INTRODUCTION
The present guide is one of the results of the project called „The
Network of Competent Authorities for Professional Qualifications in
Romania (IMI PQ NET Romania)” implemented by the Ministry of
National Education in partnership with the National Qualifications
Authority and the Institute for Social Policies (IPS), co-financed by the
European Social Fund through the Sectoral Operational Program Human
Resources Development 2007– 2013(POSDRU).
The General Objective of the project called „The Network of
Competent Authorities for Professional Qualifications in Romania (IMI
PQ NET Romania)” consists in creating and consolidating the IMI
Network (Internal Market Information) for the professional
qualifications in Romania (IMI PQ NET), with the purpose of
sustaining the CE initiative regarding the development of the System for
Informing the Internal Market, the development of a common initiative
in this respect, at a national level, targeting the consolidation of the
social partners’ capability (agencies and governmental organizations,
professional associations) to promote durable development through the
creation of proper instruments and communication channels and
mutual consultancy with the purpose of gaining efficient
communication with the similar organizations within the European
Union and the European Economic Area (EEA), through the IMI
platform.
To achieve the overall objective, MEN, as the beneficiary of the
project, aims to accomplish the following objectives:
Creating and developing a national network to support the
implementation of the Internal Market Information system
(IMI), by binding the capacity of the social partners, by creating
communicating channels and mutual consultation;

Developing and implementing common terms of recerence on
the certification standards for the Romanian workers’ skills and
the recognition of the professional qualifications of the EU
citizens;
Involving the Network members in sharing the information
mediated by the IMI platform, by providing information/data to
requests made by the organizations/associations from EU/EEA.
By making the guide for the professional certification and
recognition in the forestry field (expert that certifies, technically, the
quality of the Forestry Earhworks) is subscribed to achieve the second
objective mentioned and proposes the following:
Supporting the competent authorities from Romania in their
efforts to normalize the certification and the recognition
processes for the regulated professions, that they manage, by
informing them about the practices from other EU Member
States (the present guide presents the practices from other nine
Member States)
Informing all the persons who have acquired qualifications in
the analyzed activity , in Romania, and want to practice that
profession in one of the nine EU countries presented in the
guide.
In order to complete this guide, a refined methodology was applied
throughout the IMI PQ NET ROMANIA project, by consulting with
competent authorities. The main information sources needed to
complete this guide and other 29 similar professions were:
- The research of the ANC experts for each country;
- Information obtained from the competent authorities from
Romania, during consultations and workshops;
- IMI statistics and the database of the regulated professions,
belonging to the European Commision 1;

- Data collected during the study visits organized in Holland,
Italy, Spain, Denmark and Germany .
The structuring of the guide was based on the standard reference
terms, as a rough guide for the procedures of validating and certificating
the competences, and the recognition processes, defined during the
project, in two rounds of workshop with the members of the IMI PQ
NET Romania group, published with the 30 guides of certification and
recognition. Thus, when structuring the guide, three major aspects were
followed, in the analyzed countries compared to Romania, respectively
the procedures for validation and certification of competencies, the
recognition process for qualification and practicing the profession.

1. THE SETTLEMENT SITUATION IN ROMANIA AND IN OTHER MEMBER STATES OF THE EUROPEAN UNION
The guide covers aspects of skills validation/certification,
recognition and practice of the profession known in Romania as CTAP
expert (expert that certifies, technically, the quality of the Forestry
Earhworks) compared to identical, similar or related professions in nine
EU states, namely Austria, Czech Republic, Denmark, Germany, Italy,
UK, Holland, Portugal, Spain.
The guide is intended to be a tool to assist the competent authorities
from Romania (in this case, the Ministry of Environment and Climate
Change), in their efforts to normalize the certification and recognition
process of the regulated professions that they manage, by informing them
about the practices from other EU Member States. Also, this guide is
designed and structured so that it is an efficient way of informing all the
people that have obtained the qualification in Romania and want to
practice permanently or temporarly, in one of the nine EU Member States,
presented in the guide.
At the same time, the guide has some limitations. The first one is
that it presents the situation from only nine EU Member States, set for
all the developed guides. A second important limitation is that some of
the dates, in general the statistics, are available at the moment when the
guide was developed and they need to be periodically updated.
The profession as a forestry expert is not under the regulated
professions list of the Law 200 but, by the existing methodology, is a
regulated profession. By analyzing the similar professions existing in
the analyzed countries, it was found that very few professions
correspond exactly to the forestry expert, but there is a significant
number of compatible qualifications with the reviewed profession.
In table 1.1 the most important professions, similar to forestry expert
existing in EU Member States and Switzerland, are presented.

Some of these professions will be analyzed in detail in chapters 2, 3
and 4, for the listed countries. This analysis took into account the fact
that, in Romania, the certification as a CTAP is based on a wider range of
occupations, of which the most important are: forest engineer and
university professor in the forestry domain.
Statistically speaking, in terms of the flow of migrants who left in
other countries, others than those in which they obtained the
qualification, we can determine which are the most “mobile”
professions, taking as reference a relatively long time, 1997 – 2012,
noting that the professions are classified by the number of decisions
taken on recognition of the professional qualifications. Thus, starting
from the existing data3, we can conclude the following:
1. In terms of geographical mobility. Taking into consideration the
period of time 1997 - 2012, for all the decisions taken by the resident
country, for all the EU Member States and for all the professions, a
hierarchy of top 5 countries can be established (considering the country
in which the qualification was obtained) (Fig. 1.1) and the resident
country (Fig. 1.2). In figure 1.1, it can be seen that Romania occupies
the 4th place, with 8% of all the countries in which the qualification was
obtained, with UK on the first place, with 13%.

2. Based on the existing data, if we restrict the scope of analysys to
qualifications obtained in the 9 analyzed countries + Romania, with
recognition in the EU Member States, we can make a ranking of the top
5 host countries, in which the professions are regulated in each country
from the 9, where the qualifications were obtained:
For Austria (resident country), the top 5 host countries in
which the professions are regulated are: Germany with 61%, on
par with 10%, UK and Italy, and with 3%, Slovakia and the
Holland;
For the Czech Republic: 28% UK, 18% Germany, 16% Austria,
13% Slovakia and with 5% Ireland;
For Denmark: 44% Sweden, 28% UK, 10% Germany, 4% the
Holland, 3% Spain;
For Germany: 33% Austria, 17% UK, 9% the Holland, 7%
Luxembourg, 5% Denmark;
Italy: 41% UK, on par with 12% Greece and Germany, 11%
Spain and 5% Belgium;
The Holland: with 40% Belgium, 29% Germany, 17% UK, 3%
Austria and 2% Sweden;
Portugal: 61% UK, 10% Spain, 8% Belgium, 6% Germany
and 5% France;

Spain: 56% UK, 9% Germany, on par with 8% Italy and
Portugal and 7% France;
UK: with 56% Ireland, 17% Cyprus, 5% Germany with 3%
each the Holland and Spain;
And for Romania: UK with 29%, 24% Italy, 20% Belgium, 9%
Germany and 3% France;
3. Although the number of the IMI recognizing decisions is not as
high as in other professions (nurses, doctors etc.), in the forest area there
is a significant number of decisions, that will be discussed in chapter 3,
for each country and for each professions, trying to emphasize the
degree of compatibility of migrants comning from Romania, with the
recognition requirements of each country.
2. THE SKILLS VALIDATION/CERTIFICATION PROCEDURES
2.1. Professional validation/ certification procedures in the forestry field in ROMANIA
In Romania, the attestation of the experts that Certify, Technically
speaking, the quality of the Forest Earthworks (forestry field experts) is
done accordingly to the methodology appoved by the Ministry of
Environment and Forests no. 1039/2010, publishd in the Official
Gazette no. 493 from Jul 16th, 2010. Figure 2.1 presents a flowchart of
the validation and certification procedures, in order to obtain the
forestry expert certificate, which also include some aspects of practicing
the professions, made by the author, based on the methodology
presented above. This methodology can be a model for other professions
that need to be regulated by different competent authorities, because it
involves a common procedure element:

1. Setting up a Commission of Licensing/Certification by the
order of the head of the competent authority;
2. Compiling a file by the requester and submitting it to the
Commission of Licensing/Certification;
3. The analysis of the submitted documents by the Commission of
Licensing/Certification (including exceptions and exemptions)
and request for any possible additions;
4. The manifestation of the licensing/certification decision,
possibly after taking an exam;
5. Release of the Certificate/Authorisation and its entry in the
register;
6. Filing an appeal in case of refusal;
7. Examination and declaration of the final result.
The methodology to certify the forestry field experts must be seen in
the wider legal border of the Forestry Staff (consisting of individuals
who have specialized forest training, certified by the act of graduating a
form of education, recognized in Romania), governed by the emergency
ordinance no. 59/2000, with the subsequent amendments.
The forestry staff can work in: a) the institutions of the central
public authority, responsible for forestry, in the territorial forestry
inspectorates for the control in the national forestry, and in hunting
terrorial offices; b) managing forest forestry units of public property, as
well as in scientific research and forest design; c) units managing
publicly owned forest administrative units and in managing private
forest fund undivided; d) structures managing private forest belonging
to religious establishments, educational institutions or other legal
entities; e) structures constituted by individuals who owned forestry
fund.
For the admission in the Forestry Corps, the applicant must be a
Romanian citizen, be aged over 18, have the proper training, to be
employed with a labour contract and nothave been convicted for
commiting an intentionally crime.

The forestry staff is differentiated, depending on the level of
training, in:
A. Forestry straff with higher education - graduates of the Faculty
of Forestry and short period study courses: junior forest ranger, forestry
engineer, forestry chief engineer, forestry engineer inspector, engineer
inspector for the general forestry, engineer advisor forestry engineer,
junior forestry, forest engineer, principal forestry engineer;
B. Forestry staff with medium education – high school graduate
of forestry and forestry post-secondary technical school: junior forestry
technician, forestry technician, forestry technician principal
C. Forestry staff with basic training – graduates of the
professional school of forestry: junior forester, forester, ranger junior,

Based on the methodology and the flowchart in figure 2.1, the plug
for the forestry expert was achieved.

to perform forest management work; c) T o have a minimum 4 years experience as a project leader in a
specialized unit, authorized to perform forest management work.
E X C E P T I O N Notwithstanding the provisions of paragraphs. (1). Letter c) , may require
certification as forestry experts:
a) People who have worked for at least 8 years in planning forest, of which 4 years in the directorate for coordinating the management
activity within the central public authority responsible for forestry;
b) University teachers who organize specialized forest training, in the accredited forestry universities.
D E R O G A T I O N
Notwithstanding the provisions of art. 3, may require certification as forestry experts, individuals who have PhD obtained across resident
countries and it is recognized by the competent authority from the resident
state, based on a paper / thesis with a topic of forest planning, coordinated work by a professor in the forestry university, which is accredited.

In order to obtain the certification, the individuals are required to submit a
personal file, that must contain the following: a) The registration application to take the certification exam;
b) Curriculum vitae;
c) Detailed activity and the list of published works; d) Copies of diplomas or scientific titles;
e) Certified copy of the workbook;
f) Other ducments that prove the conditions from art. 3 The files shall be submitted to the secretariat of the certification commission.

The forester/Dottore forestale is a specialist in the forestry science
and works in the field of development and environmental protection. He
can approach various works of agronomy, animal husbandry, forest
planning, developing trees, environmental impact assessment, the
management of protected areas, greening plans, implementation of
projects of urban green spaces, etc4.
The procedure of validation/certification of competencies involves
university studies of five years and a training plan of 26 courses,
practical exercises and lab projects covering 20 subjects. After the
graduation, the applicant should become a member of the Forestry and
Agronomists Alumnii Order (Ordine dei Dottori Agronomi e Forestali).
This procedure is governed by art. 2 of Law no. 152 02.10.1992 -
Amendments to the Law no. 3 of 07.01.1976, and the rules governing
the profession of agriculture and forestry advisor.
For the agriculture and forestry advisor /Agronomo e forestale iunior
there is a similar procedure.

In addition to those regulated professions, there are many other
professions that are subject to regulation in the regions. For example, as
a study case, table 2.2 presents the regulated professions in the Veneto

In Spain the 2005/36/EC Directive was transposed by the "Royal
Decree 1837/2008”, which presents in Annex VIII, the alphabetical list
of all regulated professions and activities, grouped according to the
level of training available in Spain (Article 19 of the Royal Decree is
equivalent to the Article 11 of 2005/36/EC).
In the forestry domain in Spain thereare two regulated professions
that are presented in table 2.3.

For both professions, the training is described in article 11d of the
2005/36/EC Directive (Article 19.4 of Royal Decree 1837/2008),
meaning a diploma that certifies a training at the post-secondary level,
of a duration of at least thre years and at the most four years, or an
equivalent duration, extramural, in an university or an institution of
higher education or another establishment of the same level of training,
and the additional training required.

Under the generic name of Ingeniero Técnico Forestal, en la
correspondiente especialidad/ Forestry Technical Engineering in various
specialization, there can be found in various provinces of Spain
professions such as Forestry Technical Engineer / Ingenieros Técnicos
Forestales or Forestry Technical Service Engineer in the Public
Domain / Ingenieros Técnicos Forestales al Servicio de la Hacienda
Pública.
In Spain, both nationally and in each province, the procedure for
skills validation / certification requires membership of the Official
College for Technical Engineering (Colegio Oficial de Ingenieros
Técnicos Forestales), originally created by Decree no. 927/1965 under
the name The Mountain Expert College (Colegio de Peritos de Montes).
The current name was given by the Royal Decree no 614/1999 and
includes all owners, workers and mountain experts, and also forestry
technical engineers, university graduates. These associations are
regulated by the Spanish Constitution and by the professional colleges
no. 2/1974.
So, the Spanish forestry technical engineer profession is part of the
“collegial” professions , meaning that there is the legal obligation to
subscribe to the Official College of the Forestry Technical Engineers,
for all the forestry technical engineers or experts in the domain who
practice these profesions in various forms, either free or within
organizations / private institutions when using this title.

In Holland there are no regulated professions in the forestry domain.

2.6.1. Chartered forester
The skills validation / certification procedure requires that after
completing the university studies, the applicant to sustain one or more
exams in order to become a member of the Institute of Chartered
Foresters (ICF), founded in 1925 as the UK Society of Forestry. It became
the Institute of Forestry in 1974 and was incorporated by the Royal
Charter in 1982. The insititute’s main objectives are to maintain and to

improve the standards of practice and understanding all aspect related to
forestry, in the broadest sense, the protection of the public interest and the
promotion of the professional status of foresters (“foresters and arborists”)
from UK and Northern Ireland. The institude is the only professional
organizarion for the forestry, fruit farming domains and other related
services in the UK, and Chartered Foresters (MICFor or FICFor) are the
only attested forestry and fruit growers. The members practice in the
private sector, with the central or local governmental authorities, research
councils, universities and colleges etc.
In order to become a Chartered Forester, minimum 5 years of study
and practice are required (although there is a accredited professional
carrer path for the senior foresters and fruit growers). The applicant
should promote the rigorous exams and, after the qualification, he must
maintain high standars, by continuous professional development.
Chartered Forester are bounded by a code of ethics and professional
conduct rules.

In order to become a CIWEM6 member, the applicant must graduate
a specialized form of education with “Honours” and have proven
relevant experience. The ones who graduate receive the "Chartered
Water and Environment Manager" title. The applicants may choose, in
addition, to be registered in the Engineering Council and/or the Science
Council and/or the Society for the Environment.

2.6.7. Member of the Landscape Institute (CMLI)
A landscape architect7 is a person involved in planning, designing
and sometimes, landscaping gardens or similar areas. Professional
practice is known as landscape designer.
The landscape designer term is sometimes used to appoint the ones
who are not officially qualified or authorized as landscape designers.
Other people who practice as "landscape designer", but who have not

Landscape architecture was not recognized formally developed as a
distinct profession until the early twentieth century. The "landscape
architect" term has different meanings, depending on the place. The title
is protected and, in order to practice this profession, licensing or
registration is required.
The skill validation/certification procedure. The Landscape
Institute in UK is an organization recognized in the landscape design
domain. To become a certified landscape designer, it takes about 7
years. To start the process, an attested course needs to be followed at
the Landscape Institute, in order to obtain a degree as a landscape
designer or something similar. Once it is obtained, a Postgraduate
Diploma in the landscape design is needed, which covers the subject in
more depth, such as urban planning, construction and planting. After
this, the applicant must attend the course at Pathway to Chartership, a
program established by Landscape Institute. As a result, the applicat
receives the landscape architect title and becomes a member of the
Chartered Member of the Landscape Institute (CMLI).

2.7. Professional validation/ certification procedures in
the forestry field in GERMANY
In 2005, Germany has implemented the Bologna system, and is now
in progress a national qualifications framework. Further information can
be obtained from the website Deutscher Qualifikationsrahmen (DQR) -
dem gemeinsamen Internetportal des Bundesministeriums für Bildung
und Forschung und der Kultusministerkonferenz8.
Although Germany has no official rankings since 2002, Center for
Higher Education Development (CHE), in cooperation with Stern
Weekly Magazine, published an annual ranking that includes a large
number of institutions. Its main task of the independent agency
Akkreditierungsrat is to accredit the specific organizations that are
evaluating the studying programs. Akkreditierungsrat has 17 members,
reprezentând statele federale, instituţiile de învăţământ superior,
students, employers, employees and, also, international representatives.
Only under exceptional conditions, Akkreditierungsrat can evaluate the
studying programs.
Among the 153 regulated professions in Germany there are no
forestry professions. The only profession that is as close as the forestry
expert is Landschafts-n. Gartenarchitect/Landscape architect / designer

3. THE QUALIFICATION RECOGNITION PROCEDURES IN OTHER EU MEMBER STATES
3.1. General items
For the recognition of the professional qualifications under the
2005/36/EC Directive, there are three recognition systems, namely:
The automatic recognition system, based on the preventive
harmonization of the training and provides automatic
recognition, applicable to certain professions such as nursing,
dental, veterinary, midwife, architect, pharmacist etc.
The General System of Recognition, based on mutual trust
between the Member States, applicable to a large number of
professions, that may be different in the Member States. It
applies in the case where the profession is regulated in the
resident country and if the migrant has exercised or is entitled to
practice the resident country. In this system, the recognition is
not automatic, but it is based on a comparison of training

courses - provided in the two countries and the possibility, if
differences exist, to impose compensatory measures.
Recognition of proffesional experience Annex 4, in which the
recognition is based on the experience gained in the resident
country. The system applies to hand-made, commercial or
industrial type professions, listed in Annex IV of the
2005/36/EC Directive, and provides automatic recognition if
they meet the conditions laid down for each professional
category.
For the analyzed profession in the present guide, the recognition is
made through the General System of Recognition, on which there are
the following possible decisions:
Positive – General System of Recognition (without compensatory
measures);
Negative – General System of Recognition;
Positive/Negative after adaptation period (General System);
Positive/Negative after skills test (General System);
Positive/Negative after the examination.
In the case of negative decisions, the applicant can appeal in court,
through the SOLVIT system.
For the recognition by the General System, the request is addresses
to the Competent Authority from the resident country, mentioned in
chapter 2, for each profession and for each country. This request must
be sent with a series of documents and certifications listed in Annex VII
of the 2005/36/EC Directive.
Usually, the requested documents in the analyzed countries for the
EU citizens that are seeking for recognition are:
1. Proof of citizenship, usually through a copy of identity card or
passport;
2. Certificate of professional competence or qualifications, which
provides access to the profession (where the profession is regulated
in the resident country);

3. A certified copy of some specific documents that are requested for
the profession concerned, indicating the exams needed to determine
the possible existence of significant difference towards the resident
country;
4. Other certificates, diplomas, etc.. relevant to the profession
5. A certified copy of the submission to the Profession Register of the
country in which the title was obtained, if applicable;
6. A certificate stating that there are no criminal or professional
obstacles in the pursuit of the profession, issued by the competent
authority of the resident country;
8. Certificate that details any occupation in the resident country, as a
completion of the qualification for which the recognition is sought
(including the period of practical training conducted);
9. Contact details: name, address, telephone number and email. If
someone sends documents on behalf of the applicant, such as a
company or a trustee, the sender's name, address, phone and e-mail
are requested;
10. Specific conditions will be explicitly mentioned in this chapter, for
each profession (the belonging to a professional association in the
resident country, etc.).
All the documents written in a foreign language must be
accompanied by a translation in the language of the host country,
certified in accordance with the original text, issued by the diplomatic or
consular authorities of the host country that issued the diploma, or by an
official translator from the host country.
The procedural steps for the qualification recognition in the host
country can be summarized as below:
1. Informing the migrant byy the contact point of the host country, referred to in the next subsections, for each analyzed country;
2. Submitting the requested documents at the Competent Authority,
who can notify the applicant in maximum four weeks, for any additions;
3. Processing the file, in maximum 4 months;

4. Applying compensatory measures, if any:
Skill test, preceded, possibly, by a preparatory training offered by institutions authorized by the competent authority;
Training by an accommodation period;
Evaluating the language skills, by analyzing the evidence or by
an interview, oral/written test, if needed;
5. Fees – available on the websites of the competent authorities, regularly updated;
6. Release of the certificate;
7. Appeal to SOLVIT or in court, in case of a negative decision.
In Romania, for the recognition of some similar qualifications as the
forestry expert one, the methodology from July 1st, 2010, published in
the Official Gazette no. 493 of July 16th, 2010 has specific provisions, of
which the most important are the following:
The forestry experts who practice with a permanent title in one of
the EU member state can also work in Romania, after notifying the
Forestry Experts Commision and registering in the Certificates
Register of Forestry Experts (art. 8).
The forestry experts who practice with a permanent title in one of
the EU countries, can also provide certification activities,
technically speaking, to the quality of forests landscaping in
Romania, temporarily or permanently(art. 9).

highlighted only the additional procedural requirements to seven steps
above, specific to each profession, and some data on recognition
decisions taken so far.

For the qualification recognition in Italy, for the two identified
regulated professions (Agronomo e forestale iunior/ Agriculture and
forester advisor and Dottore forestale/ Forester), the general system for
the recognition, of which steps were described in Section 3.1, is applied.
As the main difference from Romania, in Italy is noticed the
management led by the Ministry if Justice (Ministero della Giustizia) of
a relatively large number of professions, most of which are not in the
forensic area, including the two analyzed professions. This is justified
by the fact that in Italy, the Ministry of Justice has been for a long time
the promoter of many legislation acts, in various areas and, for
traditional and historical reasons, a large number of heterogeneous jobs
remained under the authority of this ministry.

For the Ingeniero de montes/ Forest engineer profession there have
been taken, so far, 12 recognition decisions for the migrants from
different countries, among which there is also (with one decision)
Romania (Aneex 3.3a).
For the Forester / Ingeniero técnico forestal en la correspondiente
especialidad profession, for Romania, there are 4 out of 5 recognition
decisions taken so far, according to Annex 3.3b.
Unlik all other countries, it is noted that all the recognition decisions
for the migrants coming from Romania, were entirely taken without
compensatory measures or adaptation period, which shows the high
degree of compatibility between the higher education in Romania and
the recognition requirements in Spain. (Annex 3.3b).
For the recognition of these professions in Spain, there are no
additional requirements to become a member of the Official College of
Technical Engineering Foresters/Colegio Oficial de Ingenieros Técnicos
Forestales9.
Through the Spanish Constitution, by the Royal Decree. 614/1999
and the Law of the Professional Colleges No. 2/1974, there was
established the general and national framework of the college (and other
similar colleges in other areas), and the access conditions vary
according to each province, by the Official College of Technical

In Denmark there are no regulated professions in the forestry
domain, but for the regulated professions in this country, there are
detailed information on the website of the Ministry of Science,
Innovation and Higher Education10
.
Also, the Danish Agency for International Education (Styrelsen
International Uddanelse Fost Cirius) can perform a free evaluation, in
order to equivalate the migrant’s study courses from the resident country
with the Danish one, which is not mandatory for the qualification
recognition.

For the recognition of the Chartered forester profession, the
additional condition of being a member of Institute of Chartered
Foresters11
(ICF) is requiered, which is the competent authority for the
recognition of this profession. It is needed an experience in the
specialized domain of at least 5 years and promoting exams.
So far, there is little recognition decisions made in IMI, as shown in
Annex 3.6a.
For Chartered Environmental Health Officer (Scotland) there are no
data regarding the recognition decisions, and the competent authority is
the Royal Environmental Health Institute of Scotland 12
.
Also in Scotland, Environmental Health Officer (Scotland) has the
same competent authority to recognize and so far, there are only
decisions regarding the migrants from Ireland (Annex 3.6b).
For Chartered Environmental Health Practitioner there are no
special recognition requirements, the competent authority for the
recognition is Chartered Institute of Environmental Health13
, and
statistics show significant numbers of migrants from Ireland (Annex
3.6c).
For Environmental Health Officer, the competent authority is
Chartered Institute of Environmental Health, and statistics show a large
number of recognition decisions, in regard to other professions (Annex
3.6d).

In order to become a Member of Chartered Institution of Water and
Environmental Management (CIWEM), it is required relevant experience
in the area and graduating a high education institute, with the rating
equivalent “Honours” for UK. The competent authority for recognition
is Chartered Institution of Water & Environmental Management14
.
For the qualification recognition as a landscape architect in UK, the
migrant must become a Member of the Landscape Institute15
(CMLI),
which is the recognition authority. This is done by comparing the
applicant’ s study period and experience with Pathway to Chartership, a
program established by the Landscape Institute.
The decisions taken so far for the migrants from Germany, Ireland
and Portugal show that the recognition was done without compensatory
measures (anexa 3.6e).
3.7. The qualification recognition procedures in GERMANY
Germany adopted, on April 1st, 2012, the “Recognition Act”

Before this date there was no standard procedure for the professional
qualification recognition acquired abroad, although almost three million
persons with a professional qualification acquired abroad live and work
in Germany. Today, many people from other countries work in
Germany on occupations that are not consistent with their skill level.
Because the German economy is dependent on skilled workers, the
German government enacted the Law for improving the assessment
and recognition of foreign qualifications, also known as the Law on
recognition or the Recognition Act.

This helps to equate the procedures for the professional
qualifications and supports the skilled migrants and skilled foreign
workers on the labour market in Germany.
Germany has not a central organization, that is responsible for all
the foreign requests of the professional qualification recognition. The
responsible authorities are available in every land.
The Federal Institute for Vocational Education and Training has
created a portal for recognition process in Germany, on the website of
the Federal Ministry of Education and Research, to help individuals in
seeking foreign recognition of their professional qualifications in
finding an authority to investigate the case and provide prompt answers
to their questions about the procedure of recognition. The portal is
aimed not only for the immigrants who already live in Germany and
have gained professional qualifications abroad, but also for the skilled
workers from other countries, who are interested in working in
Germany. The portal also helps the staff who advises individuals who
are seeking for the recognition of qualifications acquired abroad.
This portal17
directs people who are seeking the recognition of a
certificate or a diploma by an authority that is responsible for assessing
those skills and provide important information on the laws and
regulations underlying the recognition of foreign qualifications
procedures. In addition, the portal provides tips and information on
career guidance.
If one of the qualifications was obtained abroad, the diploma’s
equivalent can be checked with the German titles, that will give the right
to practice without a title granted, under the Law of determining
professional qualifications – Berufsqualifikationsfeststellungsgesetz/
Professional qualification determination Act (BQFG)18
.

The access to this procedure may vary, depending on the special
requirement of the regulated professions. In some cases, there are no
procedures in place to assess qualifications from third countries. In the
base of the BQFG law, a request can be submitted by any person who:
Has the professional qualifications obtained in a EU/EEA country;
Intents to practice paid employment in Germany.
The procedure is not available for the unskilled or semiskilled
persons, who don’t have the professional qualifications.
Responsible authorities
The Chambers of Commerce and Industry, who are primarily
responsible for considering the equivalence training in the dual
system and the central authority for industry and commerce:
IHK FOSA (Approval of Foreign Skills).
The responsibility in the regulated professions domain is based
on the specialized laws and regulations of each Land.
The application of the procedure
The procedure compares foreign qualifications, with a similar
German occupation;
The competent authority shall consider whether there are
fundamental differences between foreign qualifications and the
German professional qualifications;
Professional experience acquired in Germany or abroad can also
be taken into account in addition to training;
If it is not possible to provide adequate evidence of
qualifications, an analysis can be performed to determine the
qualifications of professional skills (eg, technical discussions and work sample);
The procedure is the subject to a fee. The amount is based on
the tax table of the authority and depends on the cost and effort
involved in implementing the procedure. The responsible
authority may provide accurate information on tax.

Possible results
If the examination is positive, the authority issues an
equivalence certificate in unregulated professions. This has the
same legal consequences as a German professional
qualification. There is a certificate of the German examination.
The procedure is a prerequisite for access to employment in
regulated professions;
When there are considerable differences between foreign
qualifications and German skills, the following distinctions
must be implemented:
- In the case of training occupations, the competent
authority describes the existing professional qualifications
and describes the differences between these and the
German ones. This will help when applying for jobs and
make it possible to obtain additional qualifications, if
necessary;
- In the case of regulated professions, there may required an
adaptation measure (test or adaptation period) in order to
achieve the equivalence. The compensatory measures vary
according to the individual special laws. The responsible
authority may provide information on how accurate.

Proof that the applicant intends to work in Germany (does not
apply for EU / EEA / Switzerland and persons residing in the
EU / EEA / Switzerland).
The responsible authority may require certified copies or originals.
In some cases, the authority may accept simple copies of the documents.
The documents must be translated into German. Translations will be
prepared by the public appointed and sworn interpreters, translators in
Germany or abroad. The competent authority may waive the need for
translation.
Details of the procedure may be different, in the laws specific to
areas. The competent authority of the resident country may require to
provide more detailed information.
The length of the procedure
The responsible authority begins evaluating the equivalence
immediately after all the necessary documents are received;
From December 1st, 2012, the procedure should not take more
than three months. In difficult cases, the decision period may be
extended once, for good reasons;
The decision-making period starts with the receipt of all
required documents;
Applications from abroad can be sent directly to the responsible
authority or the Central Office for Foreign Education (ZAB). ZAB will
forward requests to the appropriate authorities.

For the Forester / Engenheiro florestal profession identified in

So far, according to official statistics, there is a single recognition
decision in Portugal, of a qualification obtaines in Spain (Annex 3.8).
For obtaining the qualification recognition as a Forester/
Engenheiro florestal there is the additional requirement of being a
member of the Order of Engineers in Portugal. According to the rules of
operation of this Order19
, the candidates for membership (effective
membership, trainee member, honorary member, student member, team
member) must submit an application to the regional secretariats of the
Order. For admission, the candidate's resume is reviewed and possibly
he is subjected to a test.
In 1993 the rules were changed so that the master’ s graduates and
the owners of the doctorates titles may be exempted from the admission
exam, based on comparasion with the program.. The admission as a
member for each category is is preceded by the completion of an

As discussed in section 2.8, there are four regulated professions in
the Czech Republic, in the forestry domain:

3.11. The SOLVIT system
The SOLVIT system is a problem-solving network, in which the EU
Member States work together to solve the problems resulting from
improper application of the law by the public authorities. Among the
areas in which the issue frequency is high and there are complaints to be
dealt by SOLVIT, there is also the professional recognition of
qualifications and diplomas, along with other areas such as access to
education, residence permits, voting rights, social security, free
movement of capital and payments etc.
In each EU member state there is a SOLVIT center, that provides
these services, free of charge. For the analyzed countries and for
Romania, the data regarding the SOLVIT centres are presented in Table
3.1.

The complaints can be submitted on-line, on the documents
available on the SOLVIT websites from each country (Table 3.1). Any
complaint through SOLVIT implies four stages to resolution:
the case is accepted, the legal base is being checked, if the
documents that were included in the base by the origin center are
not sufficient, additional documents are required;
obtaining the solution: the competent authority that is involved
in the case is contacted and it cooperates in order to obtain a
solution that is a fair, in accordance to European legislation;
solution proposal (implemented or not) – the solution must be
real, practical and in accordance to European legislation;
Monitoring the implementation of the applicant's proposal to
solve the case.
SOLVIT potential is still insufficiently exploited as a problem solving key
instrument at a national/European level, partially because of the
insufficient staff from different SOLVIT centers and also because of the
insufficient information received by the European citizens regarding the
competencies of these centers.

4. THE PURSUIT OF THE FORESTRY PROFESSIONS IN THE ANALYZED COUNTRIES
4.1. The pursuit of the CTAP experts activity in Romania
The pursuit of the expert’s activity that certifies, from a technical
view, the quality of the forest management work (CTAP experts) is
regulated under the methodology from July 1st, 2010, published in the
Official Gazette no. 493 of July 16th, 2010. The most important
provisions of this methodology in the pursuit of the activity are as
follows.
Individuals who have been certified as CTAP experts have the
following obligations:
a. To verify the forest management work for each phase of the
technological design (land, drafting, completion), analyze, modify
and, where appropriate, certify the proposed technical solutions,
with respect to legal regulations;
b. To respect the established and recorded forecast in the minutes of
the meeting held for the approval of the design theme - "Ist
conference for planning" - and of the technical solutions meeting -
"II nd conference for planning”;
c. To respect the measures set out in the minutes or notes issued after
the technical control made by the authorized persons or the ones
authorized by the central public authority, responsible for forestry or
by its subordinate units;
d. Require the meeting of an expert committee when it is found that the
technical solutions that are to be adopted have a higher;
e. Respond to the requests issues by the central public authority,
responsible for forestry, in order to take specific actions.
The Attestation Commission sanctiones with a warning the
individuals certified as CTAP experts in the following situations:

For the overcome of at the most than 5% of the annual maximum
area of 60,000 ha, which are allowed to certify;
The penalty applies for a period that will not exceed 6 months or
until the fulfillment of a), b) and c). During the suspension of the
certificate attesting the Forestry Field Expert profession, it is prohibited
the certification of forest management.
The Attestation Commission sanctiones individuals certified as
CTAP experts with withdrawal of their certification, in the following
situations:
If, during the technical forestry commision meetings, 3 projects
certified by the same CTAP expert are rejected;
To exceed by more than 5% of the annual maximum area 60,000
ha;
If the holder of the registration certificate is penalized for the
second time with a warning.
4.2. The pursuit of similar professions in the analyzed EU countries
In Italy for the pursuit of the agriculture and forestry advisor /
expert profession, it is required to be a member of the Agriculture and
Forestry Alumnii Order (Ordine dei Dottori Agronomi e Forestali). The
pursuit of other similar professions from the forestry area is the subject
to specific regulations in the regions and autonomous provinces.
For the professions presented in the study case in section 2.2 for the
Veneto region, it is required the condition to be a member of the
Agriculture and Forestry Alumnii Order, governing the professional
conduct and ethics and the training programs. There are similar
professional associations in other regions or autonomous provinces of
Italy.
For the pursuit in Spain of the professions in the foresty domain
(Ingeniero de montes/ Forest engineer and Ingeniero técnico forestal en

la correspondiente especialidad/ Forester) there is the legal obligation to
be a member of the Official College of Forestry Technical Engineering
Forestieri, that applies to all the individuals who practice in various
forms, either free or under private entities, when using this title.
From the Official College of Forestry Technical Engineering, there can
be Din Statutul Colegiului Oficial al Inginerilor Tehnici Forestieri
highlighted several articles governing the pursuit of those professions,
as follows.
Article 4 presents the way of how the member’s interests are
protected, without this act to be in contrary of some acts of the local
public administration, that they are working with. As an example, with
no limitation, some articles from the College Rules are presented.
For the members of the college, it is mandatory the profession
pursuit visa, if the profession is practiced individually, as an associate,
as an employee of a legally constituted company or inside of projects
assigned to forestry technical engineers. The existences of the visa is
also required in the situation where all the members of the college
practice for the profession for the public administration, and they are
paid, wholly or partly, in the professional fee system.
The visa is a professional tool used by the college that guarantees
the identity of the members of the college, their powers in the pursuit of
the profession, the unqualified skills and the fact that is he is not under
any disciplinary sanctions that could prevent him from practice. This
involves an external evaluation of the working documentation. Under no
circumstances, granting the visa does not take into consideration fees or
other contractual arrangements which are left to the free agreement
between the parties.
According to article 46, from the obligations of the members, stands
out the responsibility for the technical quality of the work that they carry
and how they correspond to the sectoral regulations. The college

responds only for the external evaluation documentation work but not
the predictions, calculations and conclusions of the project.
The members of the college must pay a visa fee, and the granting
procedure is established by an internal rule of the college.
In UK for the entru pursuit of some of the analyzed professions,
there is the obligation to be a member of professional organizations.
So, for the Chartered forester profession, it is mandatory the
member quality of the Institute of Chartered Foresters22
(ICF), that is
obtained after promoting rigorous examinations.
Acting under the motto “Maintaining excellence in forestry and
arboriculture”, the ICF members must maintain high training standards
through mandatory continuing professional development that involves a
minimum training of 100 hours, every three years. This continuous
training is recorded and monitored by a committee of professional and
educational standards of the ICF.
The ICF members are bound by a "code of ethics, professional
values and rules of conduct and professional practice", available on the
ICF website.
Similarly, for the pursuit of professions that require environmental
management (eg "Chartered Water and Environment Manager"), it is
required the membership of the Chartered Institution of Water and
Environmental Management (CIWEM)23
and, optional, registering in the
Engineering Council and/or the Science Council and/or the Society for
the Environment.
Also in this case, members must abide by a code of ethics and
professional conduct and are required to attend continuing training
courses ,approved by CIWEM.

For the pursuit of the landscape architect profession, it is mandatory
the membership of the Landscape Institute (Chartered Member of the
Landscape Institute).
Depending on the stage of career development and interest in the
profession, there can be distinguished several categories of membership:
Student Member – for the students with specialized courses;
Licenses Member - for those who have completed initial training, and
would like to become a fully qualified member (Chartered);
Affiliate Member - for those working in a related field who would
like to become a part of the landscape professionals community, to
benefit from networks, publications and services from the
Landscape Institute;
Chartered Member – granted only after the successful completion of
the Pathway to Chartership training program, for technical
competence and professional certification;
Senior Member – to recognize the contribution and professional
experience in the field;
Academic Member – for those who, by teaching or research,
contribute to professional developing;
Retired Members – for former members, no longer working in the
profession;
Subscribers – for those who wish to receive the publications of the
institute without membership.
In Portugal for the pursuit of the Forester/ Engenheiro florestal
profession, the membership of the Order of Engineers in Portugal /
Ordem dos Engenheiros24
is required.
According to the rules of operation from this Order, annually, the
professional progress for each member can be assessed, at his request
(art. 16), followed by the appropriate update of the degree or skill. Also,

once in seven years the professional progress is reviewed and certified
from the academic level E1 (Members with a degree in engineering -
EQF level 6), the E2 (Members with master's degree in engineering -
EQF level 7) and then E3 (Members with PhD in engineering - EQF
level 8) (art. 17).
On the other hand, each member can traverse three levels of
professional qualifications for receiving membership, a Senior Member
and the last step, Advisor Member.
Membership is granted to E1 levele candidates, and the Senior
Member one is given to the E2 and E3 levels, members who have at
least 5 years of experience and at least 3 recommendations from senior
members or advisor members.
To obtain the counselor membership, it is required a minimum of 5
years as a senior member or 15 years as a member or 20 years of
professional experience in the field, plus three recommendations from
other members councilors.
All fees are established and maintained by the National Board of
Directors.
In the Czech Republic, for the pursuit of three our of four
professions analyzed in chapters 3 and 4, a trei din cele patru profesii
analizate în capitolele 3 şi 4 additional conditions are required, that
consist of obtaining license from the authorities concerned:
For the Management of seeds and seedlings of forest wood species
/Nakládání se semeny a sazenicemi lesních profession – License
from the Ministry of Agriculture;
For Forestry manager / Odborný lesní hospodář and for Production
of the forest management plan and forest management programmes/
Zpracování lesního hospodářského plánu a lesních hospodářských
osnov – License from the Organization of the Forest State
Administration;
Licenses must be renewed periodically.

5. CONCLUSIONS
The present guide covers aspects of skills validation / certification,
recognition and pursuit of the profession in Romania, known as the
CTAP expert ( an expert who certifies the technical quality of Forestry
Earthworks) compared with identical, similar, homologous or
compatible professions from nein EU Member States, namely Austria,
Czech Republic, Denmark, Germany, Italy, UK, Holland, Portugal,
Spain.
These professions are discussed in detail in Chapters 2, 3 and 4, for
the countries listed. This analysis took into account the fact that in
Romania, the certification as a CTAP expert is based on a wider range
of occupations of which the most important are forest engineer and
university professor in the forestry area.
Achieving the certification and qualification recognition guide for
the CTAP expert seeks, primarily, to be a useful tool to inform all
persons who may be in the situation:
To follow a training program in one of the analyzed countries,
at the end of which is to pursue a similar profession of forestry;
Have a qualification adequate to the CTAP expert or one of the
qualifications that underpin CTAP certified expert and want to
be recognized and to practice in the analyzed countries;
After recognition in one of the analyzed countries, they want to
know the regulations and obligations regarding the pursuit of
the profession, the professional conduct and ethics in the field,
the membership in certain professional organizations etc.
Equally important, the guide aims to support the competent
authorities of Romania in its efforts to standardize the certification and
recognition of regulated professions that they manage, by informing
them about the practices of other EU Member States.
The main limitations of the guide are that it only deals with the
situation of 9 EU countries, set for all the developed guidelines and

some information, generally the statistics, are available when
developing guidelines and should be updated regularly.
The analysis revealed that for all occupations covered in this guide,
the recognition is done through the General System of Recognition.
Although the number of recognition decisions done by the IMI
system is not as high as in other professions (nurses, etc.), in the forestry
domain, there is still a significant number of decisions that are discussed
in Chapter 3, for each country and for each profession.
Unlike all other countries it is noted that recognition decisions for
migrants coming from Romania, taken in some countries, such as, for
example, Spain, were all without compensatory measures or adaptation
period, which indicates the high compatibility between the higher
education in Romania and the recognition requirements in Spain.
In Chapter 4, there are highlighted the professions whose pursuit is
the subject to certain membership organizations, colleges, orders etc.
and highlights the codes of ethics and professional conduct, career
development terms, service training etc.
