Judgment of Sheriff Drummond in the case of GHA Ltd v Duffy; competent to recall decree after a defence stated; the court held that it is competent to minute for recall of decree where eviction decree granted a pre-proof hearing, despite the fact the tenant had previously appeared/been represented and stated a defence, but failed to appear or be represented at the pre-proof hearing.
