    Possible Legislative Changes Although it is too late for this heat season, Senator Dean Florez, a democrat from Los Angeles, is pushing to put outdoor heat illness prevention standards into statute. SB 477 would include requirements for employers such as:

    Provide a continuous supply of fresh, cool drinking water,

    Maintain at least one shaded area when temperatures exceed 85ºF

    Implement high-heat procedures when temperatures equal or exceed 95ºF including:

    o Providing effective methods for employees to communicate to a supervisor when necessary

    o Observing employees for signs of heat illness o Reminding employees to drink water

    The bill also specifies content for heat illness training. Criticisms of the bill include an argument that the heat triggers are too high considering DOSH has reported cases of heat illness at temperatures below 80ºF. Critics also take issue with the shade requirements. SB 477 would call for shade sufficient for 25% of the employees at a time, but critics say that employees should all have access to shade at any time.

    Heat Illness Prevention Standard Despite recent efforts, the California Heat Illness Prevention Standard still has not been revised. Last year the Cal/OSH Standards Board rejected two attempts by the Division of Occupational Safety and Health (DOSH) to revise the standard. In the absence of any new legislation, DOSH and Cal/OSHA Consultation Service have been working to educate employers about the threat of heat illness, and also to continue to step up efforts to enforce the standard. The campaign includes billboards and radio ads. Most of the advertising is in Spanish and Hmong in the Fresno area, targeting the employees and employers who are at the most risk. Cal/OSHA has also produced an educational DVD in several languages, a website (www.99calor.org) and a hotline (877) 99-CALOR (Calor is hot in Spanish).
