    ORDER OF AN EXECUTIVE OFFICER

    NOTICE OF CLOSURE

    To: Francis Tamthe owner

    RE: The food establishment located in Calgary, Alberta and municipally described as:Fuji Yama on 17th1-908 17 Avenue SW

    WHEREASI, an Executive OfficerofAlberta Health Services, have inspected the above notedpremises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended;

    AND WHEREASsuch inspection disclosed that the following conditions exist in and about the abovenoted premises which are or may become injurious or dangerous to the public health or which mighthinder the prevention or suppression of disease, namely:

    a. Significant amount of mouse droppings found in storage area where pop canisters arestored and bar area. Observed a live mouse in the bar area.

    b. Shelving located under wooden food preparation table is rusting.c. Several missing tiles in hallway leading to back door.d. Several missing tiles on the mop sink wall.e. Tap on sink in dishwashing area is leaking.f. Hot water tap on hand sink in cooking range area is not operational.g. Sink in preparation area close to walk in cooler is leaking.

    h. Several areas of the facility have a build up of debris such as the floor in dishwashing area,lower walls in dishwashing area, floors in mop sink room, walls in mop sink room and drinkcooler in bar.

    AND WHEREASsuch inspection disclosed that the following breaches of the Public Health Act and theFood Regulation, Alberta Regulation 31/2006 and the Food Retail and Foodservices Code exist in andabout the above noted food establishment, namely:

    a. Significant amount of mouse droppings found in storage area where pop canisters arestored and bar area. Observed a live mouse in the bar area. This is in contravention ofsection 21(1) which states that the commercial food establishment and any surroundingarea, premises or facilities supporting the commercial food establishment must be kept free

    of pests and of conditions that lead to the harbouring or breeding of pests.

    b. Shelving located under wooden food preparation table is rusting. This is in contravention ofsection 28(3)which states that all equipment and utensils in a commercial foodestablishment must be kept in good working order and condition, and maintained in amanner that ensures the safe and sanitary handling of food.

    c. Several missing tiles in hallway leading to back door. This is in contravention of section17(1)(a)(b) which states that an operator must ensure that, before operation of thecommercial food establishment commences, the commercial food establishment is ofsound construction and in a good state of repair. Also is designed so as to facilitate theeffective cleaning and sanitizing of it and of all equipment, utensils and surfaces with which

    food comes into contact in it.

    d. Several missing tiles on the mop sink wall. This is in contravention of section 17(1)(a)(b)which states that an operator must ensure that, before operation of the commercial foodestablishment commences, the commercial food establishment is of sound constructionand in a good state of repair. Also is designed so as to facilitate the effective cleaning andsanitizing of it and of all equipment, utensils and surfaces with which food comes intocontact in it.

    e. Tap on sink in dishwashing area is leaking. This is in contravention of section 28(3)(a)which states that all equipment and utensils in a commercial food establishment must bekept in good working order and condition.

    f. Hot water tap on hand sink in cooking range area is not operational. This is incontravention of section 28(3)(a)(b) which states that all equipment and utensils in acommercial food establishment must be kept in good working order and condition, andmaintained in a manner that ensures the safe and sanitary handling of food.

    g. Sink in preparation area close to walk in cooler is leaking. This is in contravention ofsection 28(3)(a)(b) which states that all equipment and utensils in a commercial foodestablishment must be kept in good working order and condition, and maintained in amanner that ensures the safe and sanitary handling of food.

    h. Several areas of the facility have a build up of debris such as the floor in dishwashing area,

    lower walls in dishwashing area, floors in mop sink room, walls in mop sink room has anddrink cooler in bar. This is in contravention of section 28(2) which states that a commercialfood establishment, all equipment and utensils in it and all surfaces in it with which foodcomes into contact must be maintained in a sanitary condition and, without limiting theforegoing, must be washed and sanitized in a manner that removes contamination.

    AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to beClosed.

    NOW THEREFORE, I hereby ORDERand DIRECT:

    1. That the Owner immediately Close the above noted food establishment.

    2. That the owner immediately undertake and diligently pursue the completion of the followingwork in and about the above noted premises, namely:

    a. Clean and sanitize all areas where mouse droppings are found.b. Clean all areas that have a build up of debris such as the floor in dishwashing area,

    lower walls in dishwashing area, floors in mop sink room, walls in mop sink roomhas and drink cooler in bar.

    c. Repair shelving located under wooden food preparation table to facilitate ease ofcleaning.

    d. Repair tile in hallway leading to back door to facilitate ease of cleaning.e. Repair tile on mop sink wall to facilitate ease of cleaning.f. Repair tap in dishwashing area to ensure it is in proper working order.

    g. Repair hot water tap on hand sink in cooking range area to ensure it is in properworking order.

    h. Repair tap on sink in food preparation area by walk in cooler to ensure it is in properworking order.

    3. That until such time as the work referred to above in paragraph 2 a and b is completed tothe satisfaction of an Executive Officer of Alberta Health Services; the above noted foodestablishment shall remain closed.

    4. The work refered to in paragraph 2 c-h must be completed by March 24, 2014 to thesatisfaction of an Executive Officer of Alberta Health Services.

    The above conditions were noted at the time of inspection and may not necessarily reflect alldeficiencies. You are advised that further work may be required to ensure full compliance with thePublic Health Act and regulations, or to prevent a public health nuisance.
