April29,2020HonorableJ.ThomasMartenSeniorJudgeUnitedStatesDistrictCourt401NorthMarketStreetWichita,KS67202DearJudgeMarten,MynameisDavidKaufman,andIamtheyoungestsonofArlanKaufman(BOPinmate#19078-031).Iam43yearsoldandliveinOlivette,MO,asuburbofSt.Louis.AftergrowingupinNewton,KS,Icompletedmybachelor’sdegreefromBethelCollegein1998.IthenwentontoearnaPh.D.inclinicalpsychologyfromtheUniversityofFloridaandcompletedapostdoctoralclinicalfellowshipinneuropsychologyatUCLA.IamcurrentlyemployedasanAssociateProfessorofPsychologyatSaintLouisUniversity,andalsopracticeinthecommunityasaboard-certifiedclinicalneuropsychologist.Ihavebeenmarriedfor21yearsandhavetwosons,ages10and12.Iamwritingtorequestcompassionatereleaseformyfather.HewasjusttransferredtoFMCButnerinNorthCarolina,afterservingthelastseveralyearsofhissentenceatFCISeagovilleinTexas.Myfatherwasrecentlydiagnosedwithmetastatic,stage4prostatecancer,whichhasspreadtohispelvicbone.Hehasalsobeenstrugglingwithcardiacdiseaseandvasculardiseaseforanumberofyears,andwasrecentlytoldbyadoctorthathehadfourblockedvalvesinhisheart.Thisheartconditionisnottreatable–hewastoldbyacommunityphysicianthathewouldnotsurvivereparativesurgery.Forthelastthreemonths,hehasbeenunabletowalkandconfinedtowheelchair.Thishasunfortunatelymadeitdifficultforhimtomovearoundhisfacility,andhehasmissedmultiplemealsbecausenoonewasavailableorwillingtopushhimtothedininghall.Myfatheris83yearsoldandhishealthhasbeendecliningdramaticallyoverthelastseveralmonths.Hiscurrentprognosisisgrim.Hehasalong-standinghistoryofkidneydisease,whichwasfirstnotedinhisBOPmedicalnotesin2006.Hisdiagnosisofperipheralvasculardiseasewasfirstgivenin2017,whichhasresultedinimpairedcirculationandpersistentopensoresinoneofhisfeet.Hewasinthehospitalfor5daysinJanuary2020followingchestpainsandtheneedtostabilizehisheartrate,butthenreturnedtoFCISeagovilleforthenexttwomonths.InMarch2020,hewashospitalizedagainforapproximately4weeks.Now,thereisgrowingconcernabouttheelevatedriskofinfectionwithCOVID-19inprison,asmyfather’smultiplemedicalproblemsmakehimextremelyvulnerabletothisvirus.Becauseofhisage,cardiacdisease,vasculardisease,andmetastaticcancer,hewouldlikelynotsurviveCOVID-19ifinfected.EventhoughmyfatherwasjusttransferredtothefederalmedicalcenterinButner,NC,Ifearthathishealthconditionscannotbesuccessfullymanagedinprison.InJune2019,whenheinitiallypresentedtoSeagoville’smedicalclinicwithapersistentabscessonhisfoot,hewasnotprovidedwithanytreatmentbutsimplytoldthatheneededanewpairofshoes.InJuly2019,avascularspecialistprescribedhimpentoxifyllinetotreathispoorbloodcirculation,butthismedicationwasnotallowedbytheBOP.Sincethen,hisconditionhasworsenedandheisnowunabletowalk.Thegenerallackofavailablecareinprisonhas

alsoresultedinmissedopportunitiestodiagnosehisprostatecanceruntilithadadvancedtostage4andmetastasizedintohisneighboringpelvicbone.Sincehisconvictionin2005,myfatherhascompletedalmost15yearsofhissentence.Hisreleasedateis5/1/2031.Whileinprison,myfatherhasbeenamodelcitizen.Despitehisdeclininghealth,hehasworkedintheeducationdepartment,continuingtohelpthosewhowanttobetterthemselvesthroughfurtheringtheirowneducation.Thismirrorshisearlierlifebeforeprison,whenheworkedasaprofessorofsocialworkatBethelCollegeinthe1970s.Throughouthislife,hetirelesslydedicatedhisenergyfortheeducationofothers.Myfathercherishededucationandwasalifelonglearner.HeearnedaPh.D.insocialworkfromtheOhioStateUniversity,andinstilledtheimportanceofeducationinhischildren.Infact,Icreditmuchofmyowneducationalpursuitstohisinspiration.Myfatherhasalwaysbeenamanoffaith,andthishascontinueddespitehisdeclininghealth.HeraisedmysiblingsandIwithstrongcommitmentstopeace,compassion,andsocialjustice.HewasactiveintheMennoniteChurchthroughouthislife,andservedasamissionaryonanOklahomaNativeAmericanreservationinhisyouth.Ifprovidedcompassionaterelease,myfamilywouldwelcomehimintoourhomeinSt.Louis.Thiswouldallowhimtolivehisremainingdaysinthecareoffamilywholovehim.Hewouldbesupportedbyfamilymembers,friends,andourfaithcommunityoftheSt.LouisMennoniteFellowship.Despitetheseriousnessofmyfather’sconvictions,heisnotatriskforre-offending.Heisnotaflightrisk.Heisnotadangertosociety.Pleasegranthimtheopportunitytodiewithdignityandcompassion.Thankyouforyourconsideration,DavidKaufman

To the Honorable Judge Marten:

My name is Jenelle Basinger and I'm writing on behalf of Arlan Kaufman, Register Number: 19078-031. Mr. Kaufman is an 83 year old man incarcerated at FCI Seagoville, Texas. This letter outlines my support of his petition for compassionate release. My relationship with Mr. Kaufman is through his son, David Stigge-Kaufman. We have attended church together for over 10 years.

Mr. Kaufman has been diagnosed with advanced prostate cancer in addition to cardiovascular disease and failing kidneys. He has been in the hospital for the last month and has been bed-ridden or confined to a wheelchair for the last several months. His health continues to deteriorate and leaves him especially susceptible to COVID-19.

Arlan Kaufman has served a significant portion of his sentence and as an 83 year old with significant medical diagnoses, I believe he has fulfilled the purpose of his prison sentence and ask you to allow him to live the remainder of his life under the care and supervision of his family.

A compassionate release would allow Arlan to be cared for at the home of his son, David, in St Louis. David and his wife, Sydney, are upstanding, responsible persons and would provide a safe, supervised environment for him.

Thank you for your consideration of this compassionate release petition. I hope that you will allow Mr. Kaufman to be home and cared for by his family during his last days.

Thomas Marten,   I am writing to you on behalf of Arlan Kaufman, asking for his compassionate release.   (Register Number: 19078-031  Age: 83  Release Date 5/1/2031  Current Location: FCI Seagoville, Texas )   I have never met Arlan, but I have known his son, Dave, for nearly ten years. I am currently serving as  Interim Pastor of the church where he and his family are longtime members It has come to our  attention that Arlan’s health is in signi�cant decline, su�ering from kidney disease, circulation issues,  open sores, heart disease, and stage 4 cancer. He has been bound to a wheelchair since January and is at  the mercy of others to get to meals and activities in the prison, which means he sometimes misses both.  Daily care activities are increasingly di�cult   Arlan’s family wishes to be able to care for him in his last days. They wish for Arlan’s grandchildren to  be able to spend time with him before his death.    The Bible suggests that all people are — that each individual person is — created in the very likeness of  God. I believe that we are all called to love God and to love people. I recognize that the justice system is  not based upon any particular religion, but I do believe that it is at its best when it holds the dignity of  humankind at its heart Every major religious group has some variation of the Golden Rule to do  unto others as you would have them do unto you. Arlan Kaufman has served over 14 years of a  sentence and is clearly not a threat to anyone. His release to allow some dignity in his �nal days and  allow him to be surrounded by family would be the very de�nition of compassion.    If Arlan is granted compassionate release, he would come to stay with his son Dave and his family here  in St. Louis. They have other family here locally who would also assist, as well as others that are in  driving distance. I also know that the people of St. Louis Mennonite Fellowship would do everything  they can to o�er support if Arlan is released here    Thank you for your consideration.

Thomas Martin, I am writing to urge the compassionate release of my father-in-law, Arlan Dean Kaufman (#19078-031, Federal Medical Center in Butner, NC). He is 83 years old, has been incarcerated since 2005 and has a current release date of November 26, 2031. He has served almost 15 years of his sentence and has been commended for exemplary behavior while in the BOP system. Arlan has serious medical complications that cannot be adequately treated within the BOP. He has recently been diagnosed with stage 4 prostate cancer and the cancer has already spread to neighboring bones in his spine and pelvis. He also has vascular disease complicated by four clogged valves in his heart. He is confined to a wheelchair and has great difficulty caring for himself. Since Arlan is dependent on someone to push him any place he needs to go, he has missed meals and other activities because people are not available to help him. His health has been declining for several years. He has had failing kidneys (according to blood work) for a number of years. He has very poor circulation in his right leg (discovered over a year ago) which has caused wounds to develop on his right foot that do not heal. He has been hospitalized recently because of dizziness and disorientation. Our family is also worried about the spread of COVID-19 within prisons and Arlan’s vulnerability due to his underlying health conditions. If he was exposed to the COVID-19 virus, he would not survive. If granted compassionate release, Arlan would join my husband, our two children and I in our home. He would no longer be a burden of the state. Arlan would join us in St Louis, MO where we would provide care and support and seek appropriate cancer or hospice treatments for his medical needs. He would be also supported by our faith community, St. Louis Mennonite Fellowship, which has a strong conviction for peace, compassion and social justice.

Compassionate release would not undo the crimes of which Arlan was convicted, but it would allow for a humane way for him to live out his remaining days. He has served over half of his sentence. My father-in-law is not a danger to society nor would he have the ability to re-offend. Subject: Compassionate Release for Arlan Kaufman, BOP Registry 19078-031

Dear Judge Marten,

My name is Mark Fletcher. I am 62 years old and live in St. Charles, MO. I am a younger brother of the late Linda Kaufman and a brother-in-law of Arlan Kaufman. I have known Arlan Kaufman for 54 years, and I am wri�ng to ask you to grant Arlan a compassionate release due to his extremely poor health. Mr. Kaufman will be 84 years old this year, and has suffered from numerous medical condi�ons during his 15 years of imprisonment. I know that Arlan has been living with kidney disease and heart valve disease before his recent diagnosis of Stage 4 prostate cancer with metastasis to the bones in his hip. Prior to his imprisonment in 2005 Arlan had undergone coronary bypass surgery as well. I point out his infirmi�es in hope that you will agree that Mr. Kaufman is not a threat to society, and in hope that you will allow him the dignity of spending what li�le �me he has le� with his family.

My sister Linda Kaufman who was convicted with Arlan in 2005, passed away a�er her compassionate release due to pancrea�c cancer. I visited Linda at a community hospital in Fort Worth while she was s�ll in the federal prison system shortly before her release. I also visited her while she was hospitalized in Indiana prior to her death. Visi�ng Linda while she was in the prison system was very impersonal, and did not allow her any dignity as she was dying from cancer. She was handcuffed to her bed, had guards present around the clock, and we were very limited to how many people and how long we could visit.

In her last days of life I drove to Indiana to spend �me with her in the hospital. I was able to visit with her children and grandchildren, hold her hand, talk to her, kiss her forehead, and tell her I loved her. Her children and grandchildren were able to be at her bedside, without feeling uncomfortable and without the constant reminder that Linda had been in prison. The difference in the two experiences was night and day. I pray that you have it in your heart to allow Arlan to die with the same dignity my sister was given, and to allow his children the closure they can experience being with their father.

I was in the courtroom in 2006 when Arlan and Linda were sentenced. I understand that Arlan was convicted of serious crimes of in voluntary servitude and fraud. But, I do not think that gran�ng compassionate release at this �me would in any way minimize the severity of these offenses. He has been significantly punished.

Regardless of what the judicial system may feel about Arlan and my sister Linda, they raised three wonderful children who are valuable contributors to their communi�es. Their oldest son has a PhD in chemistry and is in the pharmaceu�cal industry working on an�-cancer drugs. Their youngest son also has a PhD and works for St. Louis University as a Neuro-Psychologist. Their daughter has a Master’s Degree and is a teacher in her community. I bring up Arlan’s children because they are good people, and I feel they should be allowed the private �me to tell their father goodbye.

I also hope you will consider the Covid-19 pandemic as part of your decision. Due to the current restric�ons of visitors at hospitals, if Mr. Kaufman were to be near death his children would probably not be able to see him. It has been widely covered by the media that prisoners are being released to prevent the spread of Covid-19 in the prison systems. Many of these prisoners are much younger than Arlan and in much be�er health. If Mr. Kaufman were to contract Covid-19 it would be an almost certain death sentence due to his age and poor health.

May 24, 2020 Honorable J. Thomas Marten Senior Judge United States District Court Ref: Arlan Kaufman # 19078-031 Dear Honorable J. Thomas Marten: I am writing in support of consideration of a Compassionate Release for Arlan Kaufman # 19078-031 who has served over 13 years of his sentence but is now 83 years old with multiple health issues including heart and advanced cancer.  As the head of the Applied Sciences Division at Bethel College where both of us taught, I knew Arlan well.  I am told that Arlan has been a model prisoner who has contributed to the welfare of the other inmates in prison.  He is no longer a threat to the community.  His sentence was not a           death-sentence yet that may occur in the crowded environment with the coronavirus in a typical over-crowded penal system.  I know that Arlan has children who love him and would like to spend his final years in their care.  A Compassion Release seems to be a logical, compassionate response to Arlan Kaufman’s situation.
