How to start the application process:

Application as a Candidate for theUN Working Group on Business and Human Rights

Chiam Tow Hui, Michael Ph.D

Human Rights Principles and Practices is now weaved in to the fabric of business andTransnational Corporation can no longer avoid the application of the proposed "GuidingPrinciples for the Implementation of the "Protect, Respect, Remedy" Framework. Therewill be many facets of Human Rights with overarching issues and social dimensions thatwill impact on trade and business development and this will be important to developingcountries, including Malaysia ..

Since my engagement in the Working Group on Social Responsibility under the ISO26000 Guidance Standards, it has opened up a whole new chapter in my businessexperience and exposure in trying to absorb and assimilate the basic rights of humanbeings in their two categories of (i) civil and political rights and (ii) the economic, socialand cultural rights. My research in these core topics over the period of more than 5 yearsinvolvement whilst engaging in many debates, discussions and deliberations with otherstakeholders, business professionals and government officials both within and outsideMalaysia.

From the business as well as individual perspectives, I am convinced that I shall becommitted to the tasks ahead in the follow-up mandate development of:

• Embedding the Guiding Principles• Clarifying certain international legal standards

My experience in the many assignments to assess the impact and implications on theadoption of human rights law under the Universal Declaration of Human Rights, the-International Covenant on Civil and Political Rights and the International Covenant ofEconomic, Social and Cultural Rights, including the principles of the UN GlobalCompact, will be further enhanced if I can be selected as the candidate for the AsiaRegion.

I believe the report by Professor John G. Ruggie will feature in the new mandate to movethe business and human rights agenda forward. His report identified a conceptual andpolicy framework organized around three foundational principles; the state duty toprotect against human rights abuses by third parties, including business; the corporateresponsibility to respect human rights; and the need for more effective access toremedies. I am indeed encouraged by these three "Protect, Respect and Remedyframework and I can envisage it gives me the challenge to lead and manage in the area ofbusiness and human rights.

Asia in general and Malaysia in particular, will have a pivotal role in the globalized worldof business and as a Malaysian, I should be able to gain the respect, influence andarticulate the Human Rights principles to our neighboring countries in line with the UN

Universal Declaration on Human Rights. The experience in Malaysia is to move ahead inthe field of human rights and in this respect, the State have enacted the Human RightsCommission of Malaysia Act 1999. The Commission comprised of twenty independentlyappointed members. I had several engagements with the Human Rights Commissionduring our debates during the development of the ISO 26000 which had Human Rights asa core topic. It will be a good challenge for me to evaluate the Region's Human Rightsrecord and see to the synchronizing of minimum obligations of human rights to businesspractices.

From the business angle, I have more than thirty years of corporate experience in a MultiNational Corporation at the senior level and this put me in good stead of understandingthe link on business with Human Rights. I was with P&O Nedlloyd, which gave me manyopportunities to network with Business leaders in the region before my retirement. I heldvarious positions in my working career from Financial Controller, Company Secretary, toHuman Resource Manager and my last position was the Head of the Country Operations.Since then, apart from attending to my own business, I was actively involved in theMalaysian Employers' Federation (MEF) and I am now the Vice President. During mytenure with MEF, I was also exposed to the many issues and development on theinternational scene, the 'soft' laws on UN agencies and lastly, the ILO/ISO workinggroup on Social Responsibilities. I am also a panel member of the Institute IntegrityMalaysia.

I am convinced that my candidature for this position as an independent expert will bebeneficial to ASEAN, Asia and UN as a whole.
