MINUTES
The Board of Education of the Fontana Unified School District held aRegular Meeting on March 5, 2003, at the John D. Piazza Education Center,9680 Citrus Avenue, Fontana, California. Present at the meeting were: Dr. D.Wayne Ruble, President; Mr. Rick McClure, Clerk; Mrs. Kathy Binks, Member;Mr. Gus Hawthorn, Member; Ms. Laura Abernathy Mancha, Member; Dr.Karen Harshman, Superintendent; Mr. Emmanuel J. D’Souza, AssociateSuperintendent, Business; Ms. Fran Mazzolini, Associate Superintendent,Educational Services; and Dr. Patricia Peoples, Associate Superintendent,Administrative Services. The President called the meeting to order at 4:00 p.m.

The meeting was opened by the Pledge of Allegiance to the Flag of theUnited States of America led by the President. Dr. Ruble requested that theaudience remain standing for a moment of silence in memory of the father ofMary Thompson, Information Center Specialist in Technology; the husband ofEllen Manske, Teacher Aide (SH-MH) at Chaparral Elementary; and KateOlsen, retired employee.

On motion made by Mr. Rick McClure, seconded by Mr. Gus Hawthorn,and carried, the Board approved the minutes of the Board of Education RegularMeeting of February 19, 2003.

On motion made by Ms. Laura Abernathy Mancha, seconded by Mrs.Kathy Binks, and carried, the Board approved the addition of therecommendation for submission to the California Department of Education of anapplication to participate in the Reading First Grant for the 2003-04 school yearto the agenda.

Mr. Tony Orlich spoke of a speech by George McGovern criticizingPresident Bush’s policy on war.
Visitors’Comments
Mr. Sam Poindexter stated that he had concerns with an item on theagenda; the resolution for non-reelection of emergency, pre-intern, variablewaiver and temporary certificated employees. He asked the Board to pull theitem, as the Association did not believe it was necessary to both lay-off and fireteachers at same time, and had concerns for the future employment of theseteachers. He questioned the legality of taking action on this item along withanother; the resolution for reduction of services of certificated employees. Mr.Poindexter then voiced concerns about the additional item to approve theReading First grant and the inservice of teachers that was tied to the grant.
Dr. Harshman referred to Mr. Poindexter’s concerns for the non-reelection resolution and stated that she was very hopeful nobody would losetheir job; that there were very few districts that did not do this; other districts dothis every year. She clarified that it was not unusual or illegal; that the districthad checked with its attorneys, and it was something that needed to be done topreserve the district’s rights.
Mrs. Binks asked for clarification on the issue regarding the non-reelects.
Mr. Poindexter explained that those employees covered under thisresolution would probably not have much hope for being hired in other districtsdue to the non-reelect on their record. These teachers would be given noopportunity to resign; they would need to explain why they were non-reelected.

Mrs. Binks expressed her concern for the lack of special educationteachers and questioned why the district would release teachers when there wasa shortage in this area.
Dr. Harshman reiterated that the teachers referred to in the resolutionwere on emergency credentials.
Mr. McClure shared his similar experience with another district duringthe years he was completing his credential and received notices of this type.
Dr. Ruble commented that notice of possible layoff had always beendone with employees funded from categorical programs.
Mr. Darin Brawley, Executive Director of Certificated HumanResources, clarified the differences in References Q and R of the agenda, andstated that the education code was very specific regarding the status ofemployees on emergency credentials, pre-interns, those on variable waivers andtemporary credentialed employees.
There was further debate between Mr. Poindexter and Mr. Brawley as tothe status and rights of the employees referred to in Reference S.
Mr. McClure interjected that the district had an obligation to fill itsclassrooms with fully credentialed teachers.
Mrs. Binks commented that if credentialed teachers were available thedistrict would not have so many working on emergency credentials.
Mr. Brawley stated his belief that if the district were unable to fill any ofthe positions that were vacated due to layoff, he had no doubt these teacherswould not be rehired. He also noted that the district had an obligation toprogress in the area of hiring fully credentialed teachers.
Ms. Mazzolini introduced Mrs. Theresa Barnett, Director of StaffDevelopment, who then explained the purpose of the Reading First Grant, thestipulation of involved teachers to receive 40 hours of inservice in connectionwith the grant, and how this would be provided. Only schools with 100% buy-inof teachers were submitted. Participating teachers would receive a stipend forattending the training; and the training was not mandated by the grant, it wasonly a recommendation.

Mr. Lloyd Cash, Director of Maintenance, Operations and Construction,presented a report on current construction and modernization projectsthroughout the district. This was followed by a brief discussion on the possibleuse of Proposition 47 funds to pay for district personnel supervising theseprojects, the possibility of requesting assistance from Senator Nell Soto’s officefor this type of funding and for recourse when contractors do not completeprojects on time.

Mr. Gene Swank, Negotiations Chairman for the Fontana TeachersAssociation, advised the Board of the Association’s intent to open Article 15,Workday, on bargaining for the 2003-2004 school year.

Mr. McClure questioned what would happen if the Resolution for Non-Reelection of Emergency, Pre-Intern, Variable Waiver and TemporaryCertificated employees was not approved, and whether the Resolution forReduction of Services of Certificated Employees covered the same thing.
Mr. Brawley explained the implication for employees if a class sizeincrease were inacted which would displace teachers, the impact of the No ChildLeft Behind Act and its provision to hire fully credentialed teachers, and that notapproving the resolution to non-reelect would establish re-employment rights forteachers on emergency credentials.
Mr. McClure referred to his own past experience as an emergencycredentialed teacher, the obligation as a Board member to protect the districtfiscally, and the need to be prepared.
Dr. Ruble asked that, if the resolution were passed, would it be theobligation of the Board to make sure all of the employees covered by theresolution would have jobs.
Mr. Brawley explained that, if the resolution were pulled from theagenda, the district might be obligated to offer contracts to these employees.

Mr. McClure spoke on the agenda item to approve a contract withCalifornia School Boards Association, stating that it had become very clear tothe board members what a responsibility it was to hire a new superintendent, andthat this would be the first time in 20 years that the district had needed toconduct a search. Although $25,000 might seem like a lot of money to spend, itwas his opinion that this would be money very well spent, as the board was veryconcerned about getting it right. He commented that he was fully in support ofthe agreement.
Ms. Mancha agreed, and stated that the size of the district also made itimportant that the search was conducted properly.
Dr. Ruble noted that the cost should amount to closer to $40,000 by thetime the consultant’s expenses were covered.

Mr. Hawthorn commented on the recent Academic Night at LocustElementary School and the District Science Fair, which both had a goodrepresentation of parents in attendance. He then mentioned a presentation fromNovember on school crisis plans, and requested an update on the status of thedistrict crisis plan.
Mrs. Binks echoed Mr. Hawthorn’s comments on the Science Fair. Shethen noted that in regards to the cost of the contract with CSBA for thesuperintendent search, that the board was under pressure to get a replacementhired, and that it would pay to listen to someone who had done this in the past.
Dr. Ruble announced that due to scheduling conflicts with two boardmembers the March 19, 2003 regular meeting would be canceled, and any urgentbusiness would be conducted at the special meeting on March 12.
Mr. McClure commented on a roundtable discussion he attended withSenator Nell Soto last week where there was discussion on educational issues aswell as the current budget situation. He noted that Senator Soto was verysupportive of educator’s concerns, and would appreciate mail from constituents.He then commented on his relationship as a board member with Dr. Harshmanand complimented her performance as superintendent.

Miller High Schoolregarding the recent visit by the Accreditation Commission for Schoolsaccrediting committee, and that the results of that visit were very positive. Healso shared a request he had received from the South Coast Air QualityManagement District requesting 5 names of individuals to serve on an electronicadvisory board.

Dr. Harshman commented on the Miller WASC review; and stated thatthey were expecting a 6-year accreditation. She then noted that as a result of therecent District Science Fair, numerous student projects were going on to thecounty competition.
