The 2015 American Academy of Ophthalmology (AAO) Annual Meeting concluded in Las Vegas where there was further discussion of optometric scope expansion initiatives and the more dire stories of optometrists demanding of co-managing ophthalmologists that the optometrist be able to undertake and charge for pre-operative decision making and testing including optical biometry, corneal topography, femtosecond laser-assisted cataract surgery choice, and intraocular (IOL) decision making. The preoperative decision for surgery, the tests and decisions needed to provide safe surgery and informed consent, cannot be performed by anyone other than the operative surgeon. Anything less is clearly outside of the standard of care. Just say no. A recent editorial in Ophthalmology Management discusses the editor’s experience in this matter. Legislative UpdateADVOCACY

Session officially convened on Tuesday, January 12, 2016, but it seems we haven’t left Tallahassee with three Special Sessions last summer and committee hearings all fall. Your Florida Society of Ophthalmology (FSO) Executive Committee was hard at work throughout the summer and fall under the direction of President, Brad Oren, MD and Legislative Chair, Mark Michels, MD, keeping an eye on legislative action and directing key fundraising activities.

We have a great deal on our plate with efforts to pass legislation dealing with telemedicine l, 1-800 contacts bills, ARNP expansion of scope of practice, direct primary care bills, prohibition on balance billing, the OD’s second year efforts to pass vision screening legislation, and much more (see legislation filed below).

We will be posting periodic updates on our FSO website throughout the Legislative Session and hope that all of you will respond to “Calls To Action” when we need legislator’s to hear our voice on specific legislation. HB 37 by Costello - Relating to Direct Primary CareGeneral Direct Primary Care: Specifies that direct primary care agreement does not constitute insurance & is not subject to Florida Insurance Code, including ch. 636, F.S.; specifies that entering into such agreement does not constitute business of insurance & is not subject to the code; provides that certificate of authority is not required to market, sell, or offer to sell such agreement; specifies criteria for such agreement. Effective Date: July 1, 2016

HB 85 by Fitzenhagen - Relating to Recovery Care ServicesGeneral Recovery Care Services: Includes recovery care centers as facilities licensed under ch. 395,

F.S.; provides admission criteria for recovery care center; requires emergency care, transfer, & discharge protocols; authorizes AHCA to establish separate standards for recovery care centers for care & treatment of patients; directs agency to enforce special-occupancy provisions of Florida Building Code applicable to recovery care centers; provides applicability of Health Care Licensing Procedures Act; exempts recovery care centers from specified minimum licensure requirements. Effective Date: July 1, 2016

SB 132 by Grimsley - Relating to Direct Primary CareGeneral Direct Primary Care; Specifying that a direct primary care agreement does not constitute insurance and is not subject to provisions relating to prepaid limited health service organizations and discount medical plan organizations, or any other chapter of the Florida Insurance Code; providing that certain certificates of authority and licenses are not required to market, sell, or offer to sell a direct primary care agreement, etc. Effective Date: July 1, 2016

SB 152 by Grimsley - Relating to Ordering of MedicationGeneral Ordering of Medication; Revising the authority of a licensed physician assistant to order medication under the direction of a supervisory physician for a specified patient; authorizing an advanced registered nurse practitioner to order medication for administration to a specified patient; authorizing a licensed practitioner to authorize a licensed physician assistant or advanced registered nurse practitioner to order controlled substances for a specified patient under certain circumstances, etc. Effective Date: July 1, 2016

SB 178 by Bean - Relating to Quality Health Care ServicesGeneral Quality Health Care Services; Requiring the Office of Economic and Demographic Research and the Office of Program Policy Analysis and Government Accountability to complete a periodic analysis of the medical tourism marketing plan; requiring Enterprise Florida, Inc., to market this state as a health care destination in collaboration with the Department of Economic Opportunity;

SB 210 by Grimsley - Relating to Health Care General Health Care; Expanding the categories of persons who may prescribe brand name drugs under the prescription drug program when medically necessary; exempting controlled substances prescribed by an advanced registered nurse practitioner or a physician assistant from the disqualifications for certification or licensure, and for continued certification or licensure, as a deputy pilot or state pilot; applying existing penalties for violations relating to the prescribing or dispensing of controlled substances by an advanced registered nurse practitioner, etc. Effective Date: Except as otherwise expressly provided in this act, this act shall take effect upon becoming a law

SB 212 by Gaetz - Relating to Recovery Care ServicesGeneral Recovery Care Services; Providing legislative intent regarding recovery care centers; authorizing the agency to establish separate standards for the care and treatment of patients in recovery care centers; directing the agency to enforce special-occupancy provisions of the Florida Building Code applicable to recovery care centers; providing applicability of the Health Care Licensing Procedures Act to recovery care centers; exempting recovery care centers from specified minimum licensure requirements, etc. Effective Date: July 1, 2016

HB 221 by Trujillo - Relating to Health Insurance Coverage for Emergency ServicesGeneral Health Insurance Coverage for Emergency Services: Prohibits coverage for emergency services from requiring prior authorization determination; requires such coverage to be provided regardless of whether service is furnished by participating or nonparticipating provider; specifies coinsurance, copayment, limitation of benefits, & reimbursement requirements for nonparticipating providers; prohibits nonparticipating provider from collecting or attempting to collect amount in excess of specified amounts; revises methodology for determining HMO reimbursement amounts for certain services. Effective Date: October 1, 2016

HB 337 by Peters - Relating to Vision Care PlansGeneral Vision Care Plans: Provides that health insurer, prepaid limited health service organization, & HMO may not require licensed ophthalmologist or optometrist to join network solely for credentialing licensee for another vision network; provides that such insurers & organizations may not restrict licensed ophthalmologist, optometrist, or optician to specific suppliers of materials or optical laboratories. Effective Date: July 1, 2016

SB 340 by Latvala - Relating to Vision Care PlansGeneral Vision Care Plans; Providing that a health insurer, a prepaid limited health service organization, and a health maintenance organization, respectively, may not require a licensed ophthalmologist or optometrist to join a network solely for the purpose of credentialing the licensee for another vision network; providing that such insurers and organizations may not restrict a licensed ophthalmologist, optometrist, or optician to specific suppliers of materials or optical laboratories, etc. Effective Date: July 1, 2016

HB 421 by Trumbull - Relating to Reimbursement of Medicaid ProvidersGeneral Reimbursement of Medicaid Providers: Defines “usual and customary charge” for purposes of Medicaid billing; provides applicability. Effective Date: July 1, 2016

HB 423 by Pigman - Relating to Drug Prescription by Advanced Registered Nurse Practitioners & Physician AssistantsGeneral Drug Prescription by Advanced Registered Nurse Practitioners & Physician Assistants: Expands categories of persons who may prescribe brand drugs under prescription drug program when medically necessary; exempts controlled substances prescribed by ARNP or physician assistant from disqualifications for certification or licensure as deputy or state pilot; applies certain existing penalties to ARNPs; requires ARNPs & physician assistants who prescribe controlled substances to make certain designation, comply with registration requirements, & follow specified standards of practice; redefines term “practitioner” to include ARNPs & physician assistants under Florida Comprehensive Drug Abuse Prevention & Control Act. Effective Date: July 1, 2016

SB 676 by Grimsley - Relating to Health CareGeneral Health Care; Expanding the categories of persons who may prescribe brand name drugs under the prescription drug program when medically necessary; requiring a hospital to provide specified advance notice to certain obstetrical physicians before it closes its obstetrical department or ceases to provide obstetrical services; requiring the Board of Nursing to establish a committee to recommend a formulary of controlled substances that may not be prescribed, or may be prescribed only on a limited basis, by an advanced registered nurse practitioner; requiring that certain health insurers that do not already use a certain form use only a prior authorization form approved by the Financial Services Commission, etc. Effective Date: Except as otherwise expressly provided in this act, this act shall take effect upon becoming a law

SB 1034 by Simmons - Relating to Health Care ProvidersGeneral Health Care Providers; Revising the definitions of the terms “contract” and “health care provider”; extending sovereign immunity to employees or agents of a health care provider that executes a contract with a governmental contractor; requiring the posting of notice that a specified health care provider is an agent of a governmental contractor; revising the definition of the term “officer, employee, or agent” to include employees or agents of a health care provider, etc. Effective Date: July 1, 2016

SB 1084 by Gaetz - Relating to Health Care ProtocolsGeneral Health Care Protocols; Requiring a managed care plan, an insurer, and a health maintenance organization to establish a process by which a prescribing physician may request an override of certain restrictions in certain circumstances; providing the circumstances under which an override must be granted; defining the term “fail-first protocol”; prohibiting a health maintenance organization from requiring that a health care provider use a clinical decision support system or a laboratory benefits management program in certain circumstances, etc. Effective Date: July 1, 2016

On Tuesday, December 1, 2015, the For Eye Care Foundation (FECF) participated in #GivingTuesday, a movement created to celebrate generosity and giving on the Tuesday following Black Friday and Cyber Monday. Florida Society of Ophthalmology (FSO) members received an e-blast sharing information on #GivingTuesday and asking them to consider contributing to the FECF.

The For Eye Care Foundation was thrilled to hear that CSX Transportation, whose corporate headquarters are located in Jacksonville, FL, selected the FECF as their 2015 charity campaign. In honor of #GivingTuesday, Dr. Darby Miller, FSO Secretary-Treasurer, visited the employees of CSX and shared information about the For Eye Care Foundation’s mission. Dr. Miller also discussed various events that the FECF participated in such as the annual Florida Vision Summit as well as the passage of the Senate Resolution 844 that designated August as Amblyopia Awareness Month and its corresponding eye-screening events. After Dr. Miller’s presentation, the employees of CSX proudly donated over $2,400 to the For Eye Care Foundation!

The generous donations from the CSX charity campaign will be used to help the FECF purchase a Spot Vision Device, a portable device used for screening and detecting vision issues in children, which will be used for many years to come. The FECF will be able to further its mission in assisting other eye care organizations with community outreach and delivering important public service messages regarding eye care and disease.

At the American Academy of Ophthalmology (AAO) 2015 Annual Meeting, held November 14-17 in Las Vegas, Stacey Kruger, MD was honored with the AAO Secretariat Award. This award recognizes special contributions to the Academy and to ophthalmology, and Dr. Kruger was selected for her outstanding efforts with the pediatric vision screening and awareness campaign in Florida. Dr. Kruger serves as the Vice President of Outreach on the FSO Board of Directors and spearheaded the 2015 Senate Resolution 844 that passed and designated August “Amblyopia Awareness Month.” Along with other FSO and For Eye Care Foundation members, Dr. Kruger was instrumental in organizing three state-wide pediatric vision screening events that screened over 400 children during the month of August.

Congratulations to Dr. Kruger on this prestigious honor!

By now, all Florida Society of Ophthalmology (FSO) members should have received their annual membership renewal forms with attached membership card in the mail. FSO Recognized Regional SocietiesThe Florida Society of Ophthalmology (FSO) provided over $4,000 in funding to the Recognized Regional Societies in 2015. FSO Board members attended and spoke at multiple meetings around the state, encouraging fellow ophthalmologists to join the FSO and attend the annual meeting-Masters in Ophthalmology.

If your regional society has not yet been approved as a Recognized Regional Society of the FSO, please reach out to your leadership and encourage them to apply.
