upon that office’s request; providing that any such clerk or Office of Public and
Professional Guardians investigator has a duty to maintain the confidentiality of such
information, etc. Effective Date: 7/1/2018
Clerks of Circuit Court; Requiring records and books to be readily accessible at the county
seat; requiring all driver improvement course providers, within 7 business days, to
transmit the individual completion certificate, or related data sufficient to update the
Comprehensive Case Information System, through the statewide e-filing portal to a

Tax Deed Sales; Requiring certain tax certificateholders applying for a tax deed to pay

for a person under a specified age who knowingly possesses a tobacco product or
misrepresents his or her age or military service for the purpose of obtaining any tobacco
product from a person or a vending machine; requiring the Department of Highway
Safety and Motor Vehicles to issue, reinstate, or renew any driver license or driving
privilege without fee which the department has withheld issuance of, suspended, or
revoked pursuant to specified provisions under certain circumstances , etc
Criminal Justice Data Collection; Citing this act as the “Criminal Diversion Racial and
Ethnic Impact Data Collection Act”; Requiring each law enforcement agency to report to
the Department of Law Enforcement the number of persons arrested and released
without being charged and the race and ethnicity of those persons; requiring each state
attorney to report to the department the number of persons against whom formal
charges were brought and subsequently dismissed and the race and ethnicity of those
persons; requiring each clerk of the circuit court to report to the department the number
of persons admitted into programs for diversion from prosecution and the race and
ethnicity of those persons, etc.
Court of Claims; Proposing amendments to the State Constitution to require the
Legislature to establish a Court of Claims by general law, to provide for a judicial
nominating commission for the court, and to provide that Court of Claims judges are

penalties or obligations other than specified penalties or obligations; prohibits additional
state or local penalties or obligations for having cannabinoids or cannabinoid metabolites
in tissue or fluid of body; provides for distribution of revenue from civil penalties.

against victims of human trafficking who seek expungement of certain criminal history
records, etc.
Ethics Reform: Repeals provisions relating to state, state university, & community college
employee lobbyists; prohibits certain public service announcements; prohibits public
officer/agency employee from soliciting specified employment/contractual relationships;
authorizes Commission on Ethics to investigate certain disclosures; prohibits certain
compensated representation for specified period following vacation of office; deletes
provision prohibiting former legislators from acting as lobbyists before certain entities &
persons for specified period following vacation of office; prohibits certain officers &
employees from soliciting employment/contractual relationships from or negotiating
same with certain employers; requires lobbyist to electronically register with
commission; revises lobbyist registration, compensation report, principal designation
cancellation, & investigation requirements. Effective Date: July 1, 2018

elected officers and legislators from soliciting employment offers or investment advice
arising out of official or political activities, etc. Effective Date: Except as otherwise
expressly provided in this act, this act shall take effect July 1, 2018
Local Government Ethics Reform: Provides that contractual relationships held by
business entities are deemed held by public officers or employees in certain situations;
provides ethics training requirements; prohibits certain governing board members from
voting in official capacity on specified matters; requires certain members of municipality
governing body to file disclosure; provides for future repeal of provisions relating to local
government authority to enact rule or ordinance requiring lobbyists to register with local
government; provides for future repeal of provisions relating to registration & reporting
for lobbying water management districts; requires Commission on Ethics to create Local
Government Lobbyist Registration System; requires lobbyists to register with commission
before lobbying specified governmental entities; provides responsibilities of Governor;
provides civil penalties. Effective Date: July 1, 2018
Financial Reporting: Requires counties, municipalities, special districts, water
management districts, & district school boards to submit certain budget & financial
information to specified entities; requires certain budget information to remain posted
on such entity's official website for specified period of time; revises reporting deadlines,
with exception; provides penalties; requires Office of Economic & Demographic Research
to develop forms for reporting certain budget information. Effective Date: July 1, 2018
County and Municipal Public Officers and Employees: Requires that request to travel
outside of state by county & municipal public officers be approved by governing board at
publicly noticed meeting; limits travel expenses of public officers & employees to
expenses incurred in specified time period; prohibits travel expenses of public officers &
employees for foreign travel; limits lodging expenses of public officers & employees;
requires public officers who are candidates for elected office to make campaign finance
reports available online; requires public officers to report travel expenses to certain
commission on ethics or to Commission on Ethics; requires public officers to comply with
constitutional financial disclosure requirements. Effective Date: July 1, 2018

involuntary placement in residential services; provides for participation of guardian or

hearing within specified timeframe when defendant is competent to proceed; provides
limitation on conditional release for community-based competency training for
defendant who is incompetent to proceed. Effective Date: July 1, 2018
Marriage of Minors; Deleting provisions that allow the issuance of marriage licenses to
minors under 16 years of age in certain circumstances, etc.
Marriage Licenses; Deletes exception for persons under 18 years of age to be issued
marriage license; deletes requirement that one party be male & other party be female to
be issued marriage license; repeals provisions relating to issuance of marriage licenses to
persons under 18 years of age.
Florida Guide to a Healthy Marriage; Creating the Marriage Education Committee within
the Department of Children and Families; requiring the clerk of each circuit court to post
an electronic copy of the guide on the court’s website and to distribute printed copies of
the guide if they are made available; prohibiting a county court judge or clerk of the
circuit court from issuing a marriage license unless he or she is first presented with a
statement verifying that both parties have obtained and read the guide or have viewed
an electronic presentation containing certain information, etc. Effective Date: 7/1/2018

Public Records/Substance Abuse Service Providers; Providing an exemption from public
records requirements to certain identifying and location information of current or former
directors, managers, supervisors, nurses, and clinical employees of substance abuse
service providers that are licensed under part II of ch. 397, F.S., and the spouses and

violations committed in school zones & crossings; requires law enforcement agencies to
adopt policies prohibiting racial profiling in enforcement; removes requirement that
enforcement be accomplished as secondary action
Traffic Infraction Detectors; Repealing provisions relating to the installation and use of
traffic infraction detectors to enforce specified provisions when a driver fails to stop at a
traffic signal, provisions that authorize the Department of Highway Safety and Motor
Vehicles, a county, or a municipality to use such detectors, and the distribution of
penalties collected for specified violations, etc.
