    In the educational environment, there are times when a student and a college

    employee (aculty/teacher/instructor, support sta, or administrator) may have aproblem or issue which needs some clarication and resolution. Thereore, GavilanCollege has a procedure to help students address problems and work

    on solutions that hopeully benet all the people involved.

    The process or resolving issues is called The STUdeNTSProBLeM reSoLUTIoN ProCeSS and applies

    to specic situations on campus. Please see page12. We also encourage you to speak with a

    counselor or assistance in clariying your issues andunderstanding the correct process to ollow.

    STaNdardS o STUdeNT CoNdUCTReference: Education Code Section 66300 and BP 5500

    Gavilan College is dedicated to promoting a harmonious learning and socialenvironment characterized by mutual respect or all our students, sta andcommunity. A student enrolling at Gavilan College assumes an obligation to actin a manner compatible with the college's unction as an educational institution.Students and visitors are expected to obey all ederal laws that pertain to behavior

    on a college campus or at a campus-sponsored event.

    The ollowing standards o conduct represent reasonable expectations o studentbehavior and violations shall constitute good cause or discipline, including but notlimited to the removal, suspension or expulsion o a student.

    1. Causing, attempting to cause, or threatening to cause physical injury toanother person.

    2. Possession, sale or otherwise urnishing any rearm, knie, explosive orother dangerous object, including, but not limited to, any acsimile rearm,knie or explosive, unless, in the case o possession o any object o thistype, the student has obtained written permission to possess the item roma district employee, which is concurred in by the Superintendent/Presidento the College.

    3. The manuacture, possession, use, sale, oer to sell or urnishing, orbeing under the infuence o, any controlled substance listed in Chapter 2(commencing with Section 11053) o Division 10 o the Caliornia Health

    and Saety Code, an alcoholic beverage, or an intoxicant o any kind; orunlawul possession o, or oering, arranging or negotiating the sale oany drug paraphernalia, as dened in Caliornia Health and Saety CodeSection 11014.5.

    4. Committing or attempting to commit robbery or extortion.

    5. Causing or attempting to cause damage to district property or to privateproperty on campus.

    6. Stealing or attempting to steal district property or private property on

    campus, or knowingly receiving stolen district property or private propertyon campus.

    7. Willul or persistent smoking in any area where smoking has been prohibitedby law or by regulation o the college or the District.

    8. Committing sexual harassment as dened by law or by District policies andprocedures.

    9. Engaging in harassing or discriminatory behavior based on race, sex

    (i.e., gender), religion, age, national origin, disability or any other statusprotected by law.

    10. Willul misconduct which results in injury or death to a student or to collegepersonnel or which results in cutting, deacing or other injury to any realor personal property owned by the District or on campus.

    11. Disruptive behavior, willul disobedience, habitual proanity or vulgarity orthe open and persistent deance o the authority o, or persistent abuseo, college personnel.

    12. Cheating, plagiarism (including plagiarism in a student publication), orengaging in other academic dishonesty.

    13. Dishonesty; orgery; alteration or misuse o college documents, records oridentication; or knowingly urnishing alse inormation to the District.

    14. Unauthorized entry upon or use o college acilities.

    15. Lewd, indecent or obscene conduct on District-owned or controlled

    property, or at District-sponsored or supervised unctions.

    16. Engaging in expression which is obscene; libelous or slanderous; orwhich so incites students as to create a clear and present danger o thecommission o unlawul acts on college premises, or the violation o lawulDistrict administrative procedures, or the substantial disruption o the orderlyoperation o the District.

    17. Persistent, serious misconduct where other means o correction have ailedto bring about proper conduct.

    Students who engage in any o the above are subject to the procedures outlinedin Student Discipline Procedures (Administrative Procedures 5520, Education Codesection 66300, 72122, 76030.)

    Academic honesty depends upon the integrity o the students and aculty. TheCollege itsel is derauded i aculty and/or students knowingly or unwittingly allowdishonest acts to be rewarded academically. It is the acultys responsibility to makeevery reasonable eort to oster honest academic conduct. I theaculty member believes that there is evidence oacademic dishonesty on the part o a studentit is the aculty members responsibility totake appropriate action in accordancewith these procedures.

    Students at Gavilan College have theright to know what constitutes academichonesty at the college and in each coursein which they are enrolled.

    Faculty members will apprise theirclasses o the ethical standards requiredin their courses and the permissible

    procedures in class work and examinations. A statement reerring to this policy as a reerence or the

    class will be presented in the course outline (green sheet)* and/or on theindividual examinations.

    Students will be inormed o the consequences o violating these standards,their rights o appeal, and the procedures to be ollowed in the appeal.

    The purpose o this procedure is to expand, clariy, and set orth clear levels o

    authority and disciplinary protocols in response to violations o the Standards oStudent Conduct (BP 5500), specically as it relates to academic honesty. Theseprocedures guarantee the student or students involved the due process rightsextended to them by state and ederal constitutional protections.     Giving homework, term paper or other academic work to another studentto plagiarize.

    Having another persons work submitted in anothers name.

    Lying to an instructor or college ocial to improve a grade.

    Altering graded work ater it has been returned, then submitting the workor re-grading (without knowledge o the instructor).

    Removing test(s) rom classroom or any other place without instructorsapproval.

    Stealing tests or keys to tests. Forging signatures on drop/add slips or other college documents.

    dfnitin Ctin: The act o obtaining or attempting to obtain credit oracademic work through any dishonest, deceptive, or raudulent means. Examplesinclude, but are not limited to:

    Copying, in part or in whole, rom anothers test or other evaluationinstrument or obtaining answers rom another person during the test

    without instructors approval. Submitting work previously presented in another course, i contrary to the

    written rules o the course.

    Using or consulting, during an examination, sources or materials notspecically authorized by the instructor.

    Intentionally altering, changing, misusing documents or records.Knowingly urnishing alse inormation or generally interering with grading

    procedures or instruction o a class. Any other act committed by student(s) in the course o academic work,

    which derauds or misrepresents, including aiding or abetting, in any othe actions dened above.

    dfnitin Pliism: The act o incorporating the ideas, words, sentences,paragraphs, or parts thereo, or the specic substance o anothers work withoutgiving appropriate credit, and representing the product as ones own work. Anexample can include, but is not limited to:

    Representing another s artistic/scholarly works such as musicalcompositions, writings, computer programs, photographs, paintings,drawings, scriptures, or similar works as ones own.

    rePorTINg ProCedUreS: When a Gavilan aculty member, responsible or acourse, has reason to believe, and has evidence to substantiate, that the behavioro a student or students alls within one or both o the above sets o denitions, itis an instructors responsibility to take the ollowing steps:

    1 Arrange an oce conerence with the student and at that time advise the

    student o the allegations and make him or her aware o the supportingevidence and the probable consequences. Any classroom conrontationshould be as discreet as possible. I, as a result o this meeting, the instructorbelieves that the students response is insucient to oset the charge oacademic dishonesty to the extent that the student may be excused, theinstructor will inorm the student o the sanctions to be recommended orassessed in accordance with this policy.

    2 At the discretion o the instructor, a written report o the inraction and

    the sanction taken may be submitted to the Vice President o Instructionwith a copy to the appropriate area Dean.

    3 When a student, who has been inormed o an impending conerenceto discuss the alleged dishonesty, ails to attend, or when the apparentdishonesty is detected near the end o the semester and the instructormakes a good aith eort to contact the student but is unable to do so, theinstructor may impose the recommended sanctions and le a written reportto the area Dean and Vice President o Instruction without a conerence.

    In either case, the students right to appeal is preserved.

    SaNCTIoNS: There shall be two major classications o sanctions that may beimposed or Academic Honesty violations: Academic and Administrative. Theimposition o one variety o sanction (Academic or Administrative) will not precludethe addition o the other.

    Academic sanctions will be dened as those actions related to courseworkand grades. Faculty are responsible or the type o academic sanction tobe applied to students involved in incidents o cheating or plagiarism.Usually a orm o grade modication will be employed.

    Administrative sanctions concerning a students status on campus and areacted on by the Vice President o Instruction.

    Faculty Discretion: Cases involving the careless or inept handling o quoted materialbut alls short o the denitions o the acts o cheating and/or plagiarism as dened inthis policy, may be dealt with at the discretion o the aculty member concerned.

    acmic Snctins: Beore sanctions can be employed, the aculty membermust have veried the instance(s) o academic dishonesty by personal observationand/or documentation. In all cases the violation should be reported to the areaDean. A student may be:

    1. Reprimanded orally. A student may be reerred or counseling but cannotbe required to seek counseling.

    2. Failed in the evaluation instrument (paper or exam).

    3. Reduced course grade, including possible ailure o course.

    4. Reerred or administrative sanctions. A aculty member may choose toreer a student to the Vice President o Instruction or disciplinary action

    in lieu o any academic sanction or in addition to the academic action theaculty member has taken.

    aministti Snctins:As stipulated in the Caliornia Administrative Code,Sanction 41301, cheating or plagiarism in connection with an academic programat a campus may warrant expulsion, suspension, probation or a lesser sanction.

    Administrative action involving academic dishonesty at Gavilan is the responsibilityo the Vice President o Instruction according to the Standards o Student Conduct(Student Discipline Procedures, AP5520). The Vice President o Instruction will notiy

    aculty members involved when action has been taken.

    The Vice President o Instruction will respond to:

    1. reerrals rom the dean

    2. fagrant violations o academic standards; and

    3. repeat violations as brought to his/her attention by the aculty or throughthe written reports led with the Vice President o Instruction.

    ProTeCTIoN o rIghTS: Nothing in this procedure is intended to denystudents who come within its scope appropriate due process. Students have theright to be inormed o the charges, the nature o the evidence supporting thecharges, and to have a meeting with the aculty member, Vice President o Instruction,or other decision-makers. Students have the right to appeal any decision resultingrom such a meeting.

    1 Academic sanctions may be appealed through the Vice President oInstruction in accordance with the Students Problem Resolution Process.

    2 Administrative sanctions resulting in disciplinary suspension or expulsioncan be appealed through the Student Discipline Procedures. (StudentDiscipline Procedures, AP5520) (Education Code 66017).

    STUdeNT-To-STUdeNT MedIaTIoN

    Mediation services will provide students with an opportunity to problem-solvetogether in a sae environment. Trained student mediators will work with two ormore students who are in confict to reach mutually agreeable solutions. Mediationservices are ree and condential.

    Students wishing to become mediators can register or Introduction to ConfictResolution (Psychology 6).

    STUdeNTS ProBLeM reSoLUTIoN ProCeSSReference: AP5530

    Confict and miscommunication are, unortunately, a act olie. Choosing how we deal with dicult issues becomes

    a personal choice we all must make.

    In the educational environment, there are also timeswhen a student and a college employee (aculty/teacher/instructor, support sta, or administrator) mayhave a problem or issue which needs some clarication

    and resolution. Thereore, Gavilan College has a procedureto help students address problems and work on solutions

    that hopeully benet all the people involved.

    The ollowing process or resolving issues is called THE STUDENTSPROBLEM RESOLUTION PROCESS and applies to specic situations on campus.

    There are also times when the students attempt to resolve problems must ollowlaws determined by the Federal Oce o Civil Rights. These situations includealleged discrimination or harassment around race/ethnicity, sexual harassment,disability, religion, gender, color, national origin and age. I you eel you haveexperienced discrimination based upon any o these actions, you must ollow aseparate procedure available rom the Gavilan College armative action ocer.

    Consult with the sta at the oce o the Vice President o Administrative Serviceslocated in HR 101.

    The areas covered by the STUDENTS PROBLEM RESOLUTION PROCESS caninclude an issue with a grade (within Education Code 76224 limitations), poorcommunication or negative behavior between you and a sta member, etc. Weencourage you to speak with a counselor or assistance in clariying your issues andunderstanding the correct process to ollow.

    I your problem is with a aculty member, you need to be aware o the concept and

    rights surrounding academic reedom.

    aCadeMIC reedoM

    It shall be the policy o the college to maintain and encourage ull reedomor its aculty, to teach, research and pursue knowledge subject to theapplicable provisions o law.

    In the exercise o this reedom the aculty member may, as provided in

    the U.S. and Caliornia Constitutions and other applicable laws, discusshis/her own subject or area o competence in the classroom, as well as anyother relevant matters, including controversial matters, so long as she/hedistinguishes between personal opinions and actual inormation.

    Faculty shall be ree rom unlawul harassment or rom unlawul intererenceor restrictions based on political views.

    Faculty shall be ree rom any and all orms o electronic or other listening orrecording devices, except with his/her express and non-continuing consent,except where allowed otherwise by law.

    The Board shall not unlawully inquire into, nor predicate any adverse actionupon a aculty members personal, political or organizational activities orpreerences.

    The Board shall not interere with a aculty members reedom o speech oruse o materials in any teaching assignment, except as allowed by law.

    The intent is to allow those activities protected by constitutional reedom

    o speech and other orms o academic reedom protected by the laws othe State o Caliornia and the laws o the United States. (From the GavilanCollege Faculty Contract, Article VII, Academic Freedom.)

    The college also recognizes and understands the hesitation you may eel whenconsidering addressing a problem with an instructor. You may ear that yourgrade in the class may suer, you may later need to take another course romthis instructor, or that nothing will change, so why bother?

    Because o these perceptions, you may sometimes think it is not worth trying

    to clear up a misunderstanding or resolve a confict. We hope that you do tryto resolve any problems, as unresolved issues take energy away rom otheraspects o your lie.

    The basic premise o any problem-solving is that you must discuss the problemwith the person who is directly involved. Although this is sometimes dicult,it is the best way to resolve a problem.

    This PROBLEM RESOLUTION PROCESS also requires this rst step.

    Preparation or your problem-solving session includes asking yoursel theollowing:

    1. What was the specic behavior with which I have a problem?

    2. How did this behavior make me eel?

    3. What specic actions do I want to see as part o a possible resolution?

    Too requently our emotional reactions to an incident cloud the actual behaviorto which we are reacting. These common reactions can also prevent us rom

    clearly stating what we would like to have happen as a resolution.

    You can work on identiying the problem alone or work through it with acounselor, sta member or riend. This preliminary thinking should help youpresent your concerns in a clear and concise manner.

    STePS or STUdeNTS ProBLeM reSoLUTIoN ProCeSS:

    The purpose o this procedure is to provide a prompt and equitable means toaddress complaints as applied to and regarding academic, administrative, andinstructional matters relating to students, and including, but are not limited to, anycomplaints dealing with any certicated, classied, or management employee oGavilan College.

    The areas covered by this procedure can include, but is not limited to poorcommunication, or negative behavior between the student and a collegerepresentative. Students with issues regarding grades must be aware o the EducationCode Section 76224 (a) which govern grievances relating to course grades. The codestates: When grades are given or any course o instruction taught in a communitycollege district, the grade given to each student shall be the grade determined by theinstructor o the course and the determination o the students grade by the instructor,

    in the absence o mistake, raud, bad aith, or incompetence, shall be nal.

    This procedure is not appropriate or situations regarding alleged discrimination orharassment around race/ethnicity, sexual harassment, disability, religion, gender,color, national origin, and age (please reer to AP 5530).

    This procedure guarantees to the student or students involved the due process rightsguaranteed to them by state and ederal constitutional protections. This procedurewill be used in a air and equitable manner, and not or purposes o retaliation. It

    is not intended to substitute or criminal or civil proceedings that may be initiatedby other agencies.

    STeP 1. Within ten (10) school days o an incident, a student must meet with theperson with whom they have a problem. The student may bring another persono their choice (i.e., sta, riend, student) to the meeting. This person is not to speakor the student, but can provide support and quiet encouragement.

    CheckPwhen step one is completeoIf the student is still dissatised, the student must notify the staff person that they will

    be taking the problem to the next step.

    STeP 2. Within ten (10) school days o Step 1, the student must meetwith the department chairperson or supervisor o the person with whom theyhave the problem. The department chairperson or supervisor can ask the student,the students supporter, and the sta member to meet together, or meet separately

    with the student and the sta person with whom there a problem.     STeP 6. An appeal may be made to the college Superintendent/President.

    This step requires that the student or the other sta member involved write a

    letter outlining the action taken so ar and the hoped-or resolution. The CollegeSuperintendent/President will review this letter and the recommendations rom theHearing Committee. She/he will schedule and hold a private meeting with the student

    to discuss and, hopeully, resolve the problem.

    The purpose o this procedure is to provide a prompt and equitable means toaddress violations o the Standards o Student Conduct (BP5500). The procedureguarantees the student or students involved the due process rights extended to

    them by state and ederal constitutional protections. The procedure will be used ina air and equitable manner, and it is not extended to substitute or criminal or civilproceedings that may be initiated by other agencies.

    In all disciplinary actions the student will be notied o the nature o the chargesagainst him/her, that he/she is given a air opportunity to reute them, and that theinstitution will not be arbitrary in its action.

    dISCIPLINary aCTIoNS aNd ProCedUreS

    The type o sanction rendered or a violation o the Standards o Conduct shall bedetermined by the appropriate college ocials or committee. Penalties are listed inthe degree o severity, but not in chronological administration. They are:

    1. Admonition: An oral statement to student oender who has violatedcollege rules.

    2. Warning: Notice to student, oral or in writing, that continuation orrepetition o wrongul conduct may be cause or additional disciplinaryaction. Written warnings may be considered in the event o utureviolations.

    3. Reprimand: Written statement o violation o a specied regulationincluding the possibility o more severe disciplinary action. Reprimandsmay be considered in the event o uture violations.

    4. Disciplinary Action: Exclusion rom participation in privileges orextracurricular activities as set orth in the notice o disciplinary action.

    5. Restitution: Reimbursement by the student or misappropriation o property.Reimbursement may take the orm o appropriate service to repair orotherwise compensate or damage.

    6. Removal rom Class: [Education Code Section 76032] An instructor mayremove a student rom his/her class when the student has interered withthe instructional process. Duration will be or the day o the removal andthe next class meeting.

    a. Instructors must complete the Student Removal rom Class orm andsubmit the orm to the area Dean.

    b. The Dean shall arrange or a conerence between the student andthe instructor regarding the removal. I the instructor or the studentrequests, the Dean shall attend the conerence.

    7. Summary Suspension: A summary suspension is or the purpose oinvestigation. It is the means o relieving the campus o tension dueto serious misconduct, removing a threat or the well-beingo students, or removing a student or students whosepresence would prevent the continued normal conducto the college community. Summary suspension islimited to that period o time necessary to ensure thatthe investigation is accomplished. This summary

    suspension shall not exceed ten (10) school days.8. Disciplinary Suspension: Exclusion rom classes

    and other privileges or activities as set orth in thenotice o suspension or denite period o time.Conditions or readmission will be stated in thenotice o suspension.

    A short term suspension is exclusion rom oneor more classes or a period o up to ten (10)

    consecutive school days.

    A long-term suspension is exclusion rom oneor more classes or the remainder o the schoolterm, or rom classes and activities o the collegeor one or more terms.

    9. Expulsion: Termination o student status or anindenite period. The conditions o readmission, ipermitted, shall be stated in the order o expulsion.

    1. Immediate Interim Suspension [Education Code Section 66017]: ThePresident o the College or designee may order immediate suspension o astudent where he or she concludes that immediate suspension is requiredto protect lives or property and to ensure the maintenance o order. Incases where an immediate interim suspension has been ordered, thetime limits contained in these procedures shall not apply. The right to aDisciplinary Appeal Hearing (when a long-term suspension or expulsionis recommended) will be aorded to the student within ten (10) schooldays o the disciplinary action.

    2. Withdrawal o Consent to Remain on Campus. The Vice President o StudentServices or designee may notiy any person or whom there is a reasonablebelie that the person has willully disrupted the orderly operation o thecampus that consent to remain on campus has been withdrawn. I theperson is on campus at the time, he or she must promptly leave or be

    escorted o campus. I consent is withdrawn by the Vice President oStudent Services a written report must be promptly made to the Presidento the College. The person rom whom consent has been withdrawnmay submit a written request or a Disciplinary Appeal Hearing withinten (10) school days o the withdrawal. The hearing will be conducted inaccordance with the provisions o this procedure relating to ImmediateInterim Suspensions. In no case shall consent to remain o campus bewithdrawn or longer than twenty (20) school days rom the date uponwhich consent was initially withdrawn. Any person as to whom consent

    to remain on campus has been withdrawn who knowingly reenters thecampus during the period in which consent has been withdrawn, exceptto come or a meeting or hearing, is subject to arrest. [Penal Code Section626.4]

    dISCIPLINary aPPeaL hearINg ProCedUreS

    1. Request or Hearing. Within ve (5) school days ater receipt o thePresidents decision regarding a long-term suspension or expulsion, the

    student may request a ormal hearing. The request must be made in writingto the President o the College or designee. Appeals are only heard orlong-term suspensions and expulsions.

    2. Schedule o Hearing. The ormal hearing shall be held within ve (5) schooldays ater a ormal request or hearing is received.

    3. Composition o the Hearing Panel. The hearing panel or any disciplinaryaction shall be composed o one administrator, one aculty member, andone student.

    4. Selection o the Hearing Panel Members. The President o the College, thePresident o the Academic Senate, and the ASB President shall each, at thebeginning o the academic year, establish a list o at least ve (5) personswho will serve on student disciplinary hearing panels. The President othe College shall appoint the hearing panel rom the names on theselists. However, no administrator, aculty member or student who has anypersonal involvement in the matter to be decided, who is a necessarywitness, or who could not otherwise act in a neutral manner shall serve

    on a hearing panel.

    5. Hearing Panel Chair. The President o the College shall appoint one membero the panel to serve as the chair. The decision o the hearing panel chairshall be nal on all matters relating to the conduct o the hearing unlessthere is a vote by both other members o the panel to the contrary.

    6. Conduct o the Hearing. The members o the hearing panel shall beprovided with a copy o the accusation against the student and any writtenresponse provided by the student beore the hearing begins. A collegerepresentative who shall be the Vice President o Student Services shallpresent the acts supporting the accusation.

    a. The college representative and the student may call witnesses andintroduce oral and written testimony relevant to the issues o thematter.

    b. Formal rules o evidence shall not apply. Any relevant evidence shall beadmitted. Unless the hearing panel determines to proceed otherwise,the college representative and the student shall each be permittedto make an opening statement. Thereater, the college representativeshall make the rst presentation, ollowed by the student. The college

    representative may present rebuttal evidence ater the studentcompletes his or her evidence. The burden shall be on the collegerepresentative to prove by substantial evidence that the acts allegedare true.

    7. Representation. The student may represent him or hersel, and may alsohave the right to be represented by a person o his or her choice. Thestudent shall not be represented by an attorney unless, in the judgment othe hearing panel, complex legal issues are involved. I the student wishes

    to be represented by an attorney, a request must be presented not lessthan ve (5) school days prior to the date o the hearing. I the studentis permitted to be represented by an attorney, the college representativemay request legal assistance. The hearing panel may also request legalassistance; any legal advisor provided to the panel may sit with it in anadvisory capacity to provide legal counsel but shall not be a member othe panel nor vote with it.

    8. Condentiality. Hearings shall be closed and condential unless the student

    requests that it be open to the public. Any such request must be made noless than ve (5) school days prior to the date o the hearing.

    a. In a closed hearing, witnesses shall not be present at the hearing whennot testiying, unless all parties and the panel agree to the contrary.

    b. The hearing shall be recorded by the District either by tape recordingor stenographic recording, and shall be the only recording made.No witness who reuses to be recorded may be permitted to givetestimony. In the event the recording is by tape recording, the hearing

    panel chair shall, at the beginning o the hearing, ask people presentto identiy themselves by name, and thereater shall ask witnesses toidentiy themselves by name. Tape recording shall remain in the custodyo the District at all times, unless released to a proessional transcribingservice. The student may request a copy o the tape recording.

    c. All testimony shall be taken under oath; the oath shall be administered

    by the hearing panel chair. Written statements o witnesses underpenalty o perjury shall not be used unless the witness is unavailable totestiy. A witness who reuses to be tape-recorded is not unavailable.

    9. Decision. Within ten (10) school days ollowing the close o the hearing,the hearing panel shall prepare and send to the President o the Collegea written decision. The decision shall include specic actual ndingsregarding the accusation, and shall include specic conclusions regardingwhether any specic section o the Standards o Student Conduct were

    violated. The decision shall also include a specic recommendationregarding the disciplinary action to be imposed, i any. The decision shallbe based only on the record o the hearing, and not on matter outsideo that record. The record consists o the original accusation, the writtenresponse, i any, o the student, and the oral and written evidence producedat the hearing.

    Long-term suspension. Within ten (10) school days ollowing receipt o the hearingpanels recommended decision, the President o the College shall render a nal writtendecision. The President o the College mayaccept, modiy or reject the ndings, decisions and recommendations o the hearingpanel. I the President o the College modies or rejects the hearing panels decision,he or she shall review the record o the hearing, and shall prepare a new writtendecision, which contains specic actual ndings and conclusions. The President othe College decision shall be orwarded to the Board o Trustees.

    The Board o Trustees shall consider any recommendation rom the President o theCollege or expulsion at the next regularly scheduled meeting o the Board ater

    receipt o the recommended decision.

    The Board shall consider an expulsion recommendation in closed session,unless the student has requested that the matter be considered in a publicmeeting in accordance with these procedures. (Education Code Section72122)

    The student shall be notied in writing, by registered or certied mail orby personal service, at least three (3) school days prior to the meeting, o

    the date, time, and place o the Boards meeting. The student may, within orty-eight hours ater receipt o the notice, request

    that the hearing be held as a public meeting.

    Even i a student has requested that the Board consider an expulsionrecommendation in a public meeting, the Board will hold any discussionthat might be in confict with the right to privacy o any student other thanthe student requesting the public meeting in closed session.

    The Board may accept, modiy or reject the ndings, decisions andrecommendations o the President o the College and/or the hearingpanel. I the Board modies or rejects the decision, the Board shall reviewthe record o the hearing, and shall prepare a new written decision, whichcontains specic actual ndings and conclusions.     Gavilan College instructors have ull authority in their classrooms. Every student isexpected to attend classes and to satisy the instructor that the work o the courseis being perormed in a systematic manner.

    Students whose classroom behavior is inappropriate may be removed rom theclass or the day o the removal and the next class meeting (See Student DisciplineProcedures in the Appendix.) Any student who reuses to leave a classroom whenrequested to do so by the instructor or an administrator o the college is subjectto disciplinary action.

    Students who eel that an instructor's authority has been misused may seek dueprocess by initiating the Students Problem Resolution Process.

    There are two types o campus parking permits - daily andsemester. Daily parking permits are available rom machineslocated near each entrance to the campus. No parking

    Developing new course curricula is an ongoing process. Ater the catalog has beenprinted, new and revised courses and majors may be available. These changes willbe available on the web version o the catalog, as it is a living document. Consultwith a counselor i your area o study has changed.

    Continuous attendance is dened as enrollment in at least one credit course peracademic year, including summers at any accredited college or university.

    Attendance at another accredited institution o higher learning is not considered aninterruption, providing the absence does not exceed our (4) years.

    A student who is absent or at least three (3) consecutive terms, including summer,is considered to be a returning student or purposes o "catalog rights" and mustollow the graduation requirements in eect at the time he or she returns or anycatalog year thereater.

    Students at Gavilan College are expected to attend all classes or which they areenrolled.

    Students missing one more class hour than the unit value or a particular coursewithout making prior arrangements may, at the instructors option, be droppedwithout possibility o credit.

    Students who do not attend the rst class session may be dropped rom class inorder to admit other students desiring to enroll. I it is necessary or a student to

    miss more than three consecutive class periods, a Leave o Absence Petition Formshould be obtained rom the Admissions and Records Oce.

    The petition must be approved by all the students instructors and returned to theAdmissions and Records Oce. Ordinarily, a petition or leave o absence will notbe granted or more than two weeks. Prolonged absence, even when excused,may result in grade penalties, since the student is still responsible or courserequirements.

    CoUrSe SyLLaBUSA course syllabus is an outline o expectations, major projects, test and assignmentdue dates, attendance policies, and other pertinent inormation established or anindividual course by the instructor.     Every course, course section or class, the average daily attendance o which is to

    be reported or State aid, wherever oered and maintained by the district, shallbe ullyopen to enrollment by any person who has been admitted to the collegeand who meets such prerequisites as may be established pursuant to Chapter II,

    Division 2, Part VI, Title V o the Caliornia Administrative Code, unless specicallyexempted by statute.

    Gavilan College provides special registration assistance to disabled and disadvantagedstudents in compliance with Title V o the Caliornia Administrative Code, Section504 o the Federal Rehabilitation Act and the Americans with Disabilities Act.

    CoUrSe rePeTITIoN

    There are limitations on the number o times a student may repeat a course. Allcourses listed in this publication with no repeat notation ollowing the descriptionmay be repeated once without ling a petition i a grade o D, F, NC or NP wasearned. A student may le a petition to repeat a course a second time i a gradeo D, F, NC or NP is earned again. To le a petition, the student must meet with acounselor to evaluate circumstances and receive written approval. The studentstranscript and grade point average will refect the last grade the student receivesin the course. A student may petition to repeat the course a third time by ling aRequest to Repeat a Course Under Special Circumstances and providing the necessary

    documentation to support the special circumstances claim.

    To repeat a course in which the student has received a nal grade o C or better,a student must le a Request to Repeat a Course Under Special Circumstances priorto registering or the course again. Units and grade points or the repeated courseare not computed in the grade point average unless the course is being repeatedto meet legally mandated training requirements as a condition o continued paidor volunteer employment. This request must also be approved by a counselor.

    WIThdraWaL PoLICyStudents may withdraw rom a course by notiying Admissions & Records either

    online or in person. The ollowing grading practices apply when withdrawingrom a course:

    A student who withdraws rom a course prior to 30% o the class meetingsbeing held will receive no grade o record.

    dfnitin Unit: Units o credit are based upon the Carnegie Unit, whichrequires a minimum o 3 hours o course-related work per unit o credit each weekthroughout a 16-week semester.

    During a 16-week semester at Gavilan College, a typical 3 unit lecture class will meetan average o 3.3 hours per week or classroom instruction and require an additional6.7 hours per week o outside work (reading, library research, problem-solving,projects, term papers, etc.) or a total o approximately 10 hours o course-relatedwork per week (or 160 total hours or the course). This time requirement increasesto 27 hours per week during a 6-week summer session.

    Units o credit earned in laboratory/activity classes are also based upon the 3 hoursper week per unit ratio

    A typical ull-time load is approximately 15 units per semester, requiring a minimumo 720 hours o course-related work when class lectures, labs and outside homeworkare combined.
