EXECUTIVE SUMMARY

INTRODUCTION

The applicant, the JN Venter Family Trust, proposes to expand a farm dam on Farm 633, referred to as Buck Kraal, measuring ~31ha in extent, near Sunland, in the Sundays River Valley Municipality. It is proposed that the dam, which has a current storage capacity of ~6 521m3 (footprint of ~1.56ha), be expanded by ~39 413m3 (~0.55ha), to have a total storage capacity of ~45 934m³

(~2.1ha). Farm 633 is zoned as Agriculture I and the remainder of the farm has been planted with citrus. The existing dam is proposed to be expanded into an area which is currently modified, but undeveloped. On 12 September 2019 an application was submitted to the Department of Economic Development, Environmental Affairs and Tourism (DEDEAT) Sarah Baartman Region, on behalf of the JN Venter Family Trust, for the proposed expansion of an existing farm balancing dam on Farm 633. The Final Basic Assessment Report (FBAR) was submitted to DEDEAT, for their decision-making, on 22 October 2019. However, prior to receipt of an environmental authorisation, the applicant commenced with activities on site associated with the expansion of the dam. DEDEAT indicated on 13 December 2019 that the original application for environmental authorisation would therefore be closed, and the matter was handed over to the DEDEAT Compliance and Enforcement Division. The applicant subsequently undertook a rehabilitation process to restore the dam to its original capacity, in line with a rehabilitation plan that had been approved by DEDEAT. DEDEAT has approved the rehabilitation of the dam and the docket has been closed by the Compliance and Enforcement Division. The applicant is therefore submitting a new application for Environmental Authorisation to DEDEAT for the expansion of the rehabilitated dam. Farm 633 is located north of the R336 (Kirkwood/ Addo Road) and ~3.3km North-West of Sunland (as the crow flies). Access to the farm is gained by travelling west on the R336, past Sunland, for a distance of ~3.9km, before turning right onto a gravel road and continuing east for a distance of ~1.5km. The nearest boundary of the Addo Elephant National Park is located ~8.6km east of Farm 633. In terms of the NEMA EIA Regulations 2014 (as amended), published in GN R326, 327, 325 and 324, promulgated under Chapter Five of the National Environmental Management Act (Act 107 of 1998) (NEMAA), and published in Government Gazette 40772 on the 7 April 2017, the project requires a Basic Assessment (BA), because it triggers the following listed activity, in Listing Notice 3 (GN R324):

“16. The expansion of reservoirs, excluding dams, where the capacity will be increased by more than 250 cubic metres. a. Eastern Cape i. Outside urban areas: (hh) Areas within 10 kilometres from national parks or world heritage sites or 5 kilometres from any other protected area identified in terms of NEMPAA or from the core area of a biosphere reserve; or…” Public Process Consultants has been appointed by the applicant as the independent Environmental Assessment Practitioners (EAP) to undertake the Basic Assessment, including Public Participation for the project. PROJECT DETAIL

Farm 633, measures ~31ha in extent and is zoned Agriculture I. The rehabilitated farm dam is located in the north-western corner of the property, has a capacity to store ~6 521m³ of water from the Lower Sundays River Water Users Association (LSRWUA) canal system, a footprint of ~1.56ha and a wall height of 4.7m. A manager’s house and storage / maintenance sheds are located near the entrance to the farm, in the south-western corner of the property. Citrus orchards have been established on the remainder of the farm. Irrigation water flows under gravity directly from the LSRWUA system, via an offtake canal, into the existing rehabilitated dam. The area that has been modified by the rehabilitation of the dam is proposed to be utilised for the expansion of the footprint, therefore no intact areas are proposed for clearance. It is proposed that existing Eskom infrastructure on the farm will be used to supply the proposed pumpstation with sufficient electricity supply. A new mainline outlet pipe (250mm) will be installed into the expanded dam to supply irrigation water to the adjacent orchards via internal irrigation pipelines of varying diameters (between 50mm and 250mm). The Sundays River flows adjacent to the eastern boundary of Farm 633, however, the proposed expansion footprint is located ~500m from the edge of the Sundays River riparian floodplain and no development is proposed on or near the banks thereof. Based on the outcome of the specialist assessments and technical input as well as input received during the consultation process, the project will entail the clearing and excavating of a portion of Farm 633 for the expansion of the farm dam. It is proposed that the dam be expanded as follows:

The Final Basic Assessment Report (FBAR) provides more detail on the proposed project components which are indicated in the Facility Illustration Drawing attached as Appendix C. Pre-construction Phase

Prior to commencement with construction activities on the farm, the detailed design drawings for the proposed expansion of the existing dam and associated infrastructure, must be finalised. Construction Phase It is anticipated that the proposed construction phase will entail the following activities:

• Existing dam will be drained prior to expansion and allowed to dry out completely.

• Existing south-western wall will be demolished and will be rebuilt during the proposed expansion

• Topsoil to be excavated and temporarily stockpiled onsite during the construction phase

• Installation of a plastic membrane to line the dam basin and walls, to ensure impermeability.

• Excavated topsoil to be used after expansion along with indigenous vegetation to rehabilitate the proposed dam walls in order to manage potential erosion.

• The existing offtake canal to be lined with cement.

• The overflow will be relocated north- and westwards, which will increase the capacity of the dam, and will be lined with cement to reduce erosion.

• Construction of a pumphouse on the southern dam wall

• Installation of an outlet irrigation pipeline with an internal diameter of ~250mm connecting to existing internal irrigation infrastructure.

Operational Phase Water will be supplied to the existing dam from the Lower Sundays River Water Users Association canal system located adjacent to the north-western boundary of Farm 633, wherefrom it will be pumped into the surrounding citrus orchards for irrigation purposes via pipelines of varying diameters. Irrigation water will flow under gravity directly into the dam via a cement offtake canal from the LSRWUA canal system. A new mainline outlet pipe will be installed into the expanded dam to supply irrigation water to the existing orchards via internal irrigation pipelines of varying diameters. The internal diameter of the new mainline outlet pipe will be ~250mm, while the internal irrigation pipelines will vary between 50mm and 250mm. Subsequent to the completion of the proposed dam expansion, the new dam will store water to irrigate ~31ha of citrus orchards, (23ha on Farm 633 and 8ha on Portion 87 of Farm 558) predominantly for the local market but also for the export market. Appendix G(ix) of the FBAR includes confirmation of scheduled water use entitlements for Farm 633 and Portion 87 of Farm 558, from the LSRWUA. BASIC ASSESSMENT PROCESS AND PUBLIC PARTICIPATION

This listed activity requires authorisation from the Department of Economic Development, Environmental Affairs and Tourism (DEDEAT). The BAR needs to show the competent authority, DEDEAT (Sarah Baartman Region), as well as the project applicant, the JN Venter Family Trust, what the consequences of their choices will be in biophysical, social and economic terms. Public participation forms an important component of this process, by assisting in the identification of issues and alternatives to be evaluated, and, together with specialist input, assists the competent authority with their decision-making. The BA Process is currently at the stage where the Final Basic Assessment Report has been submitted to the competent authority. No comment period is proposed for the FBAR. All Interested and Affected Parties will be notified of the submission to the competent authority as well as the outcome of the decision-making process. SPECIALIST STUDIES

The following specialist studies have been undertaken as part of the BA Process in order to inform the FBAR:

• Aquatic Specialist Assessment

• Desktop Heritage Screening Report (Archaeology and Palaeontology)

• Terrestrial Biodiversity Compliance Statement The specialist studies are included in Appendix D (i) – D (iii) of the FBAR. ENVIRONMENTAL IMPACT STATEMENT

The proposed expansion of the existing farm dam is anticipated to have an overall LOW NEGATIVE impact on the receiving environment during the construction phases, if all the recommended mitigation measures are applied. In the operational phase, the overall impact is VERY LOW NEGATIVE to NEUTRAL. Ecological impacts are not anticipated to be significant, as the site is largely modified, and the Sundays River and riparian habitat is located ~550m from the proposed dam expansion footprint. However, with the application of the proposed mitigation measures it has been rated as a LOW NEGATIVE impact, which has a less than 50% chance of occurring. An increase in the potential aquatic habitat would occur due to an increase in available emergent habitat associated with the expanded dam (larger water surface area). This impact has been rated as a LOW POSITIVE. Socio-economic impacts which have been identified, which include the generation of noise and dust, as well as health and safety impacts, can also be mitigated to LOW or VERY LOW NEGATIVE. Heritage impacts can be mitigated to NEUTRAL during the construction phase if the ECO and/ or construction foreman are informed of the types of heritage artefacts which could be uncovered during vegetation clearing and excavations and what action is to be taken should heritage material be uncovered. The application of the proposed mitigation and design measures, as recommended by the respective specialists, to be effectively managed in order to reduce the identified potential impacts so as to not have a detrimental effect on the receiving environment. In addition, some positive impacts have also been predicted. These include the creation of a number of additional employment opportunities and associated economic growth for the local community (rated as LOW POSITIVE), as well as the possible increase of aquatic habitat due to an increase in available emergent habitat associated with the expanded dam (larger water surface area). This impact has been rated as a LOW POSITIVE. No-Go Alternative (compulsory) The No-Go alternative will result in the potential employment and skills development opportunities for the local community not being realised. In turn, the potential opportunity for economic growth in the community will be lost. The securing of irrigation water supply for current agricultural activities will also not be realised. These consequential impacts are regarded as HIGH NEGATIVE.

1. ACTIVITY DESCRIPTION

Describe the activity, which is being applied for, in detail INTRODUCTION

The applicant, the JN Venter Family Trust, proposes to expand a farm dam on Farm 633, referred to

as Buck Kraal, measuring ~31ha in extent, near Sunland, in the Sundays River Valley Municipality. It

is proposed that the dam, which has a current storage capacity of ~6 521m3 (footprint of ~1.56ha), be

expanded by ~39 413m3 (~0.55ha), to have a total storage capacity of ~45 934m³ (~2.1ha). Farm 633

is zoned as Agriculture I and the remainder of the farm has been planted with citrus. The existing dam

is proposed to be expanded into an area which is currently modified, but undeveloped.

On 12 September 2019 an application was submitted to the Department of Economic Development,

Environmental Affairs and Tourism (DEDEAT) Sarah Baartman Region, on behalf of the JN Venter

Family Trust, for the proposed expansion of an existing farm balancing dam on Farm 633. The Final

Basic Assessment Report (FBAR) was submitted to DEDEAT, for their decision-making, on 22

October 2019. However, prior to receipt of an environmental authorisation, the applicant commenced

with activities on site associated with the expansion of the dam. DEDEAT indicated on 13 December

2019 that the original application for environmental authorisation would therefore be closed, and the

matter was handed over to the DEDEAT Compliance and Enforcement Division. The applicant

subsequently undertook a rehabilitation process to restore the dam to its original capacity, in line with

a rehabilitation plan that had been approved by DEDEAT. DEDEAT has approved the rehabilitation

of the dam and the docket has been closed by the Compliance and Enforcement Division. The

applicant is therefore submitting a new application for Environmental Authorisation to DEDEAT for the

expansion of the rehabilitated dam.

PROJECT LOCALITY

Farm 633 is located north of the R336 (Kirkwood/ Addo Road) and ~3.3km North-West of Sunland (as

the crow flies). Access to the farm is gained by travelling west on the R336, past Sunland, for a

distance of ~3.9km, before turning right onto a gravel road and continuing east for a distance of

~1.5km. The nearest boundary of the Addo Elephant National Park is located ~8.6km east of Farm

633. The locality map attached provides an overview of the location of the property under assessment

(See Map 1 below).

SURROUNDING LAND USE

Land-uses on the properties adjacent to Farm 633 include commercial agriculture (i.e. citrus orchards

and pastures) and possible livestock grazing/ browsing or derelict land. Vegetation cover on adjacent

farms is therefore characterised by activities associated with the “Sundays River Valley” agricultural

area. The proposed dam expansion is in line with land use activities which currently take place in the

area.

SITE OVERVIEW

The following section provides an overview of the existing land use, project components and activities

on Farm 663 (see Map 2 below).

Farm 633, measures ~31ha in extent and is zoned Agriculture I. The rehabilitated farm dam is located

in the north-western corner of the property, has a capacity to store ~6 521m³ of water from the Lower

Sundays River Water Users Association (LSRWUA) canal system, a footprint of ~1.56ha and a wall

height of 4.7m. A manager’s house and storage / maintenance sheds are located near the entrance

to the farm, in the south-western corner of the property. Citrus orchards have been established on the

remainder of the farm. Irrigation water flows under gravity directly from the LSRWUA system, via an

offtake canal, into the existing rehabilitated dam.

The area that has been modified by the rehabilitation of the dam is proposed to be utilised for the

expansion of the footprint, therefore no intact areas are proposed for clearance. It is proposed that

existing Eskom infrastructure on the farm will be used to supply the proposed pumpstation with

sufficient electricity supply. A new mainline outlet pipe (250mm) will be installed into the expanded

dam to supply irrigation water to the adjacent orchards via internal irrigation pipelines of varying

diameters (between 50mm and 250mm).

The Sundays River flows adjacent to the eastern boundary of Farm 633, however, the proposed

expansion footprint is located ~500m from the edge of the Sundays River riparian floodplain and no

development is proposed on or near the banks thereof.

PROJECT OVERVIEW

Based on the outcome of the specialist assessments and technical input as well as input received

during the consultation process, the project will entail the clearing and excavating of a portion of Farm

633 for the expansion of the farm dam. It is proposed that the dam be expanded as follows:

• Details of the existing dam (rehabilitated dam)

o Capacity in cubic metres: 6 521m3

o Dam footprint in square metres: 15 643m2 (~1.56ha)

o Dam wall height in metres: 4.7m

• Details of the proposed expansion

PROPOSED ACTIVITIES PRE-CONSTRUCTION PHASE

Prior to the commencing with construction activities on the farm, the detailed dam design drawings for

the proposed expansion of the existing dam and associated infrastructure, must be finalised.

CONSTRUCTION PHASE

It is anticipated that the proposed construction phase will entail the following activities:

• Existing dam will be drained prior to expansion and allowed to dry out completely.

• Existing south-western wall will be demolished and will be rebuilt during the proposed expansion

• Topsoil to be excavated and temporarily stockpiled onsite during the construction phase

• Installation of a plastic membrane to line the dam basin and walls, to ensure impermeability.

• Excavated topsoil to be used after expansion along with indigenous vegetation to rehabilitate the

proposed dam walls in order to manage potential erosion.

• The existing offtake canal to be lined with cement.

• The overflow will be relocated north- and westwards, which will increase the capacity of the dam,

and will be lined with cement to reduce erosion.

• Construction of a pumphouse on the southern dam wall

• Installation of an outlet irrigation pipeline with an internal diameter of ~250mm connecting to

existing internal irrigation infrastructure.

OPERATIONAL PHASE

Water will be supplied to the existing dam from the Lower Sundays River Water Users Association

canal system located adjacent to the north-western boundary of Farm 633, wherefrom it will be

pumped into the surrounding citrus orchards for irrigation purposes via pipelines of varying diameters.

Irrigation water will flow under gravity directly into the dam via a cement offtake canal from the

LSRWUA canal system. A new mainline outlet pipe will be installed into the expanded dam to supply

irrigation water to the existing orchards via internal irrigation pipelines of varying diameters. The

internal diameter of the new mainline outlet pipe will be ~250mm, while the internal irrigation pipelines

will vary between 50mm and 250mm.

The farm Buck Kraal is made up of two portions, namely, Farm 633 and Portion 87 of Farm 558, which

have been allocated water use entitlements of 25.7ha and 8.5ha, respectively. Appendix G(ix) of this

report includes confirmation of scheduled water use entitlements from the LSRWUA for Farm 633 and

Portion 87 of Farm 558.

Subsequent to the completion of the proposed dam expansion, the new dam will store water to irrigate

~31ha of citrus orchards, (23ha on Farm 633 and 8ha on Portion 87 of Farm 558) predominantly for

the local market but also for the export market.

PROJECT TIMING

Should the proposed dam expansion receive Environmental Authorisation, it is proposed that the

preconstruction phase (detailed planning and design approval) will commence immediately and will

be completed within ~12 months. The construction phase will commence within 6 months of

completion of the preconstruction phase and will take ~12 months to complete. The expanded dam

will become operational upon completion of the construction phases and will continue in perpetuity.

2. FEASIBLE AND REASONABLE ALTERNATIVES

“alternatives”, in relation to a proposed activity, means different means of meeting the general purpose and requirements of the activity, which may include alternatives to— (a) the property on which or location where it is proposed to undertake the activity; (b) the type of activity to be undertaken; (c) the design or layout of the activity; (d) the technology to be used in the activity; (e) the operational aspects of the activity; and (f) the option of not implementing the activity.

Describe alternatives that are considered in this application. Alternatives should include a consideration of all possible

means by which the purpose and need of the proposed activity could be accomplished in the specific instance taking

account of the interest of the applicant in the activity. The no-go alternative must in all cases be included in the assessment

phase as the baseline against which the impacts of the other alternatives are assessed. The determination of whether

site or activity (including different processes etc.) or both is appropriate needs to be informed by the specific circumstances

of the activity and its environment. After receipt of this report the competent authority may also request the applicant to

assess additional alternatives that could possibly accomplish the purpose and need of the proposed activity if it is clear

that realistic alternatives have not been considered to a reasonable extent.

Paragraphs 3 – 13 below should be completed for each alternative.

This Basic Assessment included the consideration of layout alternatives. Site alternatives were

not assessed, as this project is for the expansion of an existing dam on Farm 633. The following

factors have contributed to the identification of the preferred layout alternative:

• Location of the existing farm dam

• Location of existing infrastructure, including existing irrigation infrastructure, Eskom electrical

point as well as the LSRWUA canal system

• Water availability requirements

Layout 1 (not preferred)

Initially the proposed dam was to be expanded to a have a storage capacity of 49 680m³, a

footprint of 2.27ha and a wall height of 5m. It was to be expanded into an area that was previously

cultivated fields (i.e. Lucerne fields), but was subsequently replaced with citrus orchards. In order

to avoid loss of existing citrus orchards, the proposed location of the dam has been moved ~90m

in a westerly direction. Additionally, the applicant indicated that the proposed dam was larger

than the amount of water required to be stored. Therefore, the size of the expansion was reduced.

Layout 2 (preferred Layout)

Layout 2, as outlined above in Section 1 (Activity Description), is the preferred layout for the dam

expansion and has been assessed in full (see map 3 above). The dam is proposed to be

expanded to have a storage capacity of 45 934m³, a footprint of 2.11ha and a dam wall height of

5.9m. The dam will be expanded by rebuilding and shaping the southwestern wall, as well as the

overflow, so as to increase the storage capacity.

No-Go Alternative

In addition to the alternatives discussed in this section, the No-Go Alternative was assessed in full

in the Impact Section of this report (Section D). The expansion of the dam is primarily required to

store additional water from the LSRWUA canal system in order to sustainably irrigate the existing

citrus orchards. Currently the applicant has a temporary arrangement in place with the Sundays

River Citrus Company (SRCC), to irrigate directly from a pipeline that they have installed in the

road reserve adjacent to Farm 633. The orchard trees are still young and therefore do not require

a lot of water. However, as the orchards mature, more water will be required than can be delivered

via the pipeline. The No-Go option would result in the applicant not being able to irrigate the

orchards sufficiently, thus causing a significant loss in capital investment and existing employment.

Access to Farm 633 is gained by travelling west on the R336, past Sunland, for a distance of ~3.8km, before turning right onto the gravel road just past the Summerville liquor store and continuing east for a distance of ~1.5km. The existing south-western access point, associated with the farmhouse, is proposed to be utilised (see Map 2 above). A Traffic Impact Assessment is not proposed for the expansion of the existing dam, as the impacts on the surrounding roads will be temporary and limited to the Construction Phase of the development. It is not anticipated that the Operational Phase, where it relates to the operation of the expanded dam, will increase the traffic volumes on the surrounding roads.

Include the position of the access road on the site plan and required map, as well as an indication of the road in relation to the site. 6. SITE OR ROUTE PLAN

A detailed site or route plan(s) must be prepared for each alternative site or alternative activity. It must be attached as Appendix A to this document. The site or route plans must indicate the following: 6.1 the scale of the plan which must be at least a scale of 1:500; 6.2 the property boundaries and numbers of all the properties within 50 metres of the site; 6.3 the current land use as well as the land use zoning of each of the properties adjoining the site or sites; 6.4 the exact position of each element of the application as well as any other structures on the site; 6.5 the position of services, including electricity supply cables (indicate above or underground), water supply pipelines,

9(b) Need and desirability of the activity

Motivate and explain the need and desirability of the activity (including demand for the activity): South Africa’s National Development Plan, 2011, has as one of its focal points, the expansion of

agriculture in order to facilitate job creation. The Final IDP (2020/ 2021) for the SRVM indicates that

the current unemployment rate in the municipal area may be as high as 38.54%. The Agricultural

sector provides room for growth in terms of employment opportunities, as it currently represents

~11% of the employment for the SRVM area. The NMBM Integrated Development Plan 2017/2018

– 2021/2022 (3rd Edition, Adopted 19 June 2019) highlights some of the key socio-economic

challenges in the NMBM and lists unemployment and poverty among them. Some of the reasons

cited in the NMBM IDP (2017/2021) for the low economic growth experienced in the NMBM (1.36%

per annum) are the high unemployment and dependency ratios (unemployment rate 36.8%). The

NMBM is experiencing a devastating drought, one of the worst recorded, and it has strained all

main economy sectors of NMBM including Agro-processing, one of the four main economic sectors

in the NMBM (NMBM IDP 2017/2021). The nearby communities associated with the towns of

Kirkwood and Addo in the SRVM, as well as the greater NMBM area, represent an important labour

force in close proximity to the proposed development.

The citrus industry is a very important component of the Eastern Cape’s agricultural economy and

of the “Sundays River Valley” in particular. The expansion of the existing dam on Farm 633 has a

direct correlation to employment creation, as the Construction Phase of the project will create

additional temporary employment opportunities. The long-term land use of citrus orchards would

indirectly create additional seasonal, as well as permanent Operational Phase employment

opportunities. By making use of the local labour market, the proposed development would also

support the vision of the Sundays River Valley Local Economic Strategy, as outlined in the SDF

(April 2013), which indicates agriculture as a Local Economic Development Priority and identifies

the need to “…expand the agricultural section in the region.”, as an Economic Development

Objective.

Water supply from the LSRWUA canal system is only released at scheduled times and is thus not

readily available to farmers at all times. Therefore, a balancing dam is required in order to allow the

temporary storage of LSRWUA canal water for irrigation purposes. The applicant has entered into

a temporary agreement with the Sunday River Citrus Company (SRCC) to access irrigation water

from a pipeline that they have installed in the road reserve adjacent to Farm 633, to irrigate existing

citrus orchards on Farm 633 and Portion 87 of Farm, 558. The orchard trees are still young and

therefore do not require a lot of water. However, as the orchards mature, more water will be required

than can be delivered via the pipeline, at which point, the applicant intends to use the proposed

expanded farm dam.

The proposed expansion of the dam will ensure the security of future irrigation water supply to the

citrus orchards.

Indicate any benefits that the activity will have for society in general:

The project will provide economic stimulation in the SRVM, through a temporary increase in

demand for goods associated with the Construction Phase of the dam expansion. In the long-term

and during the Operational Phase of the activity, which includes sustainable irrigation of citrus

orchards, positive indirect economic benefits are associated with the creation of additional

employment opportunities; an increase in shipping and cargo handling requirements; as well as

increased transport requirements for goods and labour.

Indicate any benefits that the activity will have for the local communities where the activity will be located:

The Final IDP (2020/ 2021) for the SRVM indicates that the current unemployment rate in the

municipal area may be as high as 38.54%. The proposed development will indirectly create an

additional ~11 employment opportunities during the construction and operational phases

combined. The indirect employment opportunities that will be generated by the proposed

development will improve the buying power of individuals in the local communities, which in turn,

demand for goods associated with the Construction Phase of the dam expansion. In the long-term

and during the Operational Phase of the activity, positive indirect economic benefits are associated

with the seasonal employment opportunities (related to the farming operations, as well as indirectly

in support services); an increase in shipping and cargo handling requirements; as well as

increased transport requirements for goods and labour.

proposed dam expansion. Additional Construction Phase waste is expected to be

limited to litter generated by the construction staff, which must be disposed of at a

licensed waste disposal site. Waste will be recycled as far as possible. Non-recyclable

waste will be sorted into different types and disposed of at a suitably licensed waste

disposal facility.

CONSERVATION PLANNING FRAMEWORKS

According to the VegMap (2018) mapping resources, the vegetation type that should occur on

Farm 633 is Albany Alluvial Vegetation, which is classified in the National Biodiversity Assessment

(NBA,2018) as Endangered (Map 7). Consequently, it is listed as a Threatened Ecosystem in

terms of the National Environmental Management: Biodiversity Act (10 of 2004).

• Eastern Cape Biodiversity Conservation Plan (ECBCP, 2019)

In terms of the ECBCP 2019 mapping resources the majority of Farm 633, including the proposed

dam expansion footprint, has been identified as a Terrestrial ESA 2. A few portions of the site

have also been identified as Terrestrial ESA1, however, these do not fall within the proposed

footprint (See Map 8). The ECBCP Handbook (2019), does not include land-use management

guidelines for developments of this nature, i.e. reservoirs for the off-stream storage of irrigation

water. However, the Handbook does indicate that sites identified as Terrestrial ESA1 should be

maintained in a functional state i.e. a semi-natural state such that ecological function and

ecosystem services are maintained. Ecosystems that are natural/ near-natural should be

maintained and those that are moderately degraded / disturbed should be restored.

For ESA2 sites the land management objective is to maintain current land use with no

intensification. These areas have already been subjected to severe and/or irreversible

modification. Both ESA1 and ESA2 are not required to meet biodiversity targets. Given that the

site has been irreversibly modified, the designation of portions of the site as ESA1, in the ECBCP

2019 mapping resources, appears to be incorrect.

In terms of the ECBCP 2019 mapping resources a portion of Buck Kraal has been identified as an

Aquatic ESA 1 associated with the Sundays River located adjacent to the eastern boundary (see

Map 9). A protruding arm runs in a north-east to south-western direction across a portion of the

farm and is presumably a historic tributary associated with the Sundays River. According to the

ECBCP Handbook (2019), sites identified as Aquatic ESA1 should be maintained in a functional

state i.e. a semi-natural state such that ecological function and ecosystem services are

maintained. Ecosystems that are natural/ near-natural should be maintained and those that are

moderately degraded / disturbed should be restored. However, given that the site has been

irreversibly modified, the designation of portions of the site as ESA1, in the ECBCP 2019 mapping

resources, appears to be incorrect.

• Sundays River Valley Municipality Biodiversity Sector Plan (SRVM BSP, 2012)

According to the SRVM BSP (Skowno and Holness, 2012) mapping resources, the majority of

Farm 633 is indicated as No Natural Remaining (NNR) area, which represents the existing

orchards. A small portion of the eastern section of the farm, associated with the Sundays River

and its floodplain, is classified as a Critical Biodiversity Area (CBA) and Ecological Support Area

(ESA). However, the proposed dam expansion is located in the NNR area towards the western

part of the farm (Map 10).

• National Wetland Inventory V5.2 (2018)

The site falls within one Quaternary catchment, just upstream of the Coerney River confluence

with the Sundays River (N40E) (Map 11), while the remainder of the catchment occurs within a

highly transformed agricultural environment. Furthermore, no natural wetland environments are

located within the development footprint, or within 500m thereof confirmed in Version 5.2 (2018)

of the National Wetland Inventory (Map 12).

CURRENT STATE OF THE VEGETATION ON SITE

Aquatic Environment

An aquatic specialist assessment was undertaken during the previous environmental assessment

process. The full specialist study is attached as Appendix D (i) of this report. Below is an extract

of the findings of that report as it related to the aquatic environment, at that time. Given that the

dam has been modified since the study was undertaken, some of the information therein is no

longer relevant.

The only natural waterbodies found within the study area (site inclusive of 500m buffer), include

the lower portion of the Sundays River riparian zone, suffering from a high degree of Phragmites

australis reedbed and or Vachellia karroo encroachment (Photo 1), possibly because of the

constant baseflow regime (Adams, Cowie & van Niekerk, 2016), high in nutrients. This is a result

of Orange River transfer scheme and agricultural return flows in the catchment (Janse van Vuuren

& Taylor, 2015).

This lack of overall natural habitat has resulted in a general absence of indigenous aquatic

species, with only small number of instream / emergent species being found along the mainstem

systems and include:

• Phragmites australis

• Arundo donax (Spanish reed – Invasive)

• Typha capensis.

Map 13 includes the delineation of the remaining extent of the Sundays River riparian zone, as

past land use activity has resulted in the cultivation of grazing pastures, limiting the development

of any aquatic habitats, as were seen in the past

The information provided below is based on the Terrestrial Biodiversity Compliance

Statement prepared by Jamie Pote (SACNASP Registered Ecological Scientist) and

attached as Appendix D(iii) to this report.

Terrestrial Biodiversity

Habitat characteristics indicate the area is transformed and the likelihood of any terrestrial

ecosystem Biodiversity Priority Areas (BPA’s), plant or animal Species of Conservation Concern

being found at the site or within the area of influence is negligible (very low).

Being transformed, comprising of an existing dam, and surrounded by orchards which were

previously irrigated pastures, the site is not considered to be an Ecological Support Area 2 nor

likely to provide ecological function associated with such features.

The nearest natural vegetation is associated with the Sundays River and its floodplain, located

along the eastern boundary of the farm. This vegetation has been encroached by the common

reed Phragmites australis, as well as Vachellia karroo and is outside of the area of influence of

the proposed dam expansion, being separated from this by a block of citrus orchards, which were

historically irrigated pastures that is at least 500m wide.

Furthermore, since the site is transformed and has no indigenous vegetation, it will not be the

Endangered Ecosystem (Albany Alluvial Vegetation) as identified in the screening tool.

Plant Species

No sensitive plant species were identified as per the screening tool, and none were identified on

site, confirming the designated low sensitivity of the site.

Animal Species

The two animal species, an invertebrate (Aneuryphymus montanus) and Sensitive Species 5 are

not found on the site. In addition, the site, being comprised of transformed habitat, is unlikely to

provide suitable habitat for these species before or after expansion of the dam, due to existing

levels of transformation.

Aquatic Biodiversity

Although outside of the scope of this terrestrial biodiversity compliance statement, it is noted that

the existing farm dam was classified by the aquatic specialist, undertaken as part of the Basic

Assessment Process, as an “artificial dam”. As such, the Present Ecological State and

Conservation Importance of the dam were not determined. The closest natural aquatic feature is

the Sundays River, located over 500m to the east and over 800 m to the north of the site.

Furthermore, expansion of the dam will not affect or alter the flow of any natural watercourse, as

its purpose is to serve as an off-stream reservoir for water abstracted from an irrigation board

canal.

No natural Aquatic Biodiversity features are noted to be present, nor likely to be affected by the

expansion of the off-stream farm storage dam, as confirmed in the aquatic assessment report that

was compiled for the basic assessment, which also confirms the low aquatic biodiversity sensitivity

designation of the screening tool.

related to the potential for the occurrence of heritage resources on the site. Given

that the farm has been modified since the study was undertaken, some of the

information therein is no longer relevant.

“The area proposed for the dam extension is currently utilised for the cultivation of lucerne and fodder. Based on the distance of the proposed dam expansion from the banks of the Sundays River, as well as the previously disturbed nature of the area, it is unlikely that the proposed development will impact on significance archaeological resources.” “The area proposed for the dam expansion is underlain by alluvial deposits of moderate palaeontological sensitivity according to the SAHRIS Palaeosensitivity Map (Figure 4 and 5). The low sensitivity alluvial deposits overlay sediments of the Sundays River Formation of very high palaeontological sensitivity (Figure 4 and 5). According to the SAHRIS Fossil Heritage Browser, the Sundays River Formation is dated to the early Cretaceous and is known to contain rich marine invertebrate fauna (molluscs, echinoderms etc), vertebrates (eg plesiosaurs), microfossils (foraminiferans, ostracods) and trace fossils of high palaeontological significance. In addition, it is likely that the proposed excavation for the dam extension may intersect with the significant Sundays River Formation.” Recommendations The heritage resources in the area proposed for development are sufficiently recorded. It was initially recommended by the heritage specialist that a site visit by a palaeontologist take place during the construction phase of the project to inspect fresh bedrock for significant fossil material. However, given that the dam has subsequently been expanded and rehabilitated, this recommendation would no longer be necessary.

ADVERTISEMENT The person conducting a public participation process must take into account any guidelines applicable to public participation as contemplated in section 24J of the Act and must give notice to all potential interested and affected parties of the application which is subjected to public participation by— (a) fixing a notice board (of a size at least 60cm by 42cm; and must display the required information in

lettering and in a format as may be determined by the competent authority) at a place conspicuous to the public at the boundary or on the fence of— (i) the site where the activity to which the application relates is or is to be undertaken; and

(ii) any alternative site mentioned in the application;

A copy of the notice board placed on the fence of the property attached in Appendix G(i)

(b) giving written notice to—

(i) the owner or person in control of that land if the applicant is not the owner or person in control of the land;

(ii) the occupiers of the site where the activity is or is to be undertaken or to any alternative site

where the activity is to be undertaken; (iii) owners and occupiers of land adjacent to the site where the activity is or is to be undertaken

or to any alternative site where the activity is to be undertaken;

Authority Consultation

Notification of the intention to commence with a Basic Assessment Process, was submitted to the

competent authority (DEDEAT: Sarah Baartman Region), as well as affected/ Juristic Organs of

State and State Departments on the 7 May 2021. Included in the notification was a Background

Information Document, comment form, locality map and a link to the project website where

available information can be downloaded. Correspondence sent to I&APs and relevant authorities

are attached as Appendix G(iii) to this report.

Affected/ Juristic Organs of State and State Departments which may be required to issue a licence

or permit prior to commencement of the project, will be consulted and are included on the project

database. Appendix G (vi), includes the authority database with their respective contact details.

All Public Participation documentation (Draft and Final Reports) will be sent to the competent

authority via email, as well as affected/ Juristic Organs of State and State Departments, which are

registered on the project database. The competent authority, affected/ Juristic Organs of State

and State Departments will be provided with a link to the project website, where the report can be

downloaded, as agreed to with the respective Department. Authorities are required to provide their

input on the proposed dam expansion within the timeframes stipulated. Input from the authorities

will be included in the Comments and Response report for the Basic Assessment Process.

Database Development, maintenance and ongoing Information Sharing

The applicant is the landowner.

The following provides and outline of the approach to the development of the project

announcement database (Pre-Application Phase), as well as the maintenance of the database

and ongoing information sharing throughout the BA Process.

Prior to advertising the Basic Assessment Process, the EAP, drawing on experience in the local

SRV Municipal area, and the project database that was developed for the previous assessment,

developed an initial database of potential I&APs for the proposed expansion. Adjacent

landowners/ tenants were identified through deeds searches (Windeed) and, where required,

contact information was confirmed via telephonic/ email communication. This database included

amongst others, adjacent landowners/tenants, affected/ Juristic Organs of State and State

Departments as well as the competent authority (DEDEAT: Department of Economic

Development, Environmental Affairs and Tourism – Sarah Baartman Region), the Councillor for

Ward 8 and other potential I&APs (WESSA EP Region and CREW).

All potential I&APs were notified by means of Letter 1 sent via email, of intention to commence

with a Basic Assessment Process and the legislated 30-day comment period in which to raise

issues of concern for inclusion on the Consultation Basic Assessment Report (CBAR). Included in

this notification was a comment form and a Background Information Document (BID), including a

locality map of the proposed dam expansion. The 30-day comment and registration extended from

7 May 2021 to 7 June 2021. Prior to advertising the BA process, the project database included

31 Registered I&APs.

Comments were received from three I&APs, namely, Babalwa Layini (Department of Agriculture,

Forestry and Fisheries), Rudi Herholdt (SRVM: Infrastructure Planning and Development) and

Gcinile Dumse (Department of Agriculture, Land Reform and Rural Development).

All I&APs on the project database were notified via Letter 2, sent via email, of the release of the

CBAR for a 32-day comment period. The 32-day comment period extended from 01 September

2021 to 04 October 2021. At the time of the release of the CBAR, the project database included

31 Registered I&APs.

Subsequent to the release of the CBAR one I&AP, Ms Jayshree Govender requested to be

removed from all project databases. The project database for this assessment was amended

accordingly and prior to the submission of the FBAR the project database included 30 Registered

I&APs. Copies of correspondence sent to I&AP and authorities have been included in Appendix

G (iii) and a copy of the I&AP database has been submitted to DEDEAT in a separate document

accompanying the FBAR.

The identification and registration of I&APs has been ongoing for the duration of the BA Process.

While not required by the EIA regulations, those I&APs identified at the outset of the BA process

have remained on the project database, have been kept informed of all opportunities to comment

and have only been removed from the database by request.

(iv) the municipal councillor of the ward in which the site or alternative site is situated and any

organisation of ratepayers that represent the community in the area;

Cllr Kausele, Ward 8 Councillor for the Sundays River Valley Municipality (SRVM), has been included on the project database and provided with copies of all the relevant and available

correspondence. A copy of the project database is contained in Appendix G(ii) of this report.

(v) the municipality which has jurisdiction in the area;

Mr Ted Pillay, acting SRVM Municipal Manager (MM) was included on the project database during the project announcement and registration phase of the assessment process. However, Mr Sydney Fadi has been reinstated as MM and has therefore replaced Mr Pillay on the project database. Mr Fadi will be provided with a link to the project website where available information can be downloaded. A copy of the authority database is contained in Appendix G(vi).

(vi) any organ of state having jurisdiction in respect of any aspect of the activity; and

A newspaper advertisement appeared in “The Herald” on 7 May 2021. A copy of the advertisement is attached in Appendix G (i) of this report.

(d) placing an advertisement in at least one provincial newspaper or national newspaper, if the activity has

or may have an impact that extends beyond the boundaries of the metropolitan or local municipality in which it is or will be undertaken: Provided that this paragraph need not be complied with if an advertisement has been placed in an official Gazette referred to in subregulation 54(c)(ii); and

It is not anticipated that the proposed development will have any impact that will extend beyond the boundaries of the local municipality.

(e) using reasonable alternative methods, as agreed to by the competent authority, in those instances

where a person is desiring of but unable to participate in the process due to— (i) illiteracy; (ii) disability; or (iii) any other disadvantage.

None have been identified to date

2. CONTENT OF ADVERTISEMENTS AND NOTICES A notice board, advertisement or notices must: (a) indicate the details of the application which is subjected to public participation; and (b) state—

(i) that the application has been submitted to the competent authority in terms of these Regulations, as the case may be;

(ii) whether basic assessment or scoping procedures are being applied to the application, in the case of an application for environmental authorisation;

(iii) the nature and location of the activity to which the application relates; (iv) where further information on the application or activity can be obtained; and (iv) the manner in which and the person to whom representations in respect of the application

may be made.

In line with these requirements an advert notifying all I&APs on the project database of the commencement of the Basic Assessment Process, appeared in “The Herald” on 7 May 2021 and a Notice Board was placed at the entrance of the site on 7 May 2021. A copy of the notice board and newspaper advert are included in Appendix G(i) of this report.

3. PLACEMENT OF ADVERTISEMENTS AND NOTICES Where the proposed activity may have impacts that extend beyond the municipal area where it is located, a notice must be placed in at least one provincial newspaper or national newspaper, indicating that an application will be submitted to the competent authority in terms of these regulations, the nature and location of the activity, where further information on the proposed activity can be obtained and the manner in which representations in respect of the application can be made, unless a notice has been placed in any Gazette that is published specifically for the purpose of providing notice to the public of applications made in terms of the EIA regulations. Advertisements and notices must make provision for all alternatives. A copy of the notice board and newspaper advert are contained in Appendix G(i) of the report.

4. DETERMINATION OF APPROPRIATE MEASURES The practitioner must ensure that the public participation is adequate and must determine whether a public meeting or any other additional measure is appropriate or not based on the particular nature of each case. Special attention should be given to the involvement of local community structures such as Ward Committees, ratepayers associations and traditional authorities where appropriate. Please note that public concerns that emerge at a later stage that should have been addressed may cause the competent authority to withdraw any authorisation it may have issued if it becomes apparent that the public participation process was inadequate.

The following is an overview of the Public Participation Process prosed for this Basic Assessment Process.

As indicated above, the BA Process has been divided into three phases. The purpose of this

approach is to, amongst others, achieve the following:

o To ensure I&APs (including the competent authority, affected/ Juristic Organs of State and State Departments) have access to information on the proposed project from the outset of the BA Process.

o To facilitate the identification of issues of concern, to inform the range of specialist studies being conducted for this BA.

o To assist in the identification of alternatives for assessment in this BA. o To facilitate the refinement of the project description and preferred development footprint

within the property under assessment.

o PRE-APPLICATION PHASE

Project Announcement, Identification, Notification and Registration of I&APs

In order to notify and inform the public, potential I&APs, affected/ Juristic Organs of State and

State Departments, as well as the competent authority, of the proposed project, the opportunity to

register as an I&AP, as well as to raise issues of concern, the BA Process was announced as

follows:

o Advertisement in One Local Newspaper:

o The Herald, 7 May 2021 (Provincial distribution).

o Site Notice Board:

o A notice board was placed on the fence at the entrance to Farm 633.

o Letter 1 to I&APs - Notice of the BA Process, Comment and Registration Period:

o Letter 1 included a Background Information Document (BID), locality map and

comment form. Written notification of the BA Process was sent to the competent

authority and to all I&APs, including affected/ Juristic Organs of State and State

Departments on the project database, on 7 May 2021, via email. A 30-day comment

and registration period was allowed for I&APs to register their interest on the project

database and raise issues of concern for inclusion in the CBAR. The comment

period extended from 7 May 2021 to 7 June 2021.

o Availability of Information - all project information has been made available on the

website www.publicprocess.co.za.

Appendix G(i) contains a copy of the newspaper advertisement placed in “The Herald”, as well as

photos of the site notice board placed at the entrance to Farm 633. Appendix G(iii) contains copies

of the correspondence sent to all I&APs and authorities and Appendix G(iv) contains copies of

correspondence received from I&APs and authorities in response to the project announcement.

Comments were received from three (3) Organs of State / State Departments during the project

announcement phase. These have been included in the Comments and Responses Report in

Appendix E of the report. All I&APs registered on the project database were notified of the release

of the CBAR for a legislated 30-day review period.

o APPLICATION AND BASIC ASSESSMENT PHASE

This phase in the BA Process entails the following, which is outlined in more detail below: o Submission of Application Form for Environmental Authorisation to DEDEAT. o Consultation Basic Assessment Report Review (legislated 30-day comment period). o Submit Final Basic Assessment Report to DEDEAT.

Submission of Application Form for Environmental Authorisation to DEDEAT This step entails the submission of the Application Form for Environmental Authorisation to the competent authority (DEDEAT – Sarah Baartman Region), which has 10 days within which to respond to the submission of the application. An electronic copy of the application form, including cover letter was emailed in pdf format to Dayalan Govender and Andries Struwig (DEDEAT- Sarah Baartman Region; Competent Authority) on 31 August 2021. Charmaine Struwig was copied in on this email correspondence. On 01 September 2021 correspondence was received from Ms Struwig to confirm that the application was deemed correct and complete and that the application had been registered on DEDEAT’s system. The Reference Number assigned to the application is EC06/C/LN3/16/48-2021 and the case officer assigned is Ms Nokulunga Ludidi. Ms Ludidi was subsequently added to the database. The applicant must within 90 days of receipt of the application by the competent authority, submit a Basic Assessment Report, inclusive of specialist reports and EMPr, to the competent authority, which has been subjected to a Public Participation Process of at least 30 days and which reflects the incorporation of comments received form I&APs, including any comments from the competent authority. Failure to comply with these timeframes will result in the application having deemed to be lapsed by the competent authority. Consultation Basic Assessment Report Review

In parallel to the submission of the Application Form to the competent authority, the CBAR was released for a minimum legislated 30-day comment period which extended from 01 September 2021 to 04 October 2021. The following indicates the process for the distribution of information during the review of the CBAR:

o Letter 2 to I&APs - Notification of comment period on the CBAR: o All I&APs on the project database were notified of the comment period on the CBAR via

email, which included an executive summary of the CBAR, as well as a Comment Form. o Affected / Juristic Organs of State and State Departments were provided with a

copy of the CBAR, in the format as agreed to with the respective Departments, namely, emailed link to the report on the website or electronic version of the report via email.

o Project information available for the CBAR was placed on the project website: www.publicprocess.co.za

o No telephonic consultations or virtual meetings were requested by I&APs or Organs of State during the comment period.

o Submission of the CBAR to DEDEAT: o Dayalan Govender and Andries Struwig were emailed notification regarding the 30-

day comment period to be provided for the Consultation BAR and this included a link to the project website where the report could be downloaded. Charmaine Struwig was copied in on this email correspondence. Ms Nokulunga Ludidi was assigned as the case officer for this application and was consequently included on the project database and provided with a copy of the notification above. Acknowledgement of Receipt of the Application Form and CBAR was received from Ms Ludidi on 15 September 2021. Correspondence received from DEDEAT is included in Appendix G(iv) of this report.

Copies of all correspondence sent to I&APs are attached as Appendix G(iii) of this report. A comment was received from one (1) I&AP requesting to deregister during the review of the CBAR. Appendix G(iv) contains copies of correspondence received from I&APs and authorities. Apart

from the request to deregister, no additional issues were raised during the CBAR review period for inclusion in the Comments and Responses Report, attached as Appendix E..

Submission of Final Basic Assessment Report to DEDEAT (WE ARE HERE NOW)

The FBAR, inclusive of specialist reports and EMPr, will be submitted to competent authority for their decision-making, within 90 days of submission of the Application Form. The FBAR includes all the comments received from I&APs during the Pre-Application (Project Announcement), as well as the Application and BA Phase (CBAR) of the assessment. The following indicates the process for the distribution of information during the submission of the FBAR:

o Letter 3 to I&APs – Notification of the submission of the FBAR: o All I&APs, including the competent authority, affected/ Juristic Organs of State and State

departments will be notified of the submission of the FBAR via email. o No additional comment period is proposed for the FBAR. o The competent authority, affected/ Juristic Organs of State and State Departments will be

provided with a copy of the FBAR, in the format as agreed to with the respective Departments, namely, emailed link to the report on the website or electronic version of the report via email.

o Availability of Information - all project information will be made available on the website www.publicprocess.co.za.

The competent authority (DEDEAT- Sarah Baartman Region) will have 107 days from receipt of the FBAR, inclusive of specialist reports and EMPr, to either grant Environmental Authorisation in respect of all or part of the activity applied for; or refuse Environmental Authorisation.

o DECISION MAKING AND APPEAL PERIOD

In terms of Regulation 4 (2) of the NEMA EIA Regulations 2014 (as amended), the applicant must, in writing, within 14 days of the date of the decision on the application by the competent authority, notify all I&APs on the project database of the decision and provide them with access to the decision and reasons for the decision, as well as draw their attention to the fact that an appeal may be lodged against the decision in terms of the National Appeal Regulations. The following indicates the process for the notification of I&APs of the decision on the application by the competent authority:

o Letter 4 to I&APs – Notification of the decision and appeal period: o All I&APs, including affected/ Juristic Organs of State and State departments will be notified

of the decision reached by the competent authority, via email. o A copy of the Environmental Authorisation, granted, partially granted or refused, will be

placed on the website www.publicprocess.co.za o Letter 5 to I&APs – Notification of the outcome of the appeal period: o All I&APs on the project database will be notified, via email, of the outcome of the appeal

period if an appeal is lodged. Identification of Issues for Inclusion in the Basic Assessment Report

An important element of the BA Process is to identify issues for inclusion in the BAR and to record comments received from I&APs, including the competent authority, affected/ Juristic Organs of State and State Departments. These comments provide input towards the assessment of alternatives and the scope of the specialist assessments proposed for the BA Process. While all I&APs have confirmed that they have sufficient data to access reports from the project website, should they indicate, at any stage during the assessment process, that this is no longer the case, the EAP will supply data in order to facilitate access to the report. However, this will be subject to the condition that proof is submitted to the EAP that the data was utilised to view/download the reports (e.g. screenshot of the report). Copies of comments received from I&APs have been included in Draft and Final reports for submission to the competent authority. Comments have been received from three (3) Organs of

State / State Departments and one (1) I&AP. The issues raised can be divided into the following categories:

o Public Participation o Licensing Requirements for Protected Tree Species o Protection of Agricultural Resources (erosion, alien vegetation, water resources)

As required by the NEMA EIA Regulations, 2014 (as amended), this report includes a Comments and Responses Report (See Appendix E) which outlines the issues raised, by whom, the date and manner of receipt of the comment. A response to the issue raised has been provided by the EAP, relevant specialist or the project applicant and where the issue raised falls outside of the scope of this BA, clear reasoning for such has been provided. Compliance with the Protection of Personal Information Act 4 of 2013 The Protection of Personal Information Act 4 of 2013 (POPIA) was enacted to give effect to the constitutional right to privacy by safeguarding personal information processed by a responsible party. As required by Regulation 42 of the NEMA EIA Regulations, 2014 (as amended), any contact information (e.g. telephone number, email address and postal address) will be included on the I&AP database for the duration of the assessment process, and will be submitted to the competent authority, DEDEAT (Sarah Baartman Region). The I&AP register will not be included in the FBAR, nor will it be provided to any other third parties without the explicit consent of the I&APs. In compliance with Regulation 44 of the EIA Regulations, any information contained in comments made during the assessment process will be included in the reports that are made available for public review. However, this will not include personal contact information. In addition, should an appeal be lodged against the DEDEAT’s decision, the appellant will be provided with a copy of the I&AP register, containing contact information, in order to comply with Regulation 4 (1) of the National Appeal Regulations, 2014.

5. COMMENTS AND RESPONSE REPORT The practitioner must record all comments and respond to each comment of the public before the application is submitted. The comments and responses must be captured in a comments and response report as prescribed in the EIA regulations and be attached to this application. The comments and response report must be attached under Appendix E.

The Comments raised during the assessment process have been included in the Comments and Responses Report included in Appendix E of this report

6. AUTHORITY PARTICIPATION

Authorities are key interested and affected parties in each application and no decision on any application will be made before the relevant local authority is provided with the opportunity to give input. The planning and the environmental sections of the local authority must be informed of the application at least 30 (thirty) calendar days before the submission of the application. SECTION D: IMPACT ASSESSMENT

As per GN R326 Appendix 1, 3. (1) (h) the assessment of impacts must include the alternatives to be

assessed within the preferred site, including the option of not proceeding with the activity. The impact

assessment methodology has been aligned with the requirements for Basic Assessment Reports, as

stipulated in GN R326 Appendix 1, 3. (1) of the 2014 EIA Regulations (as amended), which states the

following:

“A basic assessment report must contain the information that is necessary for the competent

authority to consider and come to a decision on the application, and must include—

(h) a full description of the process followed to reach the proposed preferred alternative within the

site, including—

(v) the impacts and risks identified for each alternative, including the nature, significance,

consequence, extent, duration and probability of the impacts, including the degree to which

these impacts—

(aa) can be reversed;

(bb) may cause irreplaceable loss of resources; and

(cc) can be avoided, managed or mitigated;

(vi) the methodology used in determining and ranking the nature, significance, consequences,

extent, duration and probability of potential environmental impacts and risks associated with

the alternatives;

(vii) positive and negative impacts that the proposed activity and alternatives will have on the

environment and on the community that may be affected focusing on the geographical,

physical, biological, social, economic, heritage and cultural aspects;

(viii) the possible mitigation measures that could be applied and level of residual risk;

(ix) the outcome of the site selection matrix;

(i) a full description of the process undertaken to identify, assess and rank the impacts the activity will

impose on the preferred location through the life of the activity, including—

(i) a description of all environmental issues and risks that were identified during the environmental

impact assessment process; and

(ii) an assessment of the significance of each issue and risk and an indication of the extent to

which the issue and risk could be avoided or addressed by the adoption of mitigation measures;”

As per Guideline Document 5: Assessment of Alternatives and Impacts, the following methodology is

to be applied to the prediction and assessment of impacts and risks. Potential impacts should be rated

in terms of the direct, indirect and cumulative.

• Direct impacts are impacts that are caused directly by the activity and generally occur at the same

time and at the place of the activity. These impacts are usually associated with the construction,

operation or maintenance of an activity and are generally obvious and quantifiable.

• Indirect impacts of an activity are indirect or induced changes that may occur as a result of the

activity. These types of impacts include all the potential impacts that do not manifest immediately

when the activity is undertaken or which occur at a different place as a result of the activity.

Taking the assessment of potential impacts into account, please provide an environmental impact statement that summarises the impact that the proposed activity and its alternatives may have on the environment after the management and mitigation of impacts have been taken into account, with specific reference to types of impact, duration of impacts, likelihood of potential impacts actually occurring and the significance of impacts.

The proposed expansion of the existing farm dam is anticipated to have an overall LOW NEGATIVE

impact on the receiving environment during the construction phases, if all the recommended

mitigation measures are applied. In the operational phase, the overall impact is VERY LOW

NEGATIVE to NEUTRAL.

Ecological impacts are not anticipated to be significant, as the site is largely modified, and the

Sundays River and riparian habitat is located ~550m from the proposed dam expansion footprint.

However, with the application of the proposed mitigation measures it has been rated as a LOW

NEGATIVE impact, which has a less than 50% chance of occurring. An increase in the potential

aquatic habitat would occur due to an increase in available emergent habitat associated with the

expanded dam (larger water surface area). This impact has been rated as a LOW POSITIVE.

Socio-economic impacts which have been identified, which include the generation of noise and dust,

as well as health and safety impacts, can also be mitigated to LOW or VERY LOW NEGATIVE.

Heritage impacts can be mitigated to NEUTRAL during the construction phase if the ECO and/ or

construction foreman are informed of the types of heritage artefacts which could be uncovered

during vegetation clearing and excavations and what action is to be taken should heritage material

be uncovered.

The application of the proposed mitigation and design measures, as recommended by the

respective specialists, to be effectively managed in order to reduce the identified potential impacts

so as to not have a detrimental effect on the receiving environment.

In addition, some positive impacts have also been predicted. These include the creation of a number

of additional employment opportunities and associated economic growth for the local community

(rated as LOW POSITIVE), as well as the possible increase of aquatic habitat due to an increase

in available emergent habitat associated with the expanded dam (larger water surface area). This

impact has been rated as a LOW POSITIVE.

No-Go Alternative (compulsory)

The No-Go alternative will result in the potential employment and skills development opportunities

for the local community not being realised. In turn, the potential opportunity for economic growth in

the community will be lost. The securing of irrigation water supply for current agricultural activities

will also not be realised. These consequential impacts are regarded as HIGH NEGATIVE.
