These actions by activists are alleged to have resulted inthe following offences :

Did knowingly present false and misleadinginformation in respect to the health and envi-ronmental risks associated with pesticide prod-ucts regulated by the Federal Government to Mu-nicipal Officials and Councillors in a success-ful bid to influence the banning of pesticidesby said officials through deceit and fraudulentmeans and did thereby commit an offence contraryto Section 123 subsection 2 of the Criminal Code( R.S., 1985 c. C46 ).

Did knowingly mislead the public, lawn careindustry and government officials with the falsepretence of having " peer reviewed studies " andendorsements of the Canadian Paediatric Societyin an effort to defraud the lawn care industryaccess to products and thereby commit an offencein excess of five thousand dollars contrary toSection 380 subsection 1 Criminal Code ( R.S.,1985 c. C46 ).

Did in addition by impeding access to HealthCanada approved pesticide products through frau-dulent means directly affect Ontario's lawn in-

dustry's $1.3 billion market contrary to Section380 subsection 2 of the Criminal Code ( R.S.,1985 c. C46 ).

Did by working together conspire to preventthe supply of Health Canada approved pesticidesin the Ontario market contrary to Section 45subsection 1(a) and (d) Competition Act ( R.S.,1985, c. C34 ).

Did knowingly present false and misleadinginformation through medical reports in respectto the health and environment risks associatedwith pesticide products regulated by the FederalGovernment under the Pest Control Products Actand did there by commit an offence contrary toSection 30 subsection 2 of the Pest ControlProducts Act ( 2002, c.28 ).

These activists worked with the Ontario Government to banpesticides using alleged false and misleading information toundermine the industry.

Names of the individuals charged will be withheld pendingthe PreEnquete hearing.

C HARLES S MITH

Charles Randal Smith is a Canadian PATHOLOGIST who was the HEAD PAEDIAT-RIC FORENSIC PATHOLOGIST at the Hospital for Sick Children in Toronto , On-tario , from 1982 to 2003 . The quality of his autopsies, and the resultingcriminal charges and convictions of several people, were CALLED INTO QUESTION and a full public inquiry was ordered. The inquiry found there to be funda-mental errors made on the part of Smith and many of the cases in which hehad testified are now being reexamined and appealed. Ontario is Canada sMOST POPULOUS PROVINCE .

Charles Smith was once considered topnotch in his field of FORENSIC CHILDPATHOLOGY . In 1999 , a Canadian documentary singled him out as one of four Canadians with this rare expertise.

For twentyfour years , Smith worked at Torontos Hospital for Sick Chil-dren . In the hospitals paediatric forensic pathology unit, he conducted morethan 1,000 child autopsies . But Smith NO LONGER PRACTISES PATHOLOGY . AnO NTARIO CORONER S INQUIRY reviewed fortyfive child autopsies in whichSmith had concluded the cause of death was either homicide or criminally suspicious.

In 2008 , the CHIEF FORENSIC PATHOLOGIST for Ontario began a public inquiry into 220 cases of shaken baby syndrome to determine if anyone wasWRONGFULLY CONVICTED in the babies deaths.

In 2002 , Smith was reprimanded with a caution by the Ontario College ofPhysicians and Surgeons for his work on three suspiciousdeath cases ,and in 2003 , he was REMOVED FROM PERFORMING AUTOPSIES .

In June 2005 , the C HIEF C ORONER OF O NTARIO ordered a review of fortyfourautopsies carried out by Smith . Thirteen of these cases had resulted inCRIMINAL CHARGES AND CONVICTIONS

. The report was released in April 2007 , in-dicating that there were SUBSTANTIAL PROBLEMS with twenty of the autopsies .

In July 2005 , Smith resigned from Hospital for Sick Children in Toronto totake up a position at Saskatoon City Hospital in Saskatchewan . He FAILED tomention to his new employers that he was under investigation for misconduct in Ontario . In December 2005 , he was dismissed. He successfully appealed,

but was not reinstated because he was not licensed to practise in Saskatche- wan. He then PLED GUILTY TO A CHARGE OF UNPROFESSIONAL CONDUCT laid by theCollege of Physicians and Surgeons of Saskatchewan , for his failure to dis-close that he was under investigation in Ontario .

On October 1 s t , 2008 , a report from Justice Goudge s concluded that there were SERIOUS P ROBLEMS with the way suspicious deaths involving children arehandled in Ontario . He pointed to the problems that had been found with thetwenty or so problematic cases that Charles Smith had handled as evi-dence of serious problems in the Ontario system. The report found that Smith actively misled his superiors, made false and misleading statements

in court and exaggerated his expertise in trials. Smith was adamant that his failings were never intentional. I simply cannot accept such a sweeping attempt to escape moral responsibility said Justice Stephen Goudge . Far from an expert in forensic child pathology, Smith lacked basic knowledge about forensic pathology , wrote Goudge in the inquiry report.

Some have accused Smith of TAKING ON A ROLE LARGER THAN PATHOLOGIST .

Some claim he was on a CRUSADE and ACTED MORE LIKE A PROSECUTOR . CouldSmith have fit right in with the EnviroManiacHealthCareWorkers ? CouldSmith have been a good BasterdEnviroManiacPhysician ?

Smith told media his marriage ended in light of stress from the highly publi-cized events. He had lived with his wife and two children on a farm north of Newmarket , Ontario . As a member of the Christian and Missionary Alliance ,Smith says he has been fuelled by his lifes purpose finding out the truthfor parents who have lost babies.

the Green space industry by spreading spread needless hysteria,fear, paranoia, and terror about pest control products.

6. Were entirely ready to have God remove all these envirodefectsof character that afflicted us with the urge to create the needless,senseless, and malicious prohibition of pest control products.

7. Humbly asked Him to remove our shortcomings and our mis guided acts that conspired to prohibit legal, safe, and irreplaceablepest control products.

8. Made a list of all persons we had harmed in the Green Space In-dustry, and became willing to make amends to them all, especiallywith open public admissions of guilt as a culprit that conspired to hurtand harm people, with policies leading to loss of revenues, businessfailures, bankruptcy, and unemployment, inflicting terror, despair, anddestitution on thousands of hapless victims throughout the GreenSpace Industry .

9. Made direct amends to such people wherever possible, exceptwhen to do so would injure them or others (unless they happen to beenviromaniacs themselves).

10 . Continued to take personal inventory and when we were wrongabout being an enviromaniac, promptly admitted that pest controlproducts were legal and safe to use.

11 . Sought through prayer and meditation to improve our consciouscontact with God, as we understood Him, praying only for knowledgeof His will for us and the power to carry that out by removing our-selves from environmental terror organizations and terrorist activities.

12 . Having had a spiritual awakening as the result of these Steps,we tried to carry this message to other enviromaniacs, and to prac-tice these principles in all our affairs, including exposing the lies andtreachery of enviromaniacs and environmental terror organizations.
