3.3.1 General and Special

conditions of Contract The general conditions of a contact list the conditions

under which the contract for a building is administered.

The various conditions that are covered under generalconditions are statutory obligations

Possession of site Site-conditions

Materials and workmanship

Access to site

Sub-letting

Rise and fall Progress payments

Prime cost and provisional sums

Variations to the contract

Insurances

Delays and extension of time and practical completion.

The special conditions of contract cover those aspects thatare unique to that particular object.

The standard printed forms available may not be adequateto cover all the special aspects that are unique to that

particular object. Therefore these forms generally include a blank sheet

headed special conditions to type in the specialarrangements, charges, conditions and commitments that

are negotiated. On completion it is signed and countersigned by the

respective parties and they become party to the contract.

Examples of special conditions include extended defectsliability periods, bonus and / or penalty payments.

The Contract Documents

The size and the complexity of theproject determine the type of documentsincluded in the contract documents.

A printed standard document signed byboth parties with the pages and changesInitialled by each party and the special

conditions and schedules filled in

The drawings

The drawing may comprise architectural,engineering,services and landscapingdrawings etc.The drawings that are

included in the contract document will bethe original tender drawings without anychanges or amendments.the drawing will

be numbered and listed as a part of thecontract documents.

Specification

A document to be read in conjunction with thedrawings.

The purpose of the specification is to give a

written description of the works described in thedrawings in terms of the standard,workmanshipand the quality of the work expected from thecontractor.

It conveys the intentions of the client andinforms the public authorities on details notshown on the drawings.

Bill of quantities

Describes materials and workmamship insufficient detail for pricing and representsthe quantites of work to be executed.

Bill of quantity may or may not beincluded and its inclusion will depend onthe conditions of contract chosen for the

project.

Schedule of rates

Includes the material and labour costsincluding overheads and profit margins fora particular work section or sections. The

schedule is generally used if variationsoccur in the contract.

The Program of Work

Stipulates work to be carried out within theagreed time schedule. It generally fits in withthe clients planned occupancy of the building atstipulated time during the contract.

The contract conditions stipulates variousinsurances to be taken by the contractor duringthe life of the contract such as Workerscompensation, public risk etc.

The insurance covers may require to be taken inboth contractors and the clients name. In thisinstance, an endorsed cover note may form partof the contract documents.

Evidence of Liquidity

On larger projects the contractor may berequired to give a Bank guarantee for anominated amount. In this instance the

endorsed bank guarantee may form partof the contract document.
