A Solicitor who is a sole practitioner or a compliance partner and/or an anti-money laundering compliance partner, shall be required to undertake a minimum of three hours Management and three hours regulatory matters, of which at least two hours shall be accounting and anti-money laundering compliance.
Senior Practitioner who is not a Compliance Partner:
A Senior Solicitor who is a not a sole practitioner or a compliance partner and/or an anti-money laundering compliance partner, shall be required to undertake a minimum of three hours in any category.

The legislative framework for companies operating in Ireland is
constantly evolving but the changes now seem to be happening
more rapidly than ever. The Companies Act 2014 was supposed to
be a collection of all the requirements for a company trying to
navigate safely within the confines of the law, but since its
introduction on the 1st June 2015, there have been amendments to
the Act itself, changes to the Companies Registration Office
procedures under the Act and also a number of new Statutes and
Regulations brought in, all of which mandate compliance by Irish
companies.

Data Protection law has been the subject of increased attention in
recent years due to advances in technology and the recognition in the
EU of a right to data protection.
This lecture examines the current law as it relates to data protection in
Ireland under the Data Protection Acts 1988 - 2003, including the
rights of data subjects and the obligations on data controllers and data
processors in relation to the collection and processing of personal
data.
The EU General Data Protection Regulation (GDPR), which replaces
the existing law, will come into force in May 2018.

PERSONAL INJURIES UPDATE IN 2017 2.5 CPD GROUP STUDY POINTS

1) Updates re: legislation for periodic payments
The Civil Liability (Amendment) Bill 2017 has finally reached report stage in the Seanad and this seminar will review the provisions of the Bill and consider how it will
impact PI cases in all courts.
2) The Supreme Court ruling on The Law Society –v- the MIBI (Setanta case)
Both the High Court and the Court of Appeal have held that it is the MBI and not the Insurance Compensation Fund that should pay the claims arising from the liquidated
Setanta Insurance Company Limited. The Supreme Court has now heard the MIBI’s appeal but what will its ruling be and why?
3) An overview of High Court, Court of Appeal and Circuit Court cases in 2017
This seminar will consider the judiciary’s current attitude to personal injury claims and the level of general damages from the Circuit Court up.
4) The new Personal Injuries Commission
Pursuant to the recommendations in the Cost of Insurance Working Group Report on the Cost of Motor Insurance, a Personal Injuries Commission has been established
and on the 10th January 2017, former President of the High Court, Mr Justice Nicholas Kearns, was appointed chairperson.
The purpose of the Personal Injuries Commission is to investigate and make recommendations on processes in other jurisdictions which could enhance the claims process
in Ireland. The terms of reference include the commissioning of medical research, benchmarking of international awards for personal injury cases, analysing and
reporting on international compensation levels and compensation mechanisms.

The legislative framework for solicitors operating in Ireland is constantly evolving but the core issue of client care is something which the Law Society has recently made much
comment about. In its Annual Report of Lay Members 2014 – 2015, the Law Society Complaints and Client Relations Committee, noted that “The number of complaints alleging
Inadequate Professional Services has gone up slightly in the past year.”
The Law Society is empowered to investigate complaints against solicitors by or on behalf of clients alleging the following: misconduct as defined by Section 3 of the Solicitors (Amendment) Act, 1960 as amended by Section 24 of the Solicitors (Amendment) Act, 1994 and by Section 7 of the
Solicitors (Amendment) Act, 2002;
the provision of inadequate legal services as provided for by Section 8 of the Solicitors (Amendment) Act, 1994;
the charging of excessive fees as provided for by Section 9 of the Solicitors (Amendment) Act, 1994;
In addition, the Society may investigate any allegation, including an allegation withdrawn for whatever reason, where the Society considers that, in pursuance of its regulatory
functions and in the public interest, the Society ought to investigate or continue to investigate.
Accordingly, this seminar will propose ways to minimise client complaints with reference to the specific types of complaints made to the Law Society in the last number of
years. In particular, it will offer template letters for various types of communications with clients, will set out the requirements re: client communications and will also outline
changes in statutory duties regarding information to be provided to new clients.

The 2015 Act effects the most significant reform of the legal profession and legal costs to date. The Act establishes a new and independent Legal
Services Regulatory Authority with responsibility for oversight of the profession. Also due to be commenced shortly are provisions relating to: an
independent complaints system, an enhanced legal costs regime (with the Office of the Taxing Master being replaced with the Office of the Legal
Costs Adjudicator), a framework for new business models (including the limited liability partnership), and reforms to the regulation of legal
services advertising.
