Shorttitle.SCHEDULESCHAPTER126FACTORIESACTAn Act to provide for the registration, etc. of factories; toprovide for factoryworkersandawiderspectrumofworkersandotherprofessionalsexposed tooccupationalhazards,butforwhomnoadequateprovisionshadbeenformerlymade;tomakeadequateprovisions regarding the safetyofworkers towhichtheActappliesandto imposepenalties foranybreachofitsprovisions.11thJune,1987PARTIREGISTRATIONOFFACTORIES1. The Director of Factories shall keep a register of

    factories in which he shall cause to be entered, suchparticulars in relation to every factory required to beregisteredunderthisAct,ashemayconsidernecessaryordesirable.

    2. (1)EverypersonwhoatthecommencementofthisAct

    occupies a factory shall, within one month after suchcommencement, apply for the registration of suchfactory to the Director of Factories by completing theApplicationFormprescribedintheFirstScheduletothisAct.

    (2) Uponreceiptoftheapplication insubsection(1)ofthissection,theDirectorofFactoriesshallcausethefactoryto be registered and shall issue to the occupier acertificate of registration in the form set out in theSecondScheduletothisAct.

    3. (1)Beforeanypersonoccupiesorusesasafactoryany

    premiseswhichwerenotsooccupiedorusedbyhimatthe commencement of this Act, he shall apply for theregistrationofsuchpremisesbysendingtotheDirectorofFactoriesanapplicationcontainingtheparticularssetoutintheFirstScheduletothisAct.

    (2) Uponreceiptofsuchapplicationandonbeingsatisfied

    thatthepremisesaresuitableforuseasafactoryofthenature stated in the application, the Director ofFactoriesshallcause thepremises tobe registeredandshallissuetotheapplicantacertificateofregistrationintheformsetoutintheSecondScheduletothisAct.

    (3) Anapplicationunderthissectionshallbe filedwiththe Director of Factories at least six months before the commencementof actual constructionof abuildingor structuresintendedtobeusedasafactory.(4) Anypersonwho(a) not having been issued a certificate of registration as

    aforesaid occupies or uses as a factory any premiseswhichhavenotbeenregisteredasafactory;or

    (b) having been issued a certificate of registration of a

    factory as aforesaid occupies or uses as a factory anypremiseswhichwerenotsoregisteredasafactory,shallbeguiltyofanoffence.

    (5) Anypersonwho commits anoffenceunder subsection(4)ofthissectionshallbe liableonconvictiontoa finenotexceedingN2,000ortoimprisonmentfor12monthsortoboth such fine and imprisonment and if thecontravention iscontinuedafterconviction, thepersonshall be guilty of a further offence and liable onconviction in respect thereof to a fine not exceedingN100ortoimprisonmentnotexceeding14daysforeachdayonwhichtheoffencewassocontinued.

    (6) Where the Director of Factories refuses to issue a

    certificateofregistrationunderthissectionheshall,ifsorequestedbytheapplicant,stateinwritingthegroundsofsuchrefusal.

    4. If,atanytimeafteranapplicationhasbeensenttothe

    Director of Factories in pursuance of the provisions ofsection2or3ofthisAct,anychangeoccurswithrespecttotheparticularssetoutintheapplication,theoccupierof the premises to which the application relates shallforthwith informtheDirectorofFactories, inwriting,ofsuchchange,and,ifhefailstodoso,heshallbeguiltyofanoffenceunderthisAct.

    5. (1)Subjecttotheprovisionsofsubsections(2)and(3)of

    thissection,theMinistermay,bynotice in theGazetteappoint such persons as he thinks fit to constitute aFactoriesAppealBoard(hereafterinthisActreferredtoas "the Board") for the purpose of hearing anddetermining any appeal that may be submitted to itundertheprovisionsofsection6ofthisAct.

    (2) IftheMinisterdeemsitexpedientthatapersonholding

    office in thepublic serviceof theFederationshouldbeappointedtotheBoard,theMinistershallsoinformthe

    President, CommanderinChief of the Armed Forceswhomay,ifhethinksfit,appointapersonholdingofficeasaforesaidtotheBoard.

    (3) TheBoardshallconsistofaChairmanandnot lessthan

    fourothermembers,and theChairmanshallbea legalpractitionerwhohasbeensoqualifiedfornot lessthantenyears.

    (4) The Minister may make regulations governing the

    procedureoftheBoardand, intheabsenceofanysuchregulations; the Board shall determine its ownprocedure.

    6(1) IfanypersonisaggrievedbyadecisionoftheDirectorof

    FactoriesundertheprovisionsofthisPartofthisAct,hemay,within thirtydays from thedateofsuchdecision,send totheChairmanoftheBoardandtotheDirectorofFactorieswrittennoticeofhis intentiontoappealtothe Board against the decision, and such notice shallstatethegroundsofappeal.

    (2) On receipt of such written notice as aforesaid, the

    ChairmanoftheBoardshallappointadayandplaceforthe hearing of the appeal, and shall notify the partiesconcernedintheappeal.

    (3) For the purposes of subsection (2) of this section, the

    Directorof Factories shallbe aparty concerned in theappealandheaswellastheappellantshallbeentitledtoappearandbeheardbeforetheBoardatthehearingof such appeal andmay be represented thereat by alegalpractitioner.

    (4) TheBoard,may,onhearingtheappeal,confirm,varyorreversethedecisionoftheDirectorofFactoriesandthedecisionoftheBoardshallbefinal.

    PARTIIHEALTH(GENERALPROVISIONS)7(1) Everyfactoryshallbekeptinacleanstate,andfreefrom effluviaarising fromanydrain,sanitaryconvenienceor nuisanceandwithoutprejudicetothegeneralityofthe foregoingprovision(a) accumulationsofdirtandrefuseshallberemoveddaily

    by a suitable method from the floors and benches ofworkrooms,andfromthestaircasesandpassages;

    (b) the floor of everyworkroom shall be cleaned at least

    once ineveryweekbywashingor, if it iseffectiveandsuitable,bysweepingorothermethod;

    (c) all insidewallsandpartitions,andallceilingsor topsof

    rooms, and all walls, sides and tops of passages andstaircasesshall

    (i) where theyhaveasmooth impervioussurface,at least

    once ineveryperiodoftwelvemonthsbewashedwithhotwater and soap or cleaned by other suitablemethod,

    (ii) wheretheyarekeptpaintedwithoilpaintorvarnished,

    be repainted or revarnished at least once in everyperiodoffiveyears,andatleastonceineveryperiodoftwelvemonthsbewashedwithhotwaterand soaporcleanedbyothersuitablemethod,

    (iii) in the other cases, be kept whitewashed or colour

    washed,and thewhitewashingor colourwashing shall

    be repeated at least once in every period of twelvemonths.

    (2) WhereitappearstotheDirectorofFactoriesthatinany

    classordescriptionoffactoryorpartthereofanyoftheprovisions of subsection (1) of this section are notrequired for the purpose of keeping the factory in acleanstateorare by reason of special circumstancesinappropriateor inadequate for suchpurpose,hemay,by order published in the Gazette direct that thoseprovisions shall not apply to factories or parts offactories, of that classor description,or shall apply asvariedbytheorder.

    8(1) A factoryshallnot,whilework iscarriedontherein,be

    soovercrowdedastocauseriskorinjurytothehealthofthepersonsemployedtherein.

    (2) Without prejudice to the generality of the foregoing

    provisions, a factory shall be deemed to be soovercrowded as aforesaid if the number of personsemployed at a time in anyworkroom is such that theamount of cubic space allowed for every personemployedislessthanfourhundredcubicfeet.

    (3) Every workroom shall not be less than nine feet in

    height,measured from the floor to the lowestpointofthe ceilingor,where there isno ceiling, to the lowestpointoftheroofingmaterial.

    (4) IftheDirectorofFactories issatisfiedthatowingtothe

    specialconditionsunderwhichtheworkiscarriedoninany workroom, the application of the provisions ofsubsection (2) or (3) of this section to thatworkroomwould be inappropriate or unnecessary, he may by a

    certificate inwriting except theworkroom from thoseprovisionssubjectto any conditions specified in thecertificate.

    (5) Ifan inspectorsorequires,thereshallbeposted inthe

    workroom a notice specifying the number of persons,who,having regard to the provisions of this section,maybeemployedinthatroom.

    (6) In calculating for the purposes of this section the

    amountofcubicspaceinanyroom,nospacemorethanfourmetresfrom the floor shallbe taken intoaccount,and,wherearoomcontainsagallery,thegalleryshallbetreated for the purposes of this section as if it werepartitioned off from the remainder of the room andformedaseparateroom.

    (7) TheMinistermaymakeregulationsasrespectsanyclass

    ordescriptionoffactoryorpartsthereoforanyprocess,increasingthenumberofcubicmetrewhichshallunderthissectionbeallowed foreverypersonemployed inaworkroom.

    9(1) Effective and suitable provision shall be made for

    securingandmaintainingbythecirculationoffreshairineachworkroomtheadequateventilationoftheroom.

    (2) The Minister may make regulations specifying a

    standardofadequateventilationforfactoriesorforanyclassordescriptionoffactoryorpartsthereof.

    10. (1) Effective provision shall be made for securing and

    maintaining sufficient and suitable lighting, whethernaturalor artificial, in everypartof a factory inwhichpersonsareworkingorpassing.

    (2) Allglazedwindowsandskylightsusedforthelightingof

    workroomsshall,sofaraspracticable,bekeptcleanonboth the inner and outer surfaces and free fromobstruction, provided that this subsection shall notaffect the whitewashing or shading of windows andskylightsforthepurposeofmitigatingheatorglare.

    (3) The Minister may make regulations specifying a

    standardof suitableand sufficient lighting for factoriesorforanyclassordescriptionoffactoryorpartsthereof,orforanyprocess.

    11. Whereanyprocessiscarriedonwhichrendersthefloor

    liabletobewettosuchanextentthatthewetiscapableofbeingremovedbydrainage,effectivemeansshallbeprovidedandmaintainedfordrainingoffthewet.

    12 (1)Sufficientandsuitablesanitaryconveniencesforthe

    persons employed in the factory shall be providedmaintainedandkeptclean,andeffectiveprovisionshallbe made for lighting the conveniences and, wherepersonsof both sexes are or are intended to beemployed(exceptinthecaseoffactorieswheretheonlypersons employed are members of the same familydwelling there), such conveniences shall afford properseparateaccommodationforpersonsofeachsex.

    (2) The Minister may make regulations determining for

    factoriesor 'foranyclassordescriptionoffactorywhatis sufficient and suitable provision for the purposes ofthissection.

    13. (1) Where an inspector finds any act or default in

    relation to any drain, sanitary convenience or water

    supply or any nuisance or other matter in a factorywhich appears to him to be the concern of any localgovernmentunderany law,heshallgivenoticethereofinwritingtothelocalgovernmentcouncil.

    (2) Ifaperiodofthreemonthshaselapsedsincethegiving

    of such notice to the local government councilconcerned and the nuisance remains unabated, theinspector shall takesuchactionashedeemsnecessarytoabatethenuisance,andtheowneroroccupierofthepremisesshallbearthe costthereof.

    PARTIII SAFETY(GENERALPROVISIONS)14(1) Every flywheel directly connected to any primemoverand everymovingpartofanyprimemover,exceptanyprime movermentioned insubsection(3)ofthissection,shallbe securelyfenced,whethertheflywheelorprimemoveris situatedinanenginehouseornot.(2) Theheadandtailraceofeverywaterwheelandofevery waterturbineshallbesecurelyfenced.(3) Every part of any electric generator, motor or rotary

    converter,andeveryflywheeldirectlyconnectedhereto,shallbesecurelyfencedunlessitisinsuchapositionorof such construction as to be as safe to every personemployedorworkingon thepremisesas itwouldbe ifsecurelyfenced.

    15. (1) Every part of any transmission machinery shall be

    securely fencedunless it is in suchpositionorof suchconstructionastobeassafetoeverypersonemployedorworkingonthepremises as it would be if securelyfenced.

    (2) Efficient devices or appliances shall be provided and

    maintainedineveryroomorplacewhereworkiscarriedonbywhichthepowercanpromptlybecutofffromthetransmissionmachineryinthatroomorplace.

    (3) Nodrivingbeltwhennot inuseshallbeallowedtorest

    or rideupona revolving shaftwhich formspartofanytransmissionmachinery.

    (4) Suitable striking gear or other efficient mechanical

    appliancesshallbeprovidedandmaintainedandusedtomove drivingbelts to and from fast and loose pulleyswhich form part of the transmission machinery, andsuchgearorappliancesshallbeconstructed,placedandmaintainedastopreventthedrivingbeltfromcreepingbackontofastpulley.

    (5) The Director of Factories may by certificate in writing

    grant, subject to any conditions specified in thecertificate, exemptionfromcompliancewithanyoftherequirements of subsections (2), (3) and (4) of thissectioninanycasewhereheissatisfiedthatcompliancewiththerequirementisunnecessaryorimpracticable.

    16(1) Every power driven machine having its individualsources of power shall be provided with an efficientstartingandstoppingapplianceorcontrol.(2) Everyelectricalequipmentorapplianceintendedforusein a factoryshallbeofsuchconstructionastobesafe foruse byallpersons required touse sameorwho come into contactwithsameandshallbemaintainedatalltimesina safecondition.

    17(1) Every dangerous part of any machinery, other thanprime movers and transmission machinery, shall besecurely fenced unless it is in such a position or of suchconstruction as tobeassafe toeverypersonemployedorworkingonthepremisesas itwouldbe if securely fenced,providedthat,in so faras the safetyofadangerouspartofanymachinery cannot by reason of the nature of theoperationbesecured by means of a fixed guard, therequirementsofthis subsection shall be deemed to havebeencompliedwithifa device is provided which in theopinionoftheDirectorof Factoriessatisfactorilyprotectstheoperatororother persons from coming into contactwiththatpart.(2) Any part of a stockbar which projects beyond the headstockofalatheshallbesecurelyfencedunlessitisin such a position as to be as safe to every personemployedor working on the premises as itwould be ifsecurelyfenced.18(1) In determining, for the purposes of the foregoingprovisions of this Partof thisAct,whether anypartof anymachinery is insuchapositionorofsuchconstructionastobeassafe to every person employed or working on thepremisesasit wouldbeifsecurelyfenced(a) no account shall be taken of any person carrying out,whilethe part of machinery is in motion, an examinationthereof or any lubrication or adjustment shown by such examination to be immediately necessary, being an examination, lubrication or adjustment which it is necessarytocarryoutwhilethepartofmachinery is in motion;and(b) inthecaseofanypartoftransmissionmachineryusedin any process in any factory with respect to which the

    Director of Factories has declared, by certificate inwriting, thathe issatisfied that,owing to thecontinuousnatureof such process, the stopping of that part wouldseriously interfere with the carrying on of the process insuchfactory, no account shall be taken of any personcarryingoutinthefactory by such methods and in suchcircumstancesand subjecttosuchconditionsasmaybespecifiedinthe certificate,any lubricationoranymountinorshippingof belts.(2) Theprovisionsofthissectionshallonlyapply where(a) the examination, lubrication or other operation asaforesaid iscarriedoutbyamatepersonwho(i) hasattainedtheapparentageofeighteenyears,(ii) hasbeen appointedby theoccupierof the factory,by certificateattachedtothegeneralregister,tocarryoutsuch examination, lubrication or other operation, and hasbeenfurnishedbytheoccupierwithacopyofsuchcertificate signed,byhim,(iii) has been sufficiently trained for the purposes of the

    workentailedby,andisacquaintedwiththedangersofmoving machinery arising in connection with, suchexamination,lubricationorotheroperation,and

    (iv) hasbeenprovidedby theoccupierwithand iswearing a close fitting single piece overall suit in good repair,which is fastened by means having no exposed looseendsandhas no external pockets other than a hippocket;(b) anotherperson,instructedastothestepstobetakenincase of emergency, is immediately availablewithin sight or hearing of any person carrying out such examination, lubricationorotheroperation;

    (c) such steps as may be necessary, including where appropriateandreasonablypracticabletheerectionofa barrier, are taken toprevent anyperson,other than aperson carrying out the operation, from being in apositionwhere he is exposed to risk of injury from themachinery;and(d) any ladder in use for the carrying out of suchexamination, lubrication or other operation is securelyfixedorlashed,oris firmlyheldbyaperson stationedat thefootoftheladder.19. Allfencingorothersafeguardsprovidedinpursuanceof the foregoingprovisionsofthisPartofthisActshallbeof substantialconstruction,andconstantlymaintainedand keptinpositionwhilethepartsrequiredtobefencedor safeguarded are inmotionor inuse,exceptwhen anysuch parts are necessarily exposed for examination and forany lubricationoradjustmentshownbysuchexaminationtobe immediatelynecessary,andall the conditions specifiedin section18(2)ofthisActarecompliedwith.20(1) Inthecaseofanymachineinafactorybeingamachine intendedtobedrivenbymechanicalpower(a) every setscrew, bolt or key on any revolving shaft,spindle, wheel or pinion shall be so sunk, encased orotherwise effectivelyguardedastopreventdanger;and(b) all spur and other toothed or friction gearing, whichdoes not require frequentadjustmentwhile inmotion, shallbe completelyencasedunlessitissosituatedastobesafeasit wouldbeifcompletelyencased.(2) Anypersonwhomanufactures, assembles, sellsor letson hireorwhoasanagentofthemanufacturer,assembler,

    sellerorhirercausesorprocurestobesoldorletonhirefor use ina factory inNigeria,anymachine intendedtobe drivenbymechanicalpowerwhichdoesnotcomplywith the requirements of this section shall be guilty of anoffence and liable on conviction to a fine not exceedingN5,000.(3) The Minister may by order published in the Gazetteextend the provisions of this section to such otherdangerouspart ofmachineryorplantasmaybespecifiedintheorder.21(1) Every fixed vessel, structure, sumporpitofwhich theedge is levelwithor less thanninetyonecentimetresabovethe adjoining ground or platform shall, if it contains any scalding, corrosive or poisonous liquid, either besecurely covered or be securely fenced to at least thatheightor wherebyreasonofthenatureoftheworkneithersecure covering nor secure fencing to that height ispracticable,all practicablestepsshallbetakenbycovering,fencingor othermeans to prevent any person from failingintothe vessel,structure,sumporpit.(2) Asrespectsanyplantmentionedinsubsection(1)ofthis section,awarningnoticeinEnglishandinsuchNigerian languages as an inspector may direct, indicating thenature ofthedanger,shallbemarkedonorattachedtotheplant or, ifthis isnotreasonablypracticable,bepostednearby.22(1) No traversing part of any selfacting machine and no materialcarriedthereonshall,ifthespaceoverwhichit runs isaspaceoverwhichanyperson is liable topass, whether inthecourseofhisemploymentorotherwise,be allowedonitsoutwardorinwardtraversetorunwithin

    a distance of fortysix centimetres from any fixedstructure notbeingpartofthemachine.(2) Allpracticablestepsshallbetakenbyinstructionstothe person in charge of the machine to ensure that noperson employed shall be in the space between anytraversingpart ofaselfactingspinningmuleandanyfixedpartofthe machinetowardswhichthetraversingpartmovesonthe inward runexceptwhen themachine is stoppedwiththe traversingpartontheoutwardrun.23. Nopersonshallbeemployedatanymachineor inany process, being a machine or process liable to causebodily injury, unless he has been fully instructed as tothedangerslikely to arise in connection therewith and theprecautionstobeobserved,and(a) hasreceivedasufficienttrainingtoworkatthemachineor intheprocess;or(b) is under adequate supervision by a personwho has a thoroughknowledgeandexperienceof themachineor process.24(1) Every hoist or lift shall be of good mechanicalconstruction, soundmaterialandadequatestrength,andbeproperlymaintained.(2) Everyhoistor liftshallbethoroughlyexaminedat least onceineveryperiodofsixmonthsbyapersonapproved for the purpose of this section by the Director ofFactories by a certificate in writing; and a report' of theresultof every such examination in the prescribed formand containing theprescribedparticularsshallbesignedbythe person making the examination and shall within

    fourteen days be filed with the Director of Factories andalsobe enteredinorattachedtothegeneralregister.(3) Every hoistway or liftway shall be efficiently protectedby asubstantialenclosure fittedwithgates,beingsuchan enclosure as toprevent,when the gates are shut, anyperson fallingdownthewayorcoming intocontactwithany movingpartofthehoistorlift.(4) Anysuchgateasaforesaidshallbe fittedwithefficient interlocking or other devices to secure that the gatecannot beopenedexceptwhenthecageorplatformisatthe landingandthatthecageorplatformcannotbemoved awayfromthelandinguntilthegateisclosed: Providedthatinthecaseofahoistorliftnotconnected with mechanical powers, it shall be sufficient for the purpose of this subsection if the gate shall be keptclosed andfastenedexceptwhenthecageorplatformisatrestat thelanding.(5) Everyhoistor liftandeverysuchenclosureasaforesaid shall be so constructed as to prevent any part of anyperson oranygoodscarriedinthehoistorliftfrombeingtrapped betweenanypartofthehoistorliftandanyfixedstructure of between the counterbalanceweight and anyothermovingpartofthehoistorlift.(6) There shallbemarked conspicuouslyoneveryhoistorlift themaximumworkingloadwhichitcansafelycarryand no load greater than that load shall be carriedon anyhoistorlift.(7) The following additional requirements shall apply tohoists and lifts used for carrying persons, whethertogetherwith goodsorotherwise

    (a) efficient automatic devices shall be provided and maintained to prevent the cage or platform overrunning;(b) every cage shall, on each side from which access is afforded to landing, be fitted with a gate, and inconnectionwith every such gate efficient devices shall beprovidedtosecure that, when persons or goods are in thecage,thecage cannotberaisedorloweredunlessthecageisclosed,and willcometorestwhenthegateisopened;(c) where the platform or cage is suspended by rope orchain, there shall be at least two ropes or chainsseparately connectedwiththeplatformorcage,eachropeorchainand its attachments being capable of carrying thewholeweight of the platform or cage and its maximumworkingload,andefficient devices shall be provided andmaintainedwhichwill support the platform or cage with itsmaximum working load in the event of a breakage of theropesor chainsoranyotherattachments.(8) In the case of a hoist or lift not connected withmechanicalpower subsection (7) of this section shall notapply.(9) For the purposes of this section, no liftingmachine or applianceshallbedeemedtobeahoistor liftunless ithasaplatformorcagethedirectionofmovementofwhich is restrictedbyaguideorguides.(10) If it is shown to the satisfaction of the Director ofFactories that it would be unreasonable in the specialcircumstances of the case toenforce any requirementofthissectionin respectofanyclassordescriptionofhoist,lift,hoistwayor liftway,hemaybynoticepublished in theGazetteexcept from such requirements hoists, lifts,hoistwaysorliftways of that class or description; and any

    suchexceptionmaybe unqualifiedormaybesubjecttosuchconditionsasmaybe containedinthenotice.25(1) The following provisions shall be complied with asrespects every chain, rope or lifting tackle used for thepurposeof raisingorloweringpersons,goodsormaterials(a) nochain,ropeor liftingtackleshall,beusedunless it isof good construction, sound material, adequate strengthand freefrompatentdefect;(b) atableshowingthesafeworkingloadsofeverkindand sizeofchain,ropeorliftingtackleinuse,and,inthecase of a multiple sling, the safe working load at differentangles ofthe legs,shallbeprominentlydisplayedonthepremises, so however that the forgoing provisions of thisparagraph shall not apply in relation to any lifting tackle ifthesafe working loadthereofor, inthecaseofamultiplesling,the safeworkingloadatdifferentanglesofthelegs,isplainly markeduponit;(c) nochain,ropeorliftingtackleshallbeusedforanyload exceedingthesafeworkingloadthereofasshownbythe table aforesaid ormarked upon it as aforesaid; (d) all chains,ropeand liftingtackle inuseshallbethoroughly examinedatleastonceineveryperiodofsixmonths,orat such greater intervals as theDirectorof Factoriesmay permit inanyparticularcase,byapersonapproved forthe purposesof thissectionby theDirectorofFactoriesby certificateinwriting;(d) nochain,ropeorliftingtackleshallbetakenintouseinany factory for the first time in that factory unless it hasbeentestedand thoroughlyexaminedbyapersonapprovedby theDirectorofFactoriesforthepurposesofthissectionas aforesaid and a certificate of such a test and

    examination, has been obtained; and a report for eachchain,ropeor liftingtackleintheprescribedformshallbefiledwiththe Director of Factories and the certificateshallbekept availableforinspection;(e) everychainand lifting tackle,excepta rope sling, shall unlessofaclassordescriptionexemptedbytheDirector of Factories by notice published in the Gazette, beannealed at leastonce ineveryfourteenmonths,or, inthecaseof chains or slings of halfinch bar or smaller, orchainsusedinconnectionwithmoltenmetalormoltenslag,ineverysixmonths, so however, that chains and lifting tacklesnot inregularuseneedbeannealedonlywhennecessary. Inthissectiontheexpression"liftingtackle"meanschain slings,ropeslings,rings,hooks,shacklesandswivels.26(1) All parts and working gear whether fixed or movable,

    including the anchorage and fixing appliances of everylifting machine, shall be of good construction, soundmaterial, adequate strength and free from patentdefect,andshallbeproperlymaintained.

    (2) Allsuchpartsandgearasaforesaidshallbethoroughly

    examined at least once in every period of fourteenmonths and also after every substantial alteration orrepair, by a person approved for the purposes of thissection by the Director of Factories by certificate inwriting.

    (3) Noliftingmachineshallbetakenintouseinanyfactory

    for the first time in that factory unless it has beentested, and all such parts and working gear of themachineasarespecifiedinsubsection(1)ofthissectionhavebeenthoroughlyexamined,byapersonapprovedby the Director of Factories for the purposes of thissectionasaforesaidand

    (a) a certificate of such a test and examination specifyingthe safeworking loador loadsof themachinesand signedby the personmaking the test and examination hasbeen obtained;and(b) a report for each crane or lifting machine in theprescribed formhasbeenfiledwiththeDirectorofFactories, andthecertificateshallbekeptavailableforinspection.(4) All rails onwhich a travelling, cranemoves and every

    trackonwhich thecarriageofa transporteror runwaymoves shall be of proper size and adequate strength,andhaveanevenrunningsurface;andsuchrailsortrackshall be properly laid, adequately supported orsuspended,andproperlymaintained.

    (5) There shallbeplainlymarkedon every liftingmachine

    the safeworking loador loads thereof, except that, inthe case of a jib crane so constructed that the safeworkingloadmaybevariedbytheraisingorloweringofthe jib, there shall be attached thereto either anautomatic indicator of safe working loads or a tableindicating the safe working loads at correspondinginclinationsofthejiborcorrespondingradiioftheload.

    (6) Noliftingmachineshall,exceptforthepurposeofatest,

    be loadedbeyond the safeworking load asmarkedorindicatedundersubsection(5)ofthissection.

    (7) If any person is employed or working on or near the

    wheeltrackofaselfpropelledoverheadtravellingcraneinanyplacewherehewouldbeliabletobestruckbythecrane,effectivemeasuresshallbe taken toensure thatthecranedoesnotapproachwithinfourrnetresofthatplace.

    (8) A lifting machine shall not be operated except by a

    persontrainedandcompetenttooperatethatmachine,except that it shallbepermissible for suchmachine tobe operated by a person who is under the directsupervision of a qualified person for the purpose oftraining; and no person under eighteen years of ageshallbeemployedtooperateanyliftingmachinedrivenbymechanicalpower togivesignals to theoperatorofanysuchmachine.

    (9) Inthissectiontheexpression"liftingmachine"meansa

    crane, crab, winch, teagle, pulley block, gin wheel,transporterorrunway.

    27. Aregister,containingtheparticularssetoutinSchedule

    3tothisActshallbekept inevery factorywithrespecttoallchains,ropesorliftingtackletowhichsection25ofthisActapplies,andwithrespecttoall liftingmachinestowhichsection26ofthisActapplies.

    28(1) All floors, steps, stairs, passages, gangways and other

    partsofastructureorbuildingusedasafactoryshallbeofsoundconstructionandproperlymaintainedandkeptsafe at all times and before the construction of anyfactory,thebuildingplansandsuchotherdocumentsastheDirectorofFactoriesmayrequire,shallbesubmittedtohimforapprovalnot lessthansixmonthsbeforethecommencementofsuchconstruction.

    (2) Allopeningsinfloorsshallbesecurelyfenced,exceptin

    so far as the nature of thework renders such fencingimpracticable.

    (3) There shall, so far as is reasonably practicable, beprovided and maintained in every factory safe means ofaccessto every place at which any person has to be orwork.(4) Foreverystaircaseinabuildingoraffordingameansof exit from a building, a substantial handrail shall be providedandmaintained,which, ifthestaircasehasan open side, shall be on that side, and, in the case of a staircasehavingtwoopensides,suchahandrailshallbe provided andmaintainedonboth sides; and anyopenside ofastaircaseshallalsobeguardedbtheprovisionand maintenanceofalowerrailorothereffectivemeans.(5) All ladders shall be soundly constructed and properly maintained.(6) Sufficient clear and unobstructed space shall bemaintainedat everymachinewhile inmotion to enable theworktobe carriedonwithoutunnecessaryrisk.(7) Whereanyperson is toworkataplace fromwhichhewill be liabletofalladistancemorethantwometres,then, unless the place is one which affords secure footholdand, where necessary, secure handhold means shall beprovided so far as is reasonablypracticable,by fencingorotherwise forensuringhissafety.(8) Every teagle opening or similar doorway used forhoisting or lowering goods or materials, whether bymechanicalpowerorotherwise,shallbesecurelyfenced,andshall(a) be provided with a secure handhold on each side of theopeningordoorway;and

    (b) be properly maintained and shall, except when thehoisting or loweringofgoodsormaterials isbeingcarriedonatthe, openingordoorway,bekeptinposition.29(1) Whereworkhas tobedone insideany chamber, tank,vat, pitorother confinedplace, inwhichdangerous fumesare likelytobepresent(a) theDirectorof Factories shallbenotified inwriting, inthe prescribedform,beforethecommencementofwork(b) the confined space shall be provided with adequatemeans ofegressforpersonsenteringorworking therein;and(c) no person shall enter the confined space for anypurpose unless(i) all practicable steps have been taken to remove anyfumes whichmaybepresentandtopreventany ingressoffumes and,unless ithasbeenascertainedbya suitabletestthatthe space is free from dangerous fumes, thepersonentering shallwearabelttowhichthere issecurelyattachedarope ofwhich the free end is held by a personoutside,or(ii) the person entering has worn a suitable breathingapparatus;(d) suitable breathing apparatus and suitable revivingapparatus andsuitablebeltsandropesshallbeprovidedand maintainedsoastobereadilyaccessible;and(e) a sufficient number of the persons employed in thefactory shallbetrainedandpractisedintheuseofsuchapparatus andinthemethodofrestoringrespiration.

    (2) Without prejudice to subsection (1) of this section, aperson shall not enter or remain in any chamber, tank,vat,pit, pipe,flueorsimilarspaceforanypurposeuntil ithasteen sufficiently cooledby ventilationorotherwise tomakeworksafeandeither(a) heisensuredofasupplyofairadequateforrespirationand torenderharmlessanyfumes;or(b) heiswearingasuitablebreathingapparatus.30(1) Where inconnectionwithanygrinding,sievingorother process giving rise to dust, gas or vapour there mayescape into any workroom dust, gas or vapour of suchcharacter andtosuchanextentastobeliabletoexplodeonignition, allpracticablestepsshallbetakentopreventsuchan explosionbyenclosureofanyplantusedintheprocess, and by removal or prevention of accumulation of thedust,gasorvapourandbyexclusionoreffectiveenclosureof possiblesourcesofignition.(2) Where there is present in any plant used in any such process as aforesaid dust, gas or vapour of such acharacter andtosuchanextentastobeliabletoexplodeonignition, then, unless the plant is so constructed as towithstandthe pressure likely tobeproducedbyanysuchexplosion,all practicable steps shall be taken to restrictthespreadand effects of such an explosion by theprovision,inconnectionwiththeplant,ofchokes,bafflesandventsorotherequally effectiveappliances.(3) Noplant,tankorvesselwhichcontainsorhascontained any explosive or inflammable substance shall besubjected toanywelding,brazingorsolderingoperationortoany cutting operation which involves the applicationofheat, until all practicable steps have been taken toremovethesubstanceandany fumesarising therefromor to

    render them nonexplosive or noninflammable; and ifanyplant, tank or vessel has been subjected to any suchoperationas aforesaid, no explosive or inflammablesubstanceshallbeallowed to enter the plant, tank or vesseluntilthemetalhas cooledsufficientlytopreventanyriskofignitingthe substance.(4) The Director of Factories may by certificate in writing grant, subject to any conditions specified in thecertificate, exemption from compliance with any of therequirements ofsubsection(3)ofthissectionwhereheissatisfiedthat compliance with the requirements isunnecessaryor impracticable.31(1) Every steam boiler and all its fittings and attachmentsshall be of good construction, sound material, adequatestrength andfreefrompatentdefectandshallbeproperly maintained.(2) Everysteamboiler,whetherseparateoroneofarange(a) shallhaveattachedtoit(i) a suitable safetyvalve (separate fromand incapableof

    being isolated by any stopvalve) which shall be soadjusted as to prevent the boiler being worked at apressuregreaterthanthemaximumpermissibleworkingpressure and shall be fixed directly to, or as close aspracticableto,theboiler,

    (ii) asuitablestopvalve,connectingtheboilertothesteam pipewhichshallbesuitablytaggedatalltimes,(iii) acorrectsteampressuregauge,connectedtothesteam space and easily visibleby theboiler attendant,whichshall indicatethepressureofsteamintheboilerinkilogramsper square centimetre and have marked upon it, in a

    distinctive colour, the maximum permissible workingpressure,(iv) at least one water gauge, of transparent material orothertypeapprovedbytheDirectorofFactories,toshowthe waterlevelintheboiler,and,ifthegaugeisoftheglass tubular type and the working pressure in the boiler normally exceeds three kilograms per squarecentimetre,the gauge shall be provided with an efficientguardbutnot soastoobstructthereadingofthegauge,(v) whereitisoneortwoormoreboilers,aplatebearinga distinctivenumberwhichshallbeeasilyvisible;and(b) shall be provided with means for attaching a testpressure gauge;and(c) shall be provided with a suitable fusible plug or an

    efficient lowwateralarmdevice, sohowever that subparagraph (ii) of paragraph (a) of this subsection shallnot apply with respect to economisers, and subparagraph (iii), (iv) and (v) of paragraph (a), andparagraphs(b)and(c),ofthissubsectionshallnotapplywithrespecttoeithereconomisersorsuperheaters.

    (3) For the purposes of subsection (2) of this section, alevervalveshallnotbedeemedasuitablesafetyvalveunlessthe weightissecuredontheleverinthecorrectposition.(4) Every steam boiler attendant shall be properlyinstructedas tohisduties.(5) Nopersonshallenterorbeinanysteamboilerwhichisone ofarangeoftwoormoresteamboilersunless

    (a) all inlets through which steam or hot water mightotherwise entertheboilerfromanyotherpartoftherangeare disconnectedfromthatpart;or(b) all valvesor taps controlling suchentryare closedand securely locked, and, where the boiler has a blowoffpipe incommonwithoneormoreotherboilersorDelivering into a common blowoff vessel or sump, the blowoffvalveor taponeachsuchboiler issoconstructed that itcanonly beopenedbyakeywhichcannotberemoveduntilthe valveortap isclosedand istheonlykey inuseforthatset ofblowoffvalvesortaps.(6) Noworkshallbepermittedinanyboilerfurnaceuntilit hasbeensufficientlycooledbyventilationorotherwiseto make work safe for the persons employed and theDirector ofFactorieshasbeennotified.(7). Every steam boiler and all its fittings and attachmentsshall be thoroughly examined by an authorised boilerinspector at leastonce ineveryperiodoffourteenmonths,andalso afteranyextensiverepairs.(8) Thepersonmakinganexaminationundersubsection(7)of this sectionmay specify inwriting a period exceeding fourteen months but not exceeding eighteen monthswithin whichthenextexaminationistobemade.(9) Anexaminationundersubsection(7)ofthissectionshall consistinthefirstplace,ofanexaminationoftheboiler when it iscoldand the interiorandexteriorhavebeen preparedintheprescribedmanner,andsecondlyexceptin the case of an economiser or superheater, of an examinationwhenitisundernormalsteampressure.

    (10) The examination under steam pressure referred to in subsection (9)of this section shallbemadeas soonas possibleafter theexaminationof theboilerwhencold,and thepersonmakingtheexaminationshallensurethatthe safetyvalveissoadjustedastopreventtheboilerbeing worked at a pressure greater than the maximumpermissibleworkingpressure.(11) Areport,signedbythepersonmakingtheexamination,of the resultofevery suchexamination, in theprescribedformand containing the prescribed particulars (including particulars of the maximum permissible working pressure),'shall, as soon aspracticable and in any case within twentyeight days of the completion of the examination, be entered in or attached to the general register,andacertifiedtruecopyofthereportshallbefiled withtheDirectorofFactories.(12) Nosteamboilerwhichhaspreviouslybeenusedshallbe taken into use in any factory for the first time in thatfactory until it has been examined and reported on inaccordancewithsubsections(7),(8),(9),(10)and(11)ofthissection.(13) No new steam boiler shall be taken into use in anyfactory unless(a) there has been obtained from an authorised boilerinspector a certificate specifying themaximumpermissibleworking pressure of the steam boiler and stating thenatureofthe tests towhich the steamboilerand fittinghavebeen submitted;(b) the steam boiler is so marked as to enable it to beidentified as boiler to which the certificate so obtainedrelates;and

    (c) the certificate so obtained is kept available forinspection andacertifiedtruecopythereofisforthwithsenttothe DirectorofFactories.(14) Wherethereportofanyexaminationunderthissection specifies conditions for securing the safeworking of a steam boiler, the boiler shall not be used except in accordancewiththoseconditions.(15) Thepersonmakingthereportofanyexaminationunder this section shall within twentyeight days of the completionoftheexaminationsendtothe inspectorofthe districtacertifiedtruecopyofthereport ineverycase where the maximum permissible working pressure is reduced, or the examination shows that the boilercannot continue to be used with safety unless certainrepairsare carriedoutimmediatelyorwithinaspecifiedtime.(16) Forthepurposesofsubsections(11),(12),(13),(14)and (15)of this section relating to reportsofexaminations,the examination of a boiler when it is cold and itsexamination when it is under steam pressure shall betreatedasseparate examinations.(17) Inthissection authorised boiler inspector" means any person(whetherornotanofficerinthecivilserviceoftheFederationorany State) who is authorised by the Director ofFactories,by certificate in writing, to carry outexaminationsofsteam boilers in accordance with, and forthepurposesofthis section and to issue the certificatereferredtoinsubsection(13)ofthissection; maximumpermissibleworkingpressure"means,inthe case of a new steam boiler, that specified in thecertificate referredtoinsubsection(13)ofthissection,and,

    inthecase of a steam boiler 'which has been examined in accordance with the provisions of this section, that specifiedinthereportofthelastexamination.(18) This section shall not apply to the boiler of anylocomotiveusedonanyrailwayortotheboilerofanyship.32(1) Every steam receiver and all its fittings shall be of construction, sound material, adequate strength, andfree frompatentdefect,andshallbeproperlymaintained.(2) Every steam receiver, not so constructed andmaintainedas to withstand with safety the maximumpermissible.working pressure of the boiler or the maximumpressure whichcanbeobtainedinthepipeconnectingthereceiver with any other source of supply, shall be fittedwith(a) a suitable reducing valve or other suitable automatic appliance to prevent the safeworking pressure of the receiverbeingexceeded;(b) a suitable safety valve so adjusted as to permit thesteamto escape as soon as the safe working pressure isexceededor a suitable appliance for cutting offautomaticallythesupplyofsteamassoonasthesafeworkingpressureisexceeded;(c) acorrectsteampressuregauge,whichshallindicatethe pressureofsteaminthereceiverinkilogrampersquare centimetre;(c)(c) asuitablestopvalve;and(d)(d)exceptwhereonlyonesteamreceiver is inuse,aplate bearingadistinctivenumberwhichshallbeeasilyvisible.(3) The safety valve and pressure gauge referred to in subsection(2)ofthissectionshallbefittedeitheronthe steam receiver or on the supply pipe between the

    receiver and the reducing valve or other appliance topreventthesafeworkingpressurebeingexceeded.(4) For the purposes of subsections (2) and (3) of thissection, otherthanparagraph(e)ofsubsection(2),anysetof receiverssuppliedwithsteamthroughasinglepipeand formingpartofasinglemachinemaybetreatedasone receiver, and for the purposes of the said provisionsexcept paragraph (d) and (e) any other set of receiversappliedwith steamthroughasinglepipemaybetreatedasonereceiver: Providedthatthissubsectionshallnotapplytoanysuchset ofreceiversunlessthereducingvalveorotherapplianceto prevent the safe working pressure being exceeded isfittedonthesaidsinglepipe.(5) Every steam receiver' and all its fittings shall bethoroughly examinedbyanauthorisedboilerinspectorsofarasthe constructionofthereceiverpermits,atleastonceinevery periodoftwentysixmonths.(6) Areport,signedbythepersonmakingtheexamination,of the resultofevery suchexamination, in theprescribedformand containing the prescribed particulars (including particulars of the safe working pressure), shall beenteredin orattachedtothegeneralregister,andacertifiedtruecopy of the report shall be filed with the Director ofFactories.(7) Nosteamreceiverwhichhaspreviouslybeenusedshallbe taken into use in any factory for the first time in thatfactory until it has been examined and reported on inaccordancewithsubsections(5)and(6)ofthissection.

    (8) No new steam receiver shall be taken into use in any factoryunless(a) therehasbeenobtained from themanufacturerof thesteam receiverorfromanauthorisedboiler inspector,acertificate specifying the maximum permissible workingpressureof the steam receiverand stating thenatureof theteststo which the steam receiver and fittingshavebeensubmitted;(b) the steam receiver is somarked as to enable it to be identifiedasthesteamreceivertowhichthecertificateso obtainedrelates;and(c) the certificate so obtained is kept available forinspection andacertifiedtruecopythereofisforthwithsenttothe DirectorofFactories.(9) Every steam container shall be so maintained as tosecure that theoutlet isatall timeskeptopenand freefromobstruction.(10) In thissection 'authorisedboiler inspector"meansany person (whetherornotanofficer in thecivilserviceofthe Federation or of any State) who is authorised by the Director of Factories, by certificate inwriting, to carryout, examinationsofsteamreceiversinaccordancewithandfor the purposes of this section and issue the certificatereferredtoinsubsection(8)(a)ofthissection;

    "maximumpermissibleworkingpressure"hasthesame meaningasinsection31ofthisAct;

    safe working pressure" means, in the case of a newsteam receiver, that specified in the certificate referredtoin subsection (8)(a) of this section, and, in the case of asteam receiverwhichhasbeenexaminedinaccordance

    withtheprovisionsofthissection,thatspecified inthe reportofthelastexamination;

    steamcontainer"meansanyvessel(otherthanasteam pipeor coil) constructedwith apermanentoutlet intothe atmosphereorintoaspacewherethepressuredoesnot exceedatmosphericpressureandthroughwhichsteamis passedatatmosphericpressureoratapproximatelythat pressure, for the purpose of heating, boiling, drying, evaporating,orothersimilarpurpose;

    steam receiver"meansanyvesselorapparatus (otherthan a steamboiler, steam container, a steampipeorcoil or a part of a prime mover) used for containingsteam under pressure greater than atmosphericpressure.

    33(1) Everyairreceivershall(a) havemarkeduponit,soastobeplainlyvisible,the safeworkingpressure;(b) in the case of a receiver connected with an aircompressing plant, either be so constructed as towithstandwithsafety themaximumpressurewhichcanbeobtainedinthe compressor, or be fitted with a suitablereducingvalveor othersuitableappliancetopreventthesafeworking pressureofthereceiverbeingexceeded;(c) be fittedwitha suitable safety valve soadjustedas to permit the air to escape as soon as the safe working pressureisexceeded;(d) be fitted with a correct pressure gauge indicating the pressure in the receiver in kilograms per squarecentimetre;(e) be fitted with a suitable appliance for draining thereceiver;

    (f) beprovidedwithasuitablemanhole,handholeorother means which will allow the interior to be thoroughly cleaned;and(g) inacasewheremorethanonereceiver is inuse inthe factory,bearadistinguishingmarkwhichshallbeeasily visible.(2) Forthepurposeofsubsection(1)ofthissectionrelatingto safety valves and pressure gauges, any set of airreceivers supplied with air through a single pipe may betreatedas onereceiver;butwhereasuitablereducingvalveorother suitable appliance to prevent the safe workingpressure being exceeded is required to be fitted, thissubsectionshall not apply unless the valve or appliance isfittedonthesaid singlepipe.(3) Every air receiver and its fittings shall be of sound constructionandproperlymaintained.(4) Every air receiver shall be thoroughly cleaned and examined at least once in every period of twentysix months: Provided that in the case of a receiver of solid drawn construction(a) thepersonmakinganysuchexaminationmayspecifyin writing a period exceeding twentysix months but not exceedingfouryearswithinwhichthenextexaminationis tobemade;and(b) ifitissoconstructedthattheinternalsurfacecannotbe thoroughly examined, a suitable hydraulic test of the receiver shall be carried out in lieu of internalexamination.(5) Every examination and test shall be carried out by an approved person and a report signed by the person

    making the examination or test, of the result of everysuch examination and test, in the prescribed form andcontaining theprescribedparticulars(includingparticularsofthesafe workingpressure),shallbeenteredinorattachedtothe general register and certified true copies of thereportand certificate shall be filed with the Director ofFactories.(6) Inthissectionairreceiver"means(a) any vessel (other than a pipe or coil or an accessory,fitting or part of a compressor) for containing compressedair andconnectedwithanaircompressingplant;or(b) any fixed vessel for containing compressed air or compressedexhaustgasesandused forthepurposeof startinganinternalcombustionengine;

    "approvedperson"means anyperson (whetherornotan officer in the civil service of the Federation or of anyState) who isapprovedby theDirectorof Factories,bycertificate in writing, for the purpose of carrying outexaminationsandtests of air receivers in accordance with,andforthe purposeofthissection;

    "safeworkingpressure"meansthepressurespecifiedinthe reportofthelastexaminationcarriedoutinaccordance withtheprovisionsofthissection.(7) This section shallnotapply toanyair receiver formingpart of theplant,machineryorequipmentofanyshipor toany airreceiveronanylocomotive,carriage,wagonorother rolling stock used on any railway for the haulage ofgoods orpassengers.34. TheDirectorofFactoriesmay,bynoticepublishedinthe Gazette, except from any of the provisions of sections

    31, 32and33of thisActanyclassor typeofsteamboiler, steamreceiver,steamcontainerorairreceivertowhichhe is satisfied that such provisions cannot reasonably be applied;andsuchexceptionmaybeunqualifiedormaybe subject to such conditions asmay be contained in thenotice35(1) In every factory there shall be correctly installed, in appropriate places, effective means for detecting fire,and suchmeansshallbeprovidedandmaintained,soas tobe readily accessible, in the case of amanual device, for alerting occupants therein of the occurrence of a fireand forextinguishingsame,whichmeansshallbeadequate, suitable and approved by the Director of Factorieshaving regardtothecircumstancesofeachfactory.(2) Allstocksofhighlyinflammablesubstancesshallbekept either ina fireresistingstoreor inasafeplaceoutsideany building;provided thatno such storeasaforesaid shallbe sosituatedastoendangerthemeansofescapefromthe factoryor from anypart thereof in theeventof a fire occurringinthestore.(3) Everyowneroroccupierof a factory shall ensure that personsemployed inthefactoryareadequatelytrainedto enablethemtooperatetheextinguishingapparatuspro videdinthesaidfactory.(4) TheDirectorofFactoriesmayimposesuchconditionsas hemaychoose,inconnectionwith(a) any store or place used for the storage of highly inflammablesubstances;and(b) the training of persons employed in the factory in the operationofanyextinguishingapparatusinthefactory.

    36(1) Everyfactoryshallbeprovidedwithadequatemeansof escapeincaseoffireforthepersonsemployedtherein, havingregardtothecircumstancesofeachcase.(2) Allsuchmeansofescapeasaforesaidshallbeproperly maintainedandkeptfreefromobstruction.(3) The contents of any room in which persons areemployed shall be so arranged or disposed that there is afreepassage way for allpersons employed in the roomtoameansof escapeincaseoffire.(4) Whileanyperson iswithina factory forthepurposeof employmentormeals, thedoorsof the factory,andofany roomthereininwhichthepersonisandanydoorswhich afford a means of exit for persons employed in thefactory fromanybuildingorfromanyenclosure inwhichthe factory is situated, shall not be locked or fastened insuch manner that they cannot be easily and immediatelyopened fromtheinside.(5) Alldoorsaffordingameansofexitfromafactoryforthe personsthereinshall,exceptinthecaseofslidingdoors, openoutwards.(6) Everyhoistwayor liftway insideabuildingshall,subjectas hereafter in this subsection provided, be completely enclosedwith fireresistingmaterials,andallmeansof access to the hoist or lift shall be fittedwith doors offire resistingmaterials;provided thatany suchhoistwayor liftway shall be enclosed at the top only by somematerial easilybrokenbyfireorbeprovidedwithaventatthetop.

    (7) Everywindow,doororexitaffordingmeansofescapein case of fire or giving access thereto, other than themeans of exit in ordinary use, shall be distinctively and conspicuouslymarkedbyanoticeprinted inred lettersof anaequatesize;allsuchnoticesshallbe insuch form,and in English and in such Nigerian languages, as aninspector maydirect.(8) Ineveryfactoryeffectivestepsshallbetakentoensurethat allthepersonsemployedarefamiliarwiththemeansof escape incaseof fireandtheroutinetobe followed incase offire.37. Iftheinspectorissatisfied(a) thatanypartoftheway,work,machineryorplant,usedin a factory is in such a conditionor is so constructedor placedthatitislikelytocausebodilyinjury;or(b) thatanyprocessorwork iscarriedonoranything isorhas been done in any factory in such a manner as toconstitutearisk of bodily injury, the inspector shall issue an improvement notice stating clearly the dangercomplainedof and requiring the occupier of the factory totakesuch stepsasmaybespecifiedinthenoticetoremedythe danger.38(1) Ifthe inspector issatisfiedthatany factoryorpartofa factory is in such a condition or is so constructed orplaced that any process or work carried on thereincannotbeso carriedonwithoutunduerisktothesafetyandhealthof persons employed therein, the inspectorshallbynotice prohibittheusethereof forthepurposeofthatprocessor work.(2) Anoticeissuedbyaninspectorunderthissectionmay

    (a) prohibitthecarryingonofanyprocessorworkwhether indefinitelyoruntilsuchstepsasmaybespecifiedinthe noticehavebeen taken toenable theprocessorwork concernedtobecarriedonwithdueregardtothesafetyand healthofpersonsemployedtherein;and(b) berevokedontheapplicationoftheoccupierorownerof the factory after rectifying all thedefects contained inthe notice to enable theprocess orwork tobe carried onwith due regard to the safety and health of personsemployed therein.39. Any person aggrieved by any notice issued undersections 37, and 38 of this Act,may appeal against suchnotice(a) atfirstinstancetotheMinister;and(b) fromthedecisionoftheMinisterunderparagraph(a)of thissectiontotheFederalHighCourt.PARTIV WELFARE(GENERALPROVISIONS)40(1)Anadequatesupplyofdrinkingwatershallbeprovidedand maintainedatsuitablepointsconvenientlyaccessibletoall personsemployed.(2) Asupplyofdrinkingwaterwhich isnot laidonshallbe contained in suitable vessels, and shall be renewed atleast daily,andallpracticablestepsshallbetakentopreservethe water and vessels from contamination; and a drinkingwater supply(whetherlaidonornot)shall,insuchcasesasaninspectormaydirect,beclearly indicatedbyanotice in Englishand insuchNigerian languagesasthe inspector mayrequire.

    (3) A supply of drinking water shall not be used for the purpose of washing up and a supply of water forwashing upshallnotbeusedasdrinkingwater.(4) The location of drinkingwater shall be set apart fromthe locationofwaterforwashingup.41(1) Thereshallbeprovidedandmaintainedfortheuseofall persons employed adequate and suitable facilities for washing, which shall be conveniently accessible andshall bekeptincleanandorderlycondition.(2) TheDirectorofFactoriesmay,bycertificate inwriting , except from anyof the requirementsof subsection (1)Of thissectionanyfactorywhere,byreasonofthedifficultyof obtaininganadequate supplyofwateror the fact that accommodation isrestrictedandadequateandsuitable washing facilities are otherwise conveniently available,or suchotherspecialcircumstancesasmaybespecified inthe certificate, theapplicationof the requirementwould inhis opinionbeunreasonable.(3) TheMinistermayberegulationsspecify,eithergenerally or as respects any classordescriptionof factoryor as respects the persons employed in any process, astandardofadequateandsuitablewashingfacilities.42. Thereshallbeprovidedandmaintainedfortheuseofall persons employed adequate and suitableaccommodation forclothingnotwornduringworkinghours.43(1) There shall be provided and maintained so as to bereadily accessible a firstaid box or cupboard of theprescribed standard,andwheremorethanonehundredand

    fifty personsareemployedanadditionalboxorcupboardfor everyadditionalonehundredandfiftypersons.(2) For the purposes of subsection (1) of this section the numberofpersonsemployedinafactoryshallbetakento be the largestnumberofpersonsemployed thereinatany onetime,andanyfractionofonehundredandfiftyshallbe reckoned as one hundred and fifty, so however, thatwhere thepersonsemployedareemployed inshiftsthecalculation of thenumberemployed shouldbeaccording tothelargest numberatworkatanygivenshift.(3) Nothingexceptappliancesorrequisitesforfirstaidshallbe keptinafirstaidboxorcupboard.(4) Eachfirstaidboxorcupboardshallbeplacedunderthe charge of a responsible person who shall always bereadily availableduringworkinghours,andanoticeshallbe affixed in every workroom stating the name of theperson inchargeofthefirstaidboxorcupboardprovidedin respectofthatroom.44. If an ambulance room is provided at the factory andsuch arrangements are made as to ensure the immediate treatment thereof all injuriesoccurring in the factory,the Director of Factories may by certificate in writingexempt thefactoryfromtherequirementsofsection43ofthisAct to suchextentand subject to such conditionsashemay specifyinthecertificate.PARTVHEALTH,SAFETYANDWELFARE(SPECIALPROVISIONS

    impurityofsuchacharacterandtosuchextentastobe likely to be injurious or offensive to the personsemployed, oranysubstantialquantityofdustofanykind,all practicable measures shall be taken to protect thepersons employedagainst inhalationof thedustor fumeorother impurity and to prevent its accumulating in anyworkroom, andinparticular,wherethenatureoftheprocessmakesit practicable,exhaustappliances shallbeprovidedand maintained,asnearaspossibletothepointoforiginofthe dust or fume or other impurity as to prevent it from pollutingtheairofanyworkroom.(2) Nostationary internalcombustionengineshallbeused unless provision is made for conducting the exhaustgasesfromtheengineintotheopenair.46. Whereinanyroomanypoisonousorotherwiseinjurious substanceissousedastogiverisetoanydust,orfume,no personshallbepermittedtopartakeoffoodordrink inthat room.47. Where in any factory workers are employed in anyprocess involvingexcessiveexposuretowetortoinjuriousor offensive substance, suitable protective clothing and appliances, including,wherenecessary, suitablegloves, footwear,gogglesandheadcoverings,shallbeprovided andmaintainedfortheuseofsuchworkers.48(1) In the case of any of the processes specified in theFourth ScheduletothisAct,suitablegogglesoreffectivescreens shall be provided to protect the eyes of thepersons employedintheprocess.(2) Where in any factoryelectric arcwelding is carriedon effective provisions shall be made, by screening or

    other wise, to prevent persons employed (other thanpersons employed in the welding process) from beingexposedto theelectricarcflash.49(1) Where theMinister is satisfied that (a) owing to the conditionsand circumstancesofemploymentorof the natureoftheprocessescarriedoninafactory,provision requirestobemadeforsecuringthehealth,safetyand welfareofpersonsemployedoranyclassofthem;or(b) any manufacture, machinery, plant, equipment orprocess usedinfactoriesisofsuchnatureastocauseriskofbodily injuryorbeoffensivetopersonsemployedoranyclassof them,hemay,subjecttotheprovisionsofthisActandthe Labour Act,make such regulations as appear tohimtobe reasonablypracticableand tomeet thenecessityofthe case.(2) Regulationssomademayapplytoallsuchfactoriesorto anyspecifiedclassordescriptionofsuch factories,and mayprovidefortheexemptionofanyspecifiedclassor description of factory either absolutely or subject to conditions.(3) Regulations so made may without prejudice to the generalityof thepowersconferred in subsection (1)ofthis section(a) prohibittheemploymentoformodifyorlimitthehoursof employment of, all persons or any class of persons in connection with any manufacture, machinery, plant, equipment,appliance,processordescriptionofmanual labour;or(b) prohibit, limit or control the use of any material orprocess; or

    (c) modifyorextendwithrespecttoanyclassordescriptionof factoryanyprovisionsofParts11,111,IVorthisPartof thisAct, being provisions imposing requirements as to health,safetyorwelfare;or(d) makeprovisionfor(i) arrangements, for preparing or heating and takingmeals,(ii) ambulanceandfirstaidarrangements,(iii) restrooms,(iv) thesupplyanduseofseatsinworkrooms,(v)(v)thesupplyofprotectiveclothing,and(vi) arrangements forthesupervisionofpersonsemployed,and may impose duties on owners, employed persons andotherpersons,aswellasonoccupiers.(4) TheMinistermaymake regulations in connectionwiththe fees tobepaid in respectofanymatteror thingdoneunder thisAct.50(1) An inspector may, at any time after informing theoccupier or, if the occupier is not readily available, amanagerorother responsibleperson in the factory, take foranalysis sufficient samples of any substance used orintendedtobe used in a factory, being a substance inrespectofwhichhe suspects a contravention of anyregulationmadeunderthis Part of this Act or which hethinksmayproveonanalysisto be likely to causebodilyinjurytothepersonsemployed.(2) The occupier or the manager or other responsibleperson aforesaid may, at the time when the sample istakenunder thissection,andonprovidingthenecessaryappliances, require the inspector to divide the sample into

    threeparts,tomarkandsealorfastenupeachinsuchmannerasitsnaturepermitsand(a) todeliveronepart to theoccupieror themanagerorotherresponsiblepersonsaforesaid;(b) toretainonepartforfuturecomparison;(c) tosubmitoneparttotheanalyst, andanyanalysisunderthissectionshall, ifsorequired,be carried out by a Government Chemist in the publicservice oftheFederationoraState.(3) A certificate purporting to be a certificate by a GovernmentChemistasaforesaidastotheresultofan analysis of sample under this section shall in any proceedingsunderthisActbeadmissibleasevidenceofthe mattersstatedtherein,butanypartytotheproceedingsmay requirethepersonbywhomtheanalysis ismadetobe calledasawitness.(4) Itshallnotbelawfulforanyperson,exceptinsofarasis necessary for the purposes of a prosecution for anoffence underthisAct,topublishordisclosetoanypersonthe results ofananalysismadeunderthissection,andifanypersonacts incontraventionof thissubsectionheshallbe guiltyofanoffenceandonconvictionshallbeliabletoa finenotexceedingNI,000.PART VINOTIFICATIONAND INVESTIGATIONOFACCIDENTSANDINDUSTRIALDISEASES51(1)Whereanyaccidentoccursinafactorywhicheither(a) causes lossof lifetoapersonemployed inthatfactory;or(b) disabledanysuchpersonformorethanthreedaysfrom performing the duties for which he was employed,written noticeoftheaccident,intheprescribedformand accompanied by the prescribed particulars, shall

    forthwith be sent to the inspector of the district by theoccupierofthe factory.(2) Where any accident causing disablement is notifiedunder thissection,andafternotification thereofresultsinthedeath of the person disabled, notice in writing of thedeath shallbesenttotheinspectorofthedistrictbytheoccupier of the factoryas soonas thedeathcomes tohisknowledge.(3) Whereanyaccidenttowhichthissectionappliesoccursto apersonemployedandtheoccupierofthefactoryisnotthe actual employer of the person killed or injured, theactual employershall,ifhefailstoreporttheaccidenttothe occupierimmediately,beguiltyofanoffence.(4) Anyemployeroroccupierofafactorywhofailstoreport an accident under this section shall be guilty of anoffence and shall on conviction be liable to a fine notexceeding N1,000.(5) TheMinistermay,ifheconsidersitexpedient,institutea commission of inquiry into frequent or large scaleaccidents in factories or workhouses in order torecommendsuch actionaswouldpreventany suchaccidentinthefuture.52(1)If theMinister considers that, by reason of the risk of serious bodily injury to persons employed, it isexpedient that notice should be given under section 51 ofthisActin every caseofany special classofexplosion, fire,collapse of buildings, accident to machinery or plant, orotheroccurrences inafactory,hemaybyregulations,extendthe provisions of that section to any such class ofoccurrences, whetherdeathordisablement iscausedor

    not,andmay allowtherequirednoticeofanyoccurrencetowhichthe regulations relate, instead of being sentforthwith,tobesent within the time stipulated by theregulations.(2) TheMinistermay, ifheconsiders itexpedient, institutean inquiry into any frequent or large scale dangerous occurrenceoftheclassspecifiedinsubsection(1)ofthis section in order to recommend such action as would preventanysuchoccurrenceinthefuture.53(1) The occupier of any factorywho believes, suspects orhas reasonable ground for believing or suspecting, that acase ofoccupationaldiseasehasoccurredinthefactory,shall forthwith send written notice of such case, in theprescribed form and accompanied by the prescribedparticulars,tothenearestinspector;andtheProvisionsofthisActwith respecttothenotificationofaccidentsshallapplytoany suchcase in likemanneras toanysuchaccidentasis mentionedinthoseprovisions.(2) For thepurposesof this section "occupationaldisease" meansanydiseaseorillnesswhichisdeclaredassuchby theMinisterbynoticeintheGazette,beingadiseaseor illness which, in the opinion of the Minister, may be contracted by an employed person by reason of thenature ofhisemploymentinafactory.PART VII.SPECIAL APPLICATIONS, EXTENSIONS ANDMISCELLANEOUSPROVISIONS54(1) Whereapartofabuildingisletoffasaseparatefactory, the provisions of this Act hereafter in this subsection mentioned shallapply toanypartof thebuildingused

    for thepurposesof the factorybutnotcomprised therein,that istosay(a) the provisions of Part 11 of this Act with respect to cleanlinessandlighting;(b) theprovisionsofPartIIIofthisActwithrespecttoprime movers,transmissionmachinery,hoistsandlifts,chains, ropes and lifting machines, safe means of access andsafe place of employment, steam boilers, steam receiversand steam containers, and air receivers (including the provisions as to exceptions as to steam boilers, steam receivers,steamcontainers,andairreceivers);(c) theprovisionsofPart IIIof thisActwith respect to the powerofan inspector to issuenoticesas todangerousor unsafeconditionsandpracticesandastodangerousor unsafefactories,andtheownerofthebuildingshallbe responsibleforanycontraventionofthesaidprovisionsand shallalsoberesponsible, insteadoftheoccupierofthe factory,foranycontraventionasrespectsthefactoryofthe provisionsofPart11ofthisActwithrespecttosanitary conveniencesandoftheprovisionsofPartIIIofthisAct with respect tohoistsand lifts,preventionof fire,and safetyprovisionsincaseoffire,and,forthepurposesofthe provisionswith respect topreventionof fireandsafety provisionsincaseoffire,thefactoryshallbedeemedto includeanypartofthebuildingusedforthepurposeofthe factory: Provided that the owner of the building shall beresponsiblefor the cleanliness of sanitary conveniencesonlywhenused in common by several tenants, and shall beresponsiblefor any contravention of any of theaforementionedprovisions ofPart IIIofthisActonly insofarasthesaidprovisionsrelate to matters within his control;andtheoccupierofthe factory shall, in any case, beresponsibleforany contravention (whether as respectsthefactoryorotherwise) ofanyofthesaidprovisionsof

    PartIIIofthisActwith respect to any machinery or plantbelongingtoorsuppliedbyhim.(2) Insections37and38ofthisAct,astheyapplyinrelation tothe factoryandastheyareappliedbythe foregoing subsection,referencestotheoccupiershallbetakenas referencestotheoccupierofthefactoryortotheownerof thebuilding,according towhichof them is responsiblein respectofthematterscomplainedof.(3) Forthepurposesoftheprovisionsappliedbysubsection(1) ofthissection, liftingmachinesattachedtotheoutsideof thebuilding,andchains,ropesand liftingtackleused in connection with those machines, shall be treated asbeingin thebuilding,butany liftingmachinenotused forthe purposesof the factoryandanychains, ropesor lifting tacklenotused inconnectionwitha liftingmachine so used,shallbedisregarded.(4) Where, under subsection (1) of this section, any

    provision is applied containing a reference to thegeneral register, then, in relation tomatters in respectofwhich theownerof thebuilding is responsible, thatreferenceshallbe takenasa reference toa register tobekeptbyhim,andsubsection(2)ofsection76ofthisActshallapply in relation toanysuch registeras if theownerweretheoccupierofafactory.

    55(1) Theprovisionsof thisActhereafter in thissub section mentionedshallapplytoeverydock,wharforquayasifit were a factory, and as if the person having the actualuseor occupationof thedock,wharforquaywere theoccupierofafactory,thatistosay(a)(a)PartIIIofthisAct;(b)(b)PartIVofthisAct;

    (c)(c)the provisions of Part V of this Act with respect to regulationsforhealth,safetyandwelfare;and(d)(d)PartVIofthisAct;(e)(e) theprovisionsofthisPartofthisActwithrespecttothe abstract of this Act, regulations and notices,general registers(sofarasapplicable)andpreservationofregisters andrecords,subjecttosuchmodificationsasmaybemade by regulations made by the Minister, and theprovisionsof this Part with respect to duties of personemployed,andthe prohibition of deductions fromwages;(f)(f)the provisions of Part XI of this Act with respect ofpowers and duties of inspectors and to regulations andordersmade underthisAct;(g)(g) PartIXofthisAct;(h)PartXofthisAct.(2) subject as hereafter in this subsection provided, the provisionsofthisActmentionedinsubsection(1)ofthis sectionshallapplytotheprocessesofloading,unloadingor coaling of any ship in any dock or harbour, and to all machinery or plant used in those processes, as if the processes were carried on in a factory and themachineryor plantweremachineryorplant ina factoryandtheperson who carries on those processes were theoccupierofa factory: ProvidedthattheprovisionsofthisActmentionedinthe said paragraphs (a) and (b) of subsection (1) of thissection shallnotapply in relation toanysuchmachineryorplant whichisonboardashipandisthepropertyoftheship owner.(3) For the purposes of this subsection, the expressionplant" includes any gangway or ladder used by anyperson employedtoloadorunloadorcoalaship.

    56(1) Theprovisionsof thisActhereafter in thissub section mentioned shall apply to any premises (not beingpremises formingpartof the factoryorpremises towhichthe applicationofthisActisotherwiseextendedbythisPartof this Act) in which a steam boiler is used, as if thepremises were a factory and as if the person having theactualuseor occupation of the premises were theoccupierofafactory, thatistosay(a) theprovisionsofPartIIIofthisActwithrespecttosteam boilers and to steam receivers and steam containers (including, theprovisions as to exceptions as to steam boilers that the owner of the boiler, receiver orcontainer shall, instead of the person deemed to be theoccupier,be responsible for any contravention of thesaidprovisionsin so far as they relate tomatterswithin hiscontrol;(b) theprovisionsofPart IIIof thisActwith respect to the powerofan inspector to issuenoticesas todangerousor unsafeconditionsandpracticesandastodangerousor unsafefactories;(c) the provisions of Part V of this Act with respect to regulationsforhealth,safetyandwelfare;(d) Part VI of this Act with respect to notification ofaccidents and power to extend to dangerous occurrencesand provisionsastonoticeofaccidents;(e) the provisions of this Part with respect to generalregisters (sofarasapplicable),andpreservationofregistersand records,subject tosuchmodificationsasmaybemadeby regulationsmadeby theMinisterand theprovisionsofthe saidPartwithrespecttodutiesofpersonsemployed;(f)(f)the provisions of Part VIII of this Act with respect to powersanddutiesofinspectors,andtoregulationsand ordersmadeunderthisAct;(g)(g)PartXIofthisAct;(h)(h)(h)PartIXofthisAct.

    (2) The occupier of any premises (not being premisesforming partofa factory) inwhichasteamboiler isusedshallsend to the Director of Factories a written noticecontainingthe particulars setout in the Fifth Schedule tothisAct;andis newly taken into use in anypremises (notbeingpremises formingpartofafactory),theoccupiershallsendalike noticetotheDirectorofFactories. 57. The Minister may, by order and subject to suchconditions as may be specified in the order, extend theapplicationof alloranyoftheprovisionsofthisActtoanyofthe following classes of premises, processes oroperations,that istosay(a)(a) warehouse(notformingpartofanyfactory);(b)(b) anypremises(notbeingpremisesforming,partofa factory)inwhichahoistorliftisused;(c)(c)any work carried out in a harbour or wet dock in constructing, reconstructing, repairing, refitting,painting, finishing or breaking up a ship or in scaling,scurfingor cleaning boilers (including combustion chambersand smokeboxes) in a ship,or in cleaningoilfuel tanksor bilges inashiporanytank inaship lastused foroilofany descriptioncarriedascargo;(d)(d)building operations undertaken by way of trade orbusiness, or for the purposes of any industrial orcommercialundertaking,andany lineorsidingwhich isusedin connectiontherewithand forthepurposesthereofandis notpartofarailway;(e)(e) worksofengineeringconstructionundertakenbywayof trade or business, or for the purpose of anyindustrialor commercial undertaking, and any line orsidingwhichis used in connection therewith and for thepurposesthereof andisnotpartofarailway.

    PARTVIII.GENERAILREGISTER,ETC.58(1) There shall be kept in every factory a register, in the prescribed form, called the general register, and thereshall beenteredinorattachedtotheregister(a) thecertificateofregistrationofthefactory;(b) everyothercertificateissuedinrespectofthefactorybythe DirectorofFactoriesundertheprovisionsofthisAct;(c) the prescribed particulars as to the washing, whitewashing or colour washing, painting or varnishing of thefactory;(d) theprescribedparticularsastoeveryaccidentandcaseof occupational disease occurring in the factory ofwhich notice is required tobesent toan inspectorunder the provisionsofthisAct;(e) all reports and particulars required by any otherprovisions of this Act to be entered in or attached to thegeneral register;suchothermattersasmaybeprescribedby regulations.(2) Theoccupierofafactoryshallsendtoaninspectorsuch extracts from thegeneral registeras the inspectormayfrom timetotimerequireforthepurposeoftheexecutionofhis dutiesunderthisAct.59. Thegeneral registerandeveryother registeror recordkept inpursuanceofthisActshallbepreservedandshallbe keptavailable for inspectionbyany inspector forseven yearsorsuchshorterperiodifany,asmaybeprescribedfor any classordescriptionof registeror record,after thedate ofthelastentryintheregisterorrecord.60(1) There shall be kept posted in a prominent position ineveryfactory(a) theprescribedabstractofthisAct;

    (b) anoticeoftheaddressoftheDirectorofFactoriesandof thenearestinspector;(c) printedcopiesofanyregulationsmadeunderPartVofthis Actwhichareforthetimebeing inforce inthefactory:or theprescribedabstractsofsuchregulations;and(d) everyothernoticeanddocumentrequiredbythisActtobe postedinthefactory.(2) All such documents shall be in English and in such Nigerian languagesasan inspectormaydirectand, ifa formhasbeenprescribed foranydocument, itshallbe postedinthatform.61(1) Nopersonemployedinafactoryorinanyotherplaceto which any provision of this Act applies shall wilfully interfere with or misuse any means, appliance,convenience orotherthingprovidedinpursuanceofthisActfor securing the health, safety or welfare of thepersons employed inthefactoryorplace,and,whereanymeansor applianceforsecuringhealthorsafetyisprovidedforthe useofanysuchpersonunderthisActheshallusethat meansorappliance.(2) Nopersonemployedinafactoryorinanyotherplaceto whichanyprovisionofthisActappliesshallwilfullyand withoutreasonablecausedoanythinglikelytoendanger himselforanyotherperson.62. Theoccupierofafactoryshallnot,inrespectofanythingto be done or provided by him in pursuance of this Actmakeany deduction from the sum contracted to be paid byhimto any person employed, or receive, or allow anypersoninhis employment to receive any payment fromanysuchperson.

    PARTIX.ADMINISTRATION63. The Minister shall, within thirty days after the end ofeach financial year, submit to the National Council ofMinisters, areportonhisactivitiesunderthisAct.64(1) There shallbe, for thepurposeofexecuting thisAct,a Director of Factories of the Federation and suchinspectors offactoriesandotherofficers,bywhatevernamecalled.(2) Noticeof theappointmentof theDirectorof Factoriesand inspectors of factories and other officers shall bepublished intheGazette.'(3) TheMinistershallissuetoeverypersonappointedunder subsection (1) of this section a certificate ofappointment and when visiting a factory or place towhichanyofthe provisions of this Act apply such personshall,ifrequiredto do so,produce the certificate to theoccupierorother person holding a responsible position ofmanagementatthe factory.(4) A person who is the occupier of a factory, or who is directly interested in the factory or in any process or business carried on therein or in a patent connectedthere withorisemployedinoraboutafactory,shallnotactasan inspector.(5) No inspectorshallpublishordisclosetoanypersonthe detailsofanymanufacturingorcommercialorworking processwhichmaycometohisknowledgeinthecourseof hisdutiesexceptinsofarasisnecessary(a) for thepurposesofaprosecution foranoffenceunderthis Act;

    (b)(b) forthepurposesofaCoroner'sinquest;or(c)(c)forthepurposeofanenquiryunderanyprovisionofthis Act inconnectionwith thesafetyofanypremisesor in connection with an accident happening therein or in connectionwithanoccupationaldisease.(6) An inspector shall treat as absolutely confidential the source of any complaint bringing to his notice a contraventionoftheprovisionsofthisActandshallgiveno intimation to the occupier or his representative that avisit of inspection was made in consequence of suchcomplaint.(7) A person who contravenes any of the provisions of subsection(4),(5)or(6)ofthissectionshallbeguiltyofan offenceunderthisAct.65(1) An inspector shall, for thepurposeof theexecutionofthis Act, have power to do the following things, that is tosay(a) to enter, inspect and examine, by day or by night, afactory, andeverypartthereof,whenhehasreasonablecauseto believe thatanyperson isemployedtherein,andtoenter, inspect and examine by day any placewhich hehas reasonablecausetobelievetobeafactory,andanypartof anybuildingofwhichafactoryformspartand inwhichhe hasreasonablecausetobelievethatexplosiveorhighly inflammablematerialsarestoredorused;(b) to takewith him a police officer if he has reasonablecausetoapprehendanyseriousobstructionintheexecutionofhis duty;(c) to require the production of the registers, certificates, noticesanddocumentskeptinpursuanceofthisActandto inspect,examineandcopyanyofthem;

    (d) to make such examination and inquiry as may be necessarytoascertainwhethertheprovisionsofthisAct arecompliedwith;(e) to require any person whom he finds in a factory togive suchinformationasitisinhispowertogiveastowhois theoccupierofthefactory;(f) toexamineanyperson,eitheraloneor inthepresenceof any other person, as he thinks fit, with respect tomatters under thisAct,and to requireevery suchpersontosigna declarationofthetruthofthemattersrespectingwhichhe issoexamined;sohowever,thatnooneshallberequired underthisprovisiontoansweranyquestionortogiveany evidencetendingtoincriminatehimself;(g) in thecaseofan inspectorwho isa registeredmedical practitioner, tocarryout suchmedicalexaminationsasmay be necessary for the purposes of his duties under the provisionsofthisAct;(h) to carry out such examinations, test and analysis inorderto give effect to this Act and take instantphotographsinany factory;(i) toexercisesuchotherpowersasmaybenecessary for givingfulleffecttotheprovisionsofthisAct.(2) Theowneroroccupieroragentoftheowneroroccupier shall certify or endorse any instant photograph inpursuance ofsubsection(1)(b)ofthissectionatthetimeitistakenbut refusal to certify or endorse by the owner,occupierorhis agent shallnot invalidate the authenticityofthe photograph.(3) Theoccupierofevery factory,hisagentsand servants,shall furnishthemeansrequiredbyaninspectorasnecessaryfor anyentry,inspection,examination,inquiryorthetakingof samples, or otherwise for the exercise of his powers
