A RESOLUTION AMENDING RESOLUTION R-19-117, DETERMINING NECESSITY AND FOR EMINENT DOMAIN PROCEEDINGS FOR THE PUBLIC USE AND PUBLIC PURPOSE OF CONSTRUCTING A PUBLIC STREET, ROAD, OR HIGHWAY AS PART OF THE PUBLIC ROAD SYSTEM IN MANATEE COUNTY, FLORIDA; MAKING RELATED FINDINGS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

PARCELS 16 AND 19.1; PROJECT NO. 6054765
WHEREAS, Manatee County is a political subdivision of the State of Florida and is authorized under Chapters 73, 74, and 127, Florida Statutes, to acquire interests in privately owned lands which are necessary for the public use; and
WHEREAS, on September 24, 2019, the Board of County Commissioners of Manatee County, Florida, adopted Resolution R-19-117 determining the necessity and public purpose for and authorizing the County Attorney to commence and to prosecute eminent domain proceedings to acquire the necessary interests in certain parcels of privately owned property necessary for the Fort Hamer Road Extension Road Improvement Project; and
WHEREAS, Manatee County has determined that it is necessary to acquire or utilize property beyond that which was described in Resolution R-19-117; and
WHEREAS, the owners of these additional lands have been or may be unwilling or unable to sell the real property needed by Manatee County; and
WHEREAS, construction of the project will be impeded unless the additional property is acquired by Manatee County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Manatee County, Florida, that:
1. The Manatee County Public Works and Property Management Departments are hereby authorized to employ the services of the County Attorney, or retained counsel assigned by the County Attorney, to commence and to prosecute eminent domain proceedings to acquire the necessary interests in the aforementioned properties, which properties are more particularly described in the Schedules which are attached hereto and made a part hereof.
2. The Board of County Commissioners of Manatee County, Florida, after having considered safety of the public, cost of acquiring the right-of-way, alignment, long-term planning, and environmental factors in acquiring and utilizing the properties, hereby finds and determines that the acquisition of the following interests is necessary as to the
real properties described in the attached Schedules:

*A nonexclusive temporary right of ingress and egress, and to enter upon , place , and use as a staging and work area , and for storage of equipment, supplies , and materials , and for the purpose of demolishing all structures and removing all improvements from within the parcel and for other purposes reasonably related to said demolition across , in , on , through , under, and upon the parcel for nine months.
3. Resolution R-19-117 is hereby (1) amended to replace Schedule No. 2 thereto with attached Schedule No. 2, and (2) amended to add Schedule No. 6 .
4. Resolution R-19-117 is otherwise unaltered and shall remain in full force and effect, as amended hereby.
5. If any one or more of the provisions of this Resolution should be held contrary to law or public policy, or should for any reason whatsoever be held invalid or unenforceable by a court of competent jurisdiction , then such provision or provisions shall be null and void and shall be deemed separate from the remaining provisions of this Resolution , which remaining provisions shall continue in full force and effect, provided that the remaining provisions can be given legal effect absent the invalid portions.
6. This Resolution shall take effect immediately upon its adoption .

A RESOLUTION AMENDING RESOLUTION R-19-118, AUTHORIZING USE OF “QUICK TAKING” CONDEMNATION PROCEEDINGS FOR THE PUBLIC USE AND PUBLIC PURPOSE OF CONSTRUCTING A PUBLIC STREET, ROAD, OR HIGHWAY AS PART OF THE PUBLIC ROAD SYSTEM IN MANATEE COUNTY, FLORIDA; MAKING RELATED FINDINGS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

PARCELS 16 AND 19.1; PROJECT NO. 6054765
WHEREAS, on September 24, 2019, the Board of County Commissioners of Manatee County, Florida, adopted Resolution R-19-118 authorizing use of quick-taking condemnation proceedings for the acquisition of certain parcels of privately owned real property necessary for the construction of the Fort Hamer Road Extension Road Improvement Project; and
WHEREAS, Manatee County has determined that it is necessary to acquire or utilize property beyond that which was described in Resolution R-19-118; and
WHEREAS, Manatee County has made an effort to acquire certain property interests along or within the planned corridor of Fort Hamer Road from U.S. 301 to Erie Road by purchase from the property owners; and
WHEREAS, the Board of County Commissioners has heretofore authorized the institution of eminent domain proceedings to acquire said property, all as described and set out in Resolution R-19-117 and Resolution R-20-084; and
WHEREAS, Manatee County has determined that it is necessary to acquire or utilize portions of property adjacent to or within the planned corridor of the above-described road; and
WHEREAS, the Board of County Commissioners wishes to utilize “quick taking” condemnation proceedings.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Manatee County, Florida, that:
1. Manatee County is authorized to utilize “quick taking” eminent domain proceedings under Chapter 74, Florida Statutes, and all other applicable statutes, and the Board of County Commissioners declares its intention to utilize such proceedings to acquire the necessary interest in the properties hereinafter described.
2. Manatee County cannot proceed with the necessary improvements to the planned corridor of Fort Hamer Road from U. S. 301 to Erie Road until it acquires title to
the hereinafter-described property.
3. Delay in acquiring the necessary interest and the resultant delay in construction will adversely affect the project.
4. Manatee County will diligently pursue and prosecute the eminent domain proceedings.
5. The property to be taken is more particularly described in Schedules 1 through 6, which are attached hereto and made a part hereof.
6. Resolution R-19-118 is hereby (1 ) amended to replace Schedule No. 2 thereto with attached Schedule No. 2, and (2) amended to add Schedule No. 6.
7. Resolution R-19-118 is otherwise unaltered and shall remain in full force and effect, as amended hereby.
8. A RESOLUTION OF NECESSITY AND FOR EMINENT DOMAIN PROCEEDINGS FOR THE PUBLIC USE AND PUBLIC PURPOSE OF CONSTRUCTING A PUBLIC STREET, ROAD, OR HIGHWAY AS PART OF THE PUBLIC ROAD SYSTEM IN MANATEE COUNTY, FLORIDA; MAKING RELATED FINDINGS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
FORT HAMER ROAD EXTENSION ROAD IMPROVEMENT PROJECT (U. S. 301 TO ERIE ROAD)
PARCELS 10, 16, 19, 22, AND 26; PROJECT NO. 6054765
WHEREAS, Manatee County is a political subdivision of the State of Florida and is authorized under Chapters 73, 74, and 127, Florida Statutes, to acquire interests in privately owned lands which are necessary for the public use; and
WHEREAS, Manatee County has determined that Fort Hamer Road must be extended north of U. S. 301 to Erie Road to relieve congestion, to safely accommodate vehicular traffic, and to provide anticipated capacity needs associated with new growth, and to improve traffic circulation, and that additional land is needed for the construction, reconstruction, repairing, and maintaining of the road, and for other right-of-way purposes, including, but not limited to, sidewalks, drainage, and bicycle lanes; and
WHEREAS, Manatee County has determined that it is necessary to acquire or utilize portions of property adjacent to or within the planned corridor of the above-described road; and
WHEREAS, the owners of said land have been or may be unwilling or unable to sell the real property needed by Manatee County; and
WHEREAS, the construction of the project will be impeded unless the property is acquired by Manatee County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Manatee County, Florida, that:
1. The Manatee County Public Works and Property Management Departments are hereby authorized to employ the services of the County Attorney, or retained counsel assigned by the County Attorney, to commence and to prosecute eminent domain proceedings to acquire the necessary interests in the aforementioned properties, which properties are more particularly described in the Schedules which are attached hereto and made a part hereof.
2. The Board of County Commissioners of Manatee County, Florida, after having considered safety of the public, cost of acquiring the right-of-way, alignment, long-term planning, and environmental factors in acquiring and utilizing the properties, hereby finds and determines that the acquisition of the following interests is necessary as to the
real properties described in the attached Schedules:

If any one or more of the provisions of this Resolution should be held contrary to law or public policy, or should for any reason whatsoever be held invalid or unenforceable by a court of competent jurisdiction, then such provision or provisions shall be null and void and shall be deemed separate from the remaining provisions of this Resolution , which remaining provisions shall continue in full force and effect, provided that the remaining provisions can be given legal effect absent the invalid portions.
5. This Resolution shall take effect immediately upon its adoption .

A RESOLUTION AUTHORIZING USE OF “QUICK TAKING” CONDEMNATION PROCEEDINGS FOR THE PUBLIC USE AND PUBLIC PURPOSE OF CONSTRUCTING A PUBLIC STREET, ROAD, OR HIGHWAY AS PART OF THE PUBLIC ROAD SYSTEM IN MANATEE COUNTY, FLORIDA; MAKING RELATED FINDINGS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.
FORT HAMER ROAD EXTENSION ROAD IMPROVEMENT PROJECT (U. S. 301 TO ERIE ROAD)
PARCELS 10, 16, 19, 22, AND 26; PROJECT NO. 6054765
WHEREAS, Manatee County, a political subdivision of the State of Florida, has made an effort to acquire certain property interests along or within the planned corridor of Fort Hamer Road from U. S. 301 to Erie Road by purchase from the property owners; and
WHEREAS, the Board of County Commissioners has heretofore authorized the institution of eminent domain proceedings to acquire said property, all as described and set out in Resolution R-19-117; and
WHEREAS, Manatee County has determined that it is necessary to acquire or utilize portions of property adjacent to or within the planned corridor of the above-described road; and
WHEREAS, the Board of County Commissioners wishes to utilize “quick taking” condemnation proceedings.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Manatee County, Florida, that:
1. Manatee County is authorized to utilize “quick taking” eminent domain proceedings under Chapter 74, Florida Statutes, and all other applicable statutes, and the Board of County Commissioners declares its intention to utilize such proceedings to acquire the necessary interest in the properties hereinafter described.
2. Manatee County cannot proceed with the necessary improvements to the planned corridor of Fort Hamer Road from U. S. 301 to Erie Road until it acquires title to the hereinafter-described property.
3. Delay in acquiring the necessary interest and the resultant delay in construction will adversely affect the project.
4. Manatee County will diligently pursue and prosecute the eminent domain proceedings.
5. The property to be taken is more particularly described in Schedules 1-5,
which are attached hereto and made a part hereof.
6. The provisions of this Resolution shall supersede the provisions of any other rule, policy, or Resolution that is in conflict with and cannot be harmonized or reconciled with the provisions of this Resolution .
7. If any one or more of the provisions of this Resolution should be held contrary to law or public policy, or should for any reason whatsoever be held invalid or unenforceable by a court of competent jurisdiction , then such provision or provisions shall be null and void and shall be deemed separate from the remaining provisions of this Resolution , which remaining provisions shall continue in full force and effect, provided that the remaining provisions can be given legal effect absent the invalid portions.
8. This Resolution shall take effect immediately upon its adoption .

Background Discussion Manatee County proposes to extend Fort Hamer Road from U. S. 301 north to Erie Road to alleviate traffic demands in the area and serve the Parrish Community High School. This is a CIP-approved project which involves constructing a new four lane divided highway with closed drainage, sidewalks on both sides, and bicycle lanes to provide anticipated capacity needs associated with new growth and to improve traffic circulation in Parrish.
On September 24, 2019, the Board adopted Resolution R-19-117 determining the necessity and public purpose for and authorizing the County Attorney to commence and to prosecute eminent domain proceedings to acquire the necessary interests in certain parcels of privately owned property necessary for the Fort Hamer Road Extension Road Improvement Project, specifically, Parcels 10, 16, 19, 22, and 26, and adopted Resolution R-19-118 authorizing the use of quick-taking condemnation proceedings to acquire these parcels.
After further consideration, it was determined that it is necessary to acquire or utilize property beyond that which was described in Resolution R-19-117 and Resolution R-19-118. Because construction of the project will be impeded unless additional property is acquired, the CAO requests adoption of Resolution R-20-084 and Resolution R-20-085, amending Resolution R-19-117 and Resolution R-19-118, respectively, to include additional lands and interests.

Parcel 16) with a new Schedule No. 2. Parcel 16 in Resolution R-19-117 was two separate tracts which combined were approximately only 0.3834 acres in size. Parcel 16 in proposed Resolution R-20-084 is approximately 2.7397 acres in size. Resolution R-20-084 also amends Resolution R-19-117 to add Schedule No. 6 (also known as Parcel 19.1). Parcel 19.1 is a temporary construction easement needed for nine months to demolish structures and improvements within Parcel 19 and Parcel 19.1. Resolution R-20-085 amends Resolution R-19-118 to authorize the use of quick-taking condemnation proceedings to acquire these parcels.
Property Acquisition Division staff have attempted to negotiate to purchase these lands, but without success. If the County does not acquire these parcels, the project cannot be completed. Accordingly, the County must exercise its right and power of eminent domain to acquire these parcels in order to complete the project.
