The Georgia Composite Medical Board (GCMB) held its regular meeting on November 5, 2020
via teleconference at 2 Peachtree Street, Atlanta, GA 30303, to consider Medical Board matters.

CALL TO ORDER
Dr. Simmons called the meeting of the Georgia Composite Medical Board to order at 7:31 a.m.
AGENDA
Dr. Marshall submitted a motion, seconded by Dr. Dalton to approve the agenda of the November 5,
2020 meeting. The motion carried unanimously.
MINUTES
Dr. Retterbush made a motion to approve the minutes of the October 1, 2020 meeting. Dr. Gross
seconded the motion and it carried unanimously.
EXECUTIVE DIRECTOR’S REPORT
LaSharn Hughes, Executive Director presented the following information:
Staff Update:
Ms. Hughes updated the Board on staff turnover due to COVID-19.
Ms. Hughes recognized Patricia Zagorski, Enforcement Employee, for graduating from New
Hampshire University, Magna Cum Laude.
Meeting Dates:
Ms. Hughes affirmed the meeting dates for next year and the members decided to continue to the hold

virtual meetings for the first three meetings of 2021.
Correspondence:
Letter from Richard D. Sanders, Guidance on Medical Assistants Scope of Practice. The Board
requested additional information.
Email from Rohin Patel, regarding pain clinic licensure. The Board referred Mr. Patel to the laws and
rules.
Richard A. Kaul, MD, asked if he can be licensed in Georgia. The Board informed Dr. Kaul, he must
apply for licensure before a determination can be made.
Randi Seigel ask if the Board prohibited business corporations from employing physicians and rendering
medical services. The question was referred to the Office of the Attorney General for a response.
Nancy Allen, inquired if a physician can pay for the patient’s expenses for surgery and bill them in the
services. The Board advised against this practice, it may appear to be solicitation as noted in OCGA
Sec. 43-34-8(6).
Rules Waivers:
Motion Dr. Marshall, seconded Dr. Retterbush and motion carried to deny the following rules waivers:
Suzana Montana, MD – requesting waiver of Rule 360-10-01 & 07 (a)(b) to waive the definition of
“applicant” and “institution.”
Adilson de Costa – requesting waiver of Rule 360-10-.01 & 07 (a)(b) to waive the definition of
“applicant” and “institution.”
The Board accepted as information the following items:

Compact
The Board discussed and will conduct background checks for all license types. New applicants will have
to submit background checks when applying and currently licensed licensees will need a background
check before they will be allowed to renew. The Board is waiting on final clearance for these checks.
RULES REPORT
Opioid Prescribing Guidelines
Motion Dr. Retterbush, seconded Dr. Weil to adopt the CDC Guidelines and post to the website.
Rules for Review
Rule 360-3-.02(12) “Unprofessional Conduct Defined.”
Motion Dr. Marshall, seconded Dr. Harbin and motion carried to post the following Rule.
Rule 360-3-.05 “Renewal Applications”
Motion Dr. Weil, seconded Dr. Marshall to table for further discussion.
There will be a special committee formed to discussion HB 629 before the next meeting.
CLOSED SESSION
Dr. DeLoach motioned seconded by Dr. Dalton to go into closed session to discuss applications,
investigations and disciplinary matters. The motion carried unanimously.
OPEN SESSION
Dr. Simmons declared open session.

motion, seconded by Dr. Marshall and motion carried to accept the report as information and approved

2. I have a situation where there are interventional radiologists and vascular surgeons in the same
practice. The IRs are delegating, and the vascular surgeon is designating, and they are saying this
is ok because they all work on vascular cases. Even though these are different specialties are they
allowed to be on the protocol agreement together because their scope of practice is vascular
cases? This relationship is acceptable if the designated physician’s scope of practice is equal
to or exceeding that of the delegating physician.

The Board accepted as information the email from the American Med Spa Association stating the
erroneous Georgia laser practitioner license information on their website had been corrected.
The Board upheld the decision that a person must be licensed as a laser practitioner to perform non-
ablative facial LED light therapy. As stated in OCGA 43-34-242(5) "Cosmetic laser services" means
non-ablative elective cosmetic light-based skin care, photo rejuvenation, or hair removal using lasers or
pulsed light devices approved by the United States Food and Drug Administration for noninvasive
procedures.
RESPIRATORY CARE ADVISORY COMMITTEE
