Food Supplements
o ‘food supplements’ means foodstuffs the purpose of which is to supplement the normal diet and which are concentrated sources of nutrients or other substances with a nutritional or physiological effect, alone or in combination, marketed in dose form, namely forms such as capsules, pastilles, tablets, pills and other similar forms, sachets of powder, ampoules of liquids, drop dispensing bottles, and other similar forms of liquids and powders designed to be taken in measured small unit quantities.

o Harmonisation at EU level seen as best way to progress.
o Harmonisation of national lists could assist with this:o Giving more legal certainty; and
o Helping resolve issues with product classification.
o Safety of products on the market already ensured under existing legislation.
o Suggestions for a way forward to be included in the consultant’s final report.

Conclusion
o Unlikely to see many, if any, changes in UK legislation affecting food supplements for the period immediately after EU exit.
o Longer term, a divergence in approach between the UK and EU may potentially be seen in relation to certain food additive issues; maximum levels of vitamins and minerals; the positioning of botanicals; and health claims.
o At the moment, only educated guesses can be made...
