lot located at16801 E Iliff Ave. I heard Ofc Dasko and his FTO recruit Ofc Moen re-air the plate andasked dispatch if the plate was stolen or the vehicle. Dispatch responded"the vehicle". Additional units were dispatched as Ofc Dasko called out ahigh risk stop. I was already enroute to the call based on aired communication that a crowdof people was forming and that uninvolved parties were yelling and filmingofficers. Ofc Drexel aired for a supervisor While enroute I spoke to Ofc Dasko by phone who said that the plate had hitthe Fonix several ties over the past weeks, but that the car would turnoff before officers could track it down. Ofc Dasko then informed me thatdispatch had informed him after the high risk stop that the plate was comingback to a stolen MC out of Montana. This SGT couldn't comprehend how thevehicle could be clear but clearly showing as a STOLEN FONIX HIT. Daskosaid he tried to explain the situation to the driver but that she wanted asupervisor. ** It should be noted that while I was speaking to Ofc Dasko I could hearnumerous parties yelling and screaming in the back ground. Based on this Iasked for the help of CR23 and two additional cars from D2 to assist. Upon my arrival I observed numerous parties near the scene, yelling atofficers and stating they were recording on Facebook Live. The parties weremaking anti-police statements and yelling about "babies being handcuffed andguns pointed at them". As I approached the scene SGT Lopez was trying to speak to the adult driverof the vehicle later identified as : Brittany Guilliam.

Gilliam would yell and talk over SGT Lopez and would not allow him to speak.I too encountered this with several of the people on scene. Every reasonableeffort was made to calm the situation and mitigate the interference from theantagonists. Guilliam wanted a Watch Commander even after we tried to explain that thecar had been listed as stolen a month earlier, had been tripping police databases as stolen, and did so again on this date. Lt Tollakson arrived and spoke to Guilliam away from the crowd. SGT Lopez was able to extract the hit from the BOSS system. I took a photoof the hit from the MDC. This photo evidence was shown to the involvedparties to no avail. Officers continued to be verbally disparaged by the crowd. Lt Tollaksonadvised we could clear at approx 1205 hours. On 08/02/20, I was assigned as a Sgt to Dist 2 Patrol. At approximately 1050hrs, I was contacted by D3 Sgt Dave Wells who asked me if I could respond to16801 E. Iliff Ave where D3 officers had conducted a High Risk Traffic Stopon a suspected stolen vehicle. When I arrived on scene, I observed several parties shouting at the officersalready on scene and pointing their cell phones at the officers. I thencontacted Officer Dasco and asked him what had happened. He advised me that he and he and his recruit stopped a vehicle that hadtripped the FONIX system as a stolen vehicle several times this morning. Thehis included a photo of CO license plate . They located the vehicleand conducted a high risk stop. Immediately after the occupants were ordered out and placed into handcuffs,dispatch notified them that the plate listed in the hit, listed to amotorcycle. The occupants were immediately removed from the handcuffs at which time herequested a supervisor. He directed me to the driver of the stopped vehicle. She identified herselfas Brittney Guilliam As I approached her, she looked at me andstated "you're a Sergeant", and began shouting at me, informing me that theofficers pointed guns at her and her children, saying she was in a stolencar. I attempted to explain the circumstances to her several times however shecontinued to interrupt me, not allowing me to give her an explanation. I then requested for the WC to respond. Moments later, a gentleman arrived on scene who was appeared to becooperative and was listening to what was being explained. I asked himwho he was, he advised that he was Brittney's father, (officers on scenegathered his information prior to my contact. I explained the situation tohim and showed him the actual FONIX hit on my computer, explaining to himhow the mistake was made.

On Sunday August 2, 2020 at approximately 1055, while on routine patrol withmy FTO Officer Dasko, a vehicle crossed the BOSS system at E. Iliff and S.Buckley Rd that was flagged as a stolen vehicle. The vehicle photographed was a blue Dodge Journey with Colorado licenseplate CNK-737, headed westbound in lane 3. I was going eastbound on E. Iliff Ave and upon reaching S. Buckley Rd.decided to turn into the parking lot of the ARC thrift store on thenorthwest corner (16801 E. Iliff Ave.). While in the parking lot I observedthe vehicle parked in the center ARC thrift store parking lot. Upon sight of the vehicle, I confirmed the license plate ( ) andOfficer Dasko notified dispatch we were with the vehicle which had 3occupants. We proceeded to pull up behind the parked vehicle and initiate a high riskvehicle stop, at which time I un-holstered my duty weapon, gun pointing thepassenger side of the vehicle. I ordered the passengers to put their hands outside of the window. I thenordered the front passenger to exit the vehicle and proceeded put her intothe prone position next to the vehicle. Next, I ordered the rear passengerto exit the vehicle whom I placed in the prone position next to the otherpassenger. After having what I believed to be the only 2 occupants on the passengerside exit the vehicle, a female and a child exited from the rear passengerside of the vehicle. I had the female with the child lay on the ground nextto the 2 proned occupants. At no time was the female or young child held at gun point or placed intohand-cuffs. At this time, a large crowd with cameras started yelling and circling thescene.

After all occupants were under control, I placed two females into handcuffs.The female with the child was told to remain with the child and stay whereshe was. The driver, on the driver side began to scream and yell to the occupantson the passenger side making them visually upset. The passengers began toscream and cry. The passengers were all sat up and asked if they needed medical attention,to which they declined. Shortly after, dispatch advised that the license plate was a misread and thelicense plate number belonged to a yellow motorcycle. At which time the 2passengers were immediately removed from handcuffs. I remained on scene for security until a supervisor arrived. Body camera worn and utilized. NFAT.

On 08/02/20 at approx 1055 hours I, commissioned Aurora Police OfficerHanson (314424) was dispatched to 16801 E ILIFF AVE @ARC THRIFT STORE whenOfficer Dasko called out over the police radio he had three at gun point inthe City of Aurora, County of Arapahoe, and State of Colorado. When I arrived on scene noticed three females and a small child in theprone position as per policy for high risk stops. Officer Moen was placinghandcuffs on one female on my right as Officer Mason had her duty pistolat the ready assisting Officer Moen as per policy. Since Officer Mason wascovering Officer Moen, I drew my Taser to provide less lethal coverage. Once the second female was handcuffed I holstered my Taser then made thedecision to pat down the third woman with the small child and not have herplaced in handcuffs as a large crowd developed, was extremely agitated, andencroaching on our position. I walked to speak to Officer Dasko about the incident he immediatelyinformed me the vehicle license plate was a miss-read, I immediately turnedand announced to the Officers near me to un-handcuff all parties. Through out the encounter I asked repeatedly if all parties needed medicalattention which they denied. When I was holding the scene, I was advised by Sgt. Lopez to stay in thevicinity, but leave the immediate area, which I did until instructed toleave the scene completely. My body camera was on for the incident. END OF REPORT

On Sunday, August 02, 2020, at approximately 1055 hours, I, Officer Drexel(317745), was dispatched to a motor vehicle theft recovery located at, 16801E Iliff Ave, City of Aurora, County of Arapahoe, State of Colorado. When I arrived as the third unit on scene in my marked patrol vehicle.I observed a crowd of bystanders closing in slowly to the scene prior toexiting my patrol car. Most of the bystanders had their cellphones outrecording Officers on scene. When I exited my vehicle I observed five people prone out and I drew mytaser for a less than lethal option due to Officer Mason had her dutyweapon drawn in the ready position. There was a lot of yelling from thesubjects on the ground and from the bystanders. I made my approach to the four subjects who were prone out on the rearpassenger side of the vehicle. I observed the individual who had been proneout in front of me did not appear to be a threat and holstered my taser. Theindividual in front of me appeared to be approximately less than ofage. Officer Hansen who was to my right holstered his taser and conducted did apat-down of the subjects on the passenger side of the vehicle. I observed Officer Dasko, on the driver side of the vehicle, by himselfassist, Brittney Gillian off the ground to her feet and Iassisted him in escorting her to the rear of his vehicle. I took and helpedher safely enter the backseat of the patrol vehicle. I stayed with Brittneywhile Officer Dasko attempted to confirm the plates had been stolen. Duringthat time Brittney kept yelling and scream at us. When she would ask aquestion for us to answer, she would shout over us when we attempted tospeak to her. Brittney had asked, by yelling at me, if her daughters had been handcuffed.I advised her that the youngest female who had been prone closest to herhadn't been handcuffed prior to Brittney being escorted to the patrolvehicle. She continued to yell and appeared to become more agitated anytimean officer would help with answering her question by speaking over them.

Officer Dasko then advised Officer Hanson that the plates were clear andwere not stolen. At that time all subjects who had handcuffs on had themremoved and were no longer detained. Brittney walked back to her vehicleverbally upset at the Police by yelling. I had held the scene by standing near my patrol vehicle. The bystandersmade it known they dislike the Aurora PD by making anti-police statements.I overheard a bystander stat they were recording this incident live on theirphone. I helped with controlling the crowd and tried to keep the peace. When the scene had calmed down, Seargent Wells advised me to leave the sceneand I followed his order. This concluded my involvement in this case. My body-worn camera was activated.

Tollakson #19116 / L30 ofthe District 3 Patrol Commander's Office) was in the D3 building when Iheard radio traffic from "Cruiser 23" (Later identified as Sgt. E. Lopez)requesting the Watch Commander respond. As a part of my duties I monitor allthree primary APD Dispatch (PSCD) radio channels and all three primary APD"TAC" channels in addition to making and receiving phone calls. I received aphone call from PSCD almost immediately asking me to respond to a scene. The call notes indicated that this call was for a high-risk traffic stop fora stolen vehicle (Later determined not to be stolen) and that a crowd hadformed and was recording and goading the officers. I responded to 16801 E.Iliff Av. (ARC Thrift Store) parking lot to assist. While I was responding

I was reaching out to Sgt. Lopez to find out what was happening and to seeif there was the ability to disengage/deescalate by having the concernedparties move away from the crowd. I was told that this would not work as thecomplainant wanted to have everything recorded. I arrived at the scene in my marked watch commander vehicle and activated myAPD issue Body Worn Camera (BWC). Officer Dasko came up to me and told methat he had made a contact on a vehicle that had been flagged as stolen bysurveillance. That this same vehicle had been flagged earlier this week aswell. He conducted a high risk stop and had removed persons from the vehiclewith the assistance of other APD members. That these persons were detained/handcuffed with the exception of the That shortly after thishe learned that the "hit" was inaccurate and returned to an out of statemotorcycle with the same license plate number. They immediately unhandcuffedthe persons but that the party that had been in the driver's seat did notwant to talk to him. I was directed to this person (She later verbally identified herself to meas: BRITTNEY GILLIAM

E: I located additionalinformation within APD Versadex as I was composing the AIM complaint) whowas pointed out to me as the driver of the vehicle (2009, BLUE, DODGE,JOURNEY, CO/LP ). I spoke briefly with a Male, Black, Adult, who toldme he was her (Driver) father (I later learned that this party was a RonaldWayne Gilliam and he assisted me by calling over the driver towhere we were able to get away from the crowd and speak. I had introduced myself to this driver who told me her name was Brittney.I had pointed out that I had just arrived and did not know what all hadhappened. She then told me that she and some children (I don't recall ifshe said they were her children and I do not recall the specific ages butI believe two were teenagers and two were not with one beingI later learned that the ages were but I do notknow their names as I have not received the email from B. Gilliam yet).They were stopped in the parking lot and she became aware of police behindher car (She was in the driver's seat, but the car was parked/stopped)with guns out. That she did not know what was going on and asked what wasgoing on while the officers were giving orders but did not get an answer.That she and the children complied and were ordered out of the car andhandcuffed. That this was her sister's car she had and that it had beenstolen earlier in the year but was not stolen presently. That she was upsetthat police pointed guns at them and specifically the children and that theywere handcuffed. I am not sure of the exact sequence of events, but she did mention that sheworked for the Denver County Sheriff's Office. I asked if she was a Deputyand se told me she was a Security Specialist and that she was applying tobe a Deputy. I had made mention that depending on her training it wouldexplain some of what happened (It is not uncommon for persons in stolencars to be armed and it was also not uncommon for suspects to be teenagers

to include females) as she had stated to the effect that teenage femaleswere not stealing cars. She had also made a somewhat unusual comment tothe effect of she knew "black people did things" (I am unsure of the actualquote, but it should be available on my BWC footage). I attempted to explain what I believed happened in this incident regardingthe reason for the stop. That the car listed as being stolen and she hadmade mention that it had been stolen earlier in the year, but she did notrecall specifically when. I had surmised that there was a possibility thatit was not removed from the system and that it still showed as stolen (Imade no accusations but did state that something failed in this instanceregarding the information on the car). I would note that I did not haveany time to research this matter as I wanted to get to the scene to try andget this matter resolved and defused so I did not know what had actuallyhappened other than the car was believed to be stolen from the Fonix hit andwas determined to not be stolen. I also agreed with her being upset about this instance (I would have beenupset too) and apologized to her for this incident/inconvenience. I asked ifshe wanted to pursue a complaint to which she told me she would like to doso. I then obtained her name and basic information for the complaint. I hadprovided my business card with the case number and we discussed her sendingme an email so she could outline everything in her own words (I had alreadycovered the different methods to make a complaint and this is the one sheselected where I would take her complaint now with her email to me providingfurther information on her complaint). At one point she said something to the effect of what are they doing to thekids and she walked away from me and toward the car where there were severalpeople. As there were still several persons in this area that I did not wishto "ramp up" further. I went to the party that had identified himself as herfather and he assisted me again with getting Brittney to come away from thecrowd so we could speak further. At the conclusion of our conversation where we were discussing her email tome, I had asked for as much detail as she could provide to include names/ages of the children. I would have preferred to speak with her further toobtain this information on scene, but I also wanted to reduce the risks ofsomething going wrong with the crowd and having a larger incident wherepersons could be hurt or worse. I then walked with her back to the car andasked if she had any questions of me about this matter to which she saidshe did not. We shook hands at the conclusion of our time together. I wouldalso note that while she was visibly upset, she and I spoke with each othercivilly and in conversational tones. I also spoke briefly with B. Gilliam'sfather to see if he had any questions for me, which he did not. I then had all the APD unit clear this scene so things in the area wouldreturn to a more normal state and to reduce the chances of additionalconfrontations.

I received a picture of the Fonix hit which showed the car in question andthe license plate. I will be adding this picture to the complaint. I wasable to get the basic information for her complaint to be entered into theAPD AIM system that is used to document complaints. I was equipped with an APD issue Body Worn Camera (BWC) and had it activatedfor this incident. This report is not intended to be a transcript of my observations andactions but rather to be a synopsis of events that I was aware of. For themost accurate timelines of events, please refer to my BWC recordings. Forfurther information please refer to the other reports authored by respondingAPD members. On Monday, August 03, 2020 around noon I was advised that two (2) internalAPD codes were not entered into the call notes for this incident. Thesecodes are used so certain types of force can be searched within the system.I went to PSCD and they were able to assist me in getting back into thecall notes under #P200243328 (Which became APD Case #2020-26380). I thenentered the codes TZG and TZH into the call notes. These codes indicate thata firearm was pointed at one or more persons and that one or more personshad been handcuffed respectively. As of 4:35 p.m. I have not received anemail from B. Gilliam. When I receive her email, I will ensure that it isforwarded/included in this overall complaint. I will be completing the initial complaint in the APD AIM system and routingit to the APD Internal Affairs Unit for further inquiry into this matter. Currently, I do not have any other information reference this matter. Inthe event more information becomes available to me I will document this newinformation on additional supplemental reports.
