A regularly scheduled work session of the Lockport Town Board was conductedat 1: 00 p. m. on Monday, February 3, 2020 at the Town Hall, 6560 DysingerRoad, Lockport, New York.
Present were: Supervisor: Mark C. Crocker
Town Council Members: Paul W. Siejak
Patricia Dufour
Thomas KeoughDarlene DiCarlo
Also present: Thomas Sy, Director of Economic Development; Dave Miller,Highway Superintendent; Brian D. Seaman, Town Attorney; Rob Klavoon,Wendel Engineering and Judith A. Newbold, Town Clerk.
Supervisor Crocker welcomed everyone and began the work session as follows:
1. Town Clerk
Tonawanda Creek Road Closure
The Town Clerk inquired about the details of the Tonawanda Creek Road closure
to relay to the residents. Dave Miller, Highway Superintendent stated that this isnot a Town project, but he understands that the road will be reduced to one laneopen in a westbound direction. The east bound traffic is closed and will be
detoured. The Niagara County Highway Department has chosen this plan for thedetour because of a concern for residents' safety. They feel an alternate planwould not allow local residents to pull out without immediately facing oncomingtraffic. The project will address both sides of Tonawanda Creek( Erie County andNiagara County) and may continue until early summer.
Volunteer Fire Service Approval— Fire Prevention Bureau
The Town Clerk reported Kneland S. Wilson from South Lockport Fire Companyhas passed the mandatory physical and other requirements for acceptance intothe fire service and has been processed and approved through the Town ofLockport Fire Prevention Bureau.
MOTION ( 2020- 031) to approve Kneland S. Wilson for volunteer fire service in
the Town of Lockport was made by Councilmember Keough, seconded byCouncilmember DiCarlo. The motion was APPROVED: AYES— 5, NAYS— 0.
Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.
2. Director of Economic Development
Thomas Sy, Director of Economic Development stated he has finished reviewingthe references and resume information for Sarah Raetz. He recommended theTown Board approve her for the position of part time clerk for the IDA.
MOTION ( 2020-032) to approve the appointment of Sarah Raetz for the position
of Clerk part time for up to 17 hours per week, at a rate of$ 15. 00 per hour,effective February 3, 2020 was made by Councilmember DiCarlo seconded byCouncilmember Dufour. The motion was ADOPTED: AYES-5, NAYS- 0. VotingAYE: Crocker, Siejak, Dufour, Keough and DiCarlo.
3. Attorney
Agreement with General Code for eCode360 Update
Attorney Seaman has reviewed a contract with General Code to update the Townof Lockport Code Book and online webpage (eCode360) with all laws passed bythe Town Board in 2018 and 2019. He explained that this is a sole source
instance and the cost would vary based on the analysis of the legislation.

placement and update of new legislation passed in 2018-2019, at a cost not to

Municipal Solutions Contracts
Attorney Seaman has reviewed two contracts submitted by Municipal Solutions forservices that are provided in conjunction with bond preparation and continuingdisclosure findings, both of which are professional service contracts.
MOTION ( 2020-034) to approve an agreement with Municipal Solutions in theamount of$ 2, 000. 00 for a one-year contract to assist the Town of Lockport with our
continuing disclosure filings and authorize the Supervisor to sign same was made byCouncilmember Keough, seconded by Councilmember Siejak. The motion wasAPPROVED. AYES— 5, NAYS— 0. Voting AYE: Crocker, Siejak, Dufour, Keoughand DiCarlo
MOTION ( 2020-035) to authorize the Supervisor to accept a proposal for financial
advisement for bond/ ban rates with a size of borrowing rate scale was made byCouncilmember Keough seconded by Councilmember DiCarlo. The motion wasAPPROVED. AYES— 5, NAYS— 0. Voting AYE: Crocker, Siejak, Dufour, Keoughand DiCarlo
4. Engineer
Lockport City School District Proposed Pedestrian Access Plan— Beattie AvenueBaseball Diamonds
Rob Klavoon reported that after several meetings and proposals with the City ofLockport School District and the Niagara County Highway Department, it wasresolved there will be new" all way stop" signs erected at the crossings of LocustStreet/Harding Avenue and Beattie Avenue/ Harding Avenue, neither of which areTown roads. There will also be a new sidewalk installed on the East side of
Beattie to provide connectivity to the baseball diamonds and the Lockport HighSchool. After discussion of maintenance responsibility Rob Klavoon and DaveMiller stated they will follow the project closely. There was also a discussion
regarding stop signs that are listed in the Town of Lockport Code Book.
Brian Belson, Building Inspector arrived at 1: 27p.m.
Cont 17- 1) Transit Road Televising and Flushing ProjectRob then distributed visuals that were obtained from the televising and flushingproject on Transit Road. Issues have been noted near Reger Drive, underTransit Road and blockages on the east side. A leak has been detected onTransit in front of the Citizens Bank area and several diameter shrinkages due to
grease buildup in the pipes continuing down the east side of Transit Road. Asmall crack was found on the west side of Transit in front of the greenhouse
which will be repaired with a 10ft. repair sleeve. His concern is mostly focusedon the grease buildup on the east side. These issues and how to address theproblems were discussed in depth. Dave Miller discussed an important concern
regarding the cracks and caving on the west side. Brian Belson added that manyof the restaurants have large grease interceptors already installed in theirsystems. Rob Klavoon recommended televising and flushing South Transit Roadnorth of Strauss Road to get a complete picture before addressing the issue.
MOTION ( 2020-036) to set bid dates for the 2020 Sanitary Sewer Televising andFlushing Project for the sewers on South Transit Road ( north of Strauss Road onthe east and west sides of the road) was made by Councilmember Siejak, andseconded by Councilmember Dufour. The motion was CARRIED: AYES- 5,NAYS- 0. Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.Brian Belson exited the meeting at 1: 54 p. m.

5. Supervisor
Old Beattie Road Traffic StudySupervisor Crocker distributed a letter he received from the New York State
Department of Transportation addressing a request from Mrs. Confer of OldBeattie Road who wrote asking to decrease the speed limit on Old Beattie Road.After some research it was found that a study has not been done in two or moreyears on this road and a speed study would be prudent. Councilmember DiCarloadded that she feels the present speed limits are not being followed. SupervisorCrocker stated he will contact the local law enforcement agencies and ask themto review this situation.
MOTION ( 2020-037) to authorize the Town Supervisor to request the New York
State Department of Transportation conduct a speed study on Old Beattie Road inthe Town of Lockport was made by Councilmember Dufour, seconded byCouncilmember DiCarlo. The motion was APPROVED. AYES— 5, NAYS— 0.
Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.
Supervisor Crocker distributed a total project summary from Smart Street LightingNY after meeting with a representative from NYPA along with many Supervisorsfrom Niagara County. The Town Board will review the information and discuss at afuture meeting. He stated the Town Board is presently awaiting the responses fromenergy service companies interested in the Street Light Acquisition and LEDConversion Project.
