Dear Members of The Colorado Chiropractic Association,
A recent article in The Dynamic Chiropractor focuses on CCA’s legislative priorities, and requires some clarification and correction. The August 15, 2014 article was authored by James Edwards, D.C.
As articles sometimes are, this one is a one-sided attempt to embellish the facts for the excitement of the readers as well as for the publishers.
It’s important I provide the facts regarding what occurred at The Colorado Chiropractic Association (CCA) and its meeting on November 21, 2013.
On March 14, 2013, the CCA was contacted by the President of the Colorado Medical Society (CMS) in reference to working together with the CCA to help each other better understand what our associations could provide towards forming Medical Care Associations (MCA) and how we could integrate the Chiropractic Model with the Medical Model. This appeared to be the first step in a positive working relationship between our organization and the CMS.
There were continued meetings with The CMS, the Colorado Academy of Family Physicians and the CCA about moving this relationship

forward. The CCA Board felt this was a positive step for the chiropractic profession in the state of Colorado.
On July 16, 2013, I was appointed to the Colorado Personal Belief Exemption Policy For Immunizations Stakeholder Engagement (http://1.usa.gov/1lgoMK8) that was to start on August 13, 2013 concerning childhood vaccination waivers.
Since this was the first time a chiropractor had been invited to any policy making decision on immunizations by the Colorado Department of Public Health and Environment, it was felt that our profession would at least have a say in the legislative decision making for vaccination exemption waivers.
There were three such meetings on this issue, and the Colorado Chiropractic Association’s stance was that there should be no change to the current regulations. The Department wanted to make it a requirement that in order to have an exemption you would have to have a health care provider sign-off with the parent, and the only professional able to do that would be one approved to give the immunizations in question.
The Association voiced strong opposition on this rule change, as did several invitees at this stakeholder engagement. The final bill, HB-1288, came out with the personal exemption waiver still intact. Just as it was previously, thanks to the help of a senator who was in this stakeholder engagement process. The only exception is that schools are required to monitor and report vaccination waivers.
On November 21, 2013 we discussed at our board meeting what to consider for our 2014 Legislative agenda. A list of items that could be considered was brought forward for discussion only. All board members present had a list made up and then a vote was taken on all the items listed. The vote was not to determine what our priorities were, but to give us a consensus on the items that deserved further discussion. While the immunization issue was being focused on, many items at the meeting were being considered. The rules of the meeting allowed all board members 3-5 minutes for discussion on the following items:

Votes tallied by the voting members resulted in the top three items for possible further discussion. Our Lobbyist was present and offered analysis on each issue, prompting further discussion from the group.
A motion was made by a board member and seconded by another to pursue the immunization issue contingent upon the aforementioned physician groups also taking this stance. Discussion on this motion was heard and the motion was withdrawn after a lengthy discussion. Over the next five board meetings this issue was never discussed again.
If The CCA would have pursued this immunization issue there would have been funding spent, a bill sponsor would have been picked and our lobbyist would have lobbied for such a bill.

Lastly, I would also like to set the record straight about comments made by the author concerning the Chiropractic Summit’s Nov. 7, 2013. At the Summit the following statement was approved:
“The drug issue is a non-issue because no chiropractic organization in the summit promotes the inclusion of prescription drug rights and all chiropractic organizations in the summit support the drug free approach to health.”
As you can imagine, the Summit statement regarding vaccinations was crafted very carefully and after long discussions by all participants at the event, which included

Are you Turning Away Potential Patients?
I called a fellow chiropractor the other day and got directed to voicemail. There were a lot of
hoops to jump through and selections to press before I could leave a message. I ended up hanging up and deciding I’d just try him later.
And this is someone I know.
Now imagine a potential new patient—someone who doesn’t know the DC from Adam--having the same experience. They’ve called to find out more about the doctor, the practice, costs and how and if they can be helped. Instead of getting that information, they get a recording.
Do you think they’ll leave a message and wait to hear back, or do you think they’ll simply move on to the next chiropractor on Yelp?
Yeah, me too.
Which brings me to one of the biggest turn-offs for potential new
patients: no new-patient phone system or procedures.
What if, instead, that hypothetical new patient had reached a friendly voice? “ABC Chiropractic, this is Rebecca, and I’m here to help you!” You’re a DC with a small practice and you don’t think you can afford
a CA? You truly can’t afford not to have one. I can almost guarantee you’re losing potential patients every week. At the very least, have your office number forward to someone—your partner, your spouse, even an answering service is better than nothing—so that potential new patients talk to an
actual person.
What about your website. Far too may DC sites are big on educational information on chiropractic—which is good—but short on practical and basic information like where and how new patients get started, which is, obviously not-so-good. Where’s

the contact information, an online scheduler? Heck, where’s the phone number?
Even a new patient who reaches an actual person can be turned off by staffers who are distracted, harried, or stumbling over basic information. Most new patients, for example, start out with cost: they want to know if their care will be covered by their insurance, or, if not, how much the fees will be. The great news is, you already have an excellent answer for them if they do not have third party assistance with their financial responsibility. Every member of your staff who might ever answer the phone needs an easy-to-follow script they feel comfortable delivering while juggling three other tasks. Center for Medicare Services reports to Congress; Action taken against 938 providers due to utilization of new
Medicare anti-fraud software system.
*Actions included revocation of billing privileges, implementation of prepay-ment reviews, referral to law enforcement and suspension of payments.
CMS states they discovered/prevented more than $210,000,000.00 of improper Medicare ‘fee for service’ payments with their new ‘state of the art’ fraud prevention system. This equates to double that of last year and proves to them the efficacy of increasing utilization in the future.
One highly publicized case, known to many chiropractors, was a group practice identified as a ‘high risk for inappropriate billing’. They were surprised by an unan-nounced site visit that showed the aides were not qualified to deliver services.
They removed the doctor from the Medi-care program and prevented $700,000 of Medicare payment from being honored.
Most actions against chiropractors are relative to the physician not releasing the patient from active care when active care can no longer be justified via appropriate documentation. Remember, patients are to be issued an ABN form and released from active care when such can no longer be documented to Medicare’s standard.
This standard has nothing to do with a chi-ropractic definition of “maintenance care”.
All practitioners are required to under-stand the proper use of an ABN form and audit such, with an appropriate audit tool, annually-at a minimum. Action steps should be taken to remedy deficiencies.

organizations and individuals from all corners of the profession. When the group first approached the task, it realized that the profession could not legitimately use the word “drugless” to describe itself. Surprised? It makes sense when you consider the FDA classifies the use of certain vitamins and supplements to treat a condition as a form of drug use. With so many doctors of chiropractic using nutritional therapy to help their patients, it was obvious to even the most conservative among us that a“ drug-free approach” more accurately describes what we all do.
We all need to realize that the Colorado Chiropractic Association is a Trade Organization whose purpose is to represent its members - all of our members, no matter what their beliefs are. It’s our job is to discover and balance all of our members’ beliefs.
The type of journalism practiced by James Edwards, D.C., is unfortunate for our profession and accounts for more divisiveness. The article’s author should have done a better job obtaining the facts, and his piece should have been fact-checked by the journal. In addition, I’m concerned that a board member, with the help of others, started this ball rolling by sending misinformation to the article’s author. These are the types of issues that causes our profession to be divided, because of this type of misinformation distributed.
The editor stated that he made an attempt to contact The CCA about our legislative agenda, and that we were unavailable. To set the record straight, neither I nor the CCA was contacted by the article’s author. We’re easy to reach via email, phone or social media, so I’m confident we could have been reached if that was indeed the author’s intent. Thank you all for being a CCA member, I am proud to represent the CCA and to help look out for your best interest as a member.

I recently had a situation come up when I requested a client’s file from a chiropractor. This same situation has come up a number of times before, so I thought it made sense to discuss it. When one of your patients is involved in a medical-legal case--whether it is a car crash, a slip and fall, or some other form of negligence--your patient’s attorney will request your file. It could be that you treated this individual several years ago, and he/she was recently involved in a collision. It could be that you are treating this indi-vidual solely because of the injury causing event, or perhaps you treated the patient both before and after the injury causing event.
Whatever the situation, when an attorney requests your patient’s file, that attorney is typically requesting a complete copy of your entire file from the first time you saw the patient through the date you receive the request. My standard request for a patient’s file is in the form of a HIP-PA compliant authorization detailing the request and a cover letter indicating that I am requesting the complete medical record, including all office notes, intake forms or questionnaires, and all reports, including diagnostic reports, including prior re-cords, if any, as more fully described in the enclosed medical release, including medical bills. Despite the specificity of my request, quite often I will not receive the bills. Sometime, I will receive only the records pertaining to the injury causing event and not the prior treatment records.
If the client has not disclosed to me that he/she treated with the provider before, and I do not receive the prior records with my request, the case can get messy for obvious reasons. There have been numerous times where the client has disclosed to me that he/she saw the provider in the past, but in response to my request for the file, I receive only records from the date of the injury to present. On those occasions, I will call the provider’s office and inquire about the prior records. The response that I have consis-tently received is that the prior information is located in a different file, and the office did not realize that I wanted that file too. With the transfer of paper records to elec-tronic records, perhaps this problem with two physical files will not occur as often, but I would encourage you to keep one file for your patients or at least have a flag in your system that alerts your staff to the fact that there is a prior file which also needs to be copied.

The Michael Skolnik Medical Transparency Act of 2010
Senate Bill 10-124 enacts the "Michael Skolnik Medical Transparency Act of 2010" to extend reporting requirements to many health care professionals who apply for or renew a license, certification, or registration, on or after July 1, 2011. The Division of Registrations is in the implementation process at this time. Please refer back to www.dora.state.co.us/chiropractic/statutesrulespolicies.htm for additional information as it becomes available.

Why join the club? Donating to the CC-PAC, Colorado Chiropractic Political Action Committee, is the best way to protect your patients rights and patient access to chiropractic treatment in Colorado. Your contribution will be used to support positive, pro-chiropratic contacts with state legislators.
Each Colorado legislative session fosters issues that impact doctors of chiropractic and their patients. The Colorado Chiropractic Association, CCA, keeps updated on these issues and together with our lobbyists push for a pro-chiropractic agenda. There is always a need for a well-funded PAC. The Campaign Finance Reform Act establishes rules on contributions to PACs (Political Action Committees) in Colorado. The maximum contribution an individual can make to a PAC is $550 per election cycle (every two years). For example, an election cycle is from December 2012 to December 2014. Corporate/business checks are allowed as well as checks from individual accounts. A husband and wife may make a single $800 contribution if the contribution is done from a joint checking account. Each family member may contribute with their own personal account, but only one contribution can be made from a joint account. In addition, contributions can be made directly to candidate campaigns by individuals up to $400 each two-year election cycle ($200 for the primary election and $200 for the general election). Please include your current address, profession/employer with your contributions to make it easier for the candidates to properly report.
