REPLIES TO QUESTIONNAIRE ON IMPORT LICENSING PROCEDURES

The following notification has been received from the delegation of thePhilippines in response to the questionnaire on import licensing proceduresannexed to document L/5640/Rev.1. The present document replaces theinformation previously contained in L/5232/Rev.1, as amended, and sets outthe import licensing régime of the Philippines as of 30 September 1985. Thisdocument also replaces L/5640/Add.26, dated 6 November 1985, which was issuedby mistake.

Outline of System
1. Imports into the Philippines are free unless otherwise subject tothe requirements of prior approval by appropriate government agencies/committees concerned responsible for implementing the legislationprohibiting/regulating imports. The Tariff and Customs Code of 1978(Presidential Decree No. 1464) and the Central-Bank Charter (Repúblic ActNo. 265, as amended by.Presidential Decree No. 72), provide the primarylegal bases for the control and regulation of imports in the Philippines.However, there are other special laws that prohibit/regulate the importa-tionsof some commodities and designate certain government agenciescommittees t, administer import regulations. Import license applicationsmust be submitted to the appropriate administrative body responsible forissuing licenses (import permits/clearances/authorizations). The licenseholder is required to submit it to the Central Bank or its authorizedagent banks for authority to buy foreign exchange to pay for imports ofgoods covered by the licenses, and to the Bureau of Customs at the timeof customs declaration.
Purposes and Coverage of the Licensing
2. All commodities/commodity groups subject to automatic and non-auto-matic import licensing are embodied in the Tariff and Customs Code of 1978(Presidential Decree 1464), as amended, and in the Philippine StandardCommodity Classification Manual. Commodity groups whose importation isrestricted and/or regulated are listed in column 1 of Annex A.hereof.
3. The system applies to goods originating from any country, the choiceof the source of supply being left entirely to the prospective importers;
4. The licensing is intended mainly to (a) safeguard public health,safety, security and welfare; (b) develop and rationalize domestic industry;(c) meet the economic development needs of the Philippines by way of ensu-ring an adequate supply of commodities not available locally in sufficientquantities; and (d) for balance of payment and trade surveillance purposes.
5. As stated in the-outline of system above, the Tariff and CustomsCode of 1978 (P.D. 1464), as amended, and the Central Bank Charter (R.A. 265),as amended, provide the primary legal bases of the licensing. But there are
special laws (see second column. of Annex A) that govern the importation of,and designate the appropriate agencies/bureaus which administer the licensingregime on, a specified commodity or group of commodities. Central BankCircular No. 1029 consolidates all rules and regulations to govern importtransactions. The licensing system is statutortily required. Legislation

in certain instances leaves the designation of products to be licensed toadministrative discretion under well-defined criteria. In some cases, thesystem may be abolished without legislative approval for as long as thebasic criteria provided in basic legislation no longer apply to the particu-lar products being licensed (see Annex B).
Procedures
6. For quota products:
(a) All regulations are circulated and made available to interestedparties. They are also published in the Official Gazettes and/or in thenation's newspapers.
(b) Import quotas are on an annual basis. They are allocated usuallyon a first come, first served basis directly to qualified or registeredimporters. Since the quotas are allocated in the name of importers, theyare not published in order to avoid possible disclosure of business secrets.However, they can be made known, to government, upon request, when necessaryand appropriate.
(c) Quotas are granted on the basis of an importer's past performancein relation to historical growth in sale. Applications are not consideredon an arbitrary or formula basis but on the merits of each individual case.Adequate controlling, monitoring systems are provided to ensure that licensesallocated are actually used for imports. Unused allocations are not addedto quotas for a succeeding period except with respect to unmanufacturedtobacco. The names of quota-holders may be made known to government andexport promotion bodies of exporting countries upon request.
(d) The time allowed for submitting application for licenses is usuallyup to the end of the authorized period which is normally up to the end of aquarter, semester or end of the sixth month or year.
(e) Under normal circumstances, an application for an import licenseif complete in all respects can be granted within two weeks or even sooner.
(f) Licenses are issued with a specified period of-validity forshipment of goods. It is up to the importer to import goods any timeduring the validity period of the import license. Goods shouldbe shipped from the exporting country only after the import license isissued.
(g) Only one administrative body considers the application forlicense and where two administrative bodies are involved, theapplicant has to approach only the main license-issuing agency, whichendorses the application to the other for proper consideration andapproval.

(k) There are certain commodities (carton boxes, circus horsesimported for exhibition, display or show purposes, and certain importa-tions of textile items/fabrics, garment accessories as well as some NECand UC items) where import licenses are granted only on condition thatthe products imported will be re-exported or processed for re-export.
7. For non-quota products:
(a) Where there is no quantitative limit on importation of aproduct, application must be filed at least two (2) weeks before estimatedloading date of the product.
(b) Licenses can be granted immediately depending on the urgencyof-the request.
(c) Application may be filed on any working day of the year.
(d) See answer to 6(g).
8. In the event of denial or disapproval by the pertinent administra-tive body of an application for import license, the applicant is informedof the reason for such disapproval and given the right to make a writtenappeal for reconsideration of its original decision.
Eligibility of importers to àpply for License
9. (a) Under the restrictive (non-automatic) licensing system, onlypersons, firms and institutions duly registered as bona fide importers,domestic users, breeders, producers, traders, etc., are eligible to applyfor licenses, except in instances when only the Government or.its entities/agencies may import the products sought to be imported by applicants(e.g., rice, which is State traded).
(b) Under the non-restrictive (automatic) system, all persons,firms and institutions, are eligible to apply for license as long as theymeet the basic requirements/criteria laid down by the agencies/bureausconcerned.
There is a system of registration of persons or firms permittedto engage in importation. This system ensures that only qualified appli-cants àre granted licenses. A registration fee is charged in some cases,as indicated in Annex C.
Documentational and other requirements for application of Licenses
10. The information usually required in applications includes name
and address of importer, business of importer, name and address of exporter/shipper, country of origin, means of transport, description and amount ofgoods to be imported. The documents required to support the application,which vary from agency to agency, usually include (a) pro forma invoicecovering the importation applied for, (b) SEC registration certificate

for corporations and partnerships and Bureau of Domestic Trade registrationcerti-ficate. for single 'proprietorship,. (c) financialstatement and (d) a copyof export contract or L/C application, among others.
11. In the case of actual importation, the documents required may
include (a) commercial invoice; (b) bill of lading; (c) clearance cer-tificate from pertinent administrative bodies and (d) formal customsentry.
12. For the list of licensing fees or administrative charges imposed,see Annex D hereof.
13. There is no deposit or advance payment requirement associatedwith the issuance of licenses.
Conditions of Licensing
14. There are no set rules for the period of validity of a license.Some licenses are issued for a particular shipment only, with a validityperiod adequateto cover the whole process of importation. Others are
issued with a period validity identical with that of the period grantedon the quota held. Theperiod of validity ranges from one (1) month to
one (1) year (but for fifteen days only with regard to NEC and UC commo-
dities) and in all cases renewable upon written application by interestedparties to the concerned agency/bureau.
15. There is no penalty for the non-utilization of a license subject to
quota or a portion of it.
16. Licenses are made in the name of applicant-importer only and
non-transferable.
17. No other conditions, aside from those mentioned in the previoussections are attached to the issuance of an import license.
Other procedural requirements
18. There are no óther administrative procedures required prior to
importation apart from import licensing.
19. Except under conditions of an economic crisis, foreign exchangeis automatically provided by authorized agent banks to a holder of an
import license.

PROHIBITED IMPORT ITEMS PROVIDED FOR UNDERSECTION 101 OF THE TARIFF AND CUSTOMS CODE
OF THE PHILIPPINES (P.D. 1464)
1. Dynamite, gunpowder, ammunition and other explosives, firearms, andweapons of war, and parts thereof.
2. Written or printed articles in any form containing any matter advocatingor inciting treason, rebellion, insurrection, sedition or subversion againstthe Government of the Philippines, or forcible resistance to any law of thePhilippines, or containing any th-eat to take the life of, or inflict bodilyharm upon, any persons in the Philippines.
3. Written or printed articles, negatives or cinematographic films, photo-graphs, engravings, lithographs, objects, painting, drawings or otherrepresentation of an obscene or immoral character.
4. Articles, instruments, drugs and substances designed,intended oradapted for producing unlawful abortion, or any printedmatter whichadvertises or describes of gives directly or indirectlyinformation where,how or by whom unlawful abortion is produced.
5. Roulette wheels,gambling outfits, Loaded dice,marked cards, machines,apparatus or mechanical devices used in gambLing, or in the distribution ofmoney, cigars, cigarettes or other articles when such distribution isdependent upon chance, incLuding jackpot and pinballmachines or similarcontrivances, or parts thereof.
6. Lottery and sweepstakes tickets except those authorized by thePhilippine Government, advertisements thereof and lists of drawings therein.
7. Any article manufactured in whole or in part of gold, silver or otherprecious metals or alloys thereof, the stamps, brands or marks of which donot indicate the actual fineness of quality of said metals s or alloys.
8. Any adulterated or misbranded articles of food or any aduLterated or
misbranded drug in violation of the provisions of the "Food and Drugs Act".
9. Marijuana, opium, poppies, coca Leaves, heroin or any other narcotics orsynthetic drugs which are or may hereafter be declared habit-forming by the'President of the Philippines, or any compound, manufactured salt derivatives,or preparation thereof, except when imported by the Governrrent of thePhilippines or any person duly authorized by the Dangerous Drugs Board formedicinal purposes only.
