Dear Mr. Mumy:

At the December 6,2006 meeting of the West Virginia Infiastruchre & Jobs Development Council (the ‘“Council”), the Councif authorized the West Virginia Water Development Authority (the “‘Authority”) to enter into a loan and grant agreement with Frankfort Public Service District (the “District”) for a loan of $7,249,751 and a grant of $2,000,000. The loan and grant will be made fiom the proceeds of bonds issued by the Authority on behalf of the Council. To comply with new US Internal Revenue Code requirements, the Council and the Authority replaced the binding commitment letters with the attached loan and grant agreements.

If the District intends to accept the loan and grant, its governing body must adopt a written resolution authorizing it to enter into the loan and grant agreements. If authorized, the District should execute the loan and grant agreements in triplicate and return them, along with a certified copy of the resolution, to the Authority. The District must also submit to the Council a proposed written schedde for the dosing of the Ioan and grant.

We have reviewed the pro forma revenues and expenses described in Statement H - Cash Flow Analysis and the application of those adjustments included in the accompanying Rule 42 Financial Exhibit and supporting supplementary information of Frankfort Public Service District as of June 30,201 1 and for the year then ended. Such pro forrna adjustments are based upon assumptions of the management of Frankfort Public Service District and its Board of Directors. Our review was conducted in accordance with Statements on Standards for Accounting and Review Services issued by the American Institute of Certified Public Accountants.

A review is substantially less in scope than an examination, the objective of which is the expression of an opinion on management’s assumptions and the pro forma adjustments. Accordingly, we do not express such an opinion.

The financial statements and supporting schedules in the accompanying Rule 42 Financial Exhibit and supplementary information are presented in the form prescribed by the rules governing the construction and tariffs of public utilities in West Virginia subject to the jurisdiction of the Public Service Commission of West Virginia (PSC) and are not intended to be a presentation in conformity with generally accepted accounting principles.

The objective of these pro forma financial statements and supporting schedules is to show what the effects the proposed construction project and related rate will have on the financial information of the Frankfort Public Service District.

Based on our review, nothing came to our attention that caused us to believe that the Association’s and Board’s assumptions do not provide a reasonable basis for presenting the significant effects directly attributable to the above-mentioned event, that the related pro forrna adjustments do not give appropriate effect to those assumptions in the accompanying Rule 42 Financial Exhibit and supplementary information as of June 30,201 1 and for the year then ended.

Master Meter Customers having master meters serving mulitple residential or commercial units

shall be issued a bill equal to the greater of the minimum monthly bill of $28 mulitplied by the number of individual units or the amount of sewer service to be charged based on metered water usage.

I refer to your application, received in this office on May 25,2007, regarding your proposal to temporarily impact streams (30 temporary stream crossings) and wetlands (50 temporary wetland crossings) within the Plum Run, Rocky Run, Turner Run, and Patterson Creek watersheds in order to construct new sanitary sewer lines in northern Mineral County, West Virginia.

Activities associated with projects of this type are authorized by Nationwide Permit No. 12, Utility Line Activities (see enclosure), previously issued by the Corps of Engineers, for purposes of Section 404 of the Clean Water Act as published in the March 12,2007 issue of the Federal Register.

Enclosed is a list of conditions which must be followed for the Nationwide Permit to be valid. Adherence to these conditions will permit you to proceed with the proposed project. All stream and wetland crossings must be restored to pre-construction contours and elevations. In addition, the disturbed stream banks must be properly stabilized. Please Note, the attached Compliance Certification Form must be signed and returned to this office upon completion of the proposed work.

The verification of this Nationwide Permit is valid until August 1 , 201 0 unless the Nationwide Permit is modified, suspended, or revoked. The issuance of this Nationwide Permit will not relieve you of the responsibility to obtain any other required state, local, or Federal authorizations.

The Division of Natuial Resources hereby grants to youfor a period of Twenty-five (25) years from the date hereof License and Right of Entry to construct, replace, cover, repair, operate, maintain, use and remove four-inch (4"), eight inch (8')), ten-inch (IO'), eighteen-inch (18') and twenty-one inch (21") PVC pipelines along twenty-nine (29) separate unnamed tributaries, Turner Run, and Plum Run near Fort Ashby in Mineral County, West Virginia.

This License and Right of Entry is subject to the following terms and conditions:

1. No in stream work during the fish-spawning season (April l-June 30).

Any streambed disturbance should be restricted to the immediate area. In stream use of equipment should be kept to a minimum.

The State's issuance of this License and Right of Entry does not provide for the applicant to work outside the requested boundaries nor does the State assume any liability for the applicant's/landowner's construction activities. By accepting this License and Right of Entry, the applicantllandowner assumes liability for any/all damages caused by this activity to both upstream and downstream landowners.

Guidelines of Best Management Practices for Sediment and Erosion Control as outlined by the Section of Water Resources, Division of Environmental Protection must be followed. Copies of those guidelines are available from the Section of Water Resources, Telephone No. (304) 926-0495.

The issuance of this License and Right of Entry by the Public Land Corporation does not preclude the necessity for you to obtain a permit from the U.S. Corps of Engineers District Office, Permit Section, or any other state or federal permits which may be required by law, nor does this License and Right of Entry negate the need to comply with the West Virginia Water Pollution Control Act and/or the State Environmental Quality Board's administrative regulations, applicant is also responsible for determining if the proposed activity is located within an identified flood plain and it is the applicant's responsibility for contacting the local governmental agency in charge of that program and obtaining a flood plain development permit for it. This License and Right of Entry does not grant any rights or privileges, or permission to enter upon or to cross the property of any other person, nor is permission granted to remove any material that lies upon the property of any other persons. Work should be completed in as brief a period as possible. In the event you fail or refuse to comply with any of the terms or conditions herein, this License and Right of Entry will be canceled and considered null and void and the Corporation will reject further applications.

RESPONSE:

It is the intension of the project as well as the PSD to provide sewer service to all residents residing along the sewer lines which will convey the sewage from the existing treatment plants to the new wastewater treatment plant along Patterson Creek. The laterals will be run from the new line to the property line of each customer. It is the intension of the PSD to follow State Law for requiring the new customers to connect to the line. Proposed laterals locations are shown on the construction plans.

In addition, customers utilizing the existing treatment facilities that are to be taken out of service will now have their sewage treated by the new treatment plant.

Frankfort PSD Phase I Regional Wastewater Plant and Collection System

Mineral County, West Virginia

I. Need and Description

In 2001, the Mineral County Commission requested that the Frankfort Public Service District (FPSD) investigate the feasibility of developing a sewage collection and treatment system in northern Mineral County. The planning area is located in the northeastern, rectangular shaped, section of Mineral County and is approximately 35 square miles. It is bound on the northwest and northeast by the State of Maryland, on the southeast by Hampshire County, WV, and on the southwest by the drains of Kellar Run (east to west) and Georges Run (west to east) (see Exhibit 1,2 and 3) and contains population centers and housinghusiness road corridors. The planning area excludes the Town of Ridgeley and the Town of Carpendale, both of which are already sewered and are isolated from the planning area by Knobley Mountain. The Allegany Ballistic Laboratory (ABL) operated by Allient Technologies (ATK), the Robert C. Byrd Industrial and Technology areas, and the Waxler Road (CR 8) Industry and Pinnacle Subdivision areas are also topographically isolated from the planning area and therefore excluded from the study. The Wiley Ford Community, recently sewered by FPSD, is included in the planning area because the uses of its sewer appurtenances present sewer service options to contiguous portions of the planning area.

These population centers and corridors are either lacking central sewer service (individual septic systems provide sewage service for these customers) or are served by the Fort Ashby Public Service District (FAPSD), or by 13 individual treatment plants. A review of existing central sewage system Discharge Monitoring Reports (DMR’ s) reveal that National Pollutant Discharge Elimination System (NPDES) limits are violated at twelve (12) of the fourteen (14) treatment systems in the planning area. The frequency of violations varies from intermittent, for some systems, to constant for one or more pollutants, at most systems. Review of the West Virginia Department of Environmental Protection (WVDEP) files and the Mineral County Health Department (MCHD) records reveal numerous instances of odor (septic conditions) and complaints for at least five (5) of the treatment facilities and instances of visible stream pollution in seven (7) stream discharges in the planning area. There have been two (2) incidents of aquatic life kill in one receiving stream. The public and private wastewater systems (WS) located in the planning area (see Exhibit 4 for location) are the following:

Ten (10) existing private treatment plants require upgrades, eight (8) of which need complete reconstruction based upon their existing conditions unless these plants are either eliminated or their influents are transported to a new regional treatment facility.

Patterson Creek and its tributaries are on the 2004 303 (d) list for impaired streams for Fecal Coliform. The project will have a positive effect on fecal by eliminating the failing septic tanks drainage. By eliminate the existing plants; the project will significantly reduce potential of ovefflow of raw sewage to Patterson Creek and its tributaries. Therefore, this will reduce the potential Total Fecal Coliform loading on Patterson Creek and its tributaries

A letter dated December 16,2003 by Norman Moore, RS Administrator from the Mineral County Health Department that states the following, summarizing the need for the project:

“I, and my sanitarian staff, as the on-site septic system permitting agency for Mineral County, are well aware of the predominate soils and slopes in this region that are rated severe for the installation of septic systems. These severe parameters make locating sites for systems to facilitate residential and commercial growth in the region very difficult.

Furthermore, the severe soils and slopes parameters regularly lead to surface failures of old systems and have increased applications for individual treatment plants with surface discharges-a less than desirable public health and environmental solution.

Our department, which works closely with the local Water Resources Division of the West Virginia Department of Environmental Protection, is also very aware of the collection system and treatment system problems (sewage backups, septic odors and stream discolorations) that are occurring at nearly all of the private sewer systems in the region.

Realization of a public sewer system to serve both developed and growth areas in the planning region will certainly enhance public health and the environment for the citizens of this section of Mineral County.”

Due to funding constraint as described in Section I11 - Evaluation of Alternatives, the regional wastewater project needs to be phased. This environmental assessment will address Phase I of the regional project. The first phase of the project is to provide central sewage collection and treatment facilities for approximately 1,414 customers and to improve the existing wastewater collection and treatment facilities for 383 existing customers basically along the WV Route 28 Corridor in northern Mineral County (see Exhibits 5A, 5B, 5C). The wastewater collection portion of the project will consist of approximately 10,900 LF of 8”, 18,850 LF of lo”, 3,150 LF of 12”, 3,500 LF of 15”, and 12,300 LF of 18” gravity sewer line; 21 simplex residential grinder pump units; 16 duplex residential pump units; approximately 142 manholes; approximately 2,550 LF of 3”, and 4,800 LF of 6” sewage force main and two (2) wastewater pump stations. A new .6 MGD sequencing batch reactor wastewater treatment plant will be constructed in the Patterson Creek area with a discharge to Patterson Creek.

11. Future Environment Without the Project

Without the project the realization of a public sewer system to serve both developed and growth areas in the planning region that would certainly enhance public health and the environment for the citizens of this section of Mineral County would not occur. The potential for visible stream pollution as documented previously in seven (7) streams in the planning area from the discharges of the wastewater plants would likely increase as the existing plants continue to age and the current the level of operation and maintenance remain constant. The potential of aquatic kill would also increase as documented previously. The Total Fecal Coliform loading would increase due to the loading of the existing plants, existing failing septic tank systems and future failing septic systems due to the severe soils and slope parameters located in the planning area.

111. Evaluation of Alternatives

Collection Svstem

As part of the planning process an evaluation of both the private and public collection systems was completed. The Fort Ashby Public Service District (FAPSD) system was constructed in the mid 70’s to complement the Fort Ashby Public Service District water system and provide a sanitary method of sewage disposal for the community. The system is essentially a gravity collection system of conventional construction utilizing concrete manholes and transite (asbestos cement).

A detailed inspection and evaluation of the FAPSD collection system was beyond the scope of this plan; however, general knowledge of the system and discussions with Fort Ashby Public Service District allow the following observations. The collection system has a serious I&I problem, much of which can be attributed to earlier beliefs that “more flow is better”. According to the PSD, a significant number of homes and businesses have sump pumps discharging into the system. Likewise, construction techniques utilized when making taps and repairing lines probably account for significant I&I to the system. As part of the overall regional project approximately $ 1.65 million was included for a replacement/ rehabilitation project. $250,000 has been allocated for the inspection and evaluation portion that would include visual and television inspection of the lines and manholes, smoke testing of the system, and where necessary, dye testing would be complete during the early stage of design.

An evaluation of the existing private wastewater collection systems was completed to determine if the existing collection system could be used as part of the regional solution. The evaluation included a physical inspection and review of all data available (existing flow data, as- built drawings, etc.. .) to determine the possibilities of using the existing systems. Due to the inferior quality of the collection system by today’s standards and the significant I/I problems, the majority of the systems were recommended to be replaced as part of the overall regional solution. The exceptions based on the age of systems and the limits of the I/I problems in the systems were: (1) Summit Hills Subdivision, (2) Hunt Club Division and (3) Lakewood Subdivision.

Over 60% of the customers within the project area are currently served by various collection and treatment systems. All of the collection systems are gravity systems with minimal pumping required. Some systems may have individual grinder pumps where gravity service was not possible.

In general, the topography of the planning area will facilitate gravity flow via natural drainage to centralized treatment plant locations. The three (3) service areas and nine (9) sewer sheds plus Fort Ashby collection systems were: the Death Valley Service Area that includes Scenic Lane Sewers, Patterson Creek Sewershed and Plum Run Sewershed; Fort Ashby Service Area that includes Baker Hollow Sewershed, Knobley Road Sewershed, the Turner Run Sewershed and WV 28 Route South Sewershed; Fort Ashby Collection System Upgrade; the Wiley Ford Service Area that included Swan Pond Sewershed and Wiley Ford Sewershed (Exhibit 6 )

The four Sewershed of the Fort Ashby service area plus the existing Fort Ashby collection system flow by gravity toward the Fort Ashby WWTP. Minimal pumping will be required.

The three sewersheds of the Death Valley service area generally flow by gravity to the plant recommended in the Patterson Creek community vicinity.

The third service area was designated as Wiley Ford because the flows were directed toward the existing terminus of the Wiley Ford system. The flows from the Swan Pond section have no alternative but to be pumped to the Wiley Ford system. The natural flow of the Rt. 28 North sewershed is toward the existing Wiley Ford system. These flows could also be directed toward

the Death Valley plant with some additional pumping. The Wiley Ford service area is also unique in that it does not need a new or rehabilitated wastewater treatment plant to be built to operate since the existing flows and any future flows would be pumped to Cumberland, Maryland for final treatment.

While vacuum collection systems offer a viable alternative collection system for new systems, particularly in previously non-sewered areas, in this project area over 60% of the existing customers are already sewered with a conventional gravity collection system. Therefore, replacement of existing systems, which are generally in poor condition, with a new gravity system is most cost effective. On this basis, the use of a vacuum collection system was ruled out early in the planning study in favor of a gravity collection system.

Grinder pressure systems were considered as a viable alternative. Within the planning area, one area exists where a grinder pump system will be more cost effective than a conventional gravity system. The subject area, which is part of the Patterson Creek sewershed, contains a series of valleys and ridges that would require deeply buried lines combined with pumping to achieve gravity flow.

While each sewershed is primarily laid out as a gravity system, some customers will require an individual grinder pump to connect to the system. A limited number of grinder pumps have therefore been included in each sewershed construction estimate.

After a comprehensive review of the various methods for providing sewage collection, it was determined that a gravity /pressure combination system would be the most cost-effective and implementable solution method. Following this determination, preliminary layouts of the collection system were made using USGS topographic maps, digital aerial photography, and general knowledge of the area. Each sewershed was evaluated individually, and as a combined network for a complete project. During the preliminary layout, various routing options were considered, including the use of pump stations and force mains.

Based on the preliminary design described above, detailed cost estimates were made for each sewershed. These individual sewershed cost estimates were further grouped by service area and total project.

Wastewater Treatment Plant

The regional Facility Plan process resulted submittal having three service areas and seven - all essentially gravity oriented flow - sewer sheds and two aerated lagoon treatment plants. The final treatment option was chosen after a cost analysis of all viable option to provide treatment based on the discharge requirements at that time .The option were Aerated Lagoons, Biolac Systems, Oxidation Ditches, and Sequencing Batch Reactors. Land application for the wastewater treatment and re-use of the wastewater was consider early in the process but was eliminate due to the lack of available land and a viable re-use option. The final plan at that time included two wastewater treatment plants. One of the treatment plants was an existing aerated lagoon upgraded to 0.65 MGD with a discharge relocated from Patterson Creek to the North

Branch of the Potomac River. The other treatment plant, strategically located to accommodate gravity oriented flow from the northern section of the study area was to be a new 0.50 MGD aerated lagoon facility.

The two aerated lagoon treatment facilities met the wasteload allocations at submittal time. The draft report of an ongoing state Potomac Tributary study was released on March 15,2004 following the Facility Plan submittal seeking public comment and ultimate U.S. EPA approval of WV’s Potomac Tributary Strategy. The draft report incorporated a comprehensive strategy for reducing the nutrient loading from West Virginia treatment facilities into the Chesapeake Bay. With the understanding that ultimately a West Virginia strategy with further pollutant reductions from West Virginia will be approved - it is still not approved at this time - and at the request of the WVDEP, the Facility Plan submittal and application were withdrawn.

Driven by the still unsettled but known forth-coming nutrient pollutant reduction, Addendum 1 to the Facility Plan was developed. The Addendum included slight modifications to the original Facility Plan collection system. The proposed treatment evaluation was on the two-scenario basis:

Plan 1 - Modify existing Fort Ashby Lagoon system into a Biolac System - 0.65 MGD with BNR capabilities to meet likely new discharge standards and construct a new Biolac system - 0.50 MGD - at Death Valley with BNR capabilities to meet likely new discharge standards.

Plan 2 - Construct a new 1.2 MGD BNR plant in vicinity of Patterson Creek Community capable of meeting likely new discharge standards and utilize the two existing Fort Ashby ponds for potential flow equalization and or sludge holding. The final three alternatives after consideration of all feasible options for the 1.2 MGD treatment process - each capable of BNR - were Biolac, Oxidation Ditch, and Sequencing Batch Reactor. The State of WV has adopted a policy to require treatment to meet Total Nitrogen and Total Phosphorus limits of 5.0 mg/L and 0.5 mg/L respectively. BNR requirements, under the best capital and O&M cost alternatives, added $12 million dollars to the proposed regional system.

Also considered, was having all sewer shed flows brought to the existing Fort Ashby treatment site, both upsizing and upgrading the Fort Ashby facility to 1.2 MGD design flow via a third stage clarifier and sludge disposal to the second lagoon, to facilitate all of the study area the.

After a comprehensive review of the various methods for providing sewage treatment, it was determined that Plan 2 with a Sequencing Batch Reactor Treatment system in the vicinity of the Patterson Creek Community would be the most cost-effective and implementable solution.

The Addendum was submitted as a package - the original Facility Plan plus the Addendum - addressing the likely new BNR related requirements and extensive evaluation of existing Fort Ashby facilities.

Following a comprehensive review of the proposed project and funding constraints presented in the Facility Plan, a recommendation was made to eliminate the Swan Pond and Wiley Ford sewer sheds reducing the total project cost to $37.3 million. In addition, the West Virginia

Infrastructure & Jobs Development Council Funding Committee deemed that obtaining $15.2 million in grants in any one fiscal year was not practical. The West Virginia Infrastructure & Jobs Development Council is the state clearinghouse to determine funding sources for water and sewer projects in the state. The Funding Committee recommended the development of a phased project spanning several years. The regional collection system and wastewater plant was divided into phases. Phase I of the multi-phased project is being proposed to be designed and constructed at this time. As additional funding becomes available additional phases will be design and constructed.

Phase I Wastewater Plan

The Phase I Wastewater Treatment Plant would consist of the design of a 1.20 million gallons per day (mgd) SBR treatment plant with enhanced Nutrient Removal capabilities. Initially a 0.60 mgd facility will be constructed in the vicinity of the Community of Patterson Creek with space available for the remaining treatment capacity (0.6 MGD) to be constructed when needed as part of futures phases.

The Phase I Collection system would consist of the following:

Patterson Creek Connector Interceptor: The Patterson Creek Connector interceptor will bypass and eliminate the existing Fort Ashby Treatment Lagoons. This will allow all of the Fort Ashby collection system flow to be routed to the new plant.

Plum Run Road Interceptor: The Plum Run Road interceptor will extend from the new treatment plant into the lower portion of the Plum Run sewer shed basin. This interceptor will allow the removal of the following wastewater treatment plants from service.

a) Moreland Trailer Park d) Hunt Club Subdivision b) Knobley Estates Sanitary Corporation e) Graceland Subdivision c) Sherwood Acres Subdivision

Scenic Lane Interceptor: The Scenic Lane interceptor will run from the treatment plant through the community of Patterson Creek to the Lakewood Subdivision where it will be connected to the Lakewood Utilities treatment plant influent line thus removing the Lakewood Treatment Plant from service and providing capacity for added development in Lakewood. The residents of Patterson Creek Community along the proposed route, currently unsewered, will be connected to this interceptor.

Future phases will include the replacement / rehabilitation of collection systems in the Plum Run, Scenic Lane, Patterson Creek sewersheds as recommended based on the evaluation of the existing systems as described previously. In addition, construction of sewer service to the other service (sewershed) areas will be in future phases. The additional work on the existing FAPSD collection system, which is now part of the new Frankfort PSD, will also be a part of future phases. It should be noted that the proposed 0.6 MGD WWTP has adequate capacity to treat the

existing VI problems until additional phase are built. When additional phases are built, the UI problem will have to be addressed.

Environmental Consequences

Air Quality: There are no long-term adverse impacts to air quality anticipated as a result of the project. There could be possible short-term impacts associated with construction activities. However, such impacts will be insignificant. Construction techniques that the DEP requires contractors to utilize, such as dust control measures, will minimize any impact.

Noise: The project will cause no more than short-term intermittent increases in ambient noise levels due to operation of construction equipment. These possible short-term impacts will be insignificant and will be minimized because the City will require the contractors to limit construction to daylight hours. There are no long-term impacts anticipated.

Endangered or Threatened Species: The U.S. Fish and Wildlife Service (USFWS) and West Virginia Department of Natural Resources (DNR) were contacted regarding the presence of any endangered or threatened species in the project area. The USFWS and DNR confirmed in correspondence, dated April 27,2002 and August 22,2002, respectively, that there would be no impacts to any endangered or threatened species as a result of the project.

Fish and Wildlife Resources: There will be no impact to fish and wildlife resources since construction of the project for the most part will take place in residential streets and rights-of-way in previously disturbed areas. The project should have a beneficial impact on fish and wildlife resources due to the reduction of risk of aquatic kill as occurred previously in the planning area with the elimination of the small private wastewater plants.

Wetlands, Floodplains, or Coastal Areas: No impacts are anticipated since construction activities will be limited to public roadway rights of way and the treatment plant and pump station sites. It is believed that the County has sufficient control with both the Subdivision Ordinance and Floodplain Management Ordinance to prevent any major development in the floodplain regions or wetlands.

Surface/Ground Water Resources: Possible short-term impacts associated with construction activities will be minimized by contractor compliance with DEP-required erosion and sedimentation control plans

Excessive Energy Consumption: The project will not result in excessive energy consumption. Energy saving equipment will be utilized wherever possible.

8. Loss of Prime Agricultural Land: The U.S. Department of Agricultural, Natural Resources Conservation Service had the following comments in a letter dated August 28, 2002

“According to the Soil Survey of Hampshire, Mineral, and Morgan Counties, WV (Curry, 1978) there are scattered areas of prime and statewide important farmland soils throughout the project area. Many areas of these soils have already been developed to some extent. However, there is a significant acreage of important farmland soils that remain undeveloped on the floodplain and stream terraces along Patterson Creek between the towns of Patterson Creek and Fort Ashby. I think that it is reasonable to assume that installation of public sewer along this corridor could facilitate the development and loss of these farmlands.

There are also upland soils scattered throughout the project area that do not meet the prime farmland or statewide important farmland criteria, but are locally important as pasture and hayland. These farmlands may also be lost to development as a result of this proposed project.”

It should be noted that most of the areas between Patterson Creek Road and Patterson Creek is in the 100-year flood plain in either floodway or floodway fringe as defined on the FEMA maps. Mineral County has adopted a floodplain ordinance to control construction in the floodplain. Any houses would have to be constructed above the 100-year flood elevation in the floodplain fringe. Construction is further restricted to requiring a 10-inch water rise in the floodway which essentially eliminates any building in the floodway.

The proposed interceptor from the Fort Ashby plant to the new plant in the Patterson Creek area will require any connections from the flood plain area to be pumped. Developable areas above the road outside of the floodplain may connect by gravity pending final design of the line. As rights-of -way are obtain for the project the District is going to allow the line to have a requirement which limits the number of service available along that right-of-way to a number specified by the property owner to insure that the land remains as it is currently being used. The District will be required to work with the county’s Farm Land Protection Board to develop a “limited service” right-of-way agreement to limit the impact the project has on Farmland in the area.

9. Visual Effects and Community Amenities: Short-term visual and community impacts are anticipated whenever sewerline construction takes place in communities. The procedures outlined in the required permits will assure that proper safety measures are maintained within the work zones. Long-term beneficial impacts will be realized by the reduction of the number of discharges and the elimination of the failing septic tanks. Thus the improving water quality of the streams in the area.

Sludge Disposal: No impacts are anticipated due to the project. Sludge will be disposed at a local landfill.

Socioeconomic Considerations: The residents served by this project will be assessed user charges of approximately $40.50/month. This is less than 2% of the median household level of $51.85/month. EPA believes that affordability is generally not a concern unless user charges exceed 2%. Therefore, EPA considers this project affordable.

Historical or Archaeological Sites: The West Virginia Division of Culture and History (WV SHPO) in correspondence, dated August 7,2006 suggested the following

“Archaeological Resources: A search of office site files and maps located no known archaeological sites within the proposed project area and three known archaeological sites within a one-mile radius. Due to the geographic nature of the project area and the presence of recorded sites within close proximity to the proposed treatment plant project area, we have concerns regarding the potential for unrecorded archaeological deposits within the project area. Therefore, we request that a Phase I archaeological survey is conducted on the entire project area which includes the proposed treatment plant site and the discharge line. We will complete our review upon receipt of the results of the requested Phase I archaeological survey.”

As a result of the above, a Phase I Archaeological Study will be a condition of the approval of this FONSI. The District must also follow any and all recommendation of the Phase I report.

Wild and Scenic Rivers: There will be no impacts to wild and scenic rivers since there are none located in the project area.

Secondary Impacts: No detrimental impacts are expected since the project will not serve any new customers.

Other Environmentally Sensitive Areas: There are no other environmentally sensitive areas or resources in the project area so there will be no impacts.

Public Participation:

The public participation process began with a meeting arranged by the Mineral County Commission at the Mineral County Court House. Members of Public Service Districts, WV Department of Environmental Protection, Region VI11 Planning & Development Council, Mineral County Commission, Cumberland Times News, and Rummel, Klepper & Kahl, LLP

(RK&K) engineers were present. Michael Bland, Mineral County Coordinator, conducted the meeting.

The second meeting, announced in local press, was conducted at the Frankfort High School and was attended by 3 1 persons including 16 citizens, all Mineral County Commissioners, WV Department of Environmental Protection, Mineral County Board of Education, WV Public Service Commission, and members from both Public Service Districts. Michael Bland, Mineral County Coordinator, conducted the meeting.

The third meeting was again conducted by Michael Bland and was held on March 3 1 , 2003 at the Fort Ashby Middle School. Citizens attended, plus all three County Commissioners, members of both Public Service Districts, representatives of Region VI11 Planning & Development Council, WV Department of Environmental Protection, Mineral County Health Department, Cumberland Times News, and RK&K engineers.

At these meetings, RK&K presented the preliminary results of our study to the people present. Questions were received and addressed. Additional input was actively solicited from those present and has been incorporated into this report.

In general, the attendees recognized the need for the project. The proposed user rates raised some concern among the attendees including the Public Service District members. Also, either RK&K engineers or the Mineral County Coordinator, separately or together, have met with Frankfort Public Service District and Fort Ashby Public Service District at several PSD regular meetings to discuss this project.

VI. Conclusions

Based upon this Environmental Assessment, the EPA has concluded that this project will not cause any adverse environmental impacts. The District must follow the Following conditions:

(1). The District must complete a Phase I Archaeological Study and follow any and all recommendations of the report.

(2) The District will be required to work with the Mineral County’s Farm Land Protection Board to develop a “limited service” right-of-way agreement to limit the impact the project has on farmland in the area.
