GENERAL BODY MEETING ON 08/12/2011 AT NEW DELHI

REPORT OF GENERAL SECRETARY

Dear friends and comrades,

At the outset I, on behalf of the Central Body of the Association, would liketo convey hearty thanks to all of you for attending the General Body Meeting insuch a large number and making it a success. I also convey my season’sgreetings to you all and congratulate you on your overwhelming supportextended to the Association throughout the year in all the programmes in supportof our demands and cadre issues.

Our Association has taken up various demands and cadre issues withthe administration according to the policy decisions taken by the various ApexCommittee meetings (the latest ones being held in February 2010 at Kochiand February 2011 at Chandigarh) in which the views of all the regions andzones were taken into consideration before taking the final decisions. I will gothrough the details of all these cadre related issues later on. During the monthof May 2010, we had gone on major agitational programme to protest theunilateral suspension of one EE, one AE and one JE in a trivial incident in H-Division and to protect their career advancement prospects. But for our proteststhese officers would have been victimized by the administration ruining theircareers. Due to our persistence and the positive approach of the then UDM,the authorities were forced to revoke the suspension orders and foreclose anypossible disciplinary proceedings against them. During the year we hadconducted many tours to many stations all over the country like Mumbai,Chennai, Hyderabad, Chandigarh, Lucknow, Varanasi, Allahabad etc. in additionto a tour of Northeastern states, to interact with and learn the feelings andviews of our members in and outside Delhi. We had also participated in jointprogrammes with the Junior Engineers Assn. during the suspension issue inMay 2010 as well as during the Unity Day and Demands Day during July andAugust 2010. We also held a Day Long Mass Dharna all over the country on12th May 2011 in support of our demands which was very successful.

Coming to the issues related to our cadre, we have been taking up all theimportant issues with the authorities from time to time. Though there are morethan 20 issues which have been taken up, I am discussing the main issueswhich are of very important nature to submit the latest position.

1. Grant of `̀̀̀̀ 7600/- Grade Pay to all under MACPS:

Though MACPS has been formally notified by the Govt of India on 19th May2009, it has not been implemented by the CPWD to engineers till date andnone of our many hundreds of serving and retired members have got the 3rd

upgradation of ` 7600/- grade pay after 30 years of total service. Due tocontinuous persuasion by the Assn at all levels, the first DPCs were held inthe month of June 2011. Subsequent DPCs were held in October and November2011 with Bench Mark as Very Good as per DoPT guidelines. The review DPCswere also held for the earlier DPCs and the minutes are about to be sent to UDMinistry for the UDM’s approval and lists are likely to be issued in this month.The process of holding regular DPCs for the same as per seniority will becontinued and subsequent lists will be released regularly. As per the directionsof DoPT, the Dept and Ministry has sent a fresh proposal after consulting allstake holders, to grant the modified pattern of Special Career ProgressionScheme of CPWD specific to CPWD after the approval of the minister. Thisscheme envisages all three upgradations as per cadre hierarchy i.e ` 4600/-GP after 12 years, ` 6600/- GP after 24 years and` 7600/- GP after 30 years of total service for all, so that there is nodiscrimination between seniors and juniors. Our earlier demands for individualoption and modification to MACPS structure as per promotional hierarchy etc.were not acceded to by the Govt. Saying that the erstwhile ACPS will not beoffered as an option nor there will be any structural changes/tinkering withMACPS. But we are sure that the Govt has recognized that in CPWD, there isan issue to be addressed as far as engineers are concerned and we hope thata positive solution will emerge in near future which will be agreeable to all ourmembers.

2. Higher Pay Scale to AEs:

After the refusal of the Govt to grant ` 5400/- GP in PB-3 as per para 3.4.7 ofthe 6th CPC report, we have pursued with our decision of demanding paritywith other Group-B gazetted officers in CSS/CSSS and other cadres whohave been granted ‘ 4800/- GP in PB-2 initially and ̀ 5400/- GP in PB-3 after 4years of regular service on the basis of para 3.1.3 of the 6th CPC report, whichsays that there shall be absolute parity between secretariat and field officersupto Assistant level. Accordingly the JE should get ‘ 4600/- GP and AE shouldbe given parity with Section Officer. However this proposal sent to MoF after

UDM’s approval has been turned down by them saying that those cadres gotthat scale after Cabinet’s approval and it is not possible to extend the same tous. Moreover, they have stated that there is no established parity in duties/responsibilities of AE and SO. This is absolute absurdity and we should fightfor the same. We have been in touch with other Group-B gazetted organizationsin other ministries and departments like Railways, Income Tax, Central Excise,Customs, Audit & Accounts services etc. and other engineering wings of thecentral government regarding the pay scale issue. Many of them have alreadybeen granted ‘ 4800/- GP and the general consensus was to demand ‘ 5400/- GP in PB-2 for all gazetted group-B officers and automatic placement in PB-3 in the same grade pay after 3 years of regular service in PB-2. All of themhave acknowledged that demanding total parity with Class-I DR officers interms of initial pay is futile, and a realistic demand should be placed. We couldhave asked for parity with AEE as per para 3.4.7 only if the RR of JE’s post isDegree in Engg instead of Diploma, which is not the case in our dept so far.So, we should seek at least parity with other similar cadres first and then tryfor betterment as per common policy by confederation.

3. Cadre Review:

The Cadre review proposal of Group-A has already been approved by allconcerned and only Union Cabinet’s approval is being awaited. It is hoped thatthe same will received by the coming New Year. The Group B and C cadrereview is also sent to MoF after approval of the UDM and the same is likely tobe approved in near future. After the increased cadre posts are notified, wehave to ensure that the same is implemented in a time bound manner. Weshall also have to ensure that all in-situ SEs occupying the EEs posts shouldvacate the same especially the Divisions/field units while the cadre review isimplemented.

4. Regularisation of Ad-hoc AEs, EEs and SEs:It is a fact that the regularization of ad-hoc EEs can be done only after thedisposal of pending court cases in Delhi High Court. The DHC has only decidedthe case of diversion in our favour by upholding the same during December2008 and left the matter of further promotions under old and new RRs pendingby listing the matter in regular list. As it may take many years in queue for thesame to come up for hearing, we requested the administration to pursue with

the DHC or Apex Court for speeding up the hearing and dispose the case. Dueto the failure of administration in doing so, we have approached the court duringDec’2009 for early hearing which was not agreed to. We again approachedthe DHC during October 2011, and having realized the urgency and importanceof the issue at hand, they agreed to take up the hearing on 5th Dec’2011 onwards.But due to inexplicable stand taken by the Dept regarding non-availability ofASG, the same is delayed and is now listed for hearing after 16th Dec’2011.We hope good sense will prevail upon the administration and they will co-operate in disposal of this very important case, which may decide our seniorityand batch-parity benefits like Class-I EEs. Once all ad-hoc EEs are regularizedand assigned proper seniority, the adhocism in AEs will also be cleared. Evenotherwise we are pursuing with the department for immediate regularization ofad-hoc AEs as per rules since 2006 onwards as per their quota, so that oncethe cadre review is approved we can start making only regular promotions.

5. Amendment of Recruitment Rules of AE to EE promotion:

As per our earlier decision for seeking merger of separate quotas in to a singlequota, looking into super cession in promotions causing heart burn in degreeas well as diploma AEs, we have been pursuing the matter with CPWD, UDMand DoPT. But the recent queries by the DoPT questioning the eligibility ofdiploma holder AEs for promotion to EE’s post citing their guidelines whichstipulate that Degree in Engg as minimum qualification for technical posts inSTS level, have forced us to rethink on this issue. It is felt that we should firstprotect the granted eligibility and quota of diploma engineers to the post of EEand hence we may ask for continuation of existing separate quotas to continue,with less eligibility service period and also press for ‘Failing which’ clause to fillthe unfilled quota of class-I on regular and pro-rata basis. We seek the approvalof this General Body for the same.

6. Enhacement of Tendering Powers of AE to `̀̀̀̀ 10 lakhs and betterdelegated powers at all levels:

We strongly feel that AE’s tendering power of ` 3 lakhs is too meagre whichresults in unnecessary splitting of works and more no of tenders. With theintroduction of e-tendering at all levels in CPWD, there is no issue regardingpublicity and competition also. Hence maintaining the same average ratio ofpowers at various levels, the Assistant Engineers also should be granted atleast

` 10 lakhs tendering powers for ensuring real decentralization and quick reactiontime as well as better delivery mechanism. We are also experiencing manypractical problems day in and day out while dealing with the other delegatedpowers like grant of extra, substituted and deviated items etc. in the works.Irrespective of the delegated financial powers, all field officers have to seek in-principle approval from TS authority before deciding any changes whileexecuting a work through any contract. This unnecessarily delays the decisionmaking mechanism and results in delay in completion of a work, especially inoutstation works. Hence, we demand all delegated powers to be absolute atall levels without any in-principle approval etc.while demanding further enhancedpowers to field officers for speedy decision making and deliverance.

Coming to the other important issues relating to our cadre, the latest positionis as under :

(a) The MoF has not agreed to the recommendation of the CPWD/UDM toallow them to grant ‘ 7500-12000 scale to all eligible officers similarlyplaced with many others for which the same has been grated on theCAT’s directions. They are unnecessarily forcing everybody to approachthe courts and we are pursuing to again send the proposal with UDM’sapproval.

(b) The draft modified transfer and posting guidelines after taking the viewsand suggestions of all stake holders, for EEs and SEs which provides forinterchange between planning and field units among many other proposalslike group change of IT Val, QA posts etc. as sensitive planning instead offield posts etc. are pending in the ministry and we are pursuing their earlynotification.

(c) The seniority list of AE (Civil) is issued by the department, but it has createdmany more problems/disputes than solving the existing problems. Someof the effected members have gone to court and got the same stayed.This issue has resulted in intra-cadre disputes regarding the senioritywhich is result of well directed conspiracy by the administration to divideour cadre. We hope the ongoing court case will be decided on merits tothe satisfaction of all effected members and settle the dispute once andfor all.

(d) We are also pursuing amendment of conditions for passing departmentalaccounts exams by AEs and EEs by replacing the exam with inductiontraining programme followed by a certificate for all newly promotedofficers and existing officers also who could not clear the same till dateand their increments are stopped.

(e) Due to the intensity of agitation during May 2010, the departmenthas hatched a conspiracy and stopped issue of open passes ofMHA to AEs so that their entry to Nirman Bhawan is restricted.The present DG has earlier agreed to restore the open MHA passesto AEs which were stopped by the earlier regime. But due toover enthusiasm and lack of foresight of some of our friends, whotook up the issue with the Secretary (UD) without any need, theproposal was rejected by the Secretary. Now it has become very difficultto get the same restored and we have to approach the Minister forthe same.

(f) The demand for enhanced Design and Planning allowance is alreadybeen under submission in the Ministry which will be sent to MoF.

In the end, I would like to place my appreciation on record toall the office bearers, our executive committee members and all activemembers who extended their wholehearted support in all our activities,but for whom it would not have been possible to achieve anything.I also convey my sincere thanks to all members who have come forward to bolster our finances to fight innumerable court cases throughadvertisements in the upcoming beautiful New Year Diary-2012 which will bein your hands shortly along with calendars. I wish similar comraderie willcontinue in future and take the Association from strength to strength in theyears to come in achieving all our just and genuine demands and redressalof our grievances.

Subject : General Body Meeting of Association on 08/12/2011-Resolutions thereof-regarding.

Sir,

It is already in your knowledge that our Association had held theGeneral Body Meeting on 8/12/2011 in New Delhi which was attended by manyhundreds of members all over the country. Many issues as per the agendawere discussed thoroughly and resolutions have been taken in the meeting. Iam listing the same for your kind information and further action in this regard.

1. Grant of `̀̀̀̀ 7600/- Grade Pay to all under MACPS:

It is resolved that the Government should release the lists for granting of` 7600/- Grade Pay as per MACPS to all eligible engineers in a time boundmanner. To begin with the first list for which DPCs were already held be issuedbefore New year-2012. It is also resolved that the proposal sent by the UDMinistry, duly recommended by the Hon’ble UD Minister, to DoPT for grantingthe above grade pay of ` 7600/- to all engineers after 30 years of servicewithout any discrimination should be realized immediately.

2. Higher Pay Scale to AEs:

It is resolved that the Pay Scale of Assistant Engineers of CPWD shouldbe enhanced to ` 5400/- Grade Pay in PB-3 by amending the RecruitmentRules of Junior Engineers from Diploma to Degree in Engineering asper para 3.4.7 of 6th CPC report. Till the time the RRs are not amended,the Junior Engineer should be placed in ‘ 4600/- grade pay by granting absoluteparity with the Assistant grade of CSS cadre as per para 3.1.3of 6th CPC report and accordingly the Assistant Engineer should begranted parity with Section Officer of CSS cadre by granting ‘ 4800/- GradePay as initial pay and ` 5400/- Grade Pay in PB-3 after 4 years of regularservice as AE.

3. Cadre Review:It is resolved that the Group-A cadre review should be implemented immediatelyafter the approval of Union Cabinet and its notification. While doing so the in-situ SEs occupying the EEs posts should vacate the same and those postsshould be restored to EE cadre. It is also resolved that the Group-B and Ccadre review already sent to Finance Ministry after the approval of Hon’ble UDMinister should be got approved and implemented in a time bound manner.

4. Regularisation of Ad-hoc AEs, EEs and SEs:It is resolved that the administration should support the efforts of the Association,who got the matter listed for early hearing, to get the pending court cases inDelhi High Court disposed off at the earliest, so that the regularization of ad-hoc promotions can be done as per the Judgment. It is also resolved that theadministration should regularize all ad-hoc AEs as per rules since the 2006-07onwards, so that the post-cadre review posts can be filled on regular basisonly.

5. Amendment to Recruitment Rules of AE to EE promotion:It is resolved that the present system of separate quotas for diploma and degreeAEs to the post of EE should be continued with lesser eligibility period of 9 & 7years in place of present 10 & 8 years respectively, since the proposal formerger of these separate quotas into a single quota is facing lot of queriesfrom DoPT regarding the basic eligibility of diploma AEs to the post of EEs asper their standard guidelines for technical posts which prescribe Degree inEngg as minimum educational qualification for promotion to the post of EE.The present separate quota of diploma AEs should not be diluted in anycircumstances. It is also resolved that the Govt. should agree with the proposalof ‘Failing-Which’ clause facilitating automatic transfer of unfilled quota on regularbasis after 3 years waiting period to ensure regular supply of feeder cadre forpromotion.

6. Enhacement of Tendering Powers of AE to `̀̀̀̀ 10 lakhs and betterdelegated powers at all levels:

It is resolved that in the era of e-tendering, the tendering powers of AssistantEngineers should be raised to ` 10 lakhs for better performance of thedepartment in view of delay in deliverance presently due to meager powers. It

is also resolved that the Works Manual should be suitably amended to makeall delegated powers ‘absolute’ without any prior approval and also to improveall delegated powers of AEs and EEs for actual decentralization of powers.

In addition to the above the following more resolutions are also made in theGeneral Body Meeting :

(a) The Govt. should allow granting of ` 7500 – 12000/- (pre-revised) payscale to all eligible AEs and EEs from 1.1.1996 in line with various courtorders without forcing all to go to courts for getting the same.

(b) The modified Transfer and Posting guidelines for EEs and SEs should beimmediately be notified which is pending for a long time after draftguidelines are released and comments received.

(c) The court cases regarding the seniority lists of AEs and EEs should begot pursued by the Govt and early finalisation of the same as per applicablerules without any bias or favour to any class of engineers.

(d) The conditions regarding the departmental accounts exams to AEs andEEs should be amended by replacing the exam with induction trainingprogram on promotion followed by certificate.

(e) The Design and Planning allowance as a fixed percentage of pay likeHeadquarter allowance and training allowance should be approved bythe administration to all engineers working in planning and design unitsuniformly.

It is our earnest request that the administration should take serious,positive and favourable action in all the above issues so that the severelydeprived class of engineers of CPWD may be granted some solace which willdefinitely go a long way in improvement of their performance and enhancedepartment’s prestige.

A meeting was held under the Chairmanship of Secretary (UD) on 9.12.2011at 11.30 AM to discuss the issues related to Central PWD EngineersAssociation. The following were present in the meeting.

At the outset, Secretary (UD) welcomed all present in the meeting. Demandsof the Association were discussed with the following decisions :

1. Implementation of Modified ACP scheme and improvement of the sameto ensure uniform benefits to all Engineers without dilution of grantedbenefits under old ACPS.

(a) It was informed by the CPWD that maximum number of cases for grantof Rs. 7600 Grade Pay under MACPS would be submitted to the Ministrywithin a week. Secretary (UD) assured that MACPS cases received inthe Ministry shall be cleared on priority.

(b) It was further informed by the CPWD that a scheme named as “SpecialCareer Progression Scheme” for the cadre of Junior Engineers andsimilarly placed cadres of CPWD has been submitted to the DoPT by theMinistry in Nov’2011.

On request of the Association regarding persuasion of the matter with DoPT,Secretary (UD) assured that he will write a DO letter to DoPT in this regard.

2. Recommendation of Rs. 5400/- Grade Pay to AEs as per para 3.4.7 of6th CPC report by amending the Recruitment Rules of Junior Engineersfrom Diploma to Degree in Engineering or at least parity with SOs/Pasin CSS/CSSS cadres.

The Association was informed that a proposal for placing Assistant Engineersof CPWD in PB-3 with grade pay of Rs. 5400 was sent in August 2010 toMinistry of Finance. The Ministry of Finance did not agree to the proposal. Afurther proposal for grant of Grade Pay of Rs. 4800/- and Rs. 5400 Grade Payafter 4 years of service as Assistant Engineer in line with CSS cadre was sentin August 2011 to Ministry of Finance. Ministry of Finance did not agree to thisproposal also.

It was also informed to the Association that Ministry of Finance has not agreedfor change of qualification from Diploma to Degree in Engineering andconsequent increase in Grade Pay from 4200 to 4600 in case of JuniorEngineers of CPWD.

However, a further proposal for grant of Rs. 5400 grade pay in PB3 to theAssistant Engineers has already been moved for consideration of MoUD andMinistry of Finance.
