TERMS AND CONDITIONS

1. Bidders are required to submit the attested copy of Registration (latest) clearly mentioning the period of validity. Any firm failing to submit the same will not be entertained.

2. Rate has to be quoted for complete set of a particular item (including all sub-parts/accessories, if any) of machinery/equipment to be supplied. Bidder quoting the lowest rate for complete set of an item in the list shall only be considered fulfilling all other requisite conditions.

3. Technical bid consisting of all technical details along with commercial terms and conditions and financial bid indicating item-wise prices for the items mentioned in the technical bid shall be submitted separately by the bidders.

4. The technical bid and the financial bid shall be sealed by the bidder in separate covers duly super-scribed. Both these sealed covers shall be put in a bigger cover which shall also be sealed and duly super-scribed. The technical bids shall be opened by the Procurement Entity at the first instance and evaluated by 3 member committee constituted by Head of the Institution and at the second stage financial bids only of the technically acceptable offers, shall be opened for further evaluation and ranking before awarding the contract.

5. The tenderer shall submit the latest income tax return statement. This will help in assessing the capability of the bidder to supply the items mentioned in the schedule of bid document.

6. The bidder shall also submit the proof that it is sales tax payee. The attested photocopy of the same is required to be submitted along with the bid document.

7. The rates quoted should be F.O.R. destination at ABVGIET Pragatinagar, Distt. Shimla H.P.-171202. The rates must also include Installation/Demonstration and Training expenses, if any.

8. The rates quoted should be inclusive of GST.

9. The duly constituted College Committee shall inspect the material to satisfy itself for verifying specifications as mentioned in bid document.

10. The supplier shall be required to complete the delivery at college (including inspection) within stipulated days as mentioned in the supply order.

11. The items/equipment shall remain under Guarantee/Warranty by the supplier for a period of one year from the actual date of installation.

12. 100% payment will be made within one month against physical delivery of inspected/accepted store items, duly supported with satisfactory inspection note by the inspection committee of the institute.

13. Earnest money as mentioned in the document shall be required to be paid by the tenderer along with the tender document in shape of account payee demand draft or duly pledged fixed deposit receipts in favor of the Principal, ABVGIET Pragatinagar, District Shimla H.P.-171202 payable at Pragatinagar (Gumma).

14. Performance security as mentioned in the document shall be obtained from the successful tenderer on the award of the contract in the shape of account payee demand draft or duly pledged fixed deposit receipts or bank guarantee from commercial bank will remain valid for sixty days from the date of completion of the contract.

15. Refund of amount of performance security deposited by the firm will be made after two months from the date of expiry of contract or after the date of satisfactory completion of the given supply orders. Keeping in view both these conditions while making applications for the refund of the amount of security. The concerned firm will have to furnish a certificate that the supply of all the

supply orders received by it has been made to the consignee according to the prescribed specifications to their entire satisfaction.

16. The earnest money of the bidders whose tender has not been approved/qualify would be returned after proper scrutiny.

17. The tenders not providing the specifications/descriptions of the item mentioned in bid in catalogue form will be rejected.

18. If the date of accepting/opening the tenders happens to be holiday, the tenders will be opened on the next day at the same time.

19. Telegraphic, Fax, Conditional tenders and tenders without earnest money shall not be accepted.

20. ABVGIET Pragatinagar, Distt. Shimla H.P.-171202 reserves the right to accept or reject any or all tenders without assigning any reason.

21. The bidders shall keep their offer open for 6 months from the date of opening the tenders. A bid valid for shorter period may be rejected by the purchaser as non-responsive.

22. The Principal may appoint a “Negotiation Committee” if required.

23. The bidder will be responsible for damage or loss in transit and replace goods broken within 10 days from the date of notice thereof.

24. In case where it has not been specifically indicated in the schedule that only manufacturer can participate in tenders, in such cases the tenderers other than manufacturers should attach authorization letter from such principal manufacturer along with the tender.

25. The tender form along with the earnest money and forwarding letter on Letter Head Pad of the firm should be sent through Regd. Post/Speed Post/By Hand well in advance so as to reach to the Principal ABVGIET Pragatinagar (Polytechnic Wing) Distt. Shimla H.P.-171202 on or before the date of closing the offer i.e.30-10-2019 up to 2:00PM. The offer should be sent in a sealed envelope clearly indicating on the top the tender number, due date and the category of items.

26. All the bidders are required to sign each paper of the bid document along with the stamp of their respective organization. Without signature and stamp the tender submitted by them are likable for rejection.

27. The bidder has to attach the supporting documents/catalogues for all the items.

28. All the disputes shall be settled within the jurisdiction of Sub-Judge Court, Theog, Distt. Shimla H.P.

29. The earnest money deposited by the tenderers shall be forfeited in the following events:

i) A modification or withdrawal of tender after the deadline of submission of tenders and during the validity period.

ii) Refusal by the tenderer to accept an arithmetical error or otherwise appearing on the face of the tender.

iii) Failure on the part of the successful tenderer to provide performance security for the execution of the contract.

iv) Failure on the part of the successful tenderer to execute the contract as per terms and conditions of the tender.

30. The purchaser may, at its discretion, extend deadline for the submission of bids by amending the bidding documents, in which case all rights and obligations of the purchasers and bidders previously subject to the deadline will thereafter be subjected to the deadline as extended.

31. The purchaser has the right to ask the supplier(s) to produce the sample of the item(s) for the purpose of comparison of prices and to evaluate technically before placing supply order to the firm.

32. The purchaser or its representative shall have right to inspect or test the goods to confirm their conformity to the contract. The inspection and tests may be conducted on the premises of the supplier at his costs.

33. The purchaser reserves the right to increase or decrease the quantity of goods to be procured.

34. An excused delay by the supplier in the performance of its delivery obligations shall render the supplier to any or all of the following conditions:

i) Forfeiture of its bids security and its performance security.

ii) Imposition of liquidated damage.

iii) Termination of the contract for default.

35. If at any time during performance of the contract, supplier encounter conditions impending timely delivery of the goods and performance of the services, the supplier shall promptly notify the purchaser in writing of the facts of delay, its likely duration and its causes as soon as possible after the receipt of the supplier notice. The purchaser shall evaluate the situation and may at its discretion extend the supplier time for the performance.

Special Conditions

1. No. of items can be increase/ decreased/deleted depending up on the budget/requirement.

2. Supply is subject to the financial approval from the competent authority.

3. Proof of past supplies made satisfactorily to Govt. Deptt. In last three year to be enclosed to the satisfaction of the purchase committee.

4. At least 70 percent of the items must be quoted by the tenderer.

5. The bidder must be a manufacturer or in supplying business as authorized distributor/stockiest for at least three years.

6. Performance security will be paid after the completion of guarantee/warranty period.
