Required Updates
Hired a consultant to reflect the requirements from the state of North Carolina, and address environmental concerns.
July 2020
To meet the anticipated 160D, Falls Lake, requirements from the state of North Carolina , and provide clarification
to commonly asked questions from developers.
Late 2020/ Early 2021Updates to the watershed overlay maps.
September 2020

• Biggest Changes to 12.6 & 12.7
• Impacts to Developers
• Proposed/Potential Amendments
• Chapter 17 Updates
Public Comments• Home Builders Association of Raleigh-Wake County

Overall Updates• BMP SCM
• Best Management Practice Stormwater Control Measure
• NCDWR & NCDENR NCDEQ• North Carolina Department of Water Resources & North Carolina
Department of Environment and Natural Resources North Carolina Department of Environmental Quality
• NC Stormwater Best Management Practices Manual NC Stormwater Design Manual
• Minor Language Updates
Minor Language Examples
12.1 General Purpose & Intent• Overall Updates as previously shown
12.2 Applicability• No Updates
12.3 Erosion & Sediment Control Regulations
• Added NCG01 plan details requirement
• Referenced NCDEQ stabilization chart
• Removed existing graphic to better update with state requirements
• Individual lots grading permit requirement
• Limit Mass Grading to 10 acres per site
Impacts to Development• Increases tracking and paper work for
individual lots
• Reducing mass grading slows progress but help control sediment loss on job sites
• Requiring additional details included on plan sets
Proposed Amendment
• Limit mass grading to 20 acres per site for single family subdivision development
12.4 Flood Damage Prevention• Reference to preliminary and effective
FIRM Maps
• Restricts new manufactured mobile homes
• Existing mobile homes in floodplain need:
• To be elevated if replaced
• Submit evacuation plan
Impacts to Development• Allows preliminary FIRM data to be used in
design
• Increased safety for residents in new developments and redevelopments
• Special Flood Hazard Area (SFHA) redefined in Chapter 17 from 500-year (0.2%) to 100-year (0.1%)
12.5 Stormwater Management• Added clarification language for low & high-density
development to meet state standards
• Added language for illicit discharge enforcement and penalties to meet MS4 permitting requirements
• Added pre-post run-off volume requirement for 10-year storm
• Updated requirements for sinking funds
Impacts to Development
• Additional capacity required to meet pre-post site run off volume
• Historically sinking funds not requested
• Limits the Town of Wake Forest’s ability to request funds in less than 5 years
12.6 Water Supply Watershed Protection Regulations
• Updated language for watershed protection overlay
• Match state tables to show impervious surface rules for each watershed
• Table for Falls Lake/Horse Creek contained an error
• New examples for impervious surface calculations
• Old Table:
• New Table:
Impacts to Development• Coordinated with planning to make
requirements more site specific
• New tables help developer classify sites for high vs low density based on zoning
• Provides examples for town’s approach on impervious surface and density calculations
Proposed Amendments
• Updated Table for Falls Lake/ Horse Creek Watershed
12.7 Watercourse Buffer Areas (new)• Buffer Tables updated
• Zone 1 & 2 match riparian state buffer
• Added Zone 3 for an additional water quality measure
• Diffuse Flow Requirement
Impacts to Development
• Developers will now provide buffers for tributaries and incorporate Zone 3 in waterbodies
• Additional protected area for future homeowners located in critical waterways
Proposed Amendments• Tables updated to clarify Zones and setbacks
• Clarification of Delineation of Buffer Zones
• Combined definitions
• Reduced surface feature types
• Primary and Secondary Watershed protection area references removed
New Table B:
Chapter 17 Definitions• Base Flood Elevation
• Buffer Zone
• Critical Root Zone
• Diameter at Breast Height
• Ditch or Canal
• Ephemeral Stream
• Facility
• Flood Hazard Boundary Map
• Flood Hazard Soils
• Floodplain/ Flood Prone Area
• Flood Proofing
• High Impervious Surface Project
• Impervious Surface
• Intermittent Stream
• Letter or Map Amendment
• Letter of Map Revision
• Low Impact Development
• Low Impervious Surface Project
• Modified Natural Stream
Chapter 17 Updates
• Off-Site Stormwater Control Measures
• On-site Stormwater Control Measures
• Perennial Stream
• Preliminary Flood Insurance Map
• Preliminary Flood Insurance Study
• Regional Stormwater Control Measures
• Riparian Surface Water
• Stormwater Design Manual
• Stormwater Control Measures
• Structural SCM Measure
• Violation Floodplain Development
• Working Days
Conclusion• Our Engineering Department will help
guide developers through new requirements
• Planning Process allows for multiple opportunities to make developers aware
• Revised Chapter 12 will be uploaded to the website on 7/10/20
