Introducere

C o n s t i t u þ i a R o m â n i e iconsfinþeºte la articolul 135faptul cã „economia Românieieste economie de piaþã, bazatãpe libera iniþiativã ºi concurenþã”.

Pornind de la aceastã prevederecuprinsã în Legea fundamentalã, pentru a face faþã cu succesg loba l izãr i i economie i º iin tegrãr i i în p ia þa un icãeuropeanã, pentru a rãspundeexigenþelor impuse de calitateade viitor stat membru al UniuniiEuropene, este nevoie de ocunoaºtere aprofundatã aregu l i l o r de concuren þã ,cunoaºtere care poate fidobânditã prin promovareaactivã a culturii concurenþei.Pentru real izarea acestuideziderat un rol important revineautoritãþii naþionale în domeniu,r e s p e c t i v C o n s i l i u l u iConcurenþei.

În acest context, implementareal e g i i c o n c u r e n þ e i º i ar e g l e m e n t ã r i l o r p r i v i n dacordarea ajutorului de stat,pentru a menþine, proteja ºistimula un mediu concurenþialnormal, pentru promovareaintereselor consumatorilor ºi, nu

Introduction

The Constitution of Romaniastates in art. 135 that “Romania'seconomy is a free marketeconomy, based on freeenterprise and competition”.

Starting from this provision of theFundamental Law, in order tosuccessfully cope with theeconomic globalisation andintegration within the SingleEuropean Market, for meetingthe exigencies imposed by thequality of future Member State ofEuropean Union, it is required athorough knowledge of thecompetition rules, knowledgethat can be achieved by anactive competition advocacy. Inachieving this goal, the nationalauthority in the field has ani m p o r t a n t r o l e , i . g . t h eCompetition Council.

I n t h i s c o n t e x t , t h ei m p l e m e n t a t i o n o f t h ec o m p e t i t i o n l a w a n d o fregulations regarding the stateaids granting, in order tomaintain, protect and stimulate an o r m a l c o m p e t i t i v eenvironment, to promote the

în ultimul rând, pentru a asigurastabilitatea ºi prosperitateaeconomie i î n ansamb lu ,r e p r e z i n t ã o b i e c t i v e º iconcomitent, provocãri majorepe care Consiliul Concurenþei ºile-a asumat, astfel încâtprocesul negocierilor în curspentru Capitolul 6 – politica îndomeniul concurenþei sã poatãavansa fãrã dificultãþi.

Diseminarea culturii concurenþeiare un rol important în creareacl imatului necesar pentrue v i t a r e a d i s t o r s i o n ã r i iconcurenþei pe plan naþional. Dealtfel, cu cât existã o concurenþãmai mare pe plan intern cu atâtcompaniile româneºti devin maip u t e r n i c e î n c o m p e t i þ i ainternaþionalã.

Concomitent, respectarea strictãa regulilor privind acordareaajutoarelor de stat rãspundec e r i n þ e l o r i m p u s e d epromovarea intereselor uneilargi categorii de consumatori,prin evitarea tratamentuluidiscriminatoriu ºi a favorizãriiunor beneficiari fãrã a respectaregul i le in ternaþ ionale º ieuropene în materie.

Cultivarea, cunoaºterea ºirespectarea strictã a regulilor de

consumers' interests and, toensure economic stability andprosperity, represent objectivesand, in the same time, majorchallenges committed by theCompetition Council, thus, theon-going negotiation process forChapter 6 – Policy in the field ofcompetition to further progresswithout difficulties.

T h e d i s s e m i n a t i o n o fcompetition culture has animportant role in creating thenecessary environment foravoid ing the compet i t iondistortion on national level. Inthis manner, intense the nationalcompeti t ion is, the morep o w e r f u l t h e R o m a n i a ncompanies shall become in theinternational competition.

In the same time, the strictobservance of rules regardingthe state aid granting meets thedemands imposed by thepromotion the interests ofv a r i o u s c a t e g o r i e s o fconsumers, by avoiding unequaltreatment and preference forsome beneficiaries withoutcomplying with international andEuropean rules in this field.

concurenþã ºi a celor vizândacordarea ajutoarelor de statcreazã un mediu de afaceritransparent ºi predictibil, piaþaromâneascã devenind astfel maiatractivã pentru investitori.

Obiectivul integrãriii europene aRomâniei este condiþionat dereguli ºi practici europene îndomen iu l concuren þe i º iajutorului de stat, care sãfuncþioneze chiar înainte deaderarea propriu-zisã ca unsuport esenþial pentru statuareaeconomiei de piaþã funþionale ºiviabile.

Iatã de ce Consiliul Concurenþeia considerat oportunã adoptareaacestui document referitor lacultura concurenþei. În acelaºiscop, au fost întreprinse o seriede acþiuni concrete privinddescifrarea ºi înþelegerea unoraspecte relevante de ordinconceptual.

Promovarea culturii concurenþeinu este neapãrat un demersoriginal, românesc, ci reprezintão activitate pentru care toateautoritãþile de concurenþã ºi-auconcentrat eforturile. Experienþainternaþionalã a demonstrat cã întimp, prin promovarea culturii

Romania's integration objectiveis conditioned by European rulesand practices in the competitionand state aid field, that mustfunction even before theaccession itself as an essentialsupport for a viable andfunctional market economy.

Therefore, the CompetitionCouncil considers appropriatethe adoption of this documentregarding the competit ionculture. For the same purpose,there were undertaken a numberof concrete actions regarding theinterpretation and the under-standing of certain relevantaspects of conceptual nature.

The competition advocacy is notnecessa r i l y an o r i g i na l ,Romanian action, but representsan act iv i ty on which al lcompetition authorities werefocused. The internationalexperience demonstrated intime that, by promoting the

1.2. Consideraþii generale cuprivire la semnificaþia

An essential objective of the“ p r o m o t i o n ” f u n c t i o n i srepresented by the rigorousdefinition of the competitionpolicies and of the economice f f i c i e n c y, s o t h a t t h eGovernmental decision factorscould act in consequence. Thecompeti t ion legislat ion isattached to economic policiesand behaviors that may affectthe competition on local and/ornational markets. The one-sidedregulation by a country of then a t u r a l m o n o p o l i e s ,international trade, direct foreigninvestments, rights of intellectualproperty, financial markets andprivatization policies mayconsolidate or impede theefficiency of the competition law.

The international aspectsconcerning the creation andpromotion of the competitionculture are summarized on twomain directions: to implementthe competition rules and topromote competition in practice.

1.4. Necesitatea promovãriiculturii concurenþei în

România

The competition authority isentrusted with attributionsregarding the approval ofgovernmental economic policiesand regulating policies, whichinfluence the competition.

Having the role of promoting thecompetition, the CompetitionCouncil may countervail or, atleast, minimize the adverseeffects of the profit maximizingby means of a non-competitivebehavior.

Among the important factors,which imperatively impose theconsolidation of the competitionadvocacy, are the following:

- ensuring a more efficientenforcement of the competitionrules, by increasing thec o m p e t i t i o n a u t h o r i t y ' svisibility;

- observing the competition lawand state aid law;

Such anapproach presumes a bi-univocal action: on one hand, itconcerns the consultation ofconcerned ministr ies andagencies by the CompetitionCounc i l i n cases whereinvestigations in the specific fieldof competence are needed; onthe other hand, it is also requiredthe information and priorpresentation of the competitionauthority's points of view toministries initiators of normativeacts, avoiding thus the adoptionof regulat ions containinganticompetitive provisions.
