Aloisehas threatened, coerced, and attempted to restrain employees' exerc¡se of rights granted to them by Section 7 of theNational Labor Relalions Act by sending the employees an insulting, coercive and intimidating letter that threatensemployees who cross the union's picket line or support decertification of the union. The letter violates, coerces andattempts to restra¡n employees' exercise of rights by, including but not limited to:

(1) directly threatening employees who work during a strike and advocate decertification of the union with user/ere

consequences," including the loss of their pens¡on contribulions, health plan and retiree health plan;

(2) implicitly threatening the employees with violence by stating that a "scab needs to be smart enough to keep himselfslfe';

Locals and the Connecticut Constructions lndustries Association. (Attached) Article 30, "Hired and Leased" sets outprovisions covering the use of independent contractor owner operators. Local 559 maintains that this article prohibits use ofbwner operators uñless they are members of the Teamsters union, and has processed a grievance to arbitration scheduled

for hearíng August 12,2008. By insisting that gwner operators join the union in order to get work, the Union is violating

Section 8(e) of the National Labor Relations Act.
