My wife and I will be unable to attend the feb 14th meeting as we both work and on such short notice will not be able to get the time off. We purchased our home in Victoria park last year. One of the main factors was the nice rural area coming in from i4. We are strongly opposed to this new auto mall. 17-92 has all the car dealerships that are needed in our nice town and more here will sandwich the community of Victoria park in between lots of traffic and all the other things that come along with commercial businesses. Please don't let people's greed ruin many people's well being of life. I ask you to strongly consider not allowing this to be rezoned. Thanks for your time

Victoria Park is a 4,000 unit residential area. The part of Victoria Park closest to the proposed site is the "over 55" gated community selected by all 800 (soon to be 1,000) unit owners as a serene, safe, active retirement community. The auto mall would be devastating to all of us and you can expect very vocal resistance.

Retail, professional and restaurants will be useful to the local community. Victoria Park already has a congestion issue with limited entrances and exits, and we do not need additional traffic from non-residents. The safety hazards for our families of young children are of gravest concern.The report also states, “Rezoning the parcel to such a similar zoning classification is not likely to have a significant impact on the use or value of the affected area.” Residential property value depends largely on the nature of the property itself as well as the surrounding grounds. The development of this area into shops, stores, grocery stores and restaurants would stimulate Deland’s growth and general economy because essential services and neighborhood amenities increase desirability and home value. Residents would make frequent purchases and commercial development limited to essential services would be in line with the needs of the surrounding communities.Developing this land into acres of cars, does not add an essential service or good for those in the proximity. A car dealership is not conducive to the daily needs of the residents surrounding this area. An average American buys 13 cars in their lifetime (CNBC, 2012) whereas food, entertainment and general retail purchases are almost a daily expense in American households. An auro mall is also not aesthetically in keeping with the community. I, Heather Gargan, as a resident of Victoria Park do not want to an AutoMall in my back yard as I'm sure none of you would like one in your backyard. All of the building that is going on in this area is nonsense. The traffic on Orange Camp during rush hour in the morning and evening is getting ridiculous. Some days it takes me over five minutes to get from Interstate 4 to the first entrance into The Commons.

> Residents complain about the Bears, Coyotes and other animals roaming through our neighborhoods and its because developers knock down all of their homes to build more homes for the human race. I guess the safety and well being of these animals and our environment does not matter as much as the collecting more money.

> Most of the residents of Victoria Park and other neighborhoods close by moved out this way for the quietness, being able to see the stars and the nature. Yes, people still like and care about nature. > We deal with the daily hum of the cars, semi trucks and motorcycles on a daily basis now you want us to deal with loss of property values, bright lights, overhead paging and even more traffic. We looked long and hard to find a retirement spot thathad small town charm, the benefits of a small historic city, and beautifulsurroundings. That's why we chose to live here. An Auto Mall so close to ourresidential community would detract horribly from the beauty and tranquilityof our everyday lives. Environmentally, it would destroy naturalenvironments, trees, plants, animals AND our local environment ofconservation areas and beauty. Expanding the medical complex across OrangeCamp makes sense. This project is a ridiculous attempt to turn a buck,changing land from a planned community to looking like much of the areaaround I-4 closer to Orlando. Victoria Park has brought in thousands of newresidents to the Deland area, and has spurred commerce and growth. Those ofus in Victoria Gardens are seniors with money who had a choice of where tolive. If we'd wanted to live closer to major commercial areas like whatsurround Orlando, we would have done so. This will destroy our propertyvalues and in many cases, help cause us to lose faith in our representativesin our local government. As concerned citizens.and VOTERS.please take noteof this. PLEASE DO NOT APPROVE THIS ZONING CHANGE! An Auto Mall between hereand Sanford might make sense.NOT HERE!!

I don’t have a lot of experience with local planning requests, statutes or processes, so I will pick out the relevant “rules” within the REVIEW CRITERIA AND ANALYSIS, and state my opposition to the requestor’s analysis of each.

The rule:

Section B.2.k. – Definition of Commercial future land use designation: Commercial (COM) - This designation accommodates the full range of sales and service activities. These uses may occur in self-contained centers, multi-story structures, campus parks, municipal central business districts, or along arterial highways. In reviewing zoning requests or site plans, the specific intensity and range of uses, and design will depend on locational factors, particularly compatibility with adjacent uses, availability of highway capacity, ease of access and availability of other public services and facilities. Uses should be located to protect adjacent residential use from such impacts as noise or traffic. In wellfield protection areas uses are prohibited that involve the use, handling, storage, generation or disposal of hazardous or toxic material or waste or petroleum products. Intensity shall be no more than a fifty-five percent Floor Area Ratio (0.55 FAR) consistent with the applicable underlying zoning classification standards and land development regulations.

My response:

The I-4 interchange at Orange Camp Road already suffers from poor “ease of access.” Westbound I-4 traffic desiring to travel west on Orange Camp Road must make a full stop then a left turn across east bound traffic without benefit of traffic light. Similarly, eastbound traffic on Orange Camp Road desiring to travel east on I-4 must make a left turn across westbound traffic without benefit of a traffic light. Residential traffic exiting or entering either of the Victoria Park communities to or from Orange Camp Road do so without benefit of traffic light. During high commuter traffic hours, this entails long waits and significant risk.

The proposed auto dealership (and subsequent auto mall) with the suggested 1,000 new employees and undetermined customers, cannot possibly meet the requirement to “protect adjacent residential use from such impacts as noise or traffic” while increasing traffic

The rule:

Further, the B-4 zoning classification meets the location criteria set forth in section E.2 and 3. The most applicable standards are provided below:

2. Commercial (Generally-applicable to all commercial): I b. Not be located solely on local streets (major frontage on thoroughfare roadways);

c. Be located in areas which are adequately served by the arterial and collector road system so as not to unduly burden the local road network serving adjacent neighborhoods;

d. Have adequate area and road frontage to allow for controlled access points and proper spacing between driveways to minimize the impact on the operating capacity and safety of the adjacent road network;

e. Have sufficient area to provide adequate parking, landscaping, stormwater management, and building setbacks;

f. Where appropriate, utilize service roads, shared access, or local roads at intersections with major roads;

The response:

Orange Camp Road is already at or near capacity with commuters to DeLand from I-4 points north and south; and with commuters from DeLand to Daytona Beach and toward Orlando. Rezoning this property from B-6 to B-4 will not increase any impacts to the environment or natural resources.

My response:

The area is rich in sand hill crane, turkey, bald eagle, red-tail hawk, deer, and numerous species of heron. A lighter commercial development would much better suit the serene life-style chosen by the residents of the immediately adjacent 55+ Victoria Gardens community.

The rule:

(3) Its impact upon the economy of any affected area.

Rezoning the parcel from B-6 to B-4 is not likely to have a significant impact on the economy of the affected area.

My response:

The adjacent residential area (Victoria Gardens) is a safe, gated, serene neighborhood restricted to senior citizens who have opted for an active retirement lifestyle. This demographic group would benefit from such commercial ventures as a movie theater, bank, grocery store, restaurant, park, and a variety of shops and/or office spaces far more than from an auto dealership. They do not benefit from increased employment opportunities or auto buying opportunities.

The rule:

(7) Its effect upon the use or value of the affected area.

Both the B-6 and the B-4 zoning classifications allow similar commercial uses and intensity of development. Rezoning the parcel to such a similar zoning classification is not likely to have a significant impact on the use or value of the affected area.

My response:

Any commercial developments increasing the noise and traffic will impact the property values of the adjacent residential community – unless those developments contribute to the life-style of the demographic group living in Victoria Park/Gardens now and in the forseeable future. Those development would not include auto sales, but could include movie theater, grocery store, restaurant, bank, park, and a variety of shops and/or office spaces.

Alternatives:

If the auto mall must be built at a I-4 interchange near DeLand, the ones at SR 44 and SR 472 would be far less disruptive.

If the proposed auto dealership must be built at the Orange Camp Road interchange, then it should be isolated from the surrounding residential neighborhoods with a DOT approved noise mitigating wall and a water barrier (think moat).

I'm writing to you to express mine and my husband's concern regarding this matter. We just closed last week on our newly built home in Victoria Gardens and were shocked to discover that a proposed auto mall just a mile from our home is possibly underway. We've lived in Victoria Park for seven years (previously in Victoria Commons) and enjoy the community feel and appearance of this residential area. Allowing a business such as an auto mall in this area will certainly destroy our property values, bring obtrusive traffic and potential crime to our area and negatively affect the east DeLand and Lake Helen areas. In addition, it will open the door to other businesses of this type to come into this area. I know that the Ford family and Mr. Hurley are involved here and both are well connected in DeLand. We ask that you listen to the people of this community and consider the families and lives that will be adversely affected if the auto mall is allowed to be built, instead of the financial gain of the other parties. A more suitable location for something like this would be at either exit 118 or 114 at 472. It makes absolutely no sense to consider the area adjacent to Victoria Park.Please hear and consider our request to vote against rezoning for this proposed auto mall.
