The Board of Oil, Gas and Mining (the "Board") having fully considered Newfield

Production Company's (the "Petitioner") Ex Parte Motion to Serve Request for Agency Action by

Publication (the "Motion") and the grounds and reasons provided therefore, and good cause

appearing, hereby enters its Order granting the Motion as follows:

1. Petitioner's Motion is granted.

2. The proposed Notice attached to the Motion shall be published prior to the

Board's October 24,2012 hearing for two consecutive weeks in the Salt Lake Tribune, Deseret

News, and Uintah Basin Standard newspapers.

3. Objections or responses to Newfield's September 10, 2012 Request for

Agency Action shall be filed with the Secretary of the Board and served on Newfield's counsel no

later than October 16, 2012.

For all purposes, the Chainnan's signature on a faxed copy of this Order shall be

deemed the equivalent of a signed original.

Robert N. Miller II personally appeared before me, being duly sworn, deposes and says:

1. My name is Robert N. Miller II. I am a Landman for Newfield Production Company, whose address is 1001 1 i h Street, Suite 2000, Denver, CO 80202 ("Newfield").

2. As Operator of the Yergensen 1-18-3-1 W, Newfield has requisitioned the preparation of a Drilling and Division Order Title Opinion covering Township 3 South, Range 1 West, Section 18, Duchesne County, Utah.

3. Said Drilling and Division Order Title Opinion has identified National Treasure Mines Company as a leasehold owner in the aforementioned lands.

4. The Utah Secretary of State does not recognize National Treasure Mines Company as a registered business.

5. Inquiries to other leasehold owners who acquired an interest in the same leases as National Treasure Mines Company were unsuccessful in obtaining information regarding the current status of National Treasure Mines Company.

6. The California Secretary of State recognizes a National Treasure Mines Company, which reflects a "forfeited" status. The California Secretary of State also identifies the registered address for National Treasure Mines Company as 525 Atlas Building, Salt Lake City, Utah, 84101. Correspondence sent to National Treasure Mines Company at this address was returned to the sender as undeliverable. This address is not recognized by the US Postal Service.

7. Newfield, through its lease broker, identified a "McClellen" as a former Registered Agent of National Treasure Mines Company.

8. Newfield, through its lease broker, conducted an extensive internet search in an attempt to locate both National Treasure Mines Company and its former agent, McClellen, using the following sites: Utah Court Websites, LexisNexis, Westlaw, Google, Bing, Ancestry, White Pages, 411, People Smart, People Finders, People Search, Find A Grave, World Vital Records, Tributes, People Lookup, USA People Search, Zaba Search, Yahoo, People Search Pro, Any Who, Family Search, My Heritage, Legacy, Ancestry Obits, Archives, and various other web sites specialized in locating individuals and entities. Said internet searches did not provide information necessary to locate National Treasure Mines Company, successors and assigns, or its former Registered Agent, McClellen.

9. Based on the unsuccessful results of our extensive search, Newfield has deemed National Treasure Mines Company to be unlocatable for purposes of Docket No. 2012-036, Cause No. 139-96.

2. As Operator ofthe State 11-5-3-1 W, and the Evelyn 1-5-3-1 WH, Newfield has requisitioned the preparation of a Drilling and Division Order Title Opinion covering Township 3 South, Range 1 West, Section 5, Duchesne County, Utah.

3. Said Drilling and Division Order Title Opinion has identified Crest Resources, Inc. as a mineral owner in the aforementioned lands. The Utah Secretary of State identifies the status of Crest Resources, Inc. as "Expired" since December 4th

1981.

4. The current registered address for Crest Resources, Inc. is 219 Keams Building, Salt Lake City, Utah, 84101. This building no longer exists, and the address is not recognized by the US Postal Service.

5. Newfield, through its lease broker, attempted to locate the former Vice President of Crest Resources, Inc., Robert Kunkel, confirming Mr. Kunkel's death in 2003. Mr. Kunkel's widow, Deann Kunkel, stated she believed Forest Oil Company acquired Crest Resources, Inc. Inquiries to the Land Department at Forest Oil Company revealed this acquisition did not occur. Mr. Kunkel's former CPA, Les Bates, also stated he is not aware of the status, or of any potential successors or assigns of Crest Resources, Inc. Malcom Justice is the last Registered Agent of Crest Resources, as reflected by the Utah Secretary of State. Mr. Justice was contacted and did not provide any additional information regarding Crest Resources, Inc.

6. Entities doing business under "Crest Resources" were located in the states of Oklahoma, Colorado, and Wyoming. Each entity was determined to have no relation to Crest Resources, Inc. in the state of Utah, or the specific mineral interest in Township 3 South, Range 1 West, Section 5, Duchesne County, Utah.

7. Newfield, through its lease broker, has conducted an extensive internet search in an attempt to locate Crest Resources, Inc., using the following sites: Utah Court Websites, LexisNexis, Westlaw, Google, Bing, and various other websites specialized in locating individuals and entities. Said internet searches did not provide information necessary to locate Crest Resources, Inc., or its successors and assigns.

8. Based on the unsuccessful results of our extensive search, Newfield has deemed Crest Resources, Inc. to be unlocatable for purposes of Docket No. 2012-036, Cause No. 139-96.

Newfield, through its lease broker, has conducted an extensive internet search in an attempt to locate Wade Torgerson, using the following sites: Ancestry, 411, People Smart, People Finder, People Search, Find a Grave, Google, People Lookup, USA People Search, Zaba Search, Any Who, Family Search, My Heritage, Legacy and Archives. Said internet searches did not provide the current whereabouts of Wade Torgerson.
