Abuilding begins as a conception in the mind of its architect. The conception must be elaborated in his drawing office adapted to practical considerations and then conveyed to a number of people who will cooperate in tha erection of the building. SEC. 35.Reciprocity requirements.- No person who is not a citizen of the Philippines at the time he appliesto takethe examinationshallbeallowedto take it unless hecan prove in the manner provided by the Aules of Court that , by specific provision of law. the. country' of whichhe is a citizen, subject,or national either admits citizens of the Philippines to the practice of the same profession without restriction or allows them to practice it after an examination on terms of strictand absoluteequalitywith citizens, subjects, or nationals of the country concerned, including the unconditionalrecogni-tion of degrees issued by institutions of learning dulyrecognizedfor the purpose by theGovernmentoftnePhilippines:Provided,thatif heisnotacitizenofthePhilip-pmes,andwasadmittedtothepractiCeotaprofessionmthePhilippinesafte1 December 8.1 941, his active practice in that profession either in the Philippines or in the state or country where he was practicing his profession, shall not have been inter-rupted for a period of two years or more prior to July 4, 1946. and that the country or state from which he comes allows the citizens of the Philippines by specific provisions of taw,to practice the same profession without restriction or on terms of strict and ab-solute equality with citizens, subjects or nationals of the country or state concerned. SEC.36.Enforcementof theActbyoffice oftheLaw.- Itshallbethedutyofall constituted Officers of the taw of the National Government,of anyprovincial, city or municipalgovernmentofanypoliticalsubdivisionthereoftoprosecuteanyperson violatingthe provisionsof thisAct.TheSecretaryof Justiceorany assistantduly designated by the former shall act as legal assistance as may be necessary in carrying outthe provisionsof thisAct. SEC.37.Act not affecting other professions.- This Act shall not be construed to affect orprevent the practice of any other legally recognized profession. SEC. 38.Operationof decisionsin judginganypart of theAct Invalid.- If anyclause sentence, paragraph or part of this shall not affect, invalidate or impair any other part ofsaidAct,butshall initstotheclause,sentence,phrase. paragraphorpart directlYanvoivedinthecontroversyinwhichsuchjudgementis rendered. SEC. 39.Atl existing provisions of provincial, city or municipal ordinances or regulations pertaining to examinations for architects, and all other laws, part of laws,orders,or-dinances or regulations in conflict with the provisjons of this Act are hereby repealed. SEC.40.ThisAct shalttake effect uponItsapproval. AnArchitect shallbeconsideredsuchinthepractice of hisprofession,if thenatureand character of his employment whetherasanofficer oremployee in a private enterprise or .educationalinstitutioninvolvesdecision-makingrequiringprofessionalknowledgeinthe art and science of architecture, and such employment or position requires that the holder thereof must be an architect; or if he holds or Is appointed to a position in the architectural occupational group in the government or in government-owned or controlled corporations, including those performingproprietary functions,where a civil service eligibilit yasanar-chitect is aprerequisite. b}An architect is a bonafide holder of a certificate of registrati on issued by the Boardof Architecturein accordance with this Code. The author or authors of a set of plans or specif ications and other documents related to the practice of the.professionarethosein responsiblechargeof t heir preparation,whether madebyt hempersonally or under their immediate supervision. lt shalf be unlawful for any person, corporation, institution or agency to order, or cause the design, construction, reconstruction,erection,addition or alteration to any building unless allarchitecturaldesigns,siteplanning,spaceplanningandarchitecturaldetailsare preparedby orpreparedundertheresponsiblechargeof,andsignedandsealedbya registeredarchitect. 11 ART. 60.Suppletory to the general qualifications prescribed under Article1 7 of this Code, an applicanttothelicensureexaminationsforthepracticeofarchitecturemust,unl ess modified ih accordance w ith this Code. have at least two years of diversified experience as an architectural designer, draftsman, clerk-of-work. specification writer or superintendent, duly certified by a practicing architect and endorsedby the university, college, institute or schoolwherehe finishedhiscourseandfavorably recommendedby the duly accredited professional organization:Provided, that every year of deficiency in the required diversified experience may be substituted by twelve units creditin the subject to be prescribed by the Boardintherul esandregulations. ART.61 .Anappl icantholdingaMaster's Degree inarchitecture from a university,college, institute, or school recognized by the Government or the government of the state or coun-tryinwhichitisestablished.shallbecredited one year inhis practice experience. CHAPTER2 SCOPE OF EXAMINATIONS,ANDOWNERSHIPOFDRAWINGS, SPECIFICATIONS,AND THE LIKE ART.62.Subject to approvalof theCommission.theBoardof Architectureshallhavethe powertoprescribe,amend.orrevisethesubjectsinthelicensureexaminations f ort he practiceof architectureandtheircorrespondingrelativeweights,andunlessmodi fieGI. shall generallycover architectural design;history andtheory of architecture; environmen talsiteanalysi s;physicalplanning.architecturalengineering;structuraldesign;architec-turalpracticeandethics;andbuildingmaterialsandspecifications.ut ilitiessystems, methods ot constructi on,andconstruction drawings . ART.63.Drawingsandspecifications andotherrelateddocuments,inciudinggovernment projects, duly signed, stamped or sealedas instruments of service, are the properties and documents of thearchitects.whether the objectforwhichtheyaretnade is executedor not. No person shall .without the written consent of the architect or author of saiddocuments. reproduce or make copies of said documents for use in the repetition of,and for other pro-iectsOfbuildings,whether executedpartlyor in whole. ART. 31.Upon approval of application and payment of the required fee or fees, the following maybegrantedtemporaryspecialpermit topracticetheirrespect iveprofessionsinthe Philippines for such period of time as the commission may authorize, provided, that t h e r ~i> noFilipi noregisteredprofessi onalqualifiedforsuchrequirementatthetimethatthe applicationwasmadeorapproved. a)Foreignagriculturalengineers,architect s.chemicalengineers,chemists,civil engineers.criminologi sts.dentists.nutritionist-dieticians,electricalengineers,elec-troni csandcommuni cationengineer,f orester,geologistsorgeologicalengineers, mechanical ,erectionor guarantee engineer's medical technologists mining engineers, naval architect and marine engineers. and sugar technologi sts called in for consultation ortorspecificpurposeasmayinthejudgment of thecommissionbenecessaryand absolutely essentialfor thedevelopmentof the country:Provided, that theirpractice shallbelimitedonlytotheparti cularworkforwhichtheywereengagedbythe Filipinoregisteredprofessionals commissioned to undertake suchwork. and that they are legally qualified to practice thei r respective professions in their own state or country inwhichthe qualificati ons andrequirementsfor obtainingacertificateof registration arenotlowerthanthosespecifiedinthisCode:Provided,f urther,thatbeforethe expirati onoftheperiodgranted,renewaloftheirtemporaryspecialpermitsshall besecured. b)Foreignprofessionalstobeengagedasprofessors,instructors,teachers,lecturers, crit ics in such fields as in t he judgment of the commission, be necessary and absolutely essentialinthe fieldof education:Provided,that their wor.kshallbe confinedto such teachingonl yandtheyshallnotengageinthepracticeof theirprofessionsintheir private capacity. c)Foreignprofessional swho aremissionaries,andwhoshallengageinthepracticeof their medical,social and allied professionsfor humanitarian andcharitable purposes in the ruralareas: Provided, that practice ofFilipino professionals in said areas is not duly impairedand competed with. TITLEIll FOREIGNRECIPROCITY,PRACTICE ANDHEARINGS CHAPTER1 FOREIGNRECIPROCITY ART.32.UponrecommendationoftheBoardconcerned,theCommissionmay,incom pliance with international commitments and considering the number of qualified persons in the Philippines, entertain an offer by a foreigncountry or state to establish reciprocal reta-tions in the practice of a certain profession or professions subject to the condition that by specific J?rovisions of law, the country,state,or province tendering anagreement admits citizens of the Philippines to the practice of the particular profession or professions with or without examinations on terms of and absolute equality with the citizens,subjects, or na-tionals of saidcountry,state, or province,including the unconditional recognition of pre-requisite degrees issuedby institution of learning duly recognizedby theGovernment of thePhilippines:Provided,That upon recommendat ionoftheCommission andtheBoard concerned and upon approval of the Prime Minister, a temporary special permit to practice aprofessionfora specifiedoccasionandspecificperiodoftimemaybeissuedtoany foreigner, regardless oi whether or not reciprocity exists in the practice of his profession between hls countryandthePhilippines,andunderconditionsasmay be determinedby the Commission if such foreigner is internationally known to be an outstanding expert in his chosen profession or a well-knownspecialist inany of its branches,andthat hisser-viceswillpromote the advancement of the profession in the Philippines and will not duly impair and compete with Filipino professionals. CHAPTER2 CORPORATE PRACTICE ART.33.The practice of a profession. which includes the offer to render , furnish or contract professionalservices,shallbeinanindividualandpersonalcapacity.Thecommission, upon recommendationof theBoardconcerned,andaccordingto the rules it mayadopt, may grant authority to practice any of the regulated professions to a corporation registen; d underthe lawsofthePhilippines,Providedthatatleasteightypercentofthecapitalof whi chisowned by citizens ot the Philippineswho are registered professionals,and pro-videdfurther,that allofficers.includingthepresidentandgeneralmanager andat least eightvpercentofthestockholdersareregistered professionalsofthesameprofessionor allied profession for which authority to practice is granted. The authority granted shall be renewed every year before the expiration thereof. TheCommission shallsatisfy itself that the corporationcomplies,during .the life of theauthoritygranted,withthe requirements herein provided. ART. 34.A corporation authorized to practice aprofession or closely alliedprofessions can-not have anyother purpose except suchpractice. The construction and the manufacturing,contracting business.fabricatingandmarketing construction components systems or material, shall not be deemed as allied professions to the architecturalandengineeringprofessions. ART.35.Corporatepracticeshallbelimitedtooneprofessiononlyexceptasmaybe authorizedby theCommissionamongcloselyalliedprofessions. ART.36.Only a registered professional w ~ ois a stockholder of the corporation may perform in the name of the corporation, acts constituting the practice of his profession as defined in this Code.The corporation may employpersons not so registered,but suchpersons shall not renderoroffer to renderanyprofessional services. ART.37.Shares -ina corporation authorized to practice a profession may be transferred only to persons qualifedunder article33. Any transfer in violation of therestrictions shallbe void. ART.38.Acorporationauthorizedtopracticeaprofessionshalladoptanameindicating 14 expressly the profession inwhich such corporation is engaged. TheBoard concernedshall adopt therulesandregulat ionsnecessarytocarry out theprovision. ART.39.Individuals,corporations,institutions,firms,associations,entities,agenciesand other organizations who are not authorized to practice any of the professions may employ professionals for services allied to their trade or business only, or for their process opera-t ion, production or maintenance only and shall not compete With private practitioners; Pro-vit:.ledthattheemployershallbeliablesolidaritywiththeemployedprofessionalforthe damagesasprovidedinthecivil code of thisCode. ART. 40.Any of the following shall be a ground for disapproval, or revocation of the authority of acorporation to practice a profession: 1.Whenanyofficer,includingthepresidentorgeneralmanager,aswellasmembers shall become disqualifiedperson to pract icethe profession. 2.Whensuchcorporationshallviolateanyapplicable rule.regulationorcodeof ethics, adoptedbytheBoardregulating the profession. 3.When suchcorporationshallviolate anyprovisionof thisCode. ART.41 .Inpartnerships or firms organized for the practice of a profession or closely allied professions. all partners or firm members must beregistered professional of the same pro-fessionorthecloselyalliedprofessionsandeachpartnerandfi rmmembermay perform only thoseacts constitutingthe practice of his profession. MALACANANG MANILA PRESIDENTIAL DECREENO.223 AS AMENDEDBYPRESIDENTIALDECREENO.6 57 CREATINGTHEPROFESSIONALREGULATION COMMISSIONANDPRESCRIBINGITS POWERS AND FUNCTIONS. WHEREAS, the regulations for the various professions presently regulated by the Office of the Boards of Examiners is so extensive, practically covering all social and economic life of the country; WHEREAS,the existence of the Boardof Examiners is misconstrued for a number of years now asnothingmorethananexaminingunit,thoughalltheprofessionallawscreatingthe variousBoardshavechargedthemwiththesupervisionandregulationqver theprofes-sionalpractice in the Philippines;and. WHEREAS,toeffectively,enforcethelawsregulatingthevariousprofessions,thereisan urgentneedtocreatea three-manCommission to administer , implement,coordinateand supervise the variousBoardsof Examiners; NOW,THEREFORE,IFERDINANDE.MARCOS,PresidentofthePhilippinesbyvirtueof the powers v e s ~ e din me by the Constitution and Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081, dated September 21, 1972, as amended,do hereby orderanddecree: 15 SECTION1.ProfessionalRegulationCommission.- Thereisherebycreatedathree-man Commission to be knownastheProfessionalRegulationCommission which shallbe at-tached to the Office of the President for general direction andcoordination. SEC. 2.Compositjon. - The Commission shall be headed by one full-time Commissioner and two-full-time Associate Commissioners, all to be appointed by the President for a term of nine {9) years without reappointment to start from the time they assume office! except the first two Associate Commissioners who shallbeappointed,one for six(6)yearsandthe other for three {3)years,and thereafter, any vacancy in the Commission shall be filedfor the unexpired term only with the most senior of the Associate Commissioners succeeding the Commissioner at expiration of his term, resignation or removal. No person shall be ap-pointed chairmanor member of the Commissionunlesshe is at least forty 140) yearsof age,familiarwiththeprinciplesandmethodsof professionalregulation and/or licensing and has at least five(6) yearsof executive or managementexperience. SEC.3.Exerciseof powersandfunctionsoftheCommission.- TheCommissioner,who shall be the Chairman of the Commission,and the Associate Commissioners as members thereofshall ,asabody,exercisegeneraladministrative,executiveandpolicy-making functions for thewhole agency. SEC.4.Compensation.- TheCommissioner shall receivean annual compensation of forty-eight thousand pesos (fl48,0001 with five hundred pesos (P'600)commutable transporta-tion and representation allowances and the Associate Commissioners, thirty-six thousand pesos (P36,000) each with three hundred and fifty pesos (11360) commutable transporta-tion and representation allowances. SEC.5.Powers of the Commission:- The powers of the Commissionareas follows: 16 a)To administer,implement and enforce the regulatory policies of the National Govern-ment with respectto the regulationandlicensing of the various professionsandoc-cupations under its jurisdiction including the maintenance or professional and occupa-tionalstandards andethicsandthe enforcement of therulesandregulations relative thereto. b}To perform any and atr acts, enter into contracts, make such rules and regulations and issuesuchordersandotheradministrativeissuancesusmaybenecessaryinthe execution and implementationof itsfunctionsandtheimprovement of its services. clToreview,coordinate,integrateandappr.ovethepolicies,resolutions,rulesand regulations, order or decisions promulgated by the various Boards with respectto the professionoroccupationunder their jurisdictions including theresults of theirlicen-sures examinations but their decisions onadministrative casesshallbefinaland ex-ecutory unlessappealedto theCommissionwithinthirty(30)daysfromthedateof promulgation thereof; d)To administer and conduct the licensure examinations of the various Boards according to the rules and regulations promulgated by it; determine and fix the places and dates of examinations; appoint supervisors and room examiners from among the employees of the Government or private individuals who have been trained by the Commission for the purpose who shall be entitled to a daily allowance of not less than ten pesos (P'1 0) for every examination day actually attended;use the buildings andfacilitiesof public and private schools for examination purposes; and approve the release of examination results; e)Tokeepandmaintainaregisterof theauthorizedpractitionersof the professionor occupation; issue certificates of registrationorlicenses signed by all the members of the Board concerned and the Commissioner with the official seal of the Boardaffixed; f)To have custody of alltherecordsof the various Boards includingtheirexamination papers, minutes of deliberation, records of edmil'listrative cases and investigations and examinationresults; g)To determine,fix and collectthe amount to be chargedfor examination, registration, registration without examination, licenses, annual registration fees, certifications, sur-chargesandother fees not specifiedunder the provisions of RepublicAct No.6511 oramendtheratesprovidedthereundersubjecttoapprovalbytheOfficeofthe President; h)To appoint, subject to the provisions of existing laws, such officials and employees of theCommissionasarenecessaryintheeffective performances of its functionand responsibilities,prescribe 'their dutiesandfix their compensation;and to organize or reorganizethe sttutture of theCommission,createor abolishpositions,change the designations of existing position to meet changing conditions or as the need therefor arises:Provided,That suchchangesshallnotaffect theemploymentstatusof the incumbents,reducetheirranksand/or. salariesforresult inseparatingthemfrom the services; HTo submit and recommend to the President of the Philippine nominees for appointment asmembersofthevariousSoardfromamongthosenominatedbythebonafide . professlo.nalorganizationsaccreditedbytheCommission t-otillexistingor probable . vacancies; j)The Commission may, upon the recommeCtdation of the Soard concerned, approve the registration of and authorize the issuance of a certificate of registration with or without examination to a foreigner who is registered under the laws of his country: Provided. The contractor is likewise responsible for the damages if the edifice falls, within the same period, on account of defects in the construction or use of materials of inferior quality furnished by him, or due to any violation of the terms of the contract. However, since theword "engineer"isnot described,itcanrefertocivil,structural,mechanical,electrical, sanitary or other engineer. 5.Since the word "engineer" inArt.1723 is not specific, in present practice however, it canbeimpliedtorefer to a"structural engineer".Astructuralengineer is acivil engineerwhoholdsaspecialtycertificateofregistrationorrecognitionassuch, issued by the Professional Regulation Commission. The word "engineer" therefore in Art.1 7 2 3canbecorrectlydescribedwithout contradictionasthestructuralplans andspecifications,and certainly not anordinary civil engineer. 6.Eithertheengineerorarchitectmaysuperviseconstructionandbeheldsolidarity liablewiththecontractor.Againtheword"architect"is specificwhiletheword "engineer"is not butinpresent practicemayhoweverbeimpliedtomeanacivil engineerwho possessesspecialknowledge of supervision or constructionmanage-ment of buildings and holds a PRCcertificate of registration or recognition assuch. 7.Structural design of buildings may not bequalifiednor limited in scope for either the structural engineer or the architect. The concept is not supported by any existing Jaw on universal practice. What is important is that professional responsibility and liability is assumed by the structural engineer or architect who prepared and signed the struc-turalplans andspecificationsof the buildings. 8.Although defects in mechanical, electrical, or sanitary or other engineering plans and specificationswillnotcausethecollapseofthebuilding,damagesto thebuilding should be the responsibility andliability of the corresponding engineer who prepared and signed their respective plans andspecifications for the building.
