MINUTES OF THE SPECIAL MEETING OF THE GOVERNING BOARD School District No. 40 of Maricopa County, Arizona District Office Governing Board Room June 21, 2017 Present: Ms. Mary Ann Wilson, President Mr. Jamie Aldama, Clerk * Ms. Brenda Bartels, Member Ms. Sara Smith, Member Ms. Monica Pimentel, Member* *Participated by telephone. CALL TO ORDER AND ROLL CALL The meeting was called to order by Ms. Wilson at 4:45 p.m. She noted the presence of all five Board members, with Mr. Aldama and Ms. Pimentel participating telephonically, constituting a quorum. OPENING EXERCISES Ms. Wilson welcomed everyone and thanked them for coming. She called for a moment of silence followed by the Pledge of Allegiance. Ms. Bartels moved to adopt the meeting agenda and Ms. Smith seconded the motion. Upon call to vote, the motion carried. Ms. Smith moved to approve Ms. Bartels as the acting clerk in Mr. Aldama’s physical absence. Ms. Bartels seconded the motion. Upon call to vote, the motion carried. REPORTS AND INFORMATION ITEMProposition 206 The Administration provided information regarding Proposition 206 legislation and

related earned paid sick time and connections to required changes to governing board policies regarding leave. Ms. Jennifer MacLennan, District counsel, addressed the Board regarding the legal requirements set forth in Proposition 206 related to the accumulation of sick leave time. The Governing Board was provided with proposed revisions to the associated Board policies that will be brought forward for their consideration at a future meeting. The primary issues are regarding the accumulation of leave, payout of unused leave, and how leave is made available to employees.

Ms. Bartels asked if the language would be inclusive of domestic partners, and Ms. MacLennan confirmed it does. Additional questions were raised regarding legalities and the impacts of the proposed changes.

Mr. Quintana noted the need for a special meeting to be called next week for the Board to take action to adopt the proposed policies. Ms. Powell will contact Board members individually to arrange this meeting.

ACTION ITEMSEmployment of Principal Mr. Quintana recommended that the Governing Board approve the employment of Ms.

Andrea Arellano as Principal of Discovery School, salary and benefits commensurate with other Principals. Ms. Bartels moved to approve the recommendation as stated and Mr. Aldama seconded the motion. Upon call to vote, the motion carried.

Proposed Expenditure Budget Mr. Quintana recommended that the Governing Board approve the Proposed

Expenditure Budget for Fiscal Year 2017-18 as presented. Mr. Barragan reviewed the following presentation.

Ms. Wilson inquired about the effective date of the teacher salary increase. Mr. Barragan stated the salary increase would be paid in a lump sum, one-time payment, and is expected to be disbursed when funding from the state is received around December. In subsequent years, the increase will be added to base salaries.

Ms. Smith asked if receiving the payment in a lump sum would impact the tax liability for teachers. Mr. Barragan stated the impact would be the same amount come April 15th, whether as a lump sum or paid over the course of the year.

Ms. Bartels noted changes in the number of FTE’s reflected in the budget worksheets and asked how this was effected by the proposed salary increase. Ms. Bartels suggested reaching out to the staff members who are not going to receive 100% of the raise due to their FTE spent in direct instruction.

Ms. Smith raised additional questions regarding the coding of teachers’ FTE and the figures contained within the proposed budget. Ms. DiPasquale clarified many teaching positions were not able to be filled with certified teachers last year and educational assistants were hired instead. In addition, employees on SmartSchools also impacted these figures.

Mr. Aldama inquired about the adjacent ways tax noted on the Truth in Taxation notice. Mr. Barragan explained what these funds were related to and used for.

Ms. Wilson suggested the District look into what is being offered at the charter schools that we could also offer to increase student enrollment. Mr. Quintana promised to report back on the Executive Team’s work in this area.

Ms. Bartels moved to approve the proposed budget and Ms. Smith seconded the motion. Upon call to vote, the motion carried.

Phased Retirement Plan Mr. Quintana recommended that the Governing Board approve the Phased Retirement

Plan as presented. Dr. Goodwin spoke to the changes being proposed that would allow employees on phased retirement to return at a higher rate of pay. The changes will be applied to those staff members who have left and returned already to increase their salary level. Mr. Aldama asked how many employees have gone onto SmartSchools and did not return to our District. Dr. Goodwin was unable to provide an exact number, but stated the majority of employees who enter phased retirement return the District. Mr. Aldama asked how many employees are currently on SmartSchools. Dr. Goodwin responded approximately ten employees are entering SmartSchools. Mr. Aldama inquired what the breakdown of employees entering SmartSchools is: teachers, administrators, and support staff. Dr. Goodwin confirmed the changes would be made retroactively to employees who have already returned to the District. Ms. Smith moved to approve the recommendation as stated and Ms. Bartels seconded the motion. Upon call to vote, the motion carried with four votes in favor and one vote opposed from Mr. Aldama.

Un-adoption/Disposal of Obsolete Curriculum Mr. Quintana recommended that the Governing Board approve un-adopting and

disposing of the STORYtown Reading Curriculum for Grades K-5 and McDougal Littell 6-8 materials. Ms. Bartels moved to approve the recommendation as stated and Ms. Pimentel seconded the motion. Upon call to vote, the motion carried.

Resolution for Chief Disbursing Officer for Employee Garnishments Mr. Quintana recommended that the Governing Board approve the Resolution

appointing the Maricopa County Education Service Agency (MCESA), Superintendent of Schools Office as the statutory agent for all garnishment of wages made upon any employee of this District for the 2017-2018 Fiscal Year. Ms. Smith moved to approve the recommendation as stated and Ms. Bartels seconded the motion. Upon call to vote, the motion carried.
