Chester County Parks & Recreation Department Real Estate Rules and Regulations
Section 1 Title
This Ordinance shall be known as the Chester County Parks and Recreation Department Rules and Regulations.
Section 2 Definitions
A Except where the context clearly indicates otherwise, the following terms as used in this Ordinance shall have the following meanings:
(1) Park System – means any lands, roadways or facilities owned,
administered or leased by the Chester County and designated or managed by the Chester County Parks and Recreation Department for park purposes or open space.
(2) Department – means is the Chester County, Parks and Recreation
Department, which shall include the Administrative Offices and Regional County Park Offices.
(3) Real Estate – means any lands, roadways or facilities owned or leased by
the Chester County and shall include but not be limited to the Real Estate comprising the park system.
(4) Park Employee – designates all employees of the County of Chester,
Parks and Recreation Department.
(5) Park Ranger – refers to personnel who have been authorized and have
sworn to enforce County Ordinances according to lawful directives. Park
Rangers are classified as sworn “Peace Officers” as defined by the Pennsylvania Crimes Code.
(6) Peace Officer – (Section 501 of the Pennsylvania Crimes Code) “Any
person who by virtue of his office or public employment is vested by law with a duty to maintain public order or to make arrests for offenses,
whether that duty extends to all offenses or is limited to specific offenses…” “The term Peace Officer shall also include any member of any park police department of any county of the third class”.

(7) Authority – means a lawful grant of specific powers that have been given
to Park Rangers to enable them to act in any and all enforcement
situations.
(8) Law Enforcement Officer – refers to personnel who have been authorized
and have sworn to enforce Crime and Motor Vehicle Codes of the Commonwealth of Pennsylvania according to lawful directives.
(9) Jurisdiction – defines both the legal and geographical range of Authority.
It is the authority to enforce the law.
(10) Park Ranger, Director of Parks and Recreation, Park Superintendent shall mean the official or designee(s).
Section 3 Compliance
A All visitors to the Park system shall comply with the rules and regulations of the Department as set forth in this Ordinance.
B In conjunction with and in addition to this ordinance, the Crimes Code of the
Commonwealth of Pennsylvania shall apply to the Park System to be enforced
by local police, State Police, and other authorized officers at the request of and independent of the Department.
C In conjunction with and in addition to this ordinance, the Motor Vehicle Code of
the Commonwealth of Pennsylvania shall apply to the Park System to be enforced by local police, State Police, and other authorized officers at the request of and independent of the Department.
D In conjunction with and in addition to this ordinance, wildlife regulations of the
U.S. Fish & Wildlife Service, the Pennsylvania Fish and Boat Commission, and the Pennsylvania Game Commission shall apply to the Park System to be enforced by local police, State Police, and other authorized officers at the request of and independent of the Department.
Section 4 Park Permits and Reimbursements
A Park Permits
(1) Application for a park permit and/or contract shall be made upon the official forms of the Department.

(2) Application for a park permit or contract may be made at the Department
Office, each County park office, other designated locations, or a request may be made by telephone.
(3) The holder of a special facility use or group permit issued by the
Department shall be on-site for the duration of the entire period designated on the permit,
a) Overnight campsite occupancy by the permit holder is required during the entire period designated on the permit.
(4) The holder of a special facility use or group permit issued by the
Department shall be held responsible for the actions and conduct of the other persons in his or her party.
(5) No person under the age of eighteen (18) years shall be issued a permit to use a park facility.
(6) In the event more requests for reservations are received than space is
available, such requests shall be considered in the order received by the Department.
B Reimbursements
(1) The Department shall have the authority to issue a reimbursement schedule
for permits, set the amount of deposits, and prescribe conditions. Such revenue shall be used for the improvement of the Park System.
(2) Where reimbursements have been established, no person shall use any facility, land or area without payment of such reimbursement.
(3) Any required reimbursement must be received by the Department Office
issuing the permit, a minimum of seven days in advance of the requested activity or as otherwise specified.
(4) Reimbursements for use of permits are required from all commercial or for-profit organizations using Department facilities.
(5) Reimbursement schedules shall be made public at all Department Offices.

C Excepted Activities
(1) A park permit, Department document, or other management method may
be required to allow otherwise prohibited activities specified within this ordinance.
A park permit or other Department management document shall be required to:
(2) Use or occupy any facility within the park system at times other than defined in Section 5 – Hours.
(3) Engage in any activity as defined in Section 6 – Peddling and soliciting.
(4) Engage in any activity as defined in Section 14 – Boating and watercraft , subsection B, 7.
(5) Consume alcoholic beverages at any Department owned public rental
facility as defined in Section 22 – Alcohol, Illegal Drugs, and controlled substances, subsection D.
(6) Engage in any activity as defined in Section 24 – Recreational conduct, subsection E – Air balloons, aircraft and parachutists.
(7) Use park roadways as thoroughfares for farm equipment and/or commercial vehicles.
No person shall:
(8) Install equipment or make any alterations or adjustments to existing equipment or facilities within the park system without the specific written
approval of the Department.
(9) Group camp during the off season, except when in possession of a
camping permit.
Section 5 Hours
No person shall be permitted within the park system between the posted closing
time of any day and the posted opening time of the following day, except where allowed by special park regulations.

Section 6 Peddling and soliciting
A The use of the Park system for profitable purposes requires reimbursement and a permit from the Department.
No person shall:
B Peddle or solicit business of any nature whatever.
C Collect any funds for any service or charity.
D Distribute handbills or other advertising matter.
E Post unauthorized signs on any lands, waters, structures or property.
Section 7 Destruction of buildings, markers, monuments and other properties
No person shall:
A Destroy, deface, alter, change or remove any monument, stone marker,
benchmark, stake, post or blazed trail marking, or designation of any boundary line or survey line.
B Cut, break, mark upon or otherwise damage any building, equipment, bridge, drain, wall, foundation, lamppost, fence, gate, hedge, or other structure or
installation.
C Deface, destroy, or remove any placard, notice, or sign, whether permanent or
temporary, posted, or exhibited within the park system, or on any County owned or leased Real Estate.
D Destroy, deface, alter, cut, break, mark upon, or otherwise damage any other
tangible property owned or leased by the County of Chester.
Section 8 Destruction of plant life, natural and cultural surroundings
No person shall:
A Cut, remove or destroy any tree, sapling, seedling, bush or shrub, whether alive
or dead, or chip, blaze, box, girdle, trim, or otherwise deface or injure any tree or shrub, or break or remove any branch or foliage of any tree or shrub.
B Pick, gather, uproot, remove, or destroy any flower, fruit, plant or grass.

C Dig any sod, earth, humus, peat, boulder, rock, gravel or sand.
D Remove or cause to be removed, any artifacts, archeological or historical items.
E Remove or cause to be removed, any natural or man-made materials.
Section 9 Fires
No person shall:
A Build any fire except within the fireplaces, grills, receptacles, or open spaces
approved and designated by the Department for such purpose.
B Build any fire when a burn ban is in effect, except when using grills approved and designated for such purposes by the Department.
C Leave fires unattended at any time or not fully extinguish fires before
abandoning them.
D Drop, dump, throw, or otherwise scatter lighted matches, ashes, burning cigars,
cigarettes, tobacco paper, or other flammable material.
E Set or cause to be set on fire any tree, woodland, brush-land, grassland, or meadow.
F Set or cause to be set on fire any building or tangible property owned or leased
by the County of Chester.
Section 10 Wildlife
A All game and/or non-game or animals; live, hunted, killed, taken or destroyed,
bought, sold, bartered or possessed contrary to any of the provisions of this
section of this ordinance shall be declared to be contraband, and the same shall be subject to seizure and/or confiscation and shall be turned over to the Department for disposal.
No person shall:
B Hunt, or trap any animal.
C Spotlight any animal except as allowed by the Pennsylvania Game Commission
regulations.

D Drive or pursue any animal from the confines of the park, or within the Park System.
E Pursue, catch, and attempt to catch, strike, molest, wound or kill any animal.
F Disturb any nest, lair, den, burrow, or the like of any animal.
G Permit dogs, or other pets to pursue, catch, wound, or kill any animal or to
disturb the nests, dens, home or place of refuge of any other animal.
Section 11 Hunting, Field Trials Areas, and Trapping
A All game and/or non-game or animals; live, hunted, killed, taken or destroyed,
bought, sold, bartered or possessed contrary to any of the provisions of this
section of this ordinance shall be declared to be contraband, and the same shall be subject to seizure and/or confiscation and shall be turned over to the Department for disposal.
B The Department may set aside areas open to the public for regulated hunting,
trapping, or as field trial areas. The Pennsylvania Game Commission and/or
Federal laws will regulate such areas and violation of Pennsylvania Game Commission regulations and/or Federal laws will be a direct violation of this section.
No person shall:
C Hunt, or trap any animal.
D Allow any dog or other pet other than those held in complete control to be on
any field trial areas.
E Bring any animal into any park area unless said animal has been properly
inoculated and has a current year’s license, if so required.
F Bring any dog or other pet other than those participating into any field trial during events.
G Hunt or pursue any animal within the park that had been wounded or injured
outside the park and had taken refuge within the park, without being accompanied by Park System personnel.
H Trap, hunt or allow dogs or other pets to hunt any animal.
I Possess any firearm or ammunition in the field trial area except for designated gunners for trial purposes.

Section 12 Fishing
A All fish and other aquatic animals; live, fished, hunted, killed, taken or
destroyed, bought, sold, bartered or possessed contrary to any of the provisions of this section of this ordinance shall be declared to be contraband, and the same shall be subject to seizure and/or confiscation and shall be turned over to the Department for disposal.
B The Department may set aside areas open to the public for public fishing and
boating. The Pennsylvania Fish & Boat Commission and/or Federal laws will regulate such areas and violation of Pennsylvania Fish and Boat Commission regulations and/or Federal laws will be a direct violation of this section.
No person shall:
C Fish within the park system except in such areas and at such times as are
designated by the Department.
D Fish within the park system without being in compliance with Pennsylvania Fish
and Boat Commission regulations.
E Ice fish on any lake or pond within the park system.
F Bow fish within the Park System. [see Section 25]
Section 13 Swimming, bathing and wading
No person shall:
A Swim, tube, bathe, or wade in any of the watercourses, lakes, ponds or sloughs
contained within the Park system.
B Exceptions for wading shall be made in such instances where the participant is
engaged in legal fishing activity.
Section 14 Boating and watercraft
A All powered and non-powered watercraft must possess valid Pennsylvania Fish
and Boat Commission registration, out-of-state registration or appropriate launch permits as required by the Pennsylvania Fish and Boat Commission.

No person shall:
B Use or navigate any boat, yacht, canoe, raft or other watercraft upon any
watercourse, lagoon, lake, pond or slough except at such time or places as may be provided or designated for such purposes.
C Operate a watercraft unless it complies with the regulations of the Pennsylvania Fish and Boat Commission.
D Use air mattresses, inner tubes and other swimming aids.
E Use a boat or other watercraft in any park area unless supplied with the proper
number and size of Coast Guard approved personal floatation devices.
F Operate any watercraft in any unsafe or disorderly manner as to endanger any
person or property.
G Operate watercraft propelled by internal combustion engines on any County owned or leased waters.
H Launch and retrieve watercraft and tubers within the Park system by
commercial or for-profit business.
Section 15 Camping
A Campgrounds are provided for vacation and/or recreational purposes only.
B Overnight campsite occupancy is required during the entire period designated on the permit.
No person shall:
C Camp without a permit issued by the Department.
D Camp except in such areas as may be provided and designated for such purposes by the Department.
E Exceed six registered campers per site.
F Have more than two cars, two tents, or one camper trailer to occupy an
individual campsite unless otherwise specified. Each car must be registered on the camp permit.
G Cause, create, or make any noise or disturbance that is a hindrance to the peace, quiet and tranquility of the camping area.

H Wash dishes at pumps or drinking fountains, fail to clean up campsite daily or to discharge waste waters or any other wastes, except into designated containers
or dumping stations.
I Dig a trench or make any excavation on any campsite.
J Occupy a campsite after check out time on the last day covered by the permit.
K Occupy a campsite contrary to assignment as may be made by the
Department’s authorized representative.
L Camp with a self-contained house trailer, camper trailer or camper bus except in campsite provided for that purpose and it must not exceed the designated
length.
M Enter upon the camp site, tent, shelter or cabin of another, whether occupied or
not, without first obtaining an invitation or permission to do so by the person to whom the camp site or structure has been issued a permit within the park
system.
N Camp except on weekends during designated camping seasons specific with
each park.
O Group camp during the off season, except when in possession of a camping permit. See Section 4 – Park Permits & Reimbursements.
P Consider sleeping in personal vehicles as camping.
Section 16 Motor vehicles
A The Director, Park Superintendent or Park Ranger shall be responsible for
removal of any vehicle that is in violation of this section by towing at the owner’s expense.
B Parking
No person shall:
(1) Park a vehicle on County Real Estate for purposes other than use of the specific facility or County services, or on County business.
(2) Park in any place where “No Parking” signs have been erected.
(3) Park outside of authorized parking areas.

(4) Park upon any lawn unless specifically authorized to do so by the Department.
(5) Park a vehicle in such a manner as to block the exit or removal of another
vehicle.
(6) Park vehicle in such a manner as to take up more than one designated
parking spot.
(7) Stop, stand or park a vehicle in such a manner as to block any fire lane, fire trail, camp site road, maintenance road, boat ramp or bike/hike/horse
trail.
(8) Stop, stand or park any vehicle in any place marked as a passenger or
loading zone, other than for expeditious loading or unloading of passengers, or for the unloading and delivery or pick up and loading of
materials.
(9) Stop, stand or park such vehicle upon any roadway or in any parking area
in such manner as to form an obstruction to traffic thereon.
C Operation
No person shall:
(1) Operate a vehicle that is in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania.
(2) Operate any type of mini-bike, trail bike, all terrain vehicle, snowmobile, or
other vehicle that is not or cannot be registered for operation on the public highways.
(3) Drive upon any lawn unless specifically authorized to do so by the Department.
(4) Fail to yield at a yield sign.
(5) Fail to stop at a stop sign.
(6) Fail to yield the right-of-way to any person riding a horse, hiking or biking
on marked trails where such trails cross streets or roadways.
(7) Operate a motor vehicle in excess of the posted speed limit.

(8) Operate a vehicle where “Authorized Vehicles Only” signs have been erected.
(9) Operate a vehicle in any park, or place other than roadways open to and
regularly traveled by the general public except for vehicles authorized by the Department for purpose of maintenance, improvement, or patrol, or in an area set aside as a special use area.
(10) Operate a vehicle in such a manner as to block any fire lane, fire trail,
camp site road, maintenance road, boat ramp or bike/hike/horse trail.
(11) Operate any vehicle upon any property or roadway carelessly disregarding
the rights and safety of others or in a manner to endanger any person or property.
(12) Wash or make mechanical repairs on vehicles, except in an emergency.
D Cruising
(1) Cruising is defined as one vehicle with or without the same occupants,
proceeding through the same area more than three times per hour for no legitimate reason.
(2) No person shall continuously cruise in any motor driven vehicle in, through and around camp areas or picnic areas within the park system.
Section 17 Bicycles
No person shall:
A If under 12 years of age, operate a bicycle or ride as a passenger on a bicycle
unless the person is wearing a bicycle helmet meeting the national standards accepted by the Commonwealth of Pennsylvania.
B Operate a bicycle unless as close to the right-hand curb or right-hand side of
the path, trail or roadway as conditions will permit.
C Operate any bicycle while upon any path, trail or roadway to carry any person
upon the handlebar or frame of the bicycle, except in the case where a bicycle is equipped to carry more than one person.
D Operate a bicycle upon such paths, trails or roadways that are posted as non-
bicycle areas.

E Leave or park any bicycle upon any road or parking lot that is open to the public on which motor vehicles may be driven.
F Leave or park bicycles in walkways or active play areas, unless using
appropriate racks when available.
G Ride or operate a bicycle in play areas, in picnic areas, on ball fields, or in
congested areas.
Section 18 Trespass
No person shall:
A Enter upon any grounds that have been posted with “No Trespassing” or
“Special Wildlife” signs, or any sign that would indicate that the area is not open to the general public.
B Enter any building that is not open to and regularly used by the general public.
C Disturb any construction or maintenance equipment.
D Enter upon any construction area.
Section 19 Hindering Park Employees , or Law Enforcement Officers
No person shall:
A Interfere with any park employee, law enforcement officer, or emergency services personnel who are performing their official duties.
B Use profanity towards any park employee, law enforcement officer, or
emergency services personnel who are performing their official duties.
C Hinder any park employee, law enforcement officer, or emergency services
personnel who are performing their official duties.
D Provide false information to any park employee, law enforcement officer, or emergency services personnel who are performing their official duties.
Section 20 Resisting Park Rangers , or Law Enforcement Officers
No person shall:
A Fail or refuse to obey any lawful command or refuse to assist any Park Employee, law enforcement officer, or emergency services personnel who are
performing their official duties.

B Forcibly resist any lawful command of a Park Ranger, law enforcement officer, or emergency services personnel who are performing their official duties.
C Flee from any Park Ranger, law enforcement officer, or emergency services
personnel who are performing their official duties.
Section 21 Impersonation of Park Employees or Law Enforcement Officers
No person shall impersonate any park employee, enforcement officer, or emergency services personnel for any reason whatsoever with the Park System.
Section 22 Alcohol, Illegal Drugs, and controlled substances
A Violation of this section shall be subject to seizure and/or confiscation of any alcohol, illegal drugs, and controlled substances.
No person shall:
B Possess any alcohol, illegal drugs, and controlled substances while within the
Park System.
C Be under the influence of any alcohol, illegal drugs, and controlled substances
while within the Park System.
D Alcohol shall only be served at a County public rental facility as agreed upon by a contract with that facility.
(1) Any disorderly conduct and/or violation of this ordinance resulting from use
of alcohol at a public rental facility, shall subject the actor to prosecution under the terms of this section, separate from and in addition to any other violations committed.
Section 23 Personal conduct
A Personal conduct
No person shall:
(1) Engage in any violent or abusive behavior or conduct tending to create a breach of the peace, or to disturb or annoy others.
(2) Engage in any loud or boisterous behavior or conduct tending to create a
breach of the peace, or to disturb or annoy others.
(3) Engage in any vulgar, lewd, wanton, or obscene behavior or conduct
tending to create a breach of the peace, or to disturb or annoy others.

(4) Engage in any disorderly conduct tending to create a breach of the peace, or to disturb or annoy others.
(5) Commit any indecent or immoral act tending to debauch the morals or
manners of the public while within the Park System.
(6) Use a loudspeaker, public address system, amplified musical instruments,
or amplifier while within the Park System without a permit issued by the Department.
(7) Play or cause to play any musical instrument, or other sound producing
device in a loud or boisterous manner that tends to disturb or annoy any visitor.
B Unlawful obstruction
No person shall:
(1) Force, threaten, intimidate, harass, or by any other means, prevent any
person from entering, leaving or making full use of the park system.
(2) Fence, enclose or by any other means, prevent any person from entering,
leaving or making full use of the park system.
(3) Obstruct any person from entering, leaving or making full use of the park system.
Section 24 Recreational conduct
No person shall:
A Drive, chip or putt golf balls.
B Skate, walk or otherwise go upon any ice formed on lake or ponds.
C Use a metal detector.
D Operate a remote-control aircraft.
E Hot air balloons, aircraft and parachutists.
No person shall make any ascent in any balloon or aircraft, or any descent in or from any balloon, aircraft or parachute.

Section 25 Firearms, weapons, and firework
A Possession of any of the items in this section shall be subject to seizure and/or confiscation by a Park Ranger or law enforcement officer.
(1) A Pennsylvania License to Carry Firearms shall not apply in the County Park System.
B Firearms and other weapons
No person shall:
(1) Bring into or upon County Real Estate a revolver, pistol, shotgun, rifle, air
rifle, air gun, water gun, or any gun, rifle, firearm, or bow or other weapon that discharges projectiles either by air, explosive substance or by any other force.
(2) Have in his or her possession, a revolver, pistol, shotgun, rifle, air rifle, air
gun, water gun, or any gun, rifle, firearm, or bow or other weapon that discharges projectiles either by air, explosive substance or by any other force.
(3) Discharge, or set off anywhere upon said properties, a revolver, pistol,
shotgun, rifle, air rifle, air gun, water gun, or any gun, rifle, firearm, or bow or other weapon that discharges projectiles either by air, explosive substance or by any other force.
(4) No person shall possess any type of knife, hatchet, ax, or other edged item
unless engaged in camping, fishing, hunting, or other appropriate use.
C Fireworks
No person shall fire, discharge, initiate, or possess any rocket, firecracker, firework, or any substance of an explosive or pyrotechnic nature.
D Exceptions
(1) Except that this section shall not apply to any deputy sheriff, police officer,
Peace Officer, or other duly appointed law enforcement officer while carrying out the duties and responsibilities of his or her position.
(2) Except that this section shall not apply to any person while on or in those
areas that may be designated as hunting areas by the Department or while upon designated target ranges or areas.

Section 26 Littering, dumping, and pollution of waters
No person shall:
A Discard, deposit, dump litter, or allow to blow away any refuse of any kind or
nature except by placing said refuse in containers provided for such purposes.
B Cause or allow to be caused any substance, natural or manmade to enter any stream, lake, or other waterway.
C Bring or dispose of any type of trash, refuse or debris in any park whether
disposing of it in receptacles or not, if such refuse did not result from park usage within the Park System.
D In areas where recycling receptacles are provided, fail to place refuse as indicated on container.
Section 27 Animals
A Domestic Animals
(1) A trained assistance dog aiding a disabled individual shall not apply to this section.
No person shall:
(2) Cause or allow any animal to run at large. All pets must be under the
immediate physical control of a competent person.
(3) Bring, drive or lead any animal onto County Real Estate to be ridden by persons in charge thereof or driven before a vehicle attached thereto,
except horses, in areas as may be designated for riding or driving by the Department by permit.
(4) Bring, drive, lead or carry any pet which is unleashed.
(5) Permit any pet to be within a picnic area or children’s play area.
(6) Fail to remove all feces deposited by their pets while within the Park System.
(7) Permit any dog or pet to enter any public building or to be upon any
designated swimming area.
(8) Torture, ill-treat or neglect any animal.

(9) Bring any animal into any park area unless said animal has been properly inoculated and has a current year’s license, if so required.
(10) Allow any animal to enter any water area.
a) Except in those areas designated as dog training areas (where retriever
dogs may enter the water for training purposes) and in designated hunting areas.
(11) Drive or cause to be driven any horse, cattle, sheep, goats, swine or other livestock upon or across any property.
B Equestrian use
No person shall:
(1) Ride or lead a horse or pony while within the Park System except in specifically designated areas.
(2) Ride a horse upon any property or roadway carelessly disregarding the
rights and safety of others or in a manner to endanger any person or property.
Section 28 Enforcement
A All prosecutions shall be brought in the name of the County of Chester. All restitution received is for the benefit of the Park System.
B It shall be the responsibility of the Director of Parks and Recreation to make sure the rules and regulations of this Ordinance are enforced.
C Emergency Powers
Nothing in these rules shall:
(1) Prohibit or hinder duly authorized agents of the Department or any police
officers from performing their official duties.
(2) Prohibit the Department from establishing rules and regulations required to
protect the health, welfare and safety of park visitors and Park Employees within the County Park System.

D Penalties and arrests
(1) Any person who violates any provision of this Ordinance shall, for every
such offense, upon conviction thereof, in a summary proceeding before a District Magistrate, may:
a) Be sentenced to pay a fine of not less than five (5) dollars nor more
than three hundred (300) dollars and or to undergo imprisonment for a term of not more than thirty (30) days.
b) Be charged (in addition to the imposition of fines) the cost of
maintenance, repair or replacement of damages to the Park System or the contents thereof.
c) Be denied further use of the County Park System in addition to the imposition of fines.
Section 29 Severability
A The provisions of this ordinance are severable; and if any part hereof shall be
held to be unconstitutional or otherwise invalid by any court, such decision shall not affect or impair any of the remaining provisions of the Ordinance.
B It is declared to be the intent of the Chester County Commissioners that this
Ordinance would have been adopted even if such invalid provision had not been included therein.
Section 30 Ordinance Repeal
A All Ordinance and resolutions or parts of Ordinances and resolutions insofar as they are inconsistent herewith are hereby repealed.

Section 1 The following notes are referenced for informational purposes
only. This information is provided to identify when an act may
fall outside of the scope of summary ordinance offenses, and Police assistance is required.
Section 2 These rules and regulations are made pursuant tot he provisions of
the County Code (16 P.S. Dec 2325, et. Seq.) which authorize the policing, administration and public order of County grounds and
buildings and Section 509 of the County Code (16 P.S. Sec 509) which permits the County Commissioners to adopt resolutions and ordinances “prescribing the manner in which the powers of the
County shall be carried out and generally regulating the affairs of the County”. Violation of such rule shall subject the offender to those penalties as set forth in said ordinance at Section 28 – Enforcement.
Section 3 PA Crimes Code Article C, Chapter 33 subsection 3304. Criminal Mischief
A Offense defined – A person is guilty of criminal mischief if he:
(1) Damages tangible property of another intentionally, recklessly, or by
negligence in the employment of fire, explosives, or other dangerous means.
(2) Intentionally or recklessly tampers with tangible property of another so as to endanger person or property.
(3) Intentionally or recklessly causes another to suffer pecuniary loss by deception or threat; or
(4) Intentionally defaces or otherwise damages tangible public property
or tangible property of another with aerosol spray-paint can, broad-tipped indelible marker or similar marking device.
B Grading – Criminal mischief is a felony of the third degree if the actor
intentionally causes pecuniary loss in excess of $5,000, or a substantial interruption or impairment of public communication, transportation, supply of water, gas or power, or other public service. It is a
misdemeanor of the second degree if the actor intentionally causes pecuniary loss in excess of $1,000, or a misdemeanor of the third degree

if he intentionally or recklessly causes pecuniary loss in excess of $500 or causes loss in excess of $150 for a violation of subsection (a) (4).
Section 4 PA Crimes Code Article C, Chapter 33 subsection 3307. Institutional Vandalism
A Offense defined – A person commits the offense of institutional vandalism if he knowingly vandalizes, defaces or otherwise damages:
(1) Any church, synagogue or other facility or place used for religious worship or other religious purposes.
(2) Any cemetery, mortuary or other facility used for the purpose of burial or memorializing the dead
(3) Any school, educational facility, community center, municipal building, courthouse facility or juvenile detention center.
(4) The grounds adjacent to and owned or occupied by any facility as set forth in paragraph (1), (2), or (3).
(5) Any personal property located in any facility set forth in this subsection.
(6) Illegal possession. - A person commits the offense of institutional
vandalism if with intent to violate subsection (a), the person carries
an aerosol spray-paint can, broad-tipped indelible marker or similar marking device onto property identified in subsection (a)
B Grading – An offense under this section is a felony of the third degree if
the actor causes pecuniary loss of more than $5,000. Pecuniary loss includes the cost of repair or replacement of the property affected.
Otherwise institutional vandalism is a misdemeanor of the second degree.
Section 5 PA Crimes Code Article C, Chapter 33 subsection 3309 Agricultural Vandalism
A Offense defined – A person commits the offense of agricultural
vandalism if he intentionally or recklessly defaces, marks or otherwise damages the real or tangible personal property of another, where the
property defaced, marked or otherwise damages is used in agricultural activity or farming.
B Grading – Agricultural vandalism is a felony of the third degree if the
actor intentionally causes pecuniary loss in excess of $5,000, a misdemeanor of the first degree if the actor intentionally causes
pecuniary loss in excess of $1,000 or a misdemeanor of the second

degree if the actor intentionally or recklessly causes pecuniary loss in excess of $500. Pecuniary loss includes the cost of replacement of the
property affected. Otherwise, agricultural vandalism is a misdemeanor of the third degree.
Section 6 PA Crimes Code Article C, Chapter 35 §3510 - Pedalcycle helmets
A In conjunction with and in addition to this section of this ordinance, the Pedalcycle helmets – PA Crimes Code Article C, Chapter 35 §3510
helmets of the Commonwealth of Pennsylvania shall apply to the Park System.
B In conjunction with and in addition to this section of this ordinance, the
Criminal Trespass – PA Crimes Code Article C, Chapter 35 §3503 of the Commonwealth of Pennsylvania shall apply to the Park System.
Section 7 In conjunction with and in addition to this section of this ordinance,
Obstructing Administration of Law or other Governmental Function, – PA Crimes Code Article C, Chapter 51 §5101, Hindering
Apprehension or Prosecution – PA Crimes Code Article C, Chapter 51 §5105 and Obstructing Emergency Services – PA Crimes Code Article C, Chapter 51 §5112 of the Commonwealth of Pennsylvania shall apply to the Park System.

Protective Orders – PA Crimes Code Article C, Chapter 49 §4954 Orders of the Commonwealth of Pennsylvania shall apply to the Park System.
Section 11 Domestic Violence
APPENDIX IX
A In conjunction with and in addition to this section of this ordinance,
Protective Orders – PA Crimes Code Article C, Chapter 49 §4954 Orders of the Commonwealth of Pennsylvania shall apply to the Park System.
Section 12 Equestrian Use
A In conjunction with and in addition to this section of this ordinance, the
Recklessly Endangering Another Person – PA Crimes Code Article C,
Chapter 27 §2705 of the Commonwealth of Pennsylvania shall apply to the Park System.
